I know when completing the I129F forms it specifically said that all children claiming K2 visas must be listed on the form. You could not add them afterwards. It must be different if the father is the USC and petitioner - I would follow Aussiewench's links - she knows everything!!! I would also suggest calling USCIS for confirmation.

Michelle.....their child would not be applying for a K-2 visa as once the birth is registered the child is a USC and as with all US citizens they dont need a visa to their own country. There is no immigration process for the child.


But there IS a birth registration that must be done!!

I think Sabrina's English must have been influenced by someone else talking like that. She uses "dun" for "don't" if I remember correctly. I've never even seen that. Is that true Sabrina?

Thanks everyone for your support, i found out last night from a friend that if you graduate from uni in the states your allowed a 6 month working visa in the UK which she can get whithin 2-3 weeks!! But only 6 months after you have graduated.

The thing is when we all started our VJ you have a very tough choice "who goes where" Now i think its best that both people are open minded in which place to settle.

As for greenwood, IN i have been there lots of times and i do like it, so its not a matter of not being able to live there for me.

Also whilst i am here that Pr!ck that keeps saying stupid 5 year old comments on this thread will you please give it a rest because its very boring now. GROW UP!

My fiance is having trouble getting a copy of her birth certificate and may take her up to 2 months to get. Do we need it to file I-129 or is it needed when the packet goes to the consolate in Manila? Thanks in advance!!


I think the I-129F requires a passport or BC, so you are going to need at least one of those. Since she will need a BC to get a passport anyway if she doesn't have one, you're kind of screwed until you get the BC.

I suggest getting everything else ready now. Then when she gets the BC you are ready to roll!


Gary: please read the above posts. The filing of the I-129F does not require the beneficiary's birth certificate. She still has plenty of time to secure the document.

touches mean something. its that you dont know what the resoult of a touch is til normally 2 -3 weeks later. it means they are updating or keying in information. its a sign of life if you will. it gives people " HOPE"
in this hellish process. admit it. you were happy when you got " TOUCHED" as all of us were when we first started.


I don't even think it's a sign of life. Remember that week in July when everbody was getting touched every day? We're such a small sample of applicants. If they actually looked at every case at that time, they would probably never be done.

I mean, if they are spending time scanning the bar code on our case every time they touch it, I want my tax dollars used better.

Touches are meaningless. They didn't touch me 10 days after my NOA1 and do anything productive. I mean, this isn't VSC we're talking about. :)

Mine was approved this week and I had a July NOA1 date. My theory is that they looked at the backlog at CSC and decided to transfer a batch of cases to Vermont. They had to chose a batch that hadn't been opened yet, so they chose July NOA1s to send and then the Vermont people just raced through them, as they are known to get things done fast!

This is COMPLETE HYPOTHETICAL IMAGINATION on my part, but it could explain things....

I am so happy we had this surprise, but I do think it should be fair and we should have had to wait our turn.


If VSC approves them, then it'll show a Vermont number, not a WAC number. I don't think your hypothesis is correct.

For all the conspiracy theorists, please read the detailed reports issued by the GAO and the USCIS Ombudsman. They clearly explain the issues with name/security checks. Some people will inevitably wait a long time due to name checks. The name checks are done by the FBI. USCIS has NO control over the speed of the name checks. If the FBI delays the name checks for whatever reasons, USCIS has to wait just like us. That also explains why some VSC members have waited since March and still haven't gotten approvals either.

I strongly believe all these delays are due to name checks. It's not like they're purposely leaving certain files behind. They're all being processed, but some petitions have no problems with name checks and thus are approved very quickly. Others have more of a problem with name checks and thus have to wait longer. It sucks, but I don't think the blame lies with USCIS on this. It lies with the FBI.

Just my 2 cents.


Yeah, but that's just ignoring the facts. Plus, my congressman's immi liason told me that name checks actually SPEED UP the process many times because they only have to run one instead of two something-or-others (obviously I'm a little vague on this.)

I'm especially upset because I have a June 29 NOA1 and I filed with the new form. :( So close yet so far.

I've noticed that there have been about 10 approvals yesterday (and I guess today) and they've all been for people with first or second week of July NOA1s, with the exception of one.

I'm not complaining that they didn't have to wait long (I've only been waiting since June myself) but it seems odd that they're all from the same weeks when that doesn't seem to be where CSC is in terms of processing times...

What gives?

Guys, I've got an issue here. I've got tickets to Buenos Aires for next Wednesday. The RFE's not going to come in time, is it...

If it's for more evidence of having met, wellp, I just don't have any. I could get affidavits from Rey's family, etc.
The only other things I can think of are work history (lots of part time in college on there) or the fact that I submitted a receipt that was in Portuguese.

I'm really devastated. I feel like I'm going to miss the RFE and have to start all over. I DID let myself get excited for an approval. :(

Today I just feel awful about this.

May filers and some in June filed with the old form, which means a longer processing due to RFEs

They did not skip these people, but people that used new form are probably submitted to a compolete different processing.

We still see a lot of people from March and April getting approved. They did not forget you. Your turn will come :) Keep the faith!

Even though they said they sent it on the 21st, I doubt they did. Steven said his IMBRA RFE was postmarked like 5 days after the e-mail claimed it would be... So I'll probably not even know what it's for before I go.

If you see any possible complications in your case, you should at least get a consultation with a lawyer, IMO.

But if you are uncomfortable with doing it yourself, use a lawyer.

USCIS made the rules of adding attachments, not me. It is there to help those who forget and need to add info later, have long answers or just need a larger space to write in.


But doing your form one way and then adding an attachment saying that your original answer was wrong is not the same as adding new information or having a long answer. I don't see anywhere in the instructions that says it's ok to attach a note if you 'screw up' although I would be glad to stand corrected if I saw it!

The G-325A is fillable via computer or with an ink pen. If there's an error or something does not fit into the space provided, you can make an attachment. If he does not want to download it again, he doesn't have to. That is his option.

Not if there's an error, if something does not fit. Where does it say: "if you royally screwed up your form, don't take the extra time to fit it---just add a confusing note to the back!" That would be....stupid. The reason the form does not address this is, I'm guessing, because USCiS does not want people to do a half-### job and just scribble "oops!" on another piece of paper. This is a bureaucracy.

You overconfidently told a guy worried about the IMBRA RFE that if he paid for it he should just write down the name of the company. You made it sound like you knew the answer when in fact your answer was incomplete and wrong. If you're going to spout wrong information, I think you should at least qualify it with an "I think, but I'm not sure" kind of statement.

People have been RFE'd for this before. Why on earth would you want to confuse USCIS from the get-go?? Please explain.

Listen, I know it's a pain, but I think most people here will advise you to do it correctly the first time. You download the form, you fill it out, you sign it, and you overnight it to your fiance in the U.S. No biggie! You're pretty lucky you're in Canada!

I know this might sound incredibly stupid but what does RFE stand for and what is it...I just started my application for my fiance so I have a long way to go learn all this vocabulary.

there is also a couple of other words, which i have an idea of what they stand for but just in case, here it goes:

NSC
NOA
"touched"
NVC
RFE (IMBRA)
NOA

thanks all...and sorry "incredibly stupid" question but best to ask for the long process ahead....


RFE=request for evidence
CSC= California Service Center
NSC=Nebraska Service Center
NOA= Notice of Action
"touched"= the date on your USCIS case status page has changed. (i.e. it says "Updated September 22," you were touched Sept 22)
NVC= National Visa Center
RFE (IMBRA)= A specific RFE they sent out for everyone who filed on or after March 6 but before around June 15 which is when a new form came out (unless they filed with the old form later). It is to comply with a law to protect foreign fiances, so USCs have to disclose criminal histories for some crimes, and whether or not they used a marriage broker, etc.
NOA=you already asked that!

Anyway, I'm just posting this in case anyone who reads this is too lazy to read the guides and they ask later... Also procrastinating on going to the post office. :P

I can't speak for everyone, and I do know that people have been issued RFEs (or had the packet entirely sent back) for signatures because they were illegible. However, my fiance's signature is like "squiggle, similar squiggle" and mine is pretty much "Alz," which, incidentally, is not my initials. We didn't get our packet sent back.

Is the main thing here consistency?
