Is Skype an option for you? It provides a phone log and is free. Or if you can't get it on your computer (although most can) you can get a SkypeOut account and it makes all your calls as though they were local. I printed out my call log.

Also, OP if you are still reading this, here is something to consider: A DIFFERENT VISA. Let's say, best case scenario, you go visit your guy (who I think you said is 18) and it's amazing. Well, you might not even be the same person in a few years. Has either of you considered obtaining a degree in the other person's country? If you want to go do that, you will both have to have a chunk of change in the bank (in the US you need 18k per year plus tuition) but it is one option. Another choice: if he is a student he can get a 3-month visa to England to visit you for next summer. Or, you can do the American Work and Travel visa. Or you could both go to New Zealand.

These are just some ideas for how you might spend more time together. It's going to be a ridiculous idea to get married. You did not make it clear if your boyfriend is aware of your intentions to marry him. Listen to all these people here--please.

No. You can register.

Once you finish registering in the system its going to ask you to give them a receipt #...... Once we get our NOA1 then we will type in that reciept # there and that is how we'll be able to follow our cases online. For now I just left that part blank since I do not have one yet.....


I did that too. I have an account all set up...but no actual case. The things VJers will do to be as proactive as possible... :lol:

Just curious as to how many here on the forum have sent in the new I-129f (with IMBRA questions) and when???

I sent mine on 6/16/06 ( the day after the new forms were available) and it arrived at TSC on 6/19/06. I know it has to now go to CSC.

But so far nothing has happened. I just checked my bank account and my check has not been cashed.

I know its early, but maybe we can monitor how the service centers are going to handle the new IMBRA I-129f and what the time frames will be......

Near the end of my year in Brazil, my fiance and I went to Rio for his work for one weekend, and I brought all my evidence to get together for the K1 (since I didn't have any obligations that week). I spread it out on the floor and went to the grocery store. When I got back the maid had thrown it all away.

But I still managed to scrounge up a few things. I think that's all that matters. Don't worry til you get an RFE. If I'm not worried no reason for anyone else to be. :)

However you are short on evidence of a meeting. Passport stamps do not prove you were actually together, just you were in the country. Do you not have any photo's, or get a sworn affadavit letter from a recognised professional/official who can verify your living together...a priest, teacher, lawyer, city official, Dr etc.

How about phone bills, did you have a credit card you used in the town where you lived...send the receipts, emails, stamped envelopes addressed to both of you at that address, or mail to each other. Hmmm it's a hard one and I will kepp racking my brain for you.

Maybe others will come up with other ideas on evidence too.


Well, I included pictures of us in 5 different Brazilian cities and my plane ticket stub to one of those cities as well as my plane ticket stub from Rio to Sao Paulo, which went with the Question 18 narrative of our meetings. I have 5 pictures on there, but I read that more than that was excessive and they don't like that. I don't think any "official" person could verify that because we had no contact with people like that. I never used my credit card because I didn't want the number stolen (happened to my dad while he was visiting). Other than that I can only prove we were in the country. I printed out e-mails of us talking about when we were planning to get together. For good measure I included our phone bills, which was really more proof of ongoing relationship...
Really this was the best I could do. This cleaning lady just threw out everything else. :(

But seriously, how the HE!! are you supposed to prove you were together, other than matching plane tickets ,etc.
We just don't have that stuff anymore.

I was trying not to worry but now I don't know what....

I've got SO LITTLE evidence in my packet (because as I mentioned in another topic, a hotel maid threw out my whole K1 right before I left Brazil) that I included a receipt from our shared video store account. The video store was called 'Local Video' though so I didn't really translate the receipt, just drew arrows to our names and to the name of the video store with explanation. We lived together, but EVERYTHING was in his name (bills, lease, etc.) so there is no proof I was ever there. I also included an e-mailed receipt from a hotel reservation for 2 that my fiance had forwarded to me for a vacation that I mentioned in Question 18. But that was half in English/half in Portuguese.

Is there going to be a problem? Or will they just say "hey, that stuff is not essential since we already have these passport stamps, 2 random ticket stubs, pictures"? Are they going to send me an RFE for my effing video store receipt?

The question is very simple, answer it as asked. Where do you anticipate living when you come to the USA after receiving your K1 visa? If you know now where you will live, enter that address. If you do not know where you will live write that down, 'to be determined' should convey the idea.

Your fiancee's aunt will be sponsoring you, not her (although someone must be clothing and feeding her if she's not working).

You need to have your intended address be the same as hers. Anything else will raise eyebrows at USCIS.

But as far as I know, she can't be your sponsor til she's 18. Are you sure about this whole idea?

My fiance was living in Maryland when we sent the application to Vermont last August. By September he had been transferred to Florida (Federal government). All he did was contact the VSC and give them the change of address. Even though this officially changed the jurisdiction from Vermont to Texas, it wasn't a problem and there was no delay. However, that was prior to IMBRA so I'm not sure if they've changed the process now. I'm sure you'll be fine, though, as long as you inform them of the move.

When I move to New York I'm guessing my case will not be done. I called USCIS today to ask whether my petition would come with me when I changed addresses, but his southern accent was SO thick (seriously where are these USCIS people?) that I could barely understand him and also he seemed exasperated with me demanding more of an answer than "it will be taken care of."

anybody done this? Found that it pushed them to the end of the line? Just curious...

Rey was trying to get a J1 visa until it was denied recently (hence the K1, although we planned to get married in the future)... I looked into this, but this is just my impression (I'm not an expert). if the 2-year rule applies, she cannot enter on the K1. Also in one of your packets she should have checked a box on a form that said she was not subject to the two year rule. This in effect was actually wrong?

She must have stayed in her home country for 2 whole years (excluding time spent out of that country--this does not just mean time spent out of the US) before she is eligible to even apply for a visa.

Luckily, there is a 2-year-requirement waiver. Marriage is usually not an acceptable reason for a waiver, and waivers are usually not available to people who received funding from the US gov't or their home gov't, or work in the healthcare field. But there is a waiver for people who don't fall into those categories based solely on the home country not caring if she returns or not. I don't have a good link.

The 10,000 I-129F petitions that were pulled seems to have been because of a mix-up on the government's part. Hopefully, they will have this backlog taken care of so that the processing times on the newly filed petitions go faster. It's very difficult to tell though how a prior backlog is going to effect future petitions. The good news is that USCIS is very committed to eliminating all backlogs.

Am sorry but I dont see where the emergency is vis a vis the K-1 visa, because your fiancee can get a visitors visa to come and see her future father in law and return back to her country to await the K-1 visa processing.

You seem to be working under the assumption that she can only enter the US ona K-1 visa, maybe you need to consider other visas for her to come and go back, just in case your expedite request is turned down.



Asante: he's in the Philippines, she doesn't have a visa already, that's not going to be an easy feat. Not to mention the wait times alone for the interview. Tourist visas are very hard to get, especially in certain places. This is probably not an option.

OP: I'm so sorry for your situation. I am confident that you will be able to expedite this process, and get all the help you can to get through the bureaucracy (re: your idea of contacting congressmen).

Well, I got my NOA1 June 29, sent it the same day as you, and they have still not cashed my check. I've been getting some touches though, so I'm not exactly sure what they're doing with my petition if they haven't even cashed the check!

Yet of course it's not like the people who process petitions actually have any incentive to cash checks quickly---not like they see any of it. :)

Since then we've received the IMBRA RFE and have been touched once... Looks like they're working on March cases now, so... be patient!!


Us too. It took I think 8 calendar days for them to issue NOA1, which we received from CSC.

We didn't need the IMBRA RFE but we've been touched, although I don't think that necessarily means anything..

I know how you feel. I'm starting to loose my patience and I don't know who to talk to about it. If I say anything about it here, I get bitched at for being a selfish ####### and not thinking about those who applied 460 months ago and I only applied nearly 2 months ago.

I'm sorry that some of you have been waiting since March. I didn't know this was going to take so long, I didn't know there were delays, I didn't know it would take longer than expected. My petition has been ready since March, but I decided to wait a little bit before applying because I didn't want to rush. I wanted to go spend Christmas with him and then fly together since he's never flown before. A friend of mine had been trhough the same process in 2005 and it took them less than a month to get their NOA2 from Vermont as well. So I did tons of research and decided that it would be best to wait until around June to apply, to make sure he had enough time to get everything ready to move here. So my completed I-129F just sat there for 3 months.

We have been doing the "reunited, seperated" dance since 1998. This Christmas, that dance will not take place, even if I have to be the one to pack everything and go.

I hear that rant. Here's my similar one. I was ready to apply for the K-1 in January. I had it all filled out (although now I know it wasn't a perfect application because I hadn't found VJ then) and I overnighted it to my mother (since the K1 has to come from within the US and I was living in Brazil). Ultimately we decided to wait til I was in the US on the advice of my grandma, a former immigration official, who I now know has no idea what she is talking about.

THEN we decided it might be good for him to get a student/intern visa for a year, so I went home in April, and his visa was denied in May (and doubley denied in June) because of a forms mix-up at the consulate. Grr. THEN we had to wait for the new I-129F. THEN we filed. Seven months after we intended to originally. If I'd only found VJ before he'd be here right now. :(
So I will spend New Years with him, and I will stay until his visa is issued. Goddammit.

Im pretty sure the difference in the four and six month periods you mentioned is that an approved I129F is valid for FOUR months to try to get the K1 visa....if a visa is issued, then the visa is valid for SIX months for one entry into the United States.

Ah yes he is right. he means the 4 months your initial approval is valid for (although that can be extended at the consulate if necessary). Definitely 6 months.

Parents' house is a fine domicile to list (I did...although I haven't been approved yet).

You will have 6 months after the interview. If you want to leave in May...you should start now anyway.

I am not going to answer your main question because someone else who knows more will have to do that. But I can say that my guess is that the most important thing is that you have a U.S. domicile. Then it is considered ok.

Have you considered marrying in Chile, and applying that way? I believe it COULD actually work better for you.
