I'm a Nov filer, too - would love to know what date you received your NOA1. To that end, :time:

I didn't write down the date I mailed it, but on my NOA1 it lists the Received Date as 11-03-06 and the Notice Date as 11-9-06. I turned it into the Texas Service Center, and it was processed in California. If you filed in Novemeber, I'll bet you hear something soon!

You also may want to ask this question here on the Regional Discussions board. I seem to remember reading something from others going through Vietnam where the consulate does not look too favorably upon the use of cosponsors for the affidavit of support.

It might be wise to wait until you have a new job and a steady income to show the consulate before proceeding.

Hi people, haven't started this whole process yet, but trying to figure things out.... when i am approved the k-1 visa and i go over to the states to be with my girlfriend is it possible for us to get married in another country? or will they not allow me back into the US without some sort of other visa after we're married?

Check with the US consulate regarding DCF. The process varies from country to country.


In DCF, the US citizen needs to have lived in the beneficiary's country for a length of time (varies from country to country) before they can try DCF.

I didn't get a sense from the OP that was the case for them.

well, to keep everyone updated, my fiance got through to the helpline today to ask about it, and the woman he spoke didn't know the answer, all she knew was the part about needing to be legally free to marry, although she said she didn't know how that would apply in our situation, she suggested using the INFOPASS link on the USCIS homepage to make an appointment to see an immigration officer about it. so thats what we're doing, going to make it for early march, since i'm going over at the end of febuary i'll be able to go with him down to albany and make a day trip out of it. hopefully we'll get an answer then, because i'm not going to be able to let it go just on opinions and guesses, and there really don't seem to be any guidlines defining how the legally free to marry thing would apply for this

This is the way it is: Either you are legal to marry without consent by being age 18 OR you're legal to get married WITH parental consent for being under age 18. WHEN you file the petition, IF you are NOT 18 yet, then you need to include a letter of consent from your parents. IF you wait until you are 18 you won't NEED a letter of consent.

This might not be what you want to hear, but this is the facts.


Agreed. But if you want to take the time and go to the trouble to get an INFOPASS appointment, knock yourself out.

What's the rush anyway? Why not hedge your bets, wait until you turn 18, and take these months to get to know each other a little better? Marriage and moving country are HUGE commitments - wouldn't it be worth a few more months investment to make sure both are right for you?

I thought this website suggested sending proof of ongoing relationship such as emails, chats, etc. This would explain why she sent them with her I-129F application, which I did also.



It would explain why she is going to send it; it wouldn't explain why she feels it needs to be notorized.

I would think about the bankruptcy, though. If there's ever a chance that you may want to settle in the UK at some point in the future, the bankruptcy would pretty much kill your chances of ever getting a mortgage. And you'd probably have to start paying on the debts again as soon as you settled back there, too.

If that isn't a possibility for you, then go for it.

Agreed about no way to confirm it. You'll either have to trust those who have gone through it, or ask an immigration attorney.

To my knowledge, they do not look into the beneficiary's finances at any stage. They're more concerned with the USC's ability to support you and whether or not they have paid taxes, etc.

Once you get to AOS stage, they'll again look at you and your (then) spouse's finances in the US.

Remember too, Kinsey, that some people never show a touch or the NOA2 online (or via email) - then suddenly get the NOA2 in snail mail. Heishe springs to mind as the most recent case of this. I believe she saw the approval online a few WEEKS after she got NOA2 in the mail. Obviously its not a perfect system.

But I would totally feel the same way as you do, fwiw!

I think it is all pretty much covered under the guides. Not all RFE's are
done in package preparation as it is things get lost, they decide they want more
than they ask for etc. There just isn't a guide that covers some things.

We got an RFE for a court stamp on a divorce decree, nowhere does it say you need this
and many people before and after us didn't have it on theirs but they didn't get an rfe.

I know we can't cover every contingency but some of things are simple enough to create a list that a newbie can follow without having to read through threads and threads and threads

I wouldn't think of a list of things to get ready while waiting on the next step as an RFE list. An RFE list, to me, would be things that people have had to send back to USCIS in response to an RFE.

The guides seem to be the most comprehensive place to go to help you avoid an RFE.

You can get an RFE for something the service center misplaced, which has nothing to do with the quality of what you sent (or if you even sent it). You can also get an RFE for something that one adjudicator questions (type of evidence, proof of relationship, etc) but another one would look at and pass right by.

If you want to take the time and effort to make a 'list', go ahead. But I'm not sure how you'll be able to cover all the bases.

I believe that is exactly what we did - middle names (two in my fiance's case!) on the I 129f and G325a and just his first and last name on the letter of intent for his signature. I did refer to his full name in the body of my letters of intent. though. I'm not even sure that would make a huge difference.

I've not gotten my NOA2 yet, but I'm not expecting this to be a problem.

My fiance downloaded a trial version of Adobe professional. It allowed him to increase the size on some of the boxes (particularly on the G325a) where we had run out of room. I think he only did it once on the I 129f - for his (two) middle names. We didn't have to write anything in ourselves on either form - although that is perfectly acceptable to do!

An attorney would only help in the sense that they would be filling out the forms for you, and traversing any complications in the case if there were any (criminal records, overstays, etc).

They don't speed up the process at all. In some cases, they've slowed DOWN the process (search out 'Kym' and her posts... :whistle:
