My understanding is that removal of conditions is based on the fact that you initially got married in good faith and NOT to evade the laws of the United States.
Your burden of proof is to show them your marriage is legitimate if you are still married, or was legitimate if you are divorced. There is no grey area, you are either married or divorced. If it is your intention to get divorced, you need to get divorced first and then prove to them you were married in good faith. People who do not live together have been known to be approved before, as far as I know there is no requirement that you have to be living together.
Seek the advice of an attorney, but if you still love each other, are working on your marriage etc and have no plans to get divorced, then you have to follow the steps of filing a joint application.

The number on the NOA is a receipt number and you can't pull that up to get case status.
The number you can use will be the Application number on the Biometrics appointment notice. You should be receiving this soon and then you'll be able to check your case on line. (PS, they both start with WAC and this is what confuses some people)

The most important things they ask for are:

- Lease of joint tenancy or joint ownership of assets. (you’re not on a lease together, Chris owns both cars)
- Joint mortgage agreement and/or property deed (mortgage is in Chris’ name)
- Tax returns (this you do have)
- Birth certificates of any children born from the marriage (you have no children, right?)
- Joint policies of life, medical, and/or car insurance. (Car insurance is in Chris’ name… you don’t have joint life policies, you have not shown to be the beneficiary on any of Chris’ polices!, only he is on YOUR policies – that is not joint)

So of the 5 most important things they ask for, you have only provided 1.

If I was you, I would
1) give them a reason why you are not on the mortgage
2) give them a reason why Chris owns both cars
3) become the beneficiary on Chris’ life/insurance policies
4) and… have babies ?

You have really applied for a 10 year green card... the 1 year extension is issued because your green card will most likely expire before the 10 year card is issued.

You can apply for citizenship once you have been a perm res for 3 years if your application is marriage based and your marriage is still legit (happy, in love, doing taxes together, living together blah blah blah)

I guess I didn't know something like that existed back then.... the 800 number wasn't helpful at all, just told me to make an appointment or wait... .. the HR dept in NY tried to intervene and help but they couldn't either.... I did go to an InfoPass appointment on Jackson street and they were useless too sad.gif

Doesn't matter anymore though, I have another job that I'm happy with and all I can do is hope for the best and this application goes smoothly...

I was always in 2 minds about becoming a citizen, but after this process I've decided I'll become a citizen, go through that painful-paperwork process and then be done with immigration forever... rose.gif

I agree with Erica, the annoying part is knowing that they have control over your life. I too have a 3 year old son and if they find something wrong with my application there is always the risk of them saying "go back to SA and refile" this could take 2 years being away from my child. (that is not a cheap flight) of course this is worst case scenario...

My application is legitimate, so I'm not worried, but being at their mercy does not sit well with me.

Also... in 2002 my F1 was approved here in the US. When I went home for vacation I had to "reapply" to get the VISA in my passport and I was DENIED - I was in tears and finally the guy made me get all kinds of paperwork together in order to be approved (luckily friends in the US were able to FedEx some of the required docs to me). In my 2 week visit I spent 3 full days at the Embassy.

In 2005 when I was applying for my AOS, the EAD was supposed to take 3 months, mine too 9 months (!!!!!) and as a result I lost my job at a top tier investment bank, I ALSO lost my insurance coverage... and of course... I was 3 months pregnant at the time!!! (luckily I could get coverage from my husbands company) the bank offered me a job once I received the new card, but I knew I'd only be there a few months before having Joshua.

I know you're not asking about the entire process... but they have the ability to really affect lives, and "the process" has affected my life... so the waiting is annoying because I never know what will happen this time... especially now that people who applied before me are being approved... who knows what is coming my way....

That's why the waiting annoys me....

letters and bills in your name going to the place you lived at together is useful.

I can't really say what will help (only the USCIS can decide), I think you should just send as much in as possible to prove you were married legitimately.

Definitely submit your joint tax returns, Did you have a lease or mortgage together? Submit that...
Did you have joint (health, life, vehicle) insurance during your marriage? Was he a beneficiary of your insurance policies and you of his during your marriage? (submit this)
did he ever attempt or apply to adopt your child? (submit any applications if this was ever attempted)
In your situation it makes sense to provide every and any paperwork you have.
joint bank statements, utility bills coming to the same address, photo's, vacation itineraries, wedding pictures and notarized letters from friends.


What was the basis for your divorce? If it was abuse, adultery, felony on his part (basically his fault) submit evidence of that

That's what I would do if I was in your situation.

Send what you have. If your marriage is legit, you shouldn't be worried. Make an infopass appointment if you like and ask exactly what they're looking for.
Also.. buy a few of those plastic filing boxes... don't throw anything away. (they say you should keep documents for 7 years) I have every piece of paper since I've been married nicely filed in hanging file folders and manila folders. (including, leases, nicor bills, credit card statements, bank statements, car loans, insurance cards etc etc etc)

We have a son who is turning 3 in February, so I will be very surprised if we are RFE'ed (did I just jinx myself??? laughing.gif no0pb.gif )
But if we do receive an RFE, I will make an info pass appointment and bring in my 3 file boxes and tell them to find what the hell they're looking for.

good luck!! If your marriage is legit you will have or find the information they need yes.gif (that's what I believe!!)

Just remember you're going to go through this AGAIN (for Naturalization, or to renew the 10yr GC...) so take my advice, SAVE EVERY THING.

I think they're primarily looking for information showing you have lived together for the past 2 years, submit all evidence showing that you have resided together since being married.

Include paystubs, insurance cards, bills etc that are 2 years old showing you lived at the same address. I would include evidence of this for every quarter (or even every month!) for the past 2 years.

Second: Re-read your notice... by the section where it requests the information, does the paragraph say: "if you have not already done so..."
Now if the letter you received is a Request for Evidence... well, then you need to send in additional evidence along with the RFE notice.

As Cassie says, your whole application has been Forwarded to the California Service Center and there is no reason to resubmit the application or payment.

No, you do not need to apply for removal of conditions yet.
You'll be issued a Green Card when you arrive in the US and if that GC is conditional (2 years) you will apply to remove conditions 90 days before it expires... (so you're looking at about 2 years down the line...) your journey has really only began :wink:
