As far as forging...I'd say that's a big NO....first of all, they have your sigs all over the place...can your parents duplicate it to not arouse suspicion? And if they send it back again because the sigs don't match...imagine what that would do to your petition.

Not to mention, you get this RFE, your parents sign and mail it straight out....but then there's a paper trail that you were actually OUT OF THE COUNTRY at the time the documents were returned in such a timely fashion...don't you think that would be a little odd? You yourself even said that it would take a while to get them to you, so if they are mailed back before that timeframe, it's clear its not your siggy. There is a paper trail that can be followed.

Furthermore...are you willing to put your parents in risk of being found to have forged government documents? It's prolly an outside chance that anything would happen to them.,..but it IS illegal & could you imagine if some yahoo gov't employee decided to press charges? All for saving you a month of time, or a few bucks in int'l courier fees?


Lisa's argument really puts the kabosh on the idea. Just do it yourself, or go through the steps to use power of attorney. Don't let them forge it because it's not going to make sense and you'll spend the whole time worrying if you're going to get caught.

I will take the liberty of doing a quick edit. I cut out most of the unecessary information. I did NOT edit for grammar, punctuation, or flow. I really think you should leave out the ex-fiance. It's suspicion-raising and not really relevant to your story. Tell me what you think! (This could be cut in half from here, by the way). There are different ideas about how you should answer Question 18; I'm just editing THIS STYLE down.

I went to the Philippines on a missions trip in October 2005, I had no idea what to expect, my mom had just died and I was taking my 2 teenage daughters across a bunch of water, to a place we never really even heard of before, for two weeks. My daughters and I fell in love with the Philippines, and all we thought about was going back there someday.

Soon after the trip, back in Michigan, I recieved a PM from someone I didn't know, I checked the profile and noticed it was someone living in Manila so I figured it was a person I met from one of the churches. I accepted him on my YM list and we began to chat. He told me he had a Filipina girlfriend in Canada. Since we weren't looking for a relationship it was really easy to be real with each other. We had so much in common, and since he owned the cafe and had a computer at his house, we were always online chatting, joking, singing songs, it was like an immediate friendship building.

He called me every night on the phone, he was the first person to call me on Valentines day, he was there for me when I got laid off from my job of 10 years, he was the first person to call my daughter on her 17th birthday, and when my 15 year old had to have blood work done in the hospital, he txt messaged me the whole time we were there, cuz he knew how worried I was about the results, and he called at 3am his time, just to talk to her and make sure she was ok. It was clear he cared about me and my family.

I wanted to plan another trip to the PIs to see all my church family, and I wanted to meet my friend, so I bought tickets in January. We didn't have a place to stay. 4 days b4 we left, My friend told me that he talked to his family and we could go stay there with them. Even though we never met face to face, he had become one of the most important people in my lives, and I trusted him completely.

We spent 2 weeks together and bonded even more than I thought we could. We were in love. I wrote him a long letter on my last day there about my feelings and how they had changed. When I came home we tried really hard to keep our relationship on the friendship level. We still talked as much as before I went there, he grew closer to my daughters and they started emailing him with questions and advice on school, boyfriends, me. Their father never played a role in their life and I never brought anyone home for them to get close to.

So, we continued to talk, email, chat, and call each other. I tried a few times to not go online, and he would txt me saying he was waiting for me, I couldn't stay away from him...last week he told me that he finally broke up with the girlfriend, he told her that the thought of living without me and the girls made him cry, and he couldn't pretend to love her anymore.

On Monday, it was 6 months to the day we met online, he called me up while I was leaving for my new job. I was a little cranky cuz I was running late and he said "You don't want to talk to me debb?" and I said "ofcourse I do, but I have to work" and he said "debb, will u marry me?" That was the best feeling in the world..to hear that from him. Even though we've only known each other for 6 months I know him. He knows me....its not like anything I have ever had with anyone before, and I think its the same for him.

*Note: I cut what you had, but you should really be focusing on proof of your experiences meeting in the last 2 years (so... that's all of them). Emphasize you met his family, where you stayed (Manila?) and that's what they really want, although I think Question 18 is a fine time to make your bona fide relationship clear.

What if the alien’s circumstances change?

As long as the alien continues to provide H-1B services for a U.S. employer, most changes will not mean that an alien is out of status. An alien may change H-1B employers without affecting status, but the new H-1B employer must file a new Form I-129 petition for the alien before he or she begins working for the new employer. The merger or sale of an H-1B employer’s business will not affect the alien’s status in many instances. However, if the change means that the alien is working in a capacity other than the specialty occupation for which they petitioned, it is a status violation.

Must an H-1B alien be working at all times?

As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.


As you can see, that's a bit vague. I read on a few other web sites that once your employment is terminated, you have 60 days to find a new employer. I've also seen that if you lose your job, and don't secure new employment in the same capacity within that period of time, you become out of status and one web site suggested you have a 10-day grace period to leave. I hope someone will visit shortly with answers for you, but it sounds like the US Gov't is also vague on their policy here.

Could it be that the Sept 11 disaster would allow you to be inactive without affecting status? It would seem so.

Well, not to be too trite, but I learned that my fiance is as special and amazing as I thought and that it's the realer than real thing. This immigration process has surprisingly brought out the best in us and I am actually thankful we've had these almost five months apart (although I'm DYING to see him again a month from today and uh, as soon as it's my turn I'd like my NOA2 thank you). It gave me time to find out some really amazing qualities in my fiance that I didn't know during all the time we lived together.

Otherwise, I learned that it's a LOT easier to eat healthier when you don't live with an amazing Brazilian cook (gotta work on that), and that living with your parents to save money might actually *not* be worth it :)

I've never read where a change of address suddenly causes a change in service centers - at least not when your case is already in the pipeline. It'd be more work for them to dig out your file and send it to the new service center then to just update your address on file.

Plus, whose to say that you wouldn't go from the middle of the line at the old service center to the back of the line at the new service center?

It has been 2 months since NOA1(June 12) and when I log on to USCIS, the last time case was updated was June 15. I have not received RFE, which I guess everybody gets for IMBRA, right? Anyway, I see other cases with similar date to mine, and they have already received RFE and sent it back. On one hand, I am hoping that I have not heard anything because all papers were in order. On the other, its lost in a drawer. thanks for help

I have notice that most of the people with NOA 1 dates in June that are moving forward are not a the Calif. Center. This must be where most of the problem lies.

That is correct.

I didn't know that the US had 'long form' and 'short form' certificates, but I bet that depends on the state you were born in. Mine is a certified copy from Iowa and is only one sided. It got me a passport, so that is what I intend to use for the I 129f -- a COPY, of course.

Yeah, my state only has one form. For these purposes, long form basically means your parents' names are on the certificate. So I hear.

Hurray!

Just became engaged! Now it's time to do paperwork.

Quick question on #10. I have the birth certificate (I am the petitioner and USC). The I-129F asks for the certificate number. I am uncertain:

1) Does the second part of #10 apply to birth certificates, or certificates of naturalization?
2) If it applies to birth certificates, does anyone know which number it is on the Pennsylvania certificate? I'm guessing the one that say 'File No.', but there's a few candidate numbers.

3) I have a second 'original' long-form birth certificate (I ordered a copy a year or so back for my own records). Should I send that in, in lieu of a copy, as I have another original already?


1. That question has confused people because of the layout of the form. Some people enter the birth certificate number, but it's not necessary. People have been approved without filling in that space for numbers at all.
3. You will need the long-form birth certificate for this petition, but you do not need to send anything in the original. It doesn't help your petition any, and you will need to have the originals to give to your fiance later. I ended up sending in an original, because I had an abundance of them and hadn't found VJ yet, but you should probably just copy the certificate and send it in.

Kiwi found this site after seeing the depressing 2/23/06 Processing Date for the CSC on the USCIS page. It's nice to see such a supportive community forming around this process, and to feel like there are people who know exactly what we're going through.

I did have a couple questions about the process and specifically processing times. From the timelines I've seen, it looks like those applicants who are working through marriage brokers seem to have a longer wait time. Can I expect a quicker turnaround (and if so, how much quicker) on receiving my NOA 2 because we didn't meet through a marriage broker?


No. The delay is due to a bureaucratic Eff-up. We all have to wait now, and nobody gets special treatment.

Also, I was wondering if anyone else was officially engaged after submitting their I-129F, and if this caused any problems. I'm travelling to visit Kiwi in 9 days to officially propose (getting her parents' blessing, giving her a ring, etc.), though she knows it's happening and we're basically doing this to both have a more memorable proposal, and to make sure this goes over well with her parents.

Anyway, any advice/thoughts would be greatly appreciated. Thanks!

I know when completing the I129F forms it specifically said that all children claiming K2 visas must be listed on the form. You could not add them afterwards. It must be different if the father is the USC and petitioner - I would follow Aussiewench's links - she knows everything!!! I would also suggest calling USCIS for confirmation.

Michelle.....their child would not be applying for a K-2 visa as once the birth is registered the child is a USC and as with all US citizens they dont need a visa to their own country. There is no immigration process for the child.


But there IS a birth registration that must be done!!
