I've noticed alot of people lately getting RFE's actually requesting items that should have been sent in to begin with. I never heard of a birth certificate being 'optional' - where did you get the idea it was optional?

At any rate, again, sending too much information seems to be alot better than sending to little. You should send back everything they ask for, and more! "Bury them" as Tom recetly said.

I wish I had known to do this in advance, as I fear I'm going to be in the non-IMBRA RFE club too soon.

This is a bit silly, but you know how on the I-129F there is a blank for middle name? Reynaldo doesn't have one. So, do I put "N/A" or "none"? I generally find this to be confusing

Also, while I'm talking about these initial forms... I have a gap in addresses because I traveled for six months after my lease ended. I had my mail forwarded to my parents' house. Then I lived with Reynaldo in Brazil. So can I leave a small gap in address there? Or should I write "homeless" or "no address"?? :)

Yeah, I'm new to this board and am finding it very helpful, but I find the most disturbing thing here to be this vague anti-immigrant undercurrent in some of the posts. Just because we are all applying to have immigration benefits because of a relationship does not mean there are not a million other reasons to want to come to the U.S., many of them not legal.

I feel like if the US is going to promote selfish economic policies (i.e. NAFTA) then maybe we should accept that there are consequences. Like millions of illegal immigrants, whether you like it or not.

PS, those people are not receiving immigration benefits INSTEAD of us (ahem, much like how they are not getting jobs INSTEAD of us); in fact, the US gov't continues to SPLIT UP families where one parent is an illegal immigrant, deporting people with children who have lived here for 20 years.

but on the initial application, on the G325As or the I129F, it doesn't ask anywhere about a visa. Is it better to leave it out, so as to prevent confusing the USCIS folk, or is it better to get it all out in the open right away?

Hi all...So here's the deal. I'm just waiting for my fiance's G325A's and letter of intent to show up in the mail (am on the verge of forging his signature) before I file. But I got to wondering whether or not I should discuss his recently denied J1 visa somewhere in the application, like, for example, in Question 18.

Rey, who actually works as a senior web developer but is in his early 20s, was going to be an intern at a company in Kansas City. We thought it would be good for him to have a chance to live in the US for a year before committing to immigrating here. But on May 4 (2 weeks or so after I came back to the US) his visa was denied because the company who was facilitating his visa gave him some papers that said he was a Romanian tourism student (what?) and also told him it wasn't necessary to bring any proof of his ties to Brazil (which we know now is a huge mistake).

Before we embarked on this internship-finding mission, we had thought about a K1. Now that the J1 fell through, we decided to do the K1 for sure.

Who is going to be the first person to see that he just had a visa denied? Will it be the consular officer? Should I mention anything about this in my K1? Or what? I want to make sure this is as little of a problem as possible. We realize it could look like he's trying to get to the US at any cost now and is entering into a sham marriage.

If you are talking about the G325A, that form is not expired. That form has been the same for just over a year.

yeaahhh I noticed that. What's going on? I just filed mine June 19 to Nebraska (as in, they must have gotten it today by noon). I wonder if that means...anything. Especially since I heard they were no longer doing I-129Fs at all over there. Could be really good news for those of us who just filed there, but um.... I am not going to hold my breath for good news or a fast processing time.

Kind of a cruel joke on NSC's part though, after dumping everyone off on CSC. Jerks.

Oh one other thing. I've HEARD (from some book written by a lawyer) that the I-134 (for your interview) is not actually that binding. In fact it's supposedly been known to be worthless. The I-864 for AOS IS, however, serious. The one for your interview holds you only to sponsoring the immigrant before the K1 runs out (someone stop me if I'm wrong). The I-134 seems to require minimal preparation as well. If possible, I'm just asking my dad for the I-134 for the interview and then when it comes time to adjust status, I'll see if I still need him.

My dad has done a lot for me too, and I really know how you feel! I seriously hope you don't have to ask him for anything (oh the humiliation...just when I thought I was finally independent).

I'm in a similar situation. My dad is going to be my joint sponsor because I just started working full time too, and I don't want to deal with any maybes. Even though I now meet the requirement, I want to make sure that this visa is approved. So, I sucked it up, and asked my dad. If your parents or someone else could joint sponsor, this would be an option.

Just the route I took...

Hehe, I am from Minnesota and we go camping and canoeing in the Boundary Waters Canoe Area, a chain of lakes and portages on the border of Canada, all the time. Sometimes the rangers patrol and make sure we are not Canadian. They come in canoes, with two men per boat, paddling very quickly in their little ranger canoeing outfits. The Canadian rangers also patrol the Quetico, which is the Canadian side of the BWCA.

However, they don't do this all the time, and usually just check to make sure you're not building a fire in an undesignated area....perhaps more people should just start canoeing in. :)

So, whenever anyone hopefully posts something about the new Nebraska processing time listed (which admittedly must be some kind of joke), 40 angry people (waiting for their RFEs or just sent them in, of course) reply with "sorry, your case is going to be forwarded to California."

But does anyone REALLY know this for a fact?
a) this is not the first time (or even the first time this year) NSC has fwded petitions to CSC
B) the new K1 form instructs petitioners to send their petitions to all four service centers (although clearly the fact that TSC is on the form still shows that that this is not the strongest argument)
c) they actually posted a processing time, where Texas doesn't

I realize that if they WERE processing K1s now, it would be completely unfair (like all things in life) to all those recently sent off to CSC. And we have all heard that only Vermont and Calif. will be doing K1s either now or in the near future. But does anyone actually, factually, know that NSC is CURRENTLY not doing them?

I want to go through the K-1 visa process as i believe it will be quicker than obtaining a work visa? I need to get to NYC in the quickest time possible and i dont know which route to take.

As far as I've heard, work visas are MUCH faster to process. If you go to "processing times" and check the Nebraska Service Center (I believe they are now the only people doing I-129 forms, the forms for work visas) and find the kind of visa you'd be getting, you'll see that most of them are May 29, or at earliest March, for processing times. Vermont, at any rate, lists April 2 as their H1B date.
Companies have ways of expediting the process of work visas too. Why don't you find out more about the visa you'd be getting and ask the company when they'd expect you to be in NYC? Surely you are not the first person they've sponsored?
I have a feeling that if it's less than 3 months from now, it's going to be faster than the K1. Although of course, none of us can even begin to estimate the real timelines for those...

If the issue of getting to NYC as fast as possible is your girlfriend's expiring visa for the UK, I hear that. But if it's to take that job in NYC, bear in mind you may not be able to work when you arrive.

So you are the beneficiary and you have found a company to give you a work visa. Couldn't you theoretically come over on the work visa, cancel your K-1 petition, and while in the US on the work visa marry your fiance and adjust status? (Does your fiance live in NYC?)

It's fine to do that on an H1B, as far as I understand it (but don't take that as fact)

Working when you get here would be a relief; most people don't get to work for at least a few months after arriving.

Anyone else have an answer?

I think if alot of the people stop sending so many e-mails and calling for nonimportant reasons maybe they can get something done there .

After I read this, I was kind of amazed at the sit back and wait attitude of these statements. These attitudes are exactly how and why the USCIS has become the untransparent, inefficient behemoth it is today. To imply that people trying to communicate with their government is a negative thing which slows down governmental efficiency is nonsense and to say that this was unavoidable is also nonsense. I agree, there is a possibility there is not one agency to blame, but in my opinion it was clearly USCIS error which means I have a right to request an expedite as you do according to their policy. I'm sure a lot of the other members don't consider their correspondence with their representatives, senators and governmental agencies "junk" as you do. I hope the process goes quickly also, but I refuse to just sit and wait.

Each time people send letters ,call,send e-mails it takes manpower to do that and it just clutters up the system,i dont see how it can help unless you really have a valid complaint.



I doubt that the people who process the packages are sitting their with personal phones taking calls. I really doubt it's interrupting anything. I haven't called a service center, and I don't plan to for quite some time (see timeline) but seriously. It's 100% gov't's fault and they should be working OT to do this. They screwed up and if a few people call them on it, who knows, perhaps their approvals will be expedited. I see no problem with people standing up for themselves.

Also if you're both in Brazil you can't send it directly from there (at least that's what they told me). The petitioner has to send it from an address inside the U.S.

The rates, however are not as great as some other folks, it just depends on the country you are calling. I think its worth the extra 2 or 3 cents to have reliable service and a phone log for proof of relationship.

Is Skype an option for you? It provides a phone log and is free. Or if you can't get it on your computer (although most can) you can get a SkypeOut account and it makes all your calls as though they were local. I printed out my call log.
