Her wait is ridiculous. There has to be something that can be done.

Where's Huskerkiev gone? Wonder what light he can shed on it.

She has to be in the with the December filers, where else would her file be?

The 10 million dollar question!!!!!

And THAT is what's giving me the stomach ulcer. I have no way to know where it is or even if its still breathing (or needs life support). I've had no touch since Nov 27th and even if I call cust. service, all they can tell me is what I already know.

That said, I may call next week anyway. I may ask, in the nicest way possible, how I know that its not been lost.

Thanks JamalXTam - I appreciate it. I'm sure you can relate to how I feel based on your timeline. So just multiply your angst by 2 and that's how I've felt the last two weeks. Really sucks.

I am sure the CSC employees take care with our personal information. I don't think they are heartless - I just think they are swamped, and probably after looking at 20 + applications a day, it may seem like we're just names on a pages instead of couples (honey bunnies :D trying to start our lives. Its all in their hands.

Thanks, patiently_waiting. :) I surely do appreciate the prayers.

From what HuskerKiev said in his thread, it'd be way to early for me to consider calling my representative. He suggested 30 days past VJ processing times (which would mean the end of March). And I agree - would likely just be told that I'm within processing times.

Never filed any sort of petition before (so no IMBRA) and I haven't received an RFE. In fact, my case has had no movement whatsoever except its last touch on 11/27.

Definitely on CSC time. Which equates to 'whenever we freaking feel like it'.

And believe it or not everyone - I do feel I'm being patient (what choice do I really have?). But its hard to be completely content when December filers whiz past and I haven't even had a touch.

K-1 Fiance(e) Visa Process & ProceduresTracyTN prayer thread
Thanks all. As my dear fiance said, other things going on at the moment that just seem to be magnifying everything.

As far as the NOA2 goes, I go from anger to depression to fear to hopelessness about twice per day. They ought to take that bull$hit about processing applications in the order that they receive them off their website because its a blatant lie. (Ask the remaining October filers about it if you don't believe me.)

At this point, 3 months without so much as a touch, I just hope they haven't lost my freaking petition. I'm sure if I sent them another $170 just to consider approving us, they'd take it.

At the same time, I can say that the US government is not so great as to deter us from our ultimate goal. If they think we need to wait 2 more months, then we'll wait two more months. We've been through worse - we can do two months apart in our sleep. We've been in a long distance relationship for 3 years now, so a few more months is a drop in the bucket.

I want to marry him as much today (if not more) than I did the moment we met. Whatever it takes to do that and live with him here, together, I will do.

I'm mostly about just to check PMs and a few threads. I'd love to hear from any of you. Your support does mean a lot - as does any mojo you want to send our way. :)

The 864 is generally used for the AOS phase - but requirements vary from consulate to consulate. I'm sure the instructions your fiance receives will tell you which form they use - and the cosponsor would use the same form.

I sent in I129F petition with all paperwork to CSC on this last Friday, it was delivered on Saturday morning (USPS website confirms that).

Now how do I check status of what is happening at CSC (prior to getting NOA1 and the case number notification).? getting impatient already.

Wait till your check gets cashed and then look up your case number on the back, sign up for the USCIS website and start keeping track of it.......you'll probably be checking few hundred times a day :P

good luck :)

ok:) looking at your timeline - how did you know that you NOA1 was on 03/9 when the check was cashed on 03/14 and snail-mail notification was on 03/15?

You'll receive the NOA1 in the mail with the date.

K-1 Fiance(e) Visa Process & ProceduresPassport vs birth certificate?

I've seen here on VJ, that people have used either passport or birth certificate and it was OK. (I used my passport, but I'm at CSC...waiting for approval, no signs of life yet. ) :crying:
What I have seen that some people received RFE's for was if they used the "short form" of the birth certificate....they were given a request for further evidence to submit the "long form" of the BC. So if you plan on using that to prove your citizenship, take the better-safe-than-sorry approach and mail a copy of the longer version of the BC with your I-129F petition.

Good luck on your journey.

I didn't realize USC's had 'short form' or 'long form' birth certificates. Mine was directly from the state in which I was born - I had no choice in what information was on it.

The instructions on the I 129f say you can use either, but you must copy ALL pages of the passport. I'm sure people here have done both.

I used my birth certificate - less things to photocopy (1 page as opposed to 25 or whatever).

Your congressman/senator can't do anything for you at this stage (as you're not even in the system yet!). Nice of these people to want to help you, but they really have no idea what they're talking about.

You can involve your congressman/senator when and if your case is not approved within an acceptable length of time. That'd be at least 4 months or so after you mailed in your petition - and at that, some of them won't get involved until after your petition has not been approved outside of USCIS' published timelines (6 months).

Edited to add: JINX to ELW. :D and I'm glad he answered your other 2 questions too. :)

As the I 129 f instructions mention - yes, you will need a copy of it, and it needs to be a 'certified' copy (with either the court or state's stamp or seal).

You should be able to order one from the state, or from the county court clerk in the county in which your divorce was filed. The state record may be easier to obtain.

Yes, its true.

http://www.visajourn...h...&page=times

Those are only averages of NOA2s for VJ members, and not ALL filers going through CSC. For example, my NOA2 took exactly 4 months (128 days).

NOA1 takes about a week to receive (maybe a little more, depending on the speed of snail mail).

Yes, I meant to say that too - I'm VERY interested. I'm sorry you've had to go through it, obviously, but at least now, we all know this CAN happen - and potentially what to do to resolve it (and how USCIS/NVC will handle it when it has happened).

K-1 Fiance(e) Visa Process & ProceduresI hate VSC/NVC
My goodness! I'm so sorry to hear this has happened! I thought they were required to be so careful with these files, as they contain sensitive, personal information; but I suppose looking at the vast numbers of cases they deal with, this is possible.

Its curious to me that the three of you this has happened to (although Turboguy knows where his is at) are from VSC.

I wonder if someone could lose their job for having 'lost' your case! According to Huskerkiev (not soonerkiev!), they take it very seriously when these are misplaced.

I'm sorry - I hope you get through very quickly once they have reissued the NOA2. Thank goodness for the electronic trail!

The organization doesn't matter all that much. USCIS will arrange it the way they want it in their folders. Search for Huskerkiev's posts - he's a former NSC adjudicator and he explains things pretty well.

I used the Acco fasteners, too. Order wise, I followed the guide exactly. I used photo sleeves to put our photos in (clear holders with slots for 4 photos on them - you can get them at an office supply store) and ziploc bags for the passport photos. We didn't get an RFE so I'm guessing what I did was just fine. :)

K-1 Fiance(e) Visa Process & ProceduresIf in different countries?

Wow, that sounds incredibly cheap. There are a lot of acronyms and phrases that are foreign to me in the guide, but I'll have to look it up! I kind of figured the visa bringing him here would cost us over 1000 dollars. No, he lives in AUS right now and our daughter and myself live here in the USA. We are not married, actually divorced but wanting to work things out and live here. I figure because of the divorce we are going to have problems.....

Ah I see now. The process really is whether or not your fiance eligible for the visa, and are you eligible to sponsor him (as a USC, non criminal, free to marry, etc).

I've not yet seen the USCIS make a decision based on morals - at least not in the context of who you were married to before and why. The only way that fact effects you is for you to document that you are, indeed, divorced and therefore eligible for a fiance visa.
TracyTNFemaleUnited Kingdom2007-03-29 14:31:00
K-1 Fiance(e) Visa Process & ProceduresIf in different countries?
I'm a bit confused by how you framed the question - but the USC (dunno if that is you or him) has to send in the petition on behalf of the non USC. There are a few pieces to include in the petition that he must fill out - they need to have his original signature, so he can download them, fill them out, sign them and then Fed Ex/DHL them to you. Read the K1 guide for specifics.

The cost is listed on the instructions of the I 129f form itself - as well as the guide. Its currently $170.

Most everything you need to know is out there!

Um, Dublin, IRELAND?

There's a US immigration desk there so you can clear US immigration before landing on US soil (where you would still have to go through customs).
TracyTNFemaleUnited Kingdom2007-03-30 12:30:00
K-1 Fiance(e) Visa Process & ProceduresVWP Enrty Denial
This is why the use of the VWP needs to be done judiciously in the time leading up to sending in a petition. A few months at least between entries is a good idea.

As was said, just make sure to list the denial when asked on forms (I'm sure you would anyway). Delay wise? Who knows?

Off topic: your NOA2 was 2 days after ours - wonder if we'll have interviews around the same time? ;)
