I have a question, there are two dates on the form. a received date of Sep 04 and a notice date of Sep 6.  Which date is the one I should put in my timeline?

Still nothing in the mail.  I did find another Filipina here on VJ that will be moving to my state. She should be here around Thanksgiving.  My Fiance is happy there will be another Filipina here who is going through the adjustment phase at the same time she is.  They have exchanged e-mails and now hopefully will become friends through the process.  Life is good

On September 4, 2013, we received this I129F PETITION FOR FIANCE(E), and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or contact our customer service center at 1-800-375-5283.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

Obviously that is not the case seeing as the reason my package was returned was because the form was out of date. So either they have not updated that or the G325-A is excluded.

The latest revision of the G-325A is dated 8/8/11.

The latest revision of the I-130 is dated 12/18/12.

Are those the two versions you sent?


Yes and it was returned because the G325-A expired. They accept revisions prior to 8/8/11 but not this one.

Initially we were going the route of the K-1 but ultimately decided the CR-1 would be more conducive to our situation. Here is the dilemma: our package was returned for out of date forms. The G325-a expired at the end of 2012. I've gone to the USCIS website directly to download the form and all they have is the expired form. Has anyone else encountered this problem? If so, how long do they take to update their forms? Everything else in our package is ready and done properly, this is the only thing holding us up.

oh well follow this guide as you're Canadian!!  Most people in the world can follow the EZ guide and Canadians do as well, up to a point.  Then there is somethings that are special to certain parts of the world like online forms and electronic processing (details can be found at the NVC website.)  However this is the guide that will help you through the NVC, I found it, and Saylin, who is always able to answer PMs, to be indispensable.

NO. An overstay of the Canada visitor privilege would be to stay more than six months.  If you say you're going for a week and stay six weeks, that's not an overstay.

Just to clarify, because you will be going to Montreal (unless you live outside Canada), you will not be using the DS-230 you will be using the DS-260 which is the online form.  

 

The DS-260 only asks for the last five visits to the USA. smile.png

Put none as the answer to your first question.  Deal with previous visits by doing your best on to enter the information about your last two visits on lines one and two, then on line three, simply write.  "Many visits since (enter the year you think you first visited the US) with no overstays."  Really, yes.  Works every time it's tried.

Just to clarify, you mean overstays as in I did not exceed the time limit I told the border? Just want to make sure! And thank you!

I'm sure these will probably;y be silly once I get the answers but I'm confused about two questions and I don't want to mess it up.

 

Question 31a asks "person(s) named in 14 and 29 that will accompany you to the United States now"

 

I don't have anyone to place under 29 but I put my husband as 14 but he's already in the United States. Would I put his name even though he lives there currently or would I put N/A?

 

Question 35 asks to list all previous visits to or residence in the united states. I visit almost monthly by land travel. Am I honestly supposed to try to remember the exact days of each month I've gone down over the past 4 years? They don't stamp your passport when you cross by land and I've only gone to the US twice by air, once four years ago and the second time two years ago. I'm not sure what to put down.

 

Any advice would be great. I just want to get this paperwork prepared now so I'm not pulling my hair out when the NOA 2 comes

As an FYI, I put my husband's US address on the DS-261 to ensure that any mail we "may" get went to a US address.  The NVC will take your emails and email you correspondence however. 

The only problem for me with that is he is on tour 7-9 months out of the year so if we receive anything important, I won't know about it to be able to do anything. That's why I was planning on putting mine down.

I'm only asking because my husband goes on tour (he's a musician) frequently, approximately 7-9 months out of the year, and if something gets mailed there and he isn't home, it's kind of just sitting there.

it's advisable to have an appointment set up first before doing the medical. but that your choice. you do your medical as soon as your I-129F approved. but keep in mind medical do expired if i'm not mistaken within 6months.

about the question they ask while taking the medical..usually it's almost the same question with your interview...make sure you have some info about your fiance. other that they ask about your health history..if you have any health related problem/s before.

Well he better get away from them before his medical. At least 30 days is the length of time it takes for pot to leave your system. If he inhales it priary or secondary, it will be in his system

Ok...Papa had his medical exam on yesterday...He was asked if he had ever smoked cannibus... He told them that he has smoked in the past and that he had recently stopped (months). He is sure that he will pass the drug test as he hasnt been smoking. However, I am concerned with the question... do you think that this will hinder him from getting his visa? Please someone...this is driving me crazy...to come so far just to lose out. Please help me!!!! :crying:

Hi everyone,

I read the pinned topic about this, and quite a few others, but since I didn't see any example similar to my situation, I figured I would ask here...
Here it goes:

I'm from France, my fiancée is from the US. We just filed a I-129f together, so I'm expecting about 6 months before it's approved and transferred to the Paris Consulate, and then another couple months before I get an interview and finally the visa. So, I would like to go visit her in a few weeks, on a Visa Waiver, for almost 90 days.

The tricky part is that I have been going to the US regularly for long trips on Visa Waivers for the last 4 years. I have never been denied, but I have been sent to secondary/interview room twice (in 2009 and last January). On these two occasions, officers were skeptical about my situation (freelancer/works-from-home, no real ties to home country), but I managed to convince them that I would not overstay or seek work during my trip. They understood but said they were giving me a "warning", and advised to not come back for at least 6 months. I know that warning is on my record because the agent in January mentioned the first one.
He advised to not come back for another long trip this year, but that a shorter trip might be ok. But I know every officer thinks differently and some are more understanding than others.
What I don't know is what exactly is written on my record, and if that would be enough for them to deny me, no matter what I tell and show them.

I have a copy of the K1 petition and all the attached documents (letters of intent, pictures of my fiancée and I, tickets of our travels, emails exchanged...), and I hope than showing them that we doing everything legally and I don't intent on overstaying will convince them, but I must say I am still nervous.

Would anybody have similar experience or advice? Thanks a lot!

I've been in a similar situation. My fiance comes to visit me regularly in canada but as he is a musician, he doesn't have very many ties and was denied once at the border until we could supply proof that he wasn't trying to move here.

All I can suggest is bringing as many documents as you can proving your ties to france. i.e. bank statements, phone bills, anything work related if possible.

Bringing the k1 info won't hurt either.
