I think the only reason is that selling a business and/or a wedding are just not reasons they deem valid for expediting. If they did it in your case, as raymaga pointed out, they would have to approve so many that the point of expediting would be lost.

I'm sure you understand that those dealing with terminal illnesses really are in a race against the clock, where the impact is much more than financial.

Sorry to hear this is happening to you.

Unfortunately, as previous posters have said, it is impossible to get an expedite due to a wedding date. If that were possible, every person applying for the K-1 would just plan their wedding early in order to get an expedite.

Most of us here on VJ have done the process without a lawyer, and a lot of the people who did use a lawyer were sorry that they did. You should probably consider trying to finish the process yourself. Keep in mind that lawyers will tell you what you want to hear so they can collect their big fees.

Hope you get your approval before the wedding, but if not, you'll be out $3,000 and it could have been a lot worse.

100% agree. Unfortunately, our idea of an 'emergency' never seems to equal up to what USCIS sees as one. The only expedite requests I've ever known to be approved are if one of the parties has a terminal illness. Those in the military with pending deployments also get expedited routinely.

And to echo a previous poster's question - can't your fiance sell his business now (as he will eventually have to anyway)?

Exactly. I think there was a statement made in another thread that K1s aren't even eligible for expedites (or something of that nature) which is just completely false.

But generally, impending weddings or job offers are not reasons for expediting in any way, shape or form. In other words, planning on your part does not constitute an emergency for USCIS. :)

I know that notarizing the G325A is not a requirement.
The letter of intent for me and my fiancee basically states that we are both legally free to marry and that we intent to marry each other within the 90 days of her arrival in the united states. Why the difference between "Letter of Intent" and "Free to Marry." Whats more confusing is that you first state it may not apply then at the end of the statement you mention "It's required anyway with your petition."
You totally lost me with that.

Yes you need a letter of intent (stating you both are free to marry) at the petition phase, but they do not have to be notarized. Hope that helps.

This is definitely not the norm, and not to scare you, but I don't see it as a particularly good sign. There must be some fact under debate from the NVC (Dept of State) that is making them ask USCIS to review it.

Are there any 'unusual' circumstances with your case? I mean, you guys have met in person and everything, right? I know it's hard to do but you have to take a critical eye to your case and think of things that might have become a red flag for the DOS.

The only other suggestion I would have is to have the US citizen contact their congressman or senator's office and see if they can get any other information - like what it is specifically that they seem to be concerned with which would require this to be sent back up the chain.

that is NOT possible,its not their concern @ricardo4eva2.it happens with k-1 cases everyday( meaning its not uncommon in the immigration cases ),the parent moves to the states and then files for k-2,the arrangements made is none of USCIS's concern.

LM@O poor planning you say..? that's not correct.. YOU MUST be knowledgeable of the situation first. Mother/Father were approved in the Category IR-5 (parents of USC). Therefore.. any children they have unfortunately cannot be listed to benefit from the petition filed regardless of age You'll know this after you have done some research.

Lawyers/Senators were engaged however they were unable to help because of the Visa Category and strick immigration laws.

Hey good morn to you.

I'd like to know.. do you thihk it is possible to get an approved expedite request for a child who is 14 y/o? The mom/dad was approved however the child will be overseas. There will be no one else there to stay with the child and so the parents will have to stay overseas until the process is completed and would put them out of status.

It the answers cannot fit and you there isnt an abbreviated form for the word then you could print the form with what you have and just fill it in with a black ink pen.

So I am starting to fill out the I-129F and getting my fiance visa all put together but I have some questions about what how to fill some things out?

1. My fiance lives in Jamaica, and he doesnt have a "street number" he has a road that he lives on and i know the name of that but there is no street number (I mean he doesnt even have a mail box) should I just put the street name down for his address or should I put the post office down where he would collect any mail?
this is my biggest concern!

Your Fiance should know his mailing address. EH just needs to use Whatever address he use when he accepts his mails, the address he use for conducting business etc.




2. When it comes to sending the package, when its finished, where should I send it... to the service center? (which for me would be Vermonts) or do I send it to Dallas?

3. If you are filling out a co-sponsor for the I-134 is there a place on the form where it can be stated that they are a co-sponsor, or does it even matter?

The form does not ask for this information however when the alien* adjust status to that of a permanent resident will need good AOS documents then.




4. Does anyone know if there is an age limit to filing the forms. I'm 19 years old, do I need to be 21? (I wouldnt think so but I worry about it)

You can be 19 and submit the form.

It has been 15 months and my daughter is waiting for her fiance to obtain his K1 Visa.

He has already been through the interview process and it was approved but he is undergoing Additional Administrative Processing (AAP). So far, since the interview, its been 15 months and still they have yet to complete the AAP. He is from Zimbabwe, but living in the UK. We have already sent an email to the Embassy. There reply was that his application is still undergoing AAP and that there was no way to hurry the matter. Even after 15 months!

Has anyone else experienced a similar matter?



Man it sucks.. I can tell it's in your mind.. since you're here posting...

Unfortunately there isnt a time frame to complete the AP .. so he/she is left to just wait. Some consulates/embassies complete it in a much shorter time but it just has to run its course - even after 15 months.

Yes... you may need several other documents for this to be done. Maybe more than an ID because the ID will just show your identity. BUT if you can obtain one then it will work.

It will not help you.. The people that use the G-845, Verification Request (SAVE agencies) .. are the "AGENCIES" like social security offices, CBP etc..

I was thinking about writing a letter to the USCIS in Texas [for my citizenship Certificate] to please hurry up with it, one to the USCIS in Louisiana [about a verification letter], and one to the Vermont one [i129f petition] with my receipt for my new Certificate and all the stuff i have that was giving to me when i became a citizen explaining the cituation. I don't believe they can extend time that long to wait for my certificate and since there's a new certificate coming out, i can already guess it's going to take longer than usual. I'm really afraid that they might cancel my petition for fiance. I don't know what to do. This is really stressing me out and they have to have that proof in their hands by February 15. I'm pulling my hair out because of this!

Please! suggestions will be greatly appreciated!



I'm sorry to hear of this. It's the petitioner's/applicant's responsibility to ensure that all the necessary documents were submitted as stated on the form/s that will be used. The Instructions does give examples of how once can verify resident status.. copy or unexpired u.s. passport, birth cert., Naturalization cert. or copy of green card if LPR. IF a RFE is given by USCIS it's there for 30 days.

You can write a letter to the service center but keep in mind the only address posted as those for the Lockbox etc. I can forward you an email and you can send a rather brief email stating that your are awaiting your proof of Citizenship and make reference with the receipt number you mentioned but this maybe the best way.

Pushbrk - Please familiarize yourself with the embassy of which you are speaking before you make a blanket declaration. This is COMMON practice in Jamaica - In fact, many used to recommend that you attend the interview so that this could be avoided. However, the embassy recently changed to not allow the petitioner (without special permission) to attend the initial interview, and will blue slip if they feel appropriate.

Most people that were blue slipped incurred the cost of the trip - only to walk into the embassy, be asked who they petitioned for, and were approved.

Your response is not accurate for Jamaica.

I am new to this forum and I have a few questions. My fiancé had his interview on Nov 9, and they gave him a blue slip requesting an interview with me (not very convenient right now but what can I do). I sent an email telling them I can get to Jamaica next week.
1) Do they schedule interviews for the petitioners so soon? If not about how long does it take. Was planning to get married in January but that may not be possible now :(
2) After the interview would I be able to wait for a week or so and have him travel back with me?
3) If not, how long before he has the visa in hand?
4) If you selected on the ds-230 to have them assign a social security # would he get that at the airport?

1. NO... it's done on the first available basis which may be after 11/23/2010 at this point.
2. After the inteview..? IT'S recommened NOT to make ANY travel plans until AFTER you get the passport back.. may take upto 2 weeks.. also if it arrives with ERRORS then it must be returned.

4. They submit the necessary info on the computer that is linked to the SSN office/ and a back office team processes the submitted cases* Not certain on this..!

Under what circumstances would someone have an alien number already to put on the form? My fiancee was an au pair here (US) for 9 months but said she never got an alien number.

As a unatural us citizen you would not have a A#. A# = Alien number and you were not admitted in the usa as a Alien Resident. People who come on work programs i've come to understand will not be given an A#

You just received your NOA1 in the last 2-4 weeks. You can update your case with the proper address. IF you have moved to different state then the service center processing your request may change. Others may have different but since it is new i would if I had been waiting say 4+ months I'd leave it as is.

My fiance is a Swedish citizen living in Scotland while he attends University. I am an American citizen. We want to be married here, then I'll be moving to the UK on an EEA Family Permit (I think that's the one) to live with him and work while he finishes his degree. My question is, do we NEED to file for a K1 Visa since we are not seeking to obtain US Citizenship for him right now? We'll only be here for a short time after we're married (long enough for a honeymoon in the states and getting stuff packed), then heading over to Scotland. He will most likely be getting a job in Scotland or Sweden after he is finished his degree and we need to be legally married for me to go anywhere with him, I'd imagine.
