My fiance didn't know to check about his the first time he visited me. We mailed it back to the address you mentioned, never heard another word. He has since been over twice without issue.

If you're really concerned, I would make a photocopy of the letter you sent them (you probably did that already) and have that with you the next time you travel. Then you at least have proof of trying to do things the right way.

Hi everyone,

Have any of you tried to get a tourist visa (for the fiance) rather than going through the entire process to get a k1 visa? I mean, if you obtain a tourist visa, you can actually enter the U.S. and get married, without any problems, right?

I was just asking because my fiance and I are considering all possibilites before embarking on this k1 visa journey, which seems to take quite a bit.

I don't see where the OP is suggesting visa fraud. Then again, there does seem to be some information missing from her post. As in what will you two do after getting married? If your fiance goes home to Mexico after you marry, then there is no problem doing that. You can then file for a K3, but you will still have to be apart - and that process is no less expensive and is actually more time consuming than the K1.

So to answer your question as posted, yes you can, as long as your fiance leaves after you get married and goes back to Mexico. :)

If that's the case, don't most accounts have some kind of overdraft protection? I assume he would be charged a fee, but in that event, I thought the merchant (in this case USCIS) was none the wiser.

If there is no overdraft, then I'm not sure what would happen either.

It would help to know who the USC is in this scenario. If the OP's fiance is the Canadian, it shouldn't be an issue (as they don't go into the foreign fiance/e's financial picture). If the USC has the tax debt, I would get the returns filed immediately and start making arrangements to pay off the debt. Not to mention securing a cosponsor for the affidavit of support.

I read it just fine as well thank you. Your second post was more to what I was asking, I laid it out very clear on the first post. 90days vs. 180days that’s what I wrote and didn’t imply anything else, it seems that people cant wait to flame you on the most simple things asked (ie 90 vs. 180).

Yes, I read what you wrote just fine, and thanks for asking in a non insulting manner. :thumbs:

The point I was extracting from your post was that we would have to change what we do in order to 'match' what that UK does (and the feasability therein).

Its a two way street only in the sense that each country makes it as easy as possible to visit the other without a visa. Despite being very good friends, our two countries still have different laws and the way to make those laws - hence the difference.

But there's no denying that it would be VERY nice if ours was offered as 180 days instead of 90.

I hope you can read what I wrote, too. :)

Probably because the VWP is the only thing that exists that allows citizens from allied countries to visit here (visa free). I'm not sure how it would fly for the govt to make a 'special' visa for the UK.

Aside from the fact that LOTS of people here can't even get tourist visas for their sweeties to visit.

Consider yourself VERY lucky to have a SO from the UK.

With regards my 4th question, I have booked flights from 16th August returning some time in September, yet I would like to stay for the duration of the visa waiver (90 days). Will this affect my application for a 90 day stay as I can't prove I will return after 90 days as my return flight is only, say, 30 days later?


Why do you have to apply for a 90 day stay? The VWP requires only a valid passport (and, at the POE, the CBP's belief that you will return home after the 90 days are up) from a VWP participating country.

Once your fiance arrives on the K1, he cannot leave the US without Advanced parole. The Virgin Islands are a US territory, and therefore are ok (just be sure it is a direct flight!!). The Bahamas are not a US territory, and therefore are not ok.

Essentially, you don't set a date (at least I don't cos I'm paranoid :lol: - unless you're ok with the idea of possibly losing any deposit $ if the visa does not come through in time for your wedding.

Sounds to me like all that you're seeing is verification that they received it. That doesn't really mean that anyone has LOOKED at it.

I have no idea what your fiance has filed for. Even the K3 (spousal visa) begins with sending in an I 129F. The I 130 asks right at the outset if you are applying for a husband/wife, parent, brother/sister or child. So what was his thinking in sending in the I 130 for his wife if he's not married yet? :unsure:

If you're referring to this thread of yours as having the 'hammer' dropped on you, then I guess we'll just have to agree to disagree. I actually thought you got support in that thread. The only problem is that, as aussiewench suggested there, its a little too early for a thread of 'facts' about IMBRA to work. But if you prefer being a martyr for the 'facts', then that is your right.

And for what its worth - threads going off topic (particularly LONG ones like the IMBRA thread) are nothing new on VJ, or on message boards as a whole. Sure, it can be annoying, but I'm not sure what can be done to change it.

when i first sent in the i-129f.....i had to list all children....there was nothing specific on any child that was coming with me...i think that comes later with the info for the embassy...i have 4 kids....18-26yrs old...but only 1 is coming with me....and thats what i am a little afraid of with this imbra stuff. see he is 20 and will be 21 in april of 07. so i am hoping this gets cleared up real soon....but as far as i can see, right now, just list all kids you do have, and later on you will have to state which kid is coming with you...and welcome to vj.. (F)



Just to let you know, there have been individuals that have had severe difficulty with adjusting status for their children that are between the ages of 18 and 21. Talk with Girona21 about this.. I hope that she posts here, but you can look up her old threads in the archives. She's currently getting an opinion from the BIA about this very issue...

Your friend doesn't want to make it look as if she is using the VWP to essentially live in the US. That will make it very easy for an officer at POE to turn her away - which isn't a risk worth taking IMHO (esp. if they eventually want to petition for a fiancee or spousal visa).

Well, call me crazy, but I'd at least meet the lady first before I started sweating details like a police certificate - which is a ways down the road in the process anyway.

As it goes, most places allow you to order the certificates either via the post or online. I don't see why she would have to physically go request one.

It depends on the consulate you're going through. I got this information from the 'embassy info' part of this site:

"Financial documentation from the petitioner may include but is not limited to employment letter for the petitioner with salary information and/or a copy of tax returns (Form 1040) for the last year, bank statement, W-2s. I-134 Affidavit of Support is not required but may be requested by a consular officer. "

So on Part C of the new form: If you've never been in the military and have never been arrested, are you supposed to leave all this blank and just sign the form? Normally that is a no no (either put none or N/A).

The instructions don't provide any guidance in that situation.
