K-1 Fiance(e) Visa Process & Procedurestouches????
Agreed - lots of approved petitions went untouched (or only touched once).

Mine was touched once on 11/27 and nothing since. It'll be just fine with me if I hear nothing else until our approval (probably mid February).

What are you nervous about?

I'd be THRILLED if my fiance were coming over in a week!

K-1 Fiance(e) Visa Process & ProceduresNAO1 Received
Texas and Nebraska aren't currently processing I 129fs, so they are forwarded to CSC. You did right by mailing it to Nebraska, though.

Yes it can.

Vermont is churning out the NOA2s recently!

Us poor Texas/Nebraska CSC migrants have about 3 months to wait... tick tock tick tock

We're planning for a few months of him not having work authorization after we get married. Its really hard to predict an average.

For Vermont, it can be true.

K-1 Fiance(e) Visa Process & ProceduresNOA1/NOA2 dates in the timelines
I was in the UK when mine was mailed so I have no idea when it actually arrived. Besides which, I thought what the timeline was asking for is the date that they had issued it, so that's the date in my timeline.

But as its just a gauge for us to use, it doesn't REALLY matter.
TracyTNFemaleUnited Kingdom2006-12-16 10:37:00
K-1 Fiance(e) Visa Process & ProceduresK1 Fiancee arrived ill what about extensions?
No extensions. Get her to the courthouse and get married. I'll bet if you arrange it with them in advance, it won't take more than 15 minutes, and surely she can muster up enough strength to do that. Its a better alternative than not meeting the 90 day requirement and possibly having her sent home.

K-1 Fiance(e) Visa Process & ProceduresA little worried
When I was checking NOA1 timelines, it was about 10 days on average (mine was 4 days after the package was delivered to the TSC). Are you sure the package was delivered - did you have a way to track it?

K-1 Fiance(e) Visa Process & ProceduresReceipt or NOA?
He should be mailed his NOA1 - I didn't use a lawyer so I have no idea if they'd send it to them or directly to your fiance.

If he wrote a check for the petition fee, he can see if that check was cashed and get the case number off the back of it (and then track the case online).

K-1 Fiance(e) Visa Process & ProceduresQue regarding circumsances by which we met I-129
On the I 129 f, I stated that we met online and gave the dates, then said we had met 5 times in person and put 'see attached supplement for details'.

On the attachment, I again mentioned how and when we first 'met' (online) and then was a little more detailed about his first trip here (when we actually decided to get married). I then gave the months and years of our 4 other visits.

K-1 Fiance(e) Visa Process & ProceduresK-1 Question
Again, *I* think the process is straight forward.

But your particular case may have complications that mine does not. Overstays, a criminal record, etc etc etc.

You are the only person who can make that determination.
TracyTNFemaleUnited Kingdom2006-12-19 22:53:00
K-1 Fiance(e) Visa Process & ProceduresK-1 Question
1.) That's a decision you and your fiance have to make by reviewing both options and deciding which makes the most sense for your exact situation.

2.) No, you don't need one to send in the petition. Whether your particular circumstances dictate a need for one, however, is something only you would know.
TracyTNFemaleUnited Kingdom2006-12-19 22:45:00
K-1 Fiance(e) Visa Process & ProceduresWhat should I do?
To add to what fwaguy said - I've read that the temp EAD issued at JFK seems to depend on what CBP officer you get - so if you want it, ASK for it upon entry. Otherwise, they may not do it.
TracyTNFemaleUnited Kingdom2006-12-20 11:55:00
K-1 Fiance(e) Visa Process & ProceduresWhat should I do?
I don't think its 'stupid' to want to see your fiance. You have to decide what is best for you guys (and your pocketbook!).

Your fiance will have to have work authorization to work legally in the US. This can take several months to obtain. Did you not understand this requirement when researching the fiance visa?

K-1 Fiance(e) Visa Process & ProceduresFAX OK FOR G-325A ?
Its simple. If you are sending in the G325a in conjunction with a fiance/e visa application, then indicate that it is for a I 129f petition.
TracyTNFemaleUnited Kingdom2006-12-21 14:48:00
K-1 Fiance(e) Visa Process & ProceduresFAX OK FOR G-325A ?
It has to be an original. It'll take you less time to get the originals Fed Ex'd to you than what you might lose if they were to send an RFE for sending faxed copies (potentially 3 weeks).

K-1 Fiance(e) Visa Process & ProceduresAdvice Needed: Error on Divorce Decree
I sent in the final divorce decree that was signed by the judge and had her court's stamp on it. I didn't get a copy from the state.

Can you go to the court clerk where you were divorced and get a certified copy from them? I'd send that instead of the one from the state. At least it'd match your G325A.

Its not easy to be apart, but what choice do you have? You two certainly are lucky to have been together so much. My fiance and I have been apart nearly 3 years now with 6 visits tossed in there. But we can see the light at the end of the tunnel, and all we really care about, ultimately, is being together.

K-1 Fiance(e) Visa Process & ProceduresDo approvals typically slow down in January?

Patience is a virtue in this process. I'm a November filer, too, and I'm not expecting NOA2 until mid February at the earliest.

I'm sure there are service center employees out on leave for the holidays but there's no way to predict how much (if at all) that will slow things down.

I will accept a mid February approval but I will not accept an approval AFTER YOURS!!!

K-1 Fiance(e) Visa Process & ProceduresQuestion about Fiance Visa
He does not 'make' the interview appointment. The embassy should have mailed him 'packet 3', which contains a checklist of items he must obtain, some forms and instructions on how to book his medical. Once he sends back in the checklist and the requested documents (the checklist should include a line about the police certificate, if I remember what it looks like) and has booked his medical, the embassy will give him an interview appointment. He should receive that notification by mail as well.

He DOES have to make an appointment for the medical exam on his own.

The passport - well, I'd be ringing someone up every day until I found out what was going on.

I've honestly never heard of someone taking so long to get all these papers in order (maybe someone else here has?). Your best bet would be to email the London consulate, explain the troubles you've had and ask them what you just asked us - will he need an extension?

All of this is pretty clearly laid out in the link I gave earlier. I have not yet gone through that part of the process myself, so peeps, please correct me if I've misstated something.

K-1 Fiance(e) Visa Process & ProceduresQuestion about Fiance Visa

Well yes. I mean, ok. After three months, we re-applied for the stupid security check thing again. After another two and a half months, Alan (fiance) called and asked what the hold up was. Apparently its something a lot of people have been going through, and we were told to apply for a differant security check, although that was three weeks or so ago, and that one was only supposed to take 2 weeks. We havnt called to make the appointment because we were waiting for that paper and also his new passport, which again, was only supposed to have taken a month and its now been like 3, and we cant actually send in all that paperwork without his new passport number and the police forms. Im pretty sure now were going to have to reapply, and Im really devestated. I dont know what to do at this point. I cant get through to anyone, and it seems like Alan and I can keep reaching dead ends at every turn, you know?

Ok, I don't know if its just me, but I'm totally confused on what you've done. What 'security check' did you reapply for? I've never heard of anyone having to submit their own security check before- who told you to reapply for it? The NVC?

Or are you talking about the police certificate that your fiance has to get from his local police dept. to take with him to the interview? What appointment haven't you called to make? The medical? ????????????

Is there not someone he can phone to enquire about his passport, and why the renewal is taking so long?

K-1 Fiance(e) Visa Process & ProceduresQuestion about being allowed back in the states
There is no such law that I know of. I'm still not sure why you think you'll have to start over again. I can't find your old thread now. As I suggested there, though, I'd tell London why you've had delays getting your papers together and see if you need to ask them for an extension.

Don't call off this application until you're sure you have to.

K-1 Fiance(e) Visa Process & ProceduresIncome Tax return

I am pretty sure the requirement is not set by the Embassy involved. It is standard for all embassies. They want one tax return if you are an employee, Three tax returns if you are self employed. They also want three recient pay stubs and of course a letter from your employer. They perfer the IRS transcripts but copies of the returns are acceptable.

I've never heard of someone in London needing to provide tax returns unless they are self employed.

Why not post this same question in the Canada forum on this site?
