My fiance is a Swedish citizen living in Scotland while he attends University. I am an American citizen. We want to be married here, then I'll be moving to the UK on an EEA Family Permit (I think that's the one) to live with him and work while he finishes his degree. My question is, do we NEED to file for a K1 Visa since we are not seeking to obtain US Citizenship for him right now? We'll only be here for a short time after we're married (long enough for a honeymoon in the states and getting stuff packed), then heading over to Scotland. He will most likely be getting a job in Scotland or Sweden after he is finished his degree and we need to be legally married for me to go anywhere with him, I'd imagine.

Before NOA2...? You don't have to do anything.. the petitioner doesnt have to be working to get an approved I-130. Later it would be important.. if he/she still isn't working then all is needed is a co-sponsor and you're set.

Thank God the big step is out of the way, but bigger ones to come! In order to make sure that our "evidence of an ongoing relationship" is intact, I really am wondering about my return to Chile. I originally wanted to return to be there for Vinko's interview, but I am wondering if it will look better if I visited between the time the I-129F was filed and the interview. The last time I was in Chile to see Vinko was in May 2010. Flying to Chile is expensive so I don't really want to do this twice. Any ideas?


Well for the ongoing relationship... it's up to you non would measured any greater than the other. But if it was me I'd go prior to the Interview and so you can also provide more recent documents to prove your relationship. If the consulate would allow you to enter then I'd say going there to be present at the interview would work just as good. Know that it is not a requirement for you to appear for the interview unless otherwise requested.

soo, I just want to make sure that Im not going to screw anything up.. so this may come off like a stupid question but it would ease me a little, to know for sure!

I have used the downloaded forms from the USCIS website and typed in my information (besides signiture) then printed the forms out and signed them... if I send these forms to Dallas. these are acceptable. RIGHT?!

I just have a stupid fear that these arent going to get accepted.... just want to make sure Im sending legit doccuments.

A lawyer isn't necessary unless your case is complicated... To include things like deportation, multi marriages, filings etc.

But they will tell you the system won't let them do it because it's "still within normal processing time" and to wait another xxx days. When we called, the front line agent said it was out normal processing time for 4 days but she couldn't put in a service request for us, that we should call after 20 days. But when we asked to speak to someone higher up, the officer was able to do it.

It means that you call your service center to inquire about the status of your petition, since it is out of "normal processing time", and ask why they haven't taken any action on your case since xxxx (last update).

To do this you'll need to call your service center and after talking to representative ask to be to connected to a "higher level of customer service". They officer will put in a service request if your application has been in their system for more than 5 months.

I hear people talking about service request after 5 months waiting for NOA2 for the K1 visa. Can some one please explains it to me? I tried searching here but did not find an answer. I do not know what is the meaning of service request.

A Service requests is basically an inquiry to your case to get the status. This is normally done for cases that are OUTSIDE of the processing times of 5 months or as listed for that service center. The request can be submitted through 2 channels noted below.

1. By calling USCIS and speaking with a CSR letting him/her know your case is outside the processing times and would like to know the status/hold back.
2. By Calling the Senator or other who represent your area so that a congressional request can be submitted on your behalf.

What do you mean when you say have a legal marriage on a K1..? Is that possible...? wouldn't the case be tossed from K1 to CR1..?

okay.. well I wasnt going to plan an exact date.. I am really hoping that this processe wont take to much longer than 9 month.. which will be the time spand by october.. but thanks for the advice. we'll complete everything else in the 3 months after we have the visa.. I was going to go to jamaica in june and we would work on the rest of the visa together... I am sending the F-129 this week.. so ya I guess we'll just see what happens.

Hmmmmm no October isn't possible. Vermont has picked up speed of late. i know their processing of submitted I-130s have been on the approval spree.

I received the NOA1 on Jan 11th, and it was accepted on Jan 6th, But when I Check My Case Status at the USCIS website it says there is no case file found.

Is this normal? or could something have gone wrong?

well I used the code that they emailed to me on Jan 10th, So I assume it is the correct one. The email says it can take up to 7-10 days for it to show up.


now-a-days... yes it's normal.. you just gotta wait - sorry. My case NOA1 date is December 30, 2010 and the case status is not available on the website. The case is in the system JUST NOT ON the website. So if you need a case stus you'll get to get pass the "uscis block " that is still on the front end of the customer service line.

Give them about 1 month.

Our USCIS application/petition has been accepted and routed to the California Service center for processing within 7-10 days. We are supposed to received our official I-179 with the receipt Numberxxxxxxxxx. Now what... since Egypt is in turmoil at this moment. I hope they settled there government soon.


Nothing happens now... all they (USCIS) will do is review the documents to validate the relationship - nothing else!

RIGHT NOW - Yes I would agree i would say the Vermont Service Center. This case(IR-5) was approved in 35 days without any expedition to it.

If you are sending through the US Postal Service, you use the Dallas address. The Lewisville is for things like UPS, FedEx, DHL, I believe.

You would list her children, even if they are not accompanying her. The question says "List all children of your alien fiance(e)". It doesn't specify adult, so you list /all/ of them.

If you look at mine you will see it says February 27th - March 9th, and as you see we have already pasted the 5 month mark. You can receive sooner than 5 months or later. Things are moving slow again at Vermont Service center. Good Luck To You :)

I see that the address on the instruction form for the I-129F has changed from Vermont to Lewisville, TX. My fiance (US citizen) is a member of the military and we intend
to live in Louisiana after his deployment. Are all the petitions being sent to Texas now? And the fee is now $340 right?

IF your case will be sent by the US Postal Service then you can use the USCIS's Dallas, TX 75266 address since they have access to their P.O. Box.
IF your case will be sent by FEDEX, UPS etc then you will send your case to the Lewisville, TX 75067 address.
The fee is $340.00

They dont have to keep the visa if the case was thrown into AP.. they can request is applicant drop off the passport if necessary.
