If I understand correctly, for CR-1/IR-1 the interview is scheduled by Montreal, not the interviewee.  We plan to be overseas for 2 months (next Dec / Jan).  The info from the Montreal consulate on the VJ website says "Approx. 1-2 months from the time file is completed at NVC".

 

Approx Waiting Time for interview date from when the Consulate receives the package from the NVC: Approx. *2-6 months from the time P3 checklist is sent back. Approx. 1-2 months from the time file is completed at NVC for CR1/IR1. These are not highball numbers, they are approximately accurate. Expect a long wait for your interview. See the thread in the Canada forum for people waiting on Montreal.

 

Any suggestions on how to strategize so that an interview isn't scheduled when we're away?  Is there a small step involved sometime before then where you can drag your feet for a few weeks if necessary?  We're starting the I-130 process in the comings months and just trying to figure out when makes the most sense -- other people's NOA2 and NVC times are all over the place!

 

Well just to get my NOA 2 I had to wait ten months and I don't have a case number yet with NVC so if you haven't submitted yet, I doubt you'll need to do anything to slow down the process as it's already so slow

The other question I have is when I'm contacted by the embassy do I submit my passport then? It's just I visit my fiance often and I plan to visit one more time prolly some time around September before the wedding in December, because my fiance would be moving. Do I not get to keep my passport while everything is being processed?

 

Also, What happens if my fiance and I get married in Canada and then he sponsors me from the States (R1?) Is that a better, safer way than K1?

Hey I live in Ottawa too. You can get your police report same day if you go in. I went to the one on Bank Street (not the downtown location) and they last a year so long as you commit no crimes. Wait for your medical exam until closer to your interview date.

 

I don't know about k1 stuff but my husband and I are doing cr-1. We married at the courthouse in Ottawa in the fall of 2012 then had a large symbolic ceremony in the summer. It's not a really a matter of a safer choice, the biggest differences are cost, waiting, and ability to work. R-1's are taking a lot longer than k-1's at the moment but they cost less and you can work almost immediately. You'll have to go to MTL for the interview and exam.

Back in January, we received an RFE. Then two weeks later, when the missing document arrived to us, we received another letter stating our case was approved. The RFE case number and the approved case number were one number off. We called USCIS and they said the approved one was our case and to disregard the other one. So, Since February 7, I've been calling NVC for the case number every week. Every time, they tell me, "oh we don't have a number yet for it" ok. So I call today and the person tells me it's the wrong case number. So now we're calling USCIS to see what happened and where the screw up was. Note: we received an email of approval and USCIS confirmed the approval but we never received the hard copy NOA 2. I don't know what to do or how we have two case numbers with two different results and how NVC only told me now it was wrong case number even though I've been calling twice a week since February 7 to check on the case. We've already passed the one year mark of dealing with this BS process and now this is happening.

When he asked about it, the IO said there was nothing pending on our case so I'm wondering if they somehow have two separate receipt numbers for us. Who knows.

we received an rfe about two weeks ago, we hadn't sent out he requested info and today my husband received notice that we were approved. Called USCIS and they said the same and that our case is on its way to NVC. So I'm not sure what happened and what to believe.

Seeing all these approvals is bittersweet. While I'm happy for everyone, it's really hard to watch people being approved who submitted their petition long after you did. I know that's it's based on when the case was transferred at this point but it's still so frustrating.

My mother in law mailed the notice of transfer to me and upon opening it, I discovered that I've been stalking the wrong case number for 8 monthsheadbonk.gif . Oh well, no change on either haha!

I just checked my case status this morning and it says my case has been transferred to my "local office". I know that probably isn't the case based on what I've been reading here, people have been saying that they aren't going to local offices so hopefully I find out soon where it is exactly. I know it probably doesn't mean much but it's nice to see a change of some kind.

I am wondering if they are only transferring stand alone I-130's. If you have a pending K-3 or attached I-130's for children will they be left at the NBC to be processed there?  or is that a silly thought?    and do  you think they will start transferring right on in to the  April filers?

 

I'm a stand alone and haven't been transferred. I submitted and received my I-103 the first week of march.

What I can't, for the life of me, understand the logic that someone who is a fiancée gets preferential treatment (time-wise) over someone who has already made a legal commitment by marriage to their husband or wife.  Not against fiancées, please understand....I just don't get the thinking.

 

It's such a cruel way to treat families. I know this whole process isn't personal, but good grief, this separation is so very hard. And also couples living together outside of the U.S., married or not, get processed faster. It just seems to me to be totally backwards.

 

I am starting to despair that this will ever happen.

I agree with you that it all seems very backwards. It's definitely disheartening at times.

hi guys have someone that lives abroad not in us had heard something about uscis I live in panama my hubby in USA is been a long annoying wait Im dying to see him and all we see is processing times going up we got our noa1 as soon as we sent the paper other than that it says our case is on initial review and it has been almost 6 months the same sad.png how long you guys think we should wait to call uscis and ask them! I appreciate any comment or advice you could give !

I've been following this group since I applied on March 4th and what I've seen is that calling USCIS doesn't help at all. People keep being told different time frames and reasonings. wacko.png

It's possible that it was just sent to a local office vs being at the NBC so someone may have looked at it.  We call it a "touch"

I've been waiting for 4 months so far. According to my timeline, I'm supposed to hear back starting July 23 until October 1. After October, it's past the time frame.

Okay so I was just looking at my case status on USCIS and it says it was last touched in April but then I noticed the form was titled "IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN". My husband, who is the one who filed, is a USC. Is this an error or is everyone's titled like this?

 We filed at the beginning of March. Our timeline states we should hear something between July 22 and September. Have you filled out your timeline? It may give you a better idea as to when you may be hearing from them.

 

Also, when logging in to USCIS, the last time our petition was "touched" was in April.

ISO / Tier 2 = Immigration Services Officer

 

CSR / Tier 1 = Customer Service Representative

 

Since Aug 15, 2012 all stand alone I-130s have been sent to the National Benefits Center in Lee's Summit, Missouri.  This center used to be called the Missouri Service Center and still uses the MSC acronym.  (California is WAC and Vermont is EAC)

 

Because there are so many I-130s the NBC then sends them out, generally speaking, to the local offices of the petitioner.   They do not normally notify anyone of the transfer to the local office and the only way to find out is to call the NCSC (the USCIS call center.)  This is widely known on this site as the "misinformation line" because they constantly give out bad or inaccurate information.  Often the older members call 5-10 times and take the average response and call that the most accurate.  

 

Because the I-130 is a petition, only the USC can call and get any information.   However, once you reach the NVC, that is when the beneficiary can shine if they choose, especially someone from Canada!  biggrin.png  I would spend a great deal of time researching and making sure you have everything you need for the NVC.  Read this wiki and bookmark it for future reference as well.  http://www.visajourn...ew_Online_Forms  And also pop down into the Canada forum (or if you're from another country, to your regional forum biggrin.png) to say hi, and get questions which are specific to your country answered.

Just remember ONLY the petitioner can call.  Only talk to an ISO because a CSR will simply tell you what you see on the website.  Also it's called the misinformation line for a reason.  

 

Expect the petition to takes 6 months they won't even put in a service request until 5-6 months

 

MSC is the National Benefits Center in Missouri (although it looks like they have opened an office in Kansas too) but it's very likely that your petition has been sent to the local office of the US petitioner.  They vary greatly in processing times (Atlanta for instance is VERY slow  while the ones in California seem to be quick.) 

 

It's very difficult to not hear anything.  I know!  sad.png  I remember. 

I'm not really great on all the acronyms, I feel lost a lot of the time on here with all the different forms that everyone seems to be very familiar with. So I apologize if my question may seem silly but what is an ISO and a CSR? I thought our petition would go to the Vermont service centre as he is petitioning from New Hampshire. I heard VSC is absurdly slow.

Yes call and ask for tier2. At least find out where your file is located or what is going on with it. Nothing wrong with keeping track of it. Can you see the status online? Is your receipt number starts with MSC? If so your file is in Missouri service center.

When I enter the receipt number on USCIS it says "initial review" and I'm almost positive it starts with MSC. I can't check ATM because I'm at work. I'll definitely call then just to see. The predicted timeline here on visajourney says I should expect adjudication between July 22 and September but it's just difficult not hearing anything

If you call again and ask the tier2, you will probably get different answer. 10 days ago I called they told me the same. I called 3 days ago and they told me my file is waiting to be transferred. Not sure which tier2 to believe? If they looking at the computer screena dn answering the questions, the answers should be the same but it is not.
