The i-130 asks for "Family Name", I am sure that means what your current last name is, so if you change your name before you mail it out then you would put the new last name. When it asks about your mothers info, it specifically asks for her maiden name. Good luck.

All of the above answers are correct. You would need a good medical reason signed by your doctor. Dropping your dime and pregnant is not a reason for expedite.

hey guys. on august, when i was lpr, i filed i130 for my wife. and on sep, i became a citizen. i called uscis( cuz the case is pending in uscis for approval) and sent the copy of citizenship certificate and noa1 to uscis to asked them to upgrade the case classfication from f2a to cr1 for my wife..however, one month passed, i dont get any information about that..so wt should i do now.. how long i should wait for the processing time.


they typically dont send letter of acceptance but they online status might show a minor change. The processing time will still be on average 4-6 months for USCIS to review the case file..

we tried expediting, even when my husband's country went into a kind of civil war and i had to be escorted out of the country by the US emabssy because i was pregos... and they didn't care, it was denied. Good luck! If you can gather paperwork proving severe financial hardship, then do it!


well... most of it had to be on the part of the US Citizen.. US govt doesnt care much about anyone who is not a US Citizen and WORST. not living in the USA. The way it is seen is that.. the immigrant was living in that SITUATION before the petition was filed... nothing new.

so in order to request a expedite, you have to have financial hardship (this is one of them). Can somebody tell me what falls under this.. loss of job, less hours because of no help for baby sitter? I'm just throwing somethings out there to get a idea of what it extactly means.. Thank guys!

I'm new here, but it definitely seems like a lot of folks on this board love to let lose with complete broadsides on people.

This lady may have done nothing. This could be a case where the long delay brought on by our favorite government agency, the INS and all its derivatives, took so long that the husband ended up having an affair and has started a new relationship with someone closer to home.

How is this the girls fault? Of course she wants to complete the process. Of course she is ever the optimist.

She is not a fly by night fiancee gold digger. The USC came over and signed on the dotted line. He made her his wife. If he has abandoned her, he at least owes her the courtesy to inform her as well as give her a divorce so she can move on with her life too.


She can move on with her life.. If she is married to someone and cannot hear from him then.. move on. This can be done especially since you have not been around the person long enough. She should not want to complete the process if the person who signed the dotted line is not around to support her - that does seem strange.. i would agree.
In any normal marriage .. or common relationship if your significant other went missing it would be easy to get information on the situation.


How would you feel if you still love your spouse. You are separated from your spouse through no fault of your own. The bureaucratic red tape has kept you apart for so long that in every real possibility it seems your marriage has ended and nobody bothered to tell you it had or much less why?
You have family back at home whom you have been defending your relationship and your husband for this many months/years.

Now when you find out your ticket to America is waiting at the embassy for you. What would you do?

I'm no wide eyed innocent, and I know all about filipina scams, but in this case where they actually got married and it has been 2+ yrs since he filed there are more questions than just what happened in the last 6 months.

Why was the CR-1 delayed past 2009? past 2010? all of 2011?

perhaps the same US Citizen wanted nothing to do with the process.

regardless of the RELATIONSHIP, a Supervisor can tell the BENEFICIARY, the VISA APPLICANT, the status of the casefile. It's allowed, even.


Darnell.. well.. if the petitioner have not make contact with the NVC how would they help?????/ The writer just said that the person called up the NVC and was told what was needed to complete the case which was the DS-230. They would not know if the relationship still exists however would come to light at the interview.


She doesnt know what documents are needed so she decided to call the NVC here and the operator told her she only needs DS230 Part 1. She just mailed it to NVC few days ago and still waiting to confirm if NVC received it.


She has no basis to complete the visa process however seems to be desperate to get it done.. just sad.

Hello Everyone,

I'm new on this site and to this whole process. Honestly, I feel like I'm going to lose my mind. I am an American currently residing in South Korea with an E2 Visa. My wife is from the Philippines and is currently living with me in Korea. We are getting all our paperwork together now to file the I-130, which will be done on March 2nd.

What I'm confused about are the steps that must be taken after filing the I-130. It sounds like the CR-1 is less of a hassle compared to the K-3, so I would like to pursue the CR-1. Would you recommend the CR-1 as well? Also, do I need to submit the I-485 if I'm living abroad? Any other advice would be much appreciated!

The K3 Visa is no loner a visa that is issued. Since your wife resides over seas your have to pursue the CR-1 route. The only USCIS form required is the I-130 along with any supporting documents. No, if you are living abroad the I-485 does not apply to the case. That is used for applicants in the USA seeking to adjust their status to a permanent resident.

you're going through one of the toughest consulates. The K-1 denied, now needs the CR/1 visa. know the reasons for the denial.. keeping in mind filing the CR/1 does not guarantee the visa. be patient.

Many have traveled while their cases were pending ... you can too. Take proof of your ties to Canada and any other documents that shows you are only travelling for a visit.

The file is being returned to the Embassy for another interview, issuance of a visa is not guaranteed. If the validity of your police certificate and/or medical examination has lapsed, you will need to get another certificate and/or have another medical exam.

what you/wife can do (now) is to build on what evidences you have. The last thing you wanted WAS for uscis to reject your app.. then a refile is necessary / new priority date assigned..It helps those especially trapped in the preference category.

We both made some mistakes with the I-130. (found this site after sending I-130)

My wife, the petitioner didn't send evidence of a bonifide marriage.

to them - uscis - its not a filing error.. some ppl dont have enough initial evidence...

Me, the beneficiary didn' fill in the G-325a correctly and I didn't sign the form.

honestly this helps them with research.. even if this was not submitted it would not affect the case.

USCIS accepted the packet cause we got a form I-797C (NOA).
Is the best bet just to wait when the USCIS send a RFE to correct those mistakes?

uscis workers will accept the case as long as the primaries are met... signed i-130/485, marriage cert. showing /creating the eligibility to file the i130 etc. if the evidence submitted does not satisfy - oh you will know

bank letter..? I dont think that is required.. long as you send in your IRs tax transcrip/s.. IF your included information on the Affidavit of Support to inlcude "other" assets and things like that then I'd wait on it.. if bonds etc was included. I dont know your Bank BUT wat i can say is .. that bank of ameirca have things "immigration letter" that they submit and takes a while they say to receive. What the agent at the bank may be able to do is have the Department that will be processing the "letter" send him/her a copy of the leter via Email and then can print that out for you. That's what i did at BOA and the agent got the letter via email in about 3 days and the letter i got was bout 10 days after I really needed it...

I understand that NVC takes a long time these days to process the visa. I have so many questions and uncertainities in my mind.
It gives RFE and that again prolongs the time.
So is there a way we can predict if NVC will give us a RFE?
What happens once the log in fails? Can some one conclude that once the log in fails the file has moved to the foreign country?
Do we get any email notice once the log in fails?
After how may days should one expect to recieve any kind of mail/email or notice once the log in fails?
Can some one still recieve a RFE even after the log in fails?
Do we get any mail/post for the visa interview date or does it come online in the email?
How do we know that the home country/consulate received the visa papers?
Please inform since I am worried about the RFE and the process there after.

There is no way to predict if NVC will give a RFE...however we have the ability to control if a FRE is given by making certain the requested documents are sent and are to the requirements. From what i understand Signin fail seems to mean the case is completed and soon then will be transferred to the local counsulate. may take 2 weeks ,it may take 2 months. The 2 month wait is because of no interview dates/times at the counsulate.
IF NVC have your email then interview information will be emailed... you can perhaps contact the consulate to see if they have received the packet.

The police report has to be original. Any birth certificates, marriage cert. Can be certified. Copy of passport is as is just the photo copy of the bio page.

Some members on the board are making contradicting statements about original documents and NVC. Am I right to assume that NVC requires original documents, and once, the DS-230 is approved, the documents would be sent to Ho Chi Minh. My wife has only one marriage certificate; I hold the other one here. I am just concern because the application package requires that she bring her original documents but that would be impossible if she send them to NVC with the DS-230 package.


Certified or Originals. Yes they should* be mailed to the local consulate office...if not lost by the nvc folkx
