You can get married where ever and whenever you choose, so long as it is in the US when she arrives.

Personally, I would be very careful about putting down any sort of down payment on a location for the wedding. You may be out that $$ if the visa process takes longer than you anticipate (and it often does).

I guess if that's all you have, that's all you have. Personally, I would go visit her again (or have her come here), save the boarding passes and passport stamps, and then file. One photo and one train ticket (which proves what, I dunno) may well cause you - at best - a delay or worse, a denial.

My fiance is 6 years older than me, and I'm not the least bit concerned.

The issue is when the wife is older--CO's HAVE been known to ask RFE's (or even push to AR) on this.

When husband is older, it will sail through scrutiny (yes, it is a double-standard--but not much you can do when such a standard is applied by someone with "authority")

Well as of this moment I am still a "civilian soldier", what this means is that I have to be prepared for almost anything at a moments notice. Being "part-time" military I'm not entitled to the privilages of JAG, though I may be wrong, I'll contact my unit to see what more can be done. We're on "alert" orders for the deployment, I'm sure that if the "true" orders were cut the emergency expedite would be a sure thing. By the time that the actual orders will be cut this leaves very little time for the USCIS office to act upon the request.

The bad thing about this is that me and my fiancee want to start our family before I get deployed, if she's not here before my deployment this will risk our chances of conceiving and having our baby by waiting the additional 1 - 2 years. It would be nice if a law could be established whereas military members can have a proxy for marriage purposes, this way I could marry her while serving my country in Iraq. Doesn't help in conceiving and having our baby but sure would help knowing that I was finally married to her not just in our hearts but also on paper.

Oh I see. Well, I would still contact your unit and see if there are any other avenues available to you (that they know of). These days, 'alert' orders can turn into 'actual' orders pretty quickly. And hey, 'part time' military still counts in my book. :thumbs:

Yes, you can visit the US while a K1 is in process. Bring proof of ties to your home country (letter from employer or landlord, return ticket, bank statements, etc). The fact that you'll have to return to the UK for the visa interview also helps.

If in doubt, have your fiancee visit you in the UK instead.

These RFE's are bogus and BS. I just don't get whats going on with NVC right now. How can the people picking up the phone there have no clue or be unable to give us even any hint as to why it wasn't accepted or even know whats happening with our file. Now they are guessing what could be problem not giving us a clear shot answer.. Frustration is an under statement for how I am feeling right now.

no need to get mad at the persons answering the phones... dl u know how call center work goes..? the persons that are processing the cases etc have not contact with customer (us) and when we call in we speak with the frind line agents whp u get mad with ... when they dont have anything detailed to tell you AS to WHYYY you got a RFE if their co-worker/s did not up date the file with details notes/instructions for the applicant/petitioner etc. Do u think they dont have to give you an answer or feel embarassed when they have to tell you they dont know why you got a RFE? Be Human

All the best to you getting mad wont help u much especially if the wife is actin out to NVC supervisors... :whistle: you'll never know why the RFE was generated.

Ok here we go again well last year I filed for my husband and due to the fact that I was unemployed for part of 2009 my yearly income tax was low for 2009 and not enough for the income guideline even though I was making enough in 2010 so I had to get Co Sponsor because in JA they only look at the tax papers so now I'm filing for my step daughter and I just filed my 2010 and it is more than enough do u think that I will need a co sponsor again? First - dont email the embassy 4 times asking such question. No co-sponsor is needed id you met the income requirement.

You petitioned for your husband and you're now petitioning for a child. You will be required to have the income of $22,887.00 to support you all (3).. for any additional person you are responsible for add $4,675 and you need to earn least that amount. if you have sponsored ANY immigrant who is not a citizen or worked 40-credits then you count them in as your household.. if you only sponsored your husband then ignore it.

If they can get a PCC a month prior to the NVC and fly thru then that would be kool.... but it's best when at the nvc state.. guess would make for a earier transition at the embassy/consulate... but as long as it's not expired thought.

keep in mind that anything an happen from the time it's issued and accepted by the NVC.

I see one person who's confused as to the PURPOSE of this site..! Hey it's to ask and be advised and so he's given the information since that is what the poster did - he understood. The question was NOT when it expires question is is it tooo soon.. and just in case you dont know.. it's not advised to get a police report est. 5 months before you get to that stage. SMH

That would be nice.. but think if you request a police report anything can happen between now and the next 5 months when you complete the NVC Stage. You want the documents to be dated as close to the processing of the particular documents. If there were not such requirements then we could have all the forms prepared weeks, months before the case is completed.

We are 2 months into the I-130 Process.. My wife has all the original documents, translation and all are apostled. I was wondering how soon she can obtain police document.. It takes about 30 days for mail to arrive from Georgia to the US.. I wanted to have all documents here and ready to go.. I just didn't know how soon she could make the police document.....

you should hold off untill you are at least at the NVC stage.

No.. there's no waiver as long as the form is being reviewed in the USA then the fee applies.
You are correct the AOS document used will be the I864W because since the Petitioner is a US Citizen then the child will become a U.S. citizen immediately upon entry into th USA under the Child Citizenship Act of 2000 (CCA)

We got our first NOA with a priority date (don't know what that means) of January 10, 2011. I tried checking on our case status on the USCIS website but it says that the number doesn't exist. I checked to make sure that I had the right number. Is this typical and how long does it take for us to be able to check on the status.

It means your case is not online. This can be corrected .. you should call USCIS at the number on the notice of action and speak with the agent... YOU SHOULD.. YOU MUST speak with someone else so ask a supervisor then let the person know that you're unable to check your case status and so would like to be able to do it online so you dont have to call in and as part of their commitment. Ask that they send an email to the service center where your case was transferred.

Alot of couples that filed anywhere from end of Oct till present doesn't work..i have called twice they told me both times anywhere from one month until maybe never because there has been errors in entering the info or they just don't have to put your case online:( what is important is your paper noa 1..so keep it ..its only proof you have they got it:) Good luck on your journey!!

our cases were assigned NVC case numbers 15 days after USCIS's approval. Think i called them 2-3 days after the case #s were assigned and provided parents and my email addresses . This was received 5 days after ALONG with the Invoice to pay the AOS fee.

You can call them ANY time after approval and provide them your USCIS case number the operate CAN tell you if the case was scanned in or if it was opened as yet.

** You have to wait for the Invoice/Bill that will contain your invoice # that you must use along with the NVC case number before you can pay the bill. You can email your DS-3032 or send it in the form.
