Hi Ricardo4eva, can I ask how long it took to receive the passport stamp after interview approval...Congrats!!

Well they did not get a passport stamp as it was not requested That is often times requested if the applicant is in the USA and requested it so they can travel/have temp. evidence.

They did however receive their passport/visa back after 6 days after the second interview in Kingston, Jamaica.

ok i called the USCIS and the person I spoke with asked me a few questions. and based on the information i gave her, she said that both my minor children derived citizen because i have citizenship by naturalization. she said i could either apply for their US passport or file for the N-600. but she recommended to applying the passport because it serves as proof of citizenship and as travel documents. i do agree with her for the sole reason that applying for a passport is 500% cheaper than filing the N-600.


How nice so it turned out I was correct. Doubted the information i provided as others started to join. BUT I dont think that it would be possble to Apply for the US passport first it's not possible. Why? because she would have had no proof of US citizenship.. she she has no choice BUT to file with USCIS first after the child enters the usa,

I believe the Child Citizenship Act of 2000 applies to children that enter the US with IR3 or IR4 visas. IR2 will be eligible for citizenship at the same time as the natural parent.

Hello VJ Family,

My child was given an IR2 status by uscis. how is this status (IR2) removed when the child comes to the USA.


The child would be protected by Child Citizenship Act of 2000 that would allow the child to become eligible for Citizenship it seems.
To be eligible, a child must meet the definition of “child” for naturalization purposes under immigration and must also meet the following requirements:

• The child has at least one United States citizen parent (by birth or naturalization);
• The child is under 18 years of age;
• The child is currently residing permanently in the United States in the legal physical custody of the United States citizen parent;
• The child has been admitted to the United States as a LPR or has been adjusted to this status;

Well you are married to the NATURAL parent of this child for 2 or less years correct.? IF yes - the spouse is required to file conditions and so you/he will file to remove conditions and the child as well. Their case is cased on the bond.

If the sponsor was married in the past and got a divorce then yes they will need the divorce paper. If the applicant was married and divorce then the same.

I noticed they (CSC) misspelled my wife's first name (the beneficiary) on the I-797, Notice of Action.
The petition was eventually transferred to TSC.
However, there are no spelling errors on the I-130 petition that I submitted. I made sure everything was correct.
The I-130 petition has been approved and sent to NVC (Well,I think it's been sent but I have still not received a case#).

The I-797, Notice of Action is just a form letter, right? Will this be a problem with NVC?


You have done your part. Unfortunately they are humans too and so made errors. You should still use the correct spelling on the documents you will submit. Once the case is received by the NVC you can contact them to check if the proper spelling was communicated to them. You will be able to correct this and they will have the proof they need as printed on the original/certified copies.

Correction. They WERE up and were revoked. It's the only explanation for why they were there and are now gone.

They are still running on 2010 numbers. That's what USCIS says so trust that.

Hi There, We are currently on the NVC stage, we are using a immigration lawyer and they are asking me to send my original birth certificate, Marriage certificate and passport? Is this correct? I have read that it is ok to send in copies and then provide the originals at the time off the interview....I hate to say but i have lost a lil faith in our immigration lawyer and am also nervous off not recieving my documents back before the interview!
If anyone has been going through this or has completed this part of the journey please help!


The lawyer is right... They do need the original / certified marriage and Birth Cert. they dont need your passport BUT you need to send a copy of the biometrics page of it.

my wife is an american citizen, and she filled an I-130 and received a notice from Uscis that they received the papers in november 9th!!!
but, after that notice, we didn`t hear anything from them for anymore and they r still saying that our case still pending!!!!they are now over three months and still nothing!!!! is that a bad sign??? and how longest it genrally takes to reach the level to go to pick up the visa???

i understand your concern - hearing nothing after 3 months. The USCIS expectation for process the I-130 is 5 months so it is normal that you have not been contacted / case not updated with USCIS. IF 5 months have passed (April 9, 2011) then you should call them to put in a service request to get information about your case. It is NOT a bad sign.


Your Visa class is Immediate (IR) so you are not subjected to the visa cut off dates so once your case is completed by USCIS then a visa is waiting for you. The cases are usually at the NVC for 1-2 months (average). Without delays someone in you visa class can have his/her visa in 8-9 month if the case has no delays at USCIS or under go Administration Processing/AP.

Hi All,

Congrats to all who have been approved and good luck to all still waiting. I made a big mistake by sending my original marriage certificate and my wife's orignal birth certificate to USCIS with my I-130 package. Too bad I found VJ after the fact. Well now I know the orignals are actually needed for the NVC stage. So my question is, does anyone have any experience in this type of situaion? Darnell and Loto both gave me some good advice already. From what I can tell I have two, maybe three options: Call USCIS and see if they can pull out the necessary docs and send to NVC, or file form G-884 which requests USCIS to send back the oriignals. Just not sure how long the process of getting docs back would be. As a last result I can try to possibly have my wife get a new orignal birth certificate and marriage license made and sent to me. Any insight? Thank you.


To request the ORIGINALs back from USCIS... you need to send the exact copy of the requested document. if you dont have it then you might as well continue your route to the NVC using certified or other originals that you will get from the issuing post. It's a straight shot answer and requesting the document. I've submitted my request to get my originals back used for my parents case.. it has been 1 month and still awaiting the response so they can be used in the "other" pending case we have - F2A

It will come in the mail... My parents 2 green cards came priority mail (red envelope). DOE - 12/19/2010 , GC in Mail - 1/6/2011 so give it about the same time perhaps. of 3-4 weeks.

Hey Ricardo, Yes good in deed. My wife made it here just in time to see the last big snow!!! She had never seen it personally and the was quite exciting for her. She did freeze but managed to enjoy it just the same. Now we are into much better weather and she is still cold most of the time.

My wife hasn't received anything yet. I even have to submit a form so they will return her original documents which were not returned during her interview or at the POE.

** Don't feel bad I have to submit the G-Form so they can return the 4 birth certificates they have .. guess i'll mail it today/tomorrow. Did she get her social security card..? If not You should take her to the SSN and apply for it because even though the DS-230 says a number will be assigned they did not do it for her. She came in February here so would give it 3-4 weeks.

Well I don't know how else to do this or get this message out. I am hoping that most if not all of us have finally reached out goal and have our loved ones living with us. I just wanted to personally thank the dedicated VJ Gurus who helped all of us along the VISA path. Boy what a long and winding road. I could not have done this without your support and help. To those who made March 2010 a 318 page brother and sister hood thanks to all of you also for asking questions, helping each other, listening to our stories of happiness and whoa and listening without judging to much :). We were and are all from different back grounds and cultures and became family even if it was for a short while. I will not forget these many hours spent on VJ... My I-130 was approved on january 31 2011 i keep calling that nvc number but it keeps saying that they have not received my case at that office. when i called last week i spoke to a lady and she said i should be able to have the case number by yesterday, but it still says the same thing. should i be worried or is there anywhere else i can call to see whats going on.

I had a case (F3) that took about 30 days to get there. Even so you can contact USCIS to confirm the case file was sent to them. You may need the assistance of a level two agent who will be able to confirm if it was sent.

I saw some forums.Thay got NVC case number in couple days.Why?

I too wish I had a good answer. I can say that it all depends on when it was received by USCIS. Even though approved it may be in a pending status to be transferred to the NVC. Some field offices or Service Centers are slower than others.

Recently we got married my wife is in U.S and she is going to file I-130 petition.

1st question: There is a form g-325a which is also need to be filled by my information and my required signature, i am in Pakistan is it necessary to do sign the g-325a if i am out of U.S ? if yes then can i put digital signature on it ? or i has to be my signature by my hand ?

The Signature is not required. USCIS will not reject the form/application if the signature was not included.

2nd question: In I-130 package i don't see affidavit of support requirement when I-130 need to file any reference USCIS link for it ?

The I-864 is not submitted along with the I-130 unless you are submitting the packet I-864

About 3 months ago, I've received a request from NVC to pay all fees; I did so, including the expensive $400 each fees.We sent in all our paper work, affadavit of support, etc. Im in New York, how long will it take for them to receive it,considering i have sent it over a month ago? Now recently, I have seen the visa bulletin and seen that the category for Alien Relatives got pushed back to January 2000. Will this have an effect on my case? And considering that the National Visa Center has taken down the website to pay the fees, will my case still have a chance to be processed this year?
