They're doing something though, because they at least received our RFE on Oct 4.

No, it's not needed. We don't know exactly why I got an RFE for it, but it happens sometimes. Nobody here is saying you have to send it in right away.

I know you guys are just about to file, so what I would do is just file and if you get an RFE, you get one. But that's just what I would do.

Hehe, ah yes, I've got the RFE and after that a cover letter, then the birth certificate (front and back, with specified "front" and "back") my translator sworn statement, and my English translation.

When you send the RFE evidence back, send it USPS Express ($14 and change).

On the front and back of the USPS provided document Envelope, write the following: ATTN:RFE in red marker.

This is the information on the RFE envelope supplied by CSC.

You may want to write your case number on the envelope, as well.

It will then move through CSC very fast!

Wow this is so weird! I never thought they would ask for the foreign birth certificate. Good luck Alex, and sorry this happened, but luckily it's a pretty easy one I hope. Also, on the USCIS website under general tips on assembling packet they show you how to type up the translator's certification page and it's easy peasy.

My husband's translated birth certificate looks very similar to his original in terms of the layout. It's entirely in English. We submitted both together and it's easy to tell which lines match up.

The requirements only request a BC of the petitioner when it is being used to show US citizenship. It is not a requirement of the beneficiary. However, like with anything, an adjudicator can and will request anything deemed necessary in adjudicating the petition. Just as an adjudicator can send a request for an original of a document, when only a photocopy is submitted (being the requirement).

Yeah, but Joey guessed wrong. We did not send any birth certificate at all. Not in Porguese or translated. Their decision that they needed Rey's birth certificate was totally random. Probably because he's male and got a latino last name, IMO.

My mouth hurts and the little disolvable stitches are irritating, but I think I'll make it. I have enjoyed a lot of mashed potatoes and bananas today (separately, of course).

This is a strange RFE indeed! However, if it turns out that all they want in the beneficiary's BC then thank goodness that's all it is. Perhaps his name was flagged when they did preliminary name checks and they are just trying to rule him out as a possible maniac etc.

I like this explanation. One can never tell why they are asking for it. Did you try to contact USCIS for clarification of what they are asking for. There is a prompt that asks if you are not clear on the RFE to press # whatever. So maybe you should call them and find out what it is they are looking for. Everything or just what is checked.

Well, Alex is the expert on the K-1 process, but as far as I have read, the birth certificate is not needed on this first part of the process.

Technically, it's not required, but they always seem to ask for it.

Yes, you can translate it yourself. I did that with my RFE (I can't remember what it was now
but it was something in French from our trip to Canada which we submitted as evidence and
they wanted translated.)

Yep, that's how my RFE looked as well -- basically just a long list of things with a couple of boxes checked.



Mine just asks for the Birth Certificate, but I think we're going to send in the passport too because it's less than 20 years old, unlike the birth certificate Rey's got at home.
I already printed out and signed the paper, and Rey will be faxing or e-mailing PDFs of the birth certificate (front and back) and his passport tomorrow. Then I can just send 'er in. Yay! Argentina here I come... barring a case of dry socket....

Yep, if you sent it, you'll probably get a RFE to have it translated! DOn't sweat it, just be ready if and when an RFE comes your way.

I used VisaJourney's K-1 Guide and so far, it seems to have been accurate.

Ok, so my RFE came. It lists like 10 things, each with a box next to it. Only one item has the box checked, which is "Birth Certificate: Submit a birth certificate and English translation for the beneficiary."

I thought this was officially not required.
The other things listed (sans description) are:
Foreign Document
Verification of Status
Circumstances of Meeting
Last Meeting
Divorce/Death Decree (this does not apply to us even)
Photographs
Form G-325A (for beneficiary)
Birth Certificate
Other: Consulate you selected does not process fiance visas....

Is this how everyone's RFE looks? The Divorce/Death one and the Other one have unfilled in blanks.

You got the RFE because you (your Lawyer) submitted a Birth Certificate that's in Portuguese for your Fiancee. He was not supposed to do that! It did not need to be submitted in this phase of the process. The beneficiary needs it when she goes to the Consulate in Rio for the Interview. But because it is in your package, now they want it translated into English.

Action: Get the Birth Certificate translated and resubmit.


Nope, I don't have a lawyer, and I submitted no such thing. I think it's a new requirement that they're not listing on the list of requirements (chopf##ks). I hate when you follow the rules so well that they make up new ones to screw you up.

Yes, a copy of the original and a copy of the english translation is acceptable

I've noticed alot of people lately getting RFE's actually requesting items that should have been sent in to begin with. I never heard of a birth certificate being 'optional' - where did you get the idea it was optional?

At any rate, again, sending too much information seems to be alot better than sending to little. You should send back everything they ask for, and more! "Bury them" as Tom recetly said.

I wish I had known to do this in advance, as I fear I'm going to be in the non-IMBRA RFE club too soon.

PETITIONER BC (or passport) is required. Beneficiary is usually NOT required. I got that idea from all the people who told me that on VJ.

PS I remember I think Yodrak or someone posting a memo that USCIS was supposed to have sent to all the service centers explaining that this was an RFE not acceptable to collect. NO! I think i was even the beneficiary's G325A. So how can they RFE this?! Ridiculous.

You are now welcomed to the CSC shipping club. Now you get to sit back and relax and wait about 3-5 weeks till you get some good information from NVC with a case number, and other information.

when you hit the three week waiting period call the NVC and see if you are given good news with a NVC case number for your approved case.

You might be one of the lucky ones where the CSC ships your case out in a week to the NVC, but the norm has been between 3-5 weeks and a few people waiting six weeks.

I am about to join the five week waiting club.

That's just USCIS; they don't go in exact order. What's the question? It looks like your NOA1 was just 9 days before mine, and I just got approved yesterday. I don't think it's time to worry just yet, what with the whole IMBRA hold up still being taken care of. We all understand how hard it is to be apart with no end of it in sight, but this whole process is about waiting. Hang in there.

I just saw in your timeline that you have no RFE listed. Is that correct? Because if you sent in the I129F on June 5th, you would have used an old form and you should have received an IMBRA RFE. If you haven't, it is definitely time to call.
