Just a personal observation. If you look for instances of "unfair treatment," you'll find them and become indignant. If you look for "people being penalized," you'll find them and become outraged.

But if you remember that no one has a right to a visa, you'll stop comparing engaged couples with married couples and become calm. It's a moot point ... a non issue. The time it takes YOU is based on many factors (and surprises like IMBRA), and everyone here wishes you all the best.

Congratulations on your engagement. I guess I'm a bit biased, but I think marriage to a Brit is a fine idea! I went to your photos to check out your UKC, but it wasn't such a great shot for a positive "adorable" ID. ;) You sure look happy, though, and GSM Nat'l Park is a great place for feeling romantic. I'm on the other side of the hills from you, but I've spent a lot of time snuggling all over the Blue Ridge/Smokies. :D

I've already filled out G-325A's for my I-130 and my soon-to-be posted I-129F, so that part I have covered. It's those years further back that would be a pain in the butt. As I said, hopefully I won't need 'em.

Hi Alice, and welcome to VJ!!

I am going to be going the K1 route with my adorable UK fiance :) but I know that the G325-A form (that both the UKC and USC have to fill out) asks for the last 5 years of your employment. This form is also used for the visa you're going for.

I'm not sure where else along the CR1/IR1 route you'll be asked (if at all) but I know someone smarter than me will happen along soon to answer that for sure. ;)

I'm sorry I can't help with the 221(g). However, he cannot file as single - it isn't legal. He must file as "married - filing separately" if you do not want to apply for an ITIN. He can then write N/A in the SSN line for you. He will still give your name though as his wife, and if he wants, he could include a letter stating that you are not a USC or resident in the US. He may miss out on some married benefits, but it saves the hassle of applying for an ITIN for you and you having to prepare a 1040 with the 2555 foreign income exclusion. About the ITIN though - you don't have to wait for the number to file. You include the W7 with the 1040s and send it all to a certain address in Texas. He would copy everything before mailing, and give you the copies and proof of postage to you as proof of filing.

I DO know that London is good about getting back to you after submitting the documents they need. They're slightly slower this time of year, but nothing drastic.

I don't know why filing as single would 'look bad' - obviously they just want him to have filed. If you don't have an SSN or ITIN, what choice does he have but to file single? I would, though, have him call the IRS and make sure that this lark about taking 'months' to issue an ITIN is true; if so, file single and get on with it.

Obviously the consulate wants the tax return filed in order to issue the visa. I'd have him do it pronto and then send you the proof (1040, any W2s, etc.) and if the ITIN will truly take months to get, worry about filing married next year.

I'll bet once the consulate has his return, they'll issue your visa. In comparison to other consulates, London is pretty quick about such things.

Come visit us in the UK forum and maybe you'll find a better idea of a timeline there.

I remember this same frustration when I was stuck at CSC. And you're right - they will not believe you when you say you KNOW of others who were behind you that are already through unless you can provide case numbers to back you up.

Now, we all at VJ like each other, but would you want your personal info available to someone you only know through a website? And even if you could find such a willing participant, I somehow doubt they'd answer you with any more speed than they already do, and if they did, they'd have some kind of an excuse. They stick to their cover your a$$ lines - that they process first come, first serve and that you cannot put in a 'formal' inquiry until you are outside of their (BS, ever constant) 6 month processing dates.

I am curious to see what a 'formal' inquiry would garner. Looks like member 'chasnik' may be doing just that shortly - maybe then we'll have a better idea.

How would they get in the US - on a tourist visa? To enter the US as a tourist with the intent to stay and adjust status is immigration fraud. I suggest you wait out the visa interview appointment and have them enter free and clear.

T My husband was told that I had to return to the states and send proof that I still domiciled here since I was there for 2 years and also send the A. of support then after that he should be good to go but with my illness it has slowed down our progress, I did come back home but he is still there and when I came home I was hospitalized for 2 weeks, I do have the hospital discharge papers but I was wondering if this situation could possibly help us speed up our process.


sorry to hear of your illness and hope it will be delivered soon. Also You could have still stayed there and you enter the USA with him you dud not have to go back home to show proof.
As someone said above the country has a high issue with immigration fraudsters but i think you living there for 2 years says a lot

Sheis a us citizen so she doesn't need them visa to be available, visa are alwas available to us citizen just send in them request for an expedite with your evidence and it never hurts to try

I am a U.S. citizen who now resides in Chicago but my husband is still in Nigeria we filed the I130 and now just need the affidavit of support I was recently diagnosed with end stage renal disease and need my spouse here in Chicago for support and care is there anything we can do to expedite the process or is there any exceptions for cases like this?

Ricardo is correct. I am sorry for your situation but unfortunately, expedites are only possible when a visa number is available, and you have about a four year wait from when you filed for that to happen.

wrong wrong wrong........OP said she is US citizen..means IR1 not F2A...doesn't need Visa number..She is eligible to make expedite request..She also mention that she is just waiting for affidavit support..I believe her I-130 was approved and she is in NVC stage.

Make an expedite request to USCIS explaining your situation. USCIS will determine if your request meets the criteria for expedite.

Hahhahah yes.. Humans are at the NVC.. you would think otherwise.. for real the lines are always engaged... I thought to my self teh other day.. are they realllly BUSY or they don't have enough lines.... 10 perhaps..? IT's crazy...!!!


Keeo on trying that you will be able to get someone soon... I call at late nights... or early morniings... seeem to be best... they close at 12am EST.... they are most busy from 1st - 18th monthly it seem.. so you should have no problems calling them.. i was able to get thru last night after like 5 attemps.. i think..!!!! I got my I-130 approved on 10/5/2010. However I am still waiting for NVC case number. I emailed them. I wrote letter to them with a copy of approved I-130. Now I am asking my congressman to help.

I have to leave the country next month so I would like to submit all the forms by 10/30. What should I do?

Can NVC accept AOS (864) with out the case number?

My wife has not received any 3032 form either.

Dedinately.. I understand what you're dealing with...

Have you spoken to A HUMAN at NVC..? The agent can tell you IF the packet is in the "Mail-Room" and tell you when to call back as the case has to be opened and assigned visa category etc.


To answer your question - You're not able to send in ANY documents without a CASE number... because it'll just go to trash... it has to be tied with the approved case...

Wow.. I did not know that it was a holiday... THANKS.. I guess that's why I called the IRS dept at 830a TO GET MY 2009 transcript and got a message saying they were closed... That's sad.. guess I might need to delay applying for my N-400 :whistle:

Wasn't with VJ back in march.


Packet with 2 I-130 delivered at the CSC on 3/3/10 NOA1 issued 3/9/10. NOA2 6/28/10....case got to the NVC on 7/13/10, case completed at the NVC on 9/13/10.

Interview assigned on 10/5/10 for November 1, 2010 @ 830am (double interview)
