IR-1 / CR-1 Spouse Visa Process & ProceduresHow to reach to USCIS Tier 2 person

Does any one know how to reach to tier 2 person, every time I call them tier 1 person just does not transfer call. Any trick, tip ?

If you dont have a case pending .. it's so difficult. The Tier 1 people are like robots. Just try asking for a supervisor and just tell the Tier 1 person that you have call about what ever issue you have and have been given 2-3 different answers as to your case if you on pending etc.. Not a certain why to bypass them.

Hope you'll get some other helpful answers.

IR-1 / CR-1 Spouse Visa Process & ProceduresPhotocopy of the beneficiary's passport biographic data page

I called the NVC twice to validate if documents written in Arabic needed translated into English and was told to get my husband's civil Arabic documents translated into English. Since Morocco uses both French and Arabic in their government processes, the peference is French. Some will argue you do not need it, but I prefer to play it safe. You can call the NVC and you may get opposing positions on this, but remember that Morocco is a difficult Consulate. You can get a reasonable English translation in Morocco. My husband is getting his civil documents/passport translated just to save us time in case it is requested. I know that the NVC website states that no translation is needed if your documents are in the offical language of the consulate, but I prefer to play it safe. I wish you success in your process.

The Official language being French so if it's in ANY other language that is not the official then yes a translation to EnglisH is necessary.

Hi folks . does any one if they need Photocopy of the beneficiary's passport biographic data page translated too, if so can anybody tell any website where i can do the translation . thanks

if it is in the language native to the country/consulate then not required. Also many passports are of th international standards and have the native/official language of the country and followed by english.

To me seem as though the office that was handling your case sent it to another office.. sometimes fied office help to help meet quota. Other thing I could think of is that the case was just tranf. to the appropriate office that will not process your case file.

IR-1 / CR-1 Spouse Visa Process & Proceduresinterview

Hi All, so I received an e-mail for AOS bill and D-3032, so i plan to fax it to my husband so he can sign fax it back and e-mail it to NVC, my question is can I get him to sign the D-230 and fax it back to me or does he have to send the original from Jamaica, since I am the agent can I send it?

Also I was suppose to go visit, but he would prefer me to wait for when the interview is scheduled, I read some threads and they say that the petitioner is not allowed in the interview, so does it make sense for me to go there..I was hoping we could come back together but some people say it takes 5 days where other say it takes longer than 2 weeks if he is approved...any suggestions?

Y.e.s the original signature is required no exception. Where jamaica is concerend for your visa/interview type it is not common (now-a-days) for the petitioner to accompany the applicant to the interview. You can contact the consulate to see if this would be allowed. If you do show up and allowed in you may be asked to wait in the "general area or court yard" and the applicants would be allowed to go inside and if you are needed then the request would be made and if they want to interview you then you can go in .. of they may just issue a Blue Slip

The visa is typically ready after 7 days. The DHL agent will set the expectation that you can start tracking the package after 7 days. Now you will not know if your case would go under AP even after you have been approved and passport was dropped off as happed to our most recent member from Jamaica - Time Tested who had to wait 3 months even after approval

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat Actually is Expedited??

It requires a letter from your doctor stating
your medical condition is severe and you are
in need of your wife to assit you with your
daily living and your inability to live and get
around on your own.
You can also request hekp from your Senator
with a request release form submitted to them.

If they see a need for your disability and your
request is valid they will and can approve your
case to be expedited.
Also if you have a HARDSHIP renendering your
spouses need to help you can file for this also
Than its to the descretion of the USCIS to approve
your claim.

Good Luck

You can sit around as claudia said or be proactive ... Your choice, your case. It was completed after the time interviews are typically scheduled... Note though that the NVC will schedule interviews even in the 3rd week for some consulates. Guess you could check again at the end of the second week in january.

IR-1 / CR-1 Spouse Visa Process & Procedurescalling nvc

Does no harm but just to call to call ties up representatives for those who are expecting a status change and/or needs to speak with an agent. If you are not expecting a case status change and are not due for one, why call?

Well... if there are people like me out there.. Who didnt send in a form to expect a status change or due for one why call..? There could be several reasons allow me to say -- > People might have questions about a form... Questions about a mail or email correspondence that we would like to call about... we may want to request special proccessing.. I say call and get all the questions you have answered.. I did and I guess that is why I went from USCIS TO the great NVC without a single RFE because i sure had a few questions and was stoppable by no one who is not paying the visa fees etc I had to pay - end of point.

IR-1 / CR-1 Spouse Visa Process & Procedurescr1 entry

hi all...hope everyone had a gr8 christmas...i have another question, i have read that if you enter the us after your 2yr wedding anniversary on your CR1 visa you can ask the officer at the point of entry to change it to an IR1, my wedding anniversary will be on the 17th or march 2011, so i was wondering if there is any truth to the above story. if anyone has any fact that they can shed on the situation it would be greatly appreciated. as i would just wait, i know it would be 2 months longer to be united with my husband as i was planning to travel in january, but i think it would save us the problem of filing to remove the condition and also save us a little cash.
thanks guys!

the CR1 are for those persons married for LESS than 2 years// if the marriage is more than 2 years old at time of entry THEN only could you request to be added as IR1.. let the officer know you have been married for 2+ years

IR-1 / CR-1 Spouse Visa Process & Procedurescr1 entry

Excuse the comment but why isnt he contacting the US Embassy or he should already know the status of his case
I dont mean to be rude but why is he asking some body here when he has the Embassy to contact and get details of this ? ? ? ?
Surely we dont know ALL DETAIL OF YOUR SITUATION..but how do your think they will just change it from a CR-1 to a IR-1
if they dont have the paperwork. USCIS cant make changes along the way if they are aware of your changes along the way
unless you advise them of your situation. Upon Entry the US INS cant make a change out of noplace, without documents
and of what your trying to do. INS at the border just allows or disallows your request to entry. Without
the Embassy's yellow envelope how will he entert the USA at the border. To file a IR-1 you have to submit paperwork so upon entry they have the correct info from the Embassy on the status of the Visa and the and kind of Visa your entering the USA on.
Visa entries to the USA are limited usually to 6 month after they are issued to come and enter the USA.
If you come after this time you have to re apply for a new Visa since the one you have has expired 6 month after being issued.

Better go to the US Embassy and ask them and be sure you have and can enter the USA with a expired Visa

And regardless who or what time frame it is. you cant have a visa expire and come into the US later asking for something else but what the Embassy provided them but a CR-1. He should go to the US Embassy to ask them or e mail and ask the Visa office what they suggest to do. Thats the only word he needs to worry about. USCIS HAVE RULES THEY MUST FOLLOW ALSO, and we cant just change them to make them fit our needs. Thats why they have regulations and procedures & rules to follow also.

Good Luck

IR-1 / CR-1 Spouse Visa Process & ProceduresPOE

Hi, I'm new here. My husband is waiting for his NVC case to be closed.

I noticed that many people state the POE and location. Will the POE be assigned to you? I'm a resident of Washington, so will he have to arrive in Seattle?

I am temporarily living out of state finishing my education. But we want to end up living in Seattle. I will only be on the east coast for a few more months, and he should have his interview in the next few weeks as far as we can tell.

Once he gets his visa, can he travel and work freely in the USA, or must it be in a certain location in the beginning?

Also, have any of you updated your address throughout this process? Was it a hassle or easy to do? Do you think it's better to change it now or wait until he's been approved and has the visa in his hand? Would it be terrible to not change it all? We may be living in another location but just a few weeks (months at most), but obviously I don't want anything to go wrong! My parents would keep me up to date with any mailings, so I'm not worried about that at all.

Thanks so much for your thoughts.

No POE isn't assigned. It means port of entry he can enter the usa at any airport he choose to use. He can work, travel... When he gets his status. He can update his address at the US Airport when he arrives.
