I believe this differs depending on the consulate. So what you need or don't need in the Philippines is probably not the same as the requirements for the OP in Germany.

I'd look at the 'embassy info' section of this site and see if it outlines it for your particular consulate. If not, I'm sure the embassy will tell you exactly what to bring for the interview - including another letter of intent if necessary.

Another possiblity for you may be to contact the London embassy and see about getting a regular tourist visa (B2) - if you're worried about trying the VWP (visa waiver program). I don't know too much about them or what they require, but it may not hurt to do a little research.

Yes you can have a cosponsor. You need to take a breath, read the guides and familarize yourself with the process so that you can give a potential cosponsor all the information they might need. The fear you're displaying here will be removed when you arm yourself with knowledge.

This site has almost everything you'd need to learn about the process, including example forms to download (most of which have coordinating instructions).

There is nothing illegal whatsoever about entering the US on a tourist visa to marry so long as you had returned to Germany after that. I'm not sure why you thought it was.

I read somewhere here that the affidavit support I-184 will change some rules starting from the 21st of July 2006, is it only for that Affidavit right?

I'm not sure she'd be able to get a tourist visa if she revealed that her intent was to come here and marry you, but she could try. It is legal to do so. If she could prove to them that she would return to Germany after the wedding, then they may likely approve it.

As I believe Germany is a Visa Waiver Program participant, she could enter visa free (just on her German passport) with permission to stay for 90 days. She would be asked at POE what was the purpose for her visit. If she said 'to get married', it would be quite likely that they would turn her away (as it would appear she has strong immigrant intent). If she said 'just to visit', but then married you and stayed, then that is misrepresentation and fraudulent. So if you two really want to marry here, you have to decide which of these options makes the most sense for you.

If you do go the K1 route, your fiancee would get here and have 90 days in which to marry you. After that, she will have to remain in the US until she receives travel permission (called Advanced parole), which is part of the adjustment of status process.

Read the guides section of this site for the best information on all your options.

And I'm sorry, but there's not really anyway to go without some kind of separation. None of us like it, but sometimes that's the breaks of an LDR!

This is a very salient point. I'm not sure, though, how that rule is applied (meaning does it depend upon the marriage rules of the state that the petitioner resides in, or is this across the board?).

Personally, I wouldn't bother with the trips where you only have secondary evidence. You only need to prove that you have met within the last two years to satisfy the requirements of the petition. It sounds like the trips you have 'primary' evidence of will fulfill that requirement nicely.

Save the information about the trips with only the 'secondary' information for the interview in the event that you are asked for documents to prove the ongoing nature of the relationship. Sending it with the petition will only make them slog through more (useless) paperwork.

Update:

I just received a reply from the person helping me with this process saying that because my fiancee never adjusted her marital status in the Philippines there is no marriage to consider for divorce/annulment. He recommends the K-1 route because there is no question about previous marriages whereas the K-3 does ask. He is the expert and I trust his advice so it sounds like I have my answer.

K1s most certainly ask about previous marriages ! You have to provide divorce decrees for them. Also, some consulates require the previous marriage certificates at the interview.

Maybe the expert needs to do some more reading.

If I had it to do over again I would send my I-129F to the VSC. You might get lucky and they process it. The worse that can happen is they send it to CSC so what do you have to lose if you haven't sent it already.


What would likely happen is they would send it back to you when they realized your error. Then you would have lost several weeks of time for trying to sneak one past the goalie.

Not worth it (in my opinion).
