IR-1 / CR-1 Spouse Visa Process & ProceduresI-130, Petition for Alien Relative

About 3 months ago, I've received a request from NVC to pay all fees; I did so, including the expensive $400 each fees.We sent in all our paper work, affadavit of support, etc. Im in New York, how long will it take for them to receive it,considering i have sent it over a month ago? Now recently, I have seen the visa bulletin and seen that the category for Alien Relatives got pushed back to January 2000. Will this have an effect on my case? And considering that the National Visa Center has taken down the website to pay the fees, will my case still have a chance to be processed this year?

Welcome to VisaJourney

What is your case category? Who petitioned for who...? This is important to know so your question regarding processing expectations can be answered

Thanks everybody for their response! Yeah you're right I'm not wasting my time on somebody who wants to commit immigration fraud because they think they are helping their sister.

Sorry but seeems you HavE an idiot as your boyfriend. Of all persons his sister, the sister is senseless too. In this day when every thing is checked for legality. This guy neeeds help and yea you ought to listen to the others and consider if you want a bird brain as your boyfriend. He is silly and the directives given by others puts him at risk to kicked out the country and miss "wifey" to be banned. It's this kinda stupid makes the visa process harder for every one else who are real and who will do the right thing...sucks and I hope they get caught.

IR-1 / CR-1 Spouse Visa Process & ProceduresNo Pay Stubs for Affidavit of Support

I am preparing the affidavit of support, I have my tax returns, but as I am self-employed I don't have pay stubs. the joint sponsor is my sister, and she gets paid in cash as wlel, but she has her tax returns as well with no paystubs either. is that gonna be a problem at NVC? or I should just write a letter explaining why there are no paystubs?
did anyone send the affidavit of support (I-864) without paystubs and got his completed with no RFEs and no problems? do you know anyone who did?

I submitted The Affidavit of Support and 2 "co-sponsor" forms... There were no RFEs. Pay Stub/s ARE not required. IF you seubmit the Tax return then you WILL need to send in paystub... IF, only if you will send in a TAX transcript then you need to only do JUSt that. IF youhave any other questions just let me know.

Hope this Helped You...!

IR-1 / CR-1 Spouse Visa Process & ProceduresAirport Immigration Process Time

Does anyone know how long it takes at the U.S. airport for processing of an immigrant under the cr-one visa? How long does it take to clear through customs and immigration? Just trying to plan connecting domestic flight ok. Thanks.

POE varies and arrival hour etc. average immigration "line" wait is about 30-45 minutes. You will then be sent to the "room" where your documents will be processed and with there again depends and processing is done on a"first come, first serve" basis. You can expect to be there any where from 30 min (if there is no wait) to 3 hours. This could be more if there a lot of people waiting. Customs is usually the quickest part, 30 min- including luggage retrieval. And maybe 30-60 min if there is a connection involved.

* 3-4 hours would be good enough though.

No, I haven't yet. I will post a reply as soon as I get an answer from them. We don't need it right now so we are prioritizing things first. We have a pending request in USCIS and we'll get the result by next week, so after we get the result, we will try to call NVC. But as we plot our calendar, we will be able to call on the second week of October as we are pretty busy with some stuff.

I'll post soon. I'll be out of town for a while but I will be able check the forums sometimes.

God bless our petitions!

Ok since you're extremely right now thought I'd help u during this process... So call nvc and spoken with "Aden" I asked him if someone can take their documents there his exact words were

" No, we don't accept packets here and no one will take it inside, we provide instructions on how to return the requested documents."

But if u still feel the burning desire to have your documents acccepted/assigned in person then an update to this policy change would definitely expedite things.

Driving for 15 minutes is hardly wasting time, especially if you are going to do something and let the world know about it. And it's all for his spouse. Wouldn't you climb the Everest for your spouse and certainly drive 15 minutes to NVC?

It's not testing nothing and the END result will be NO.. so you need me to COPY and PASTE you the link concerning this from thier website.. I'm CERTAIN there are others in the Portsmouth, NH area who like 5 min from the area who have tried this...

IT's hard but sometimes they have a hard work load and it's still a benefit that we all are seeking and so we have to be patient with the process.

Excuse the above answer that was for another thread. See below.

Varies by location example the applicants in the Philippines may have a 2-5 month wait after the case/s is/are completed while in Jamaica there may only be 1-2 months for an interview to be scheduled.

New Fee: AOS $88 and IV $404 - Total $492

Loto

Correct loto , I knew of the changes back then. My case got to the NVC on july 13, 2010 and I was subject to the new fee. Hope it wasn't a miscommunication but was saying that no new fees were made as of 9.23.10, following uscis's press release-sorry.

of yea a lpr can't hold a government job, vote, get government assistance-public tested, spend excessive time out of the usa, may become deportable depending on the crime. There are other things like filing form ar-11 (change of address) if moved and with in 10 days. The usc isn't required to do this unless they have a pending case with uscis.

what's the differece with U.S citizen and LPR? What is an LPR ? :star:

US citizen is someone born in the usa or status obtained through naturalization.

A LPR is a legal permanent resident. A foreign citizen/alien allowed to live and work in the USA.

My 2 I-130s were approved in 4 months at UCSIS and now we are await an interview. The case was compeleted about 11 days ago.

I agree with the others above... I'd take 5-7 months over the previous processing time and have no access to a case online. Just Be Humble... It's a Benefit....

Hi People,

Quick question, if my sister was to have her Turkish boyf visit the UK, would he need any type of proof to prove he was going to return to his home country, even if he had a round trip ticket?

Also she doesn't want to sponsor him at this time.

Thanks

You sister lives in the UK it seem and he lives in Turkey. But isnt showning ties to one's own country a requirement to gain legal entry into most countries if not all.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan i do interview in the USA instead of my country

My husband, LPR filed I-130 in September 2010. I want to visit him in December and spend 4-5 months, and am wondering if my case is really completed within the 5 months timeframe, can i stay in the USA and do my interview there? how do i request that my interview be done there instead of in Jamaica?

ALl my previous visits i was given 6 months in the country, so would i be expected to pay for adjustment of status even though i dont think i would be out of status if my interview is set before May 2011 (i would be there, December 2010 -April 2011)?

THanks for response

Naw, this won't work. When the petitioner, your husband submitted the application u were in jamaica and a certain question ask of the applicant is currently in the usa where will he/she have the interview/do the adjustment. Since u were NOT in the usa then the kingston, jamaica consulate was chosen.

When u enter the usa come december you cannot misuse the intended purpose of the visa which is to travel, to visit. because the border officer WILL ask you the reason for your trip you can only say to visit and he still ask when do u plan yo leave. You can't say u will stay because u want to do an immigrant interview in america... You'll probably be denied entry and on the next flight back to jamaica.

after the pending application is adjudicated and if approved would be sent to the nvc. ... You cannot call the m saying you're in the usa. Depending on the visa bulletin your case will/will not be transferred immediately to the nvc .... Especially if they are not processing your p-date/after. When the nvc does get your case file then u can notify them you are in the usa and would like to adjust status at the local office/interview. They will then send your info back to immigration and then only u can submit the necessay forms the 980 & 80 fees. Processing for the adjustment status takes about 4-6 months to be adjudicated and another month to receive the GC. In all reality this takes much longer and is more expensive.

it's a rather high chance you'll be required to return to (your country) jamaica so that an interview etc cam be done. You can't use the privilege of the tourist visa to jump over the immigration process.

Others might have some thing else to add.

she gave you accurate information. Once SIF occurs, the case file/s go under a final review which takes 1-2 weeks. The response time for interview depends on the interview dates and how soooon they become avaliable in Burkina Faso. Checj the consulate reviews for Burkina Faso.

Hope someone else will be able to contribute. congtats on your sif.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarch Filers Out There....

Yes, Ricardo, we have paid all of the fees and submitted the packets... just waiting now for some kind of word. Did they inform you by email? How did you find out?

Thanks, Teya. :star:

No.. They will NOT notifiy you that that the submitted packets were reveiwed or accepted. If all documents sent are accepted the NEXT time you would hear from them would be for packet 4 which is the medical/interview.

I called them for a few weeks after I sent off the documents to see if THEY were reviewed. They tell applicants to allow 6-8 weeks for document review... but lately they have been getting the docs reviewed in 2-3.5 weeks. The AOS is reviewed much quicker the DS-230 they probably take 3.5 weeks.

I looked at your time line .. so yours took 5 month and about 1 week to be completed. I saw that you filed the I-129f and I-130.. .. the i130 was sent like 3 months before the I129f... but you were married by then.. so why the I129f..? I think this could have caused delays in your case.
