K-3 Spouse Visa Process & ProceduresQuestion about interview!!!
You shouldnt have any problems with that. Many couples are not religious and do not get married in a church but as long as you are legaly married it should cause you no problem.

it takes some time with any passport even the US pasport. I paid extra for mine to have it fixed express because I was going out of the country and it took a little bit over than a month to recieve it. My mom paid regular amount for hers and recieved it in a month and a half. So you can either try and change the name in the passport which will delay your process until you recieve it or you could just write them a letter. It is reaLLY up to you.

Obviously I'd prefer to go the letter route if acceptable along w/ showing them our marriage certificate. Should I just have my spouse bring the letter to the interview or mail it w/ her packet of forms she sends back?

Both, Mail it with the packet and notarize it as well otherwise it wont make any difference, keep a copy for yourself and also for your spouse and make sure you have copies of ALL forms and documents your sending in the package.

I have been putting our married name for my spouse on the I-130 and I-129F. For the DS-156, it asks for my spouse's surname as it is in her passport which is her maiden name. Will the conflicting info. be a problem/confusing? Will it be ok if I just show them our marriage certificate.

Just write her name as it appears on the passport, make a copy of the passport, the marriage certificate (Where it shows the name change) and also write them a letter attached to the I-130 and I-129F explaining this conflict.

Hello,

For the past year and a half I have been living in Macedonia. I was also recently married here to a Macedonian citizen. I have citizenship here as well as in the US being that I was born in the US. I have an appointment this week in the US embassy in Skopje to file an immigrant visa petition (I-130). Back to the topic, I have legally changed my last name to my husbands name here in Macedonia but in my US documents (passport, drivers license, bank statements) I have nothing documented in my married name. How should I approach filling out the forms?... with my maiden name or my married name? I definetly do not want to be sent back for having forms improperly filled out.. Does anyone know what is the most accurate thing to do? Thanks for the help good.gif

Use the marriage lisence they gave you with the name change and birth certificate as well
(izvod od maticna kniga na rodenite) they should not give you any problems.

K-3 Spouse Visa Process & ProceduresPacket 3 questions
QUOTE (yeye @ Aug 25 2008, 02:11 AM) <{POST_SNAPBACK}>
I will be applying for K3 in New Delhi. I have few questions if somebody can help

1) New Delhi doesn't have packet 3 forms. Is it ok to download from Mumbai us consulate and print them?

2) What forms need to be submitted?
DS-230 Part 1
Any other forms DS-2001 or Application statement that comes with packet 3. Do they need to be submitted?

3) At what address can these forms be mailed?

4) After mailing, do you get the interview date for next month?

Thanks for your help.

Its best of if you call USCIS and check with them.

K-3 Spouse Visa Process & ProceduresConfused if I am eligible to file for an I-130/K3 and other issues
QUOTE (souvarine @ Aug 25 2008, 08:02 AM) <{POST_SNAPBACK}>
I'm an American and a Japanese citizen and my wife is a Chinese citizen. We met and married in Japan and lived there as a married couple for over two years. We recently moved to her hometown in China and now I am starting the lengthy and convoluted process of filing for an I-130 + K3 visa. However, I have run into a number of problems.

First of all, I was given the impression that there are different processes to file the I-130/K3 petition depending on whether you are petitioning from within or from outside the United States. I would like to confirm if this is true or if the process is the same despite the petitioner's location. My concerns regarding my legal area of residency stem from this uncertainty. According to the US Embassy in Beijing, I am unable to claim residency status in China as I do not have a student or work visa (or any visa on my US passport for that matter... I obtained a renewable 6 month family relation visa on my Japanese passport as I had applied for it while in Japan).

I am also unsure whether I can petition for these visas while outside of the US. According to the US Embassy, I am able to file them at the USCIS Offices in China as long as I possess a Work or Student visa, neither of which I have. I am guessing that only leaves me with sending the petition to the LockBox in Chicago and letting the USCIS take it from there.

Finally, my wife came across some information on a Chinese immigration-related forum stating that foreign marriage certificates require some type of official statement asserting the authenticity of the marriage certificate (and English translations for both documents). However, after reading various threads on this forum and other immigration help sites, it seems as if such a statement of authenticity can be replaced with items such as document showing joint-ownership of property or affidavits having personal knowledge of our relationship.

Has anyone ever had to present such a document in order to verify the validity of their marriage? I'd like to hear what kind of documents the members of this forum have used as evidence that bona fides your marriage.

It would be greatly helpful if anyone could share their experience with this extremely trying (gut-wrenchingly stressful) process. I know that this has turned into a monster of a first post and so I'd like to thank all of you who stuck with it to the very end. Thanks for your time everyone!

PS. Whatever happened to the introductory letter that is supposed to narrate you and your spouse's relationship? I talked to a lawyer while in Japan and was told that I would have to write one, but I can't seem to find it listed in any of the checklists on the forum. Any info on this is also appreciated!

If you got married in a foreign country and you (The citizen of the USA) have lifed there for over than 6 months do Direct Consular Filing (DCF) Its is the fastest way.

hi
i got NOA-1,S for both i 130 and i 129 petitions.

i do not have a priority date mentioned on them.( is it quite usual to not have priority date mentioned on both NOA1,S)

i have two questions.

1] can i file an expedite for the application for extreme hardship as my wife has to live along with our baby alone in u.sa as we are having tough time to find a baby sitter .

2] whats the process to file an expedite.
do we just call the uscis directly and make a request or
do we have to contact our senator or congress person.

i think it is a little too early for me to think about expedite because its been a month since we received our NO1s and we filed our 130 on july 25th 2008, i just want to be prepared ahead in case we need to file one.

please help me with replies.

thank you.
rahi

You call USCIS directlly at the 1-800 number listed on their website. Follow the instructions to get to a life representative and let them know you want to expedite your case. They review it for about a week and they return your call (only if the expedition has been approved) Just to let you know they are very strict about the reason of why you are requesting the expedition. Like I have mentioned before I am due to give birth any day and have no much support here in the states from anyone and they declined my request to expedite my case to bring my husband. Call them and try it. Best of luck!

Another thing I wanted to add to this is its better if you go ahead and apply for the I-130 ASAP because since your wife is pregnant you want to have her here soon, if she gives birth in a foreign country that you need to file the same petition for the kid as well... It will be duble the trouble and the cost.

Since 9/11 its gotten really bad it is very rare to get a visitor visa for the states if you are marred to a citizen. Like some of us already said you can go ahead and try we wish you best of luck but dont take your hopes too high up most likely dissapointment will be coming your way.

I have seen where it's happened tho. Only cost $131 to try.

Unfortunately, that is not true.
His wife could be granted a B-2, and she could fly all the way to the U.S., only to be denied entry at her arrival.
Very possible and it has happened to many people.
So, in that case, the cost would be $131 + ~$1500 (plane fare), to say nothing about the disappointment...

BenAndNida thats exacly what I think as well. It is very unlikely for the embassy to grant her a visa but either way you dont want to risk it. Especially now that she is expecting it will be much harder for her to make that trip and have to turn around and return. I am very sorry for the disapointment I know exacly how you feel I am going thru it as we speak but you have to be patient and strong. Everything in its time.

Not to change the subject here, but congrats with the new baby coming. My wife is currently 8 weeks pregnant with our first baby and it just drives the anxiety level up another notch with this whole visa process! Good luck with the new family and good luck in the rest of your visa journey good.gif

Jamster congrats to you as well. A child is a blessing from God. He gives them to us for a reason, lets hope that he will be as generous to have our families together very soon too.

Most likely she will get declined. I went thru exacly the same thing. I am expecting any day now and we tried the B-2 visa just so my husband can come and be presnt for the baby if nothing else. MAin reason he got declined is because he is married to me ( A US citizen) and expecting a baby tgether. They look at how strong his ties to the US are and go from there. In this case marriage and children are the strongest ties you could have. Only way you can bring her is the I-130. Sorry and best of luck.

So then as of the end of november what apps are they now processing? Cause if thats how they are putting it then they should be processing apps from May!!! And then if i filed in August when should my papers be processed according to them? AARRRGGGGG This is driving me crazy!! I havent seen my husband since April and we only got married in Feb!! We wont even be together to celebrate our first wedding aniversary at this rate!!
