There's nothing to stop the OP marrying in the US, if they decide to go for a spouse visa rather than a fiance one, so long as they go home to complete the rest of the process afterwards.


That's the key, but it's not what the OP asked in the original post. They asked if they can marry on the B1 and stay here while their spouse petitions them. In theory, they could get married here legally and return home to wait for their visa, but I think it'd be a tough sell to the inspecting officer. Can anyone cite any examples of people who have come here to marry and then returned to their home country for visa processing? My guess would be that in most cases, if they're here and they marry, they don't leave.

My point is that applying for the K1, since the OP isn't in the US now, saves them the trouble of a) trying to get into the US to marry on the B1 and B) ensures they can stay with their spouse in the US once they marry. Besides, they'll have a shorter wait in Moscow for a fiance visa than they would if they came back and applied for an IR1.


I can't 'cite' you particular examples of folks who have married here and returned to their home country simply because I don't know the stories of everyone on VJ personally. But surely not everyone who gets the tourist visa to marry here takes advantage of it by staying.

I agree with your interpretation of what the OP asked, which is why I advised what I did in my first post.

Personally, I would rather get the K1 and then get married here after that, but that may not work for everybody (depending on their particular circumstances).

It's not illegal to marry on a tourist visa if you are already here. If I read the OP's posting right, they're not here yet. It is not legal to use a tourist visa to enter the country with intent to immigrate.


Yes, but it's 'entering the country on a non-immigrant visa with intent to immigrate' that's not legal - not 'entering the country on a non-immigrant visa with intent to marry'. Your fiancee can mail in the petition for the K1 visa while you are here, but you'll have to return to Moscow once your tourist visa is up.

If you marry while you're here, you've sort of pushed aside the use for a FIANCE/E visa, yes? You would then have to petition for a spousal visa (K3 or CR1/IR1). Again, that process would have to be waited out with you in Moscow.

I know that you're trying to find a way to stay in the states while this process is ongoing; but you have to plan for some time apart. If your girlfriend is the right person for you, what's a little time apart in the grand scheme of things?

On the I129F it says that the petitioner must provide certified copies of police and court records for certain types of legal transgressions. It also says that this is done in order to comply with the International Marriage Brokers Act. Does this mean that you only need to provide this information/documentation if you met your foreign fiancee through a marriage broker, or do all petitioners need to answer this part and provide documentation? Thanks for any advice anybody can provide.


I had to provide police records (or lack thereof, in my case). I've never had more than a speeding ticket (which are not on the record, by the way), and they still want that proof. In Massachusetts, it took me 2 weeks to receive it.

The question on the I 129f asks if you have ever been convicted of the types of crimes listed (homicide, domestic violence, or 3 or more for controlled substances) - and if so, to attach information about them. In my case, I left those boxes unticked and moved on to part D. They are going to do a background check anyway, so I didn't see the point of going through the process of getting and sending information that they did not ask for.

To the OP: answer the question appropriately, regardless as to where you met your fiance/e.

Depends on where you sent the I 129f. If it was Texas, Nebraska - which are now forwarded to California - or California, you can expect about 90 days between NOA1 and NOA2. If it was sent to Vermont, I'm surprised you don't have NOA2 yet.

See 'processing times' link at the top of this page for estimates. You're probably getting close to an approval!

I didn't send my fiance's, but I did include a copy of the inside front cover of his passport (mainly because I used passport stamps as part of our proof of having met in person) just in case. ;)

USCIS does not ask us where our parents live....nor what state our driver's license is from.

The timeline depends on a LOT of factors - the service center you'll be going through, how backed up London is when your case arrives, how many people are ahead of you, the time of year, etc etc etc.

The 'processing times' link above should give you a feel for how long the service centers are taking to approve the petitions. You can add another few months on to that for processing time in London.

The day I mailed my I 129f, I got back to work from the post office, only to see page 4 of my fiance's G325a laying on top of the copy machine!! Aaargh!!! I FLEW back to the post office and threw myself on their mercy. Luckily, it was still in the bin beside the lady who had waited on me, and they let me open it, insert it and seal it back.

Will it cause a problem at the petition stage? Not likely, but what is the alternative?

I guess you could say I sent a combination of both. All my evidence was photocopied, except we scanned in my fiance's absolute divorce decree - mainly because we wanted to print it out on a color printer (to show the red crown stamp on it). My office's color copier was on the fritz at the time, so this seemed the best way to go.
