Well you received acknowledgement good..! Now the next step/action is from USCIS (adjudicating your case) which may take 5-7 months After that the case is transferred to the NVC where THEN you will make payments of $88.00 ( AOS) and $404 (IV) and send in the associated forms/proofs after which an interview would be scheduled and medical assessment completed.

Supporting of illegal immigration activities... Marriage fraud.... Having a friend who is in it to gain and keep up with the nonsense.. Then wonder why they get denied but the friend/family got through. They follow a no tell policy... Then they get stuck.

Sus I agree with you on that one. I think one or two things did happen. Either they thought the marriage was fake bcuz of the HUGE age difference or the husband said something for them to implied that the marriage is fake. It is unfortunate that the CO's hold our future in their hands but it is their job to weed out valid and invalid marriages the sad thing about it is, sometimes they get it totally wrong.

Our case has been approved. I just need to find out if they're going to issue my wife an IR-1 visa or a CR-1 visa. We got married back in 2008, but our marriage certificate wasn't issue until 2010. Does this mean we've been married for two years or not?


issue date and marriage date are separate and would be a IR/1 since the marriage was 2+ years ago. The issue date can change anytime a document as it says is - issued.

I know when I filed for my husband for his fiance visa,it was said thah when approved he would need a RT ticket to the states.When we got married last year, I had to re file an I-130 and we are almost at the interview stage with that application and I am wanting to know if he will still be required to get a Round Trip ticket or will One Way be ok since we are doing the CR1 visa??

If you are really lucky maybe she will have it in Canada, think of the cost savings! In the usa it costs about $2,000 or more total and insurance won't cover very much of it . So hopefully you guys can have the child in Canada, be very thankful for being able to live in such a great country such as Canada

There is no returning resident visa. Who said so..?

The USC will have to petition for a C R 1 for you because you gave up your green card. The process will not change. It will probably take about 10 to 12 months to get the visa. The USC will need to provide the support docs therefore need U S job & or a co sponsor in the USA. That wont be required for about 6 months or more.

that 2 year thing is only for K-visas not for someone with a wife/husband and having the baby isnt as much of a plus as many might that.. all it says is there was a sexual exchange. research how many have been denied EVEN having 2 children... since that says nothing about a valid marriage tho is helps somewhat.

I'm new to this site and just have a couple question. I currently got married as in a week ago. I don't know but suddenly this site had made me very nervous to file my paperwork. My husband is in the military and we have a one year old son he got his cbra and us passport recently. This year makes 4 years since we are together but only married a week. it seems like I have to prove the validity of our marriage and that i might be turned down especially the 2 year stipulation. Should I wait a while for him to sign up the I-130 or not. I am currently being added into the military system. Please let me know or am I just nervous for nothing.

It varies by country like Canada. You will need just one for Jamaica to cover your history there.

** my parents entered the USA on December 20, 2010 and left within 2 weeks on january 5, 2010. My mother returned to the USA on may 17 2011 and left on May 20, 2011 So within 4 months. They asked her some questions if she was working in the USA...POE was Miami. My father is going on 7 months as of August 5 and will enter the USA on August 31, 2011 and left on Sept. 5, 2011 POE will be Ne York (JFK).. lets see how that goes.
** My mother and father left in janaury without the greencard in hand and my mother came back in May with the TEMP. Stamp. .. no issues.. my father will use the green card. **

There is ABSOLUTELY no reason to wait for the green card--the stamp in the passport gives you all the rights and responsibilities of the actual card, and it is good for one year. You may personally be nervous about not having the actual card, but there is zero risk using the stamped passport.

Line 21 does not specify address in U.S., I used my wife's address in China on my I-130, technically you have lived together ( at your parents home) the line does not ask whether you own the residence or not, they are asking at what address you lived together at. When he visits, you and him live together at your parent's address. If you need evidence have your parent's prepare an affidavit stating he stays there when he visits.

Visiting and living are two different things.

Furthermore, it's your USC husband who fills out and submits the I-130, not you.


The instructions on the form says if the QUESTIONS is not applicable... then you write "N/A"

My understanding is;there should be no extra documents required being LPR compare to citizen on filing I-130. If I am missing something, correct me.

I got that part. I am still wondering, what's the time difference in whole process if I file I-130 now and later update my case with USCIS being Citizen or wait until get Citizenship and then initiate filing I-130?? make it simple, let's say it will take 6/7 months to complete CR-1 process.If I submit the I-130 now ( Status : LPR) and update my case being citizen after 3 months then how many more months in general take to complete the whole process. Still 6/7 months after UPDATE my case or just another 3/4 months.

USCIS often process I-130s faster that will have visas available upon approval than those in the preference categories. There isnt any true difference if you will become a citizen about 3 -4 months from now. chances are the submitted I-130(s) will be adjudicated in about 4-6 months regardless of residency. There are i-130s filed by us citizens and lprs alike that toook 6-9 months to be approved.

as us citizen and without and case related delays.. on average our cases will be timely processed in about 7-9 months

Hello VJ Geeks...
I got married on June 25, 2011. Returned back to USA in the end of July. As of now I am Legal Permanent Resident (LPR) and already processed for Naturalization (N-400). One step in the process, I received a letter from USCIS last Friday, September 02,2011 mentioning about appoint date for September 15, 2011.

Should I file I-130 for my Spouse ( wife) right now being LPR or Wait until get Citizenship?? If I file at this time, how it works to change my status of LPR to Citizen when I get it to speedier the whole process.

And you all guys know, the whole idea is what is the best course of action to bring her where I am at (USA) QUICKER as possible.

you can submit the i-130 now and upgrade the case with uscis once you become a us citizen by submitting the noa1 along with the naturalization cert. the nvc will receive the case as cr-1 which is eligible for immediate processing

I finally received the info I needed from my husband for the follow up interview @ the embassy ..was given a date (09-20-11), Now I'm here nervous as hell as I dont know what to expect. The embassy requested our call records and proof of his visits here. I got the call records but the print out of his passport not so lucky...he lost it while moving. I however got a print out from our immigration offices here of the dates he landed here..would the be enough for them?


Also what should I expect in the follow up interview!
