K-1 Fiance(e) Visa Process & ProceduresThink it's all over when you're visa arrives???
Dear OP,

Most of us were smart enough not to get a lawyer. But you have shown you have no ability to interpret the rules on your own, so you really should have retained a lawyer. Best of luck, but please stop posting incorrect information.

K-1 Fiance(e) Visa Process & ProceduresDoes "age" make a different?

Hey guys,
I wonder if it makes a different if Sam and I are only 20 years old? I'm sure most people apply for visa they are already done with school and got a good job!

I am 22 and Alex is 23. I am about to be unemployed and she is between jobs and just got out of college...

So I don't think age is an issue...

K-1 Fiance(e) Visa Process & ProceduresI am starting a prayer brigade for non-stop approval of NOA2s especially for those who have long been waiting and for all other approvals you

I, Vigo, the scourge of Carpathia, the sorrow of Moldavia, command you. On a mountain of skulls in a castle of pain, I sat on a throne of blood. What was will be, what is will be no more. Now is the season of evil. Find me a child that I might live again.

Amen.

Hmmm, what part of "2 inch by 2 inch" don't you understand?

Um, the fact that it doesn't say anything about paper size in the I-129F instructions, which I think it would if it were an important detail... Has anyone gotten away with not using 2"x2" pictures?

K-1 Fiance(e) Visa Process & ProceduresMy fiance just got the pink slip! In Ho CHi Minh City!!!
Thank you everyone. Really. From the bottom of our hearts Anh and I thank you.

Here is how it happened...

First of all, I decided on the Orgy of Evidence theory. Why take a risk on not including something?

2005 tax year was not available so I included the letter from the IRS (plus the stamped envelope it came in) saying that I cannot not yet receive 2005 transcripts. I included proof from years 2002 - 2004 and a letter stating my ex-wife threw out all my W2's so I could only include what I was able to obtain from former employers.

I included a picture of my car, copy of car insurance and a copy of the title for proof I owned my own new car with no loan. Just helps proof financial security.

My parents were co-sponsors, but amazingly enough, they were not considered. The interviewer told Anh that my income was enough. That really worried me because of the lack of 2005 records, but the letter from the IRS did the trick. However, anyone going through HCMC with a co-sponsor may run into trouble because the interviewer did tell Anh they don't consider them as of this year because of fraud.

I found my original birth certificate right before the interview and sent it to Anh and she put it on top of the certified copies from my town hall.

The interview:

When she arrived a Vietnamese lady took the packet and got upset because there would be no way for her to find anything. Anh pointed out the tabs at the bottom which will make it very easy and the woman frowned, but stopped complaining. Anh saw this same women yell at a lot of girls about their packets.

Anh waited until around 9:45am when she was called over. The translator talked first, in Vietnamese, then the interviewer, "a very handsome looking young man" started to talk in English.

1. "What is your fiancé’s name and does he have any nicknames?" Anh spoke directly to the interviewer in English. She said my name and that she just calls me Matthew when she wants me to give her something.

2. "How did you meet your fiancé?" Anh told him in English and the translator left. When she explained about our meeting in Paris at the Eiffel Tower her interviewer smiled and said it sounded incredibly romantic. He was very warm and friendly and right then Anh knew she would get the visa.

Other questions...

3. Do you know anything about Matthew's ex-wife?

4. What does Matthew do for a living?

5. What were you doing in Paris?

6. What do you plan to do when you go to America? Work or continue your education?

And that's it. The other questions involved small talk. He asked about her experiences traveling and they talked about Paris and Munich and just acted like it was a casual conversation.

He then asked for evidence and she handed him the pictures of our three meetings. Again, he commented on Paris and recommended we honeymoon there because it would be romantic and like in a movie.

Then he saw us in a picture at an art gallery where Anh used to work. We were standing next to a beautiful painting and he asked why we chose that painting. Anh explained that it was out favorite and that we hoped to buy it one day. He told her too late, he just bought it!! I ###### you not. You cannot make this stuff up! Unreal!

Then he saw the Euro Disney photo and asked if I told her about Disney World in Florida and Anh said yes, that I told her it was better. He agreed and said I would be a bad husband if I do not take her there.

Interview over! "OK, you can come back tomorrow and get your visa. I hope your honeymoon is as romantic as your first meeting."

This was the kind of interview one can only dream of. Now, that being said, this IS Ho Chi Minh City and time after time people will go back the next day for their visa only to find there is a new problem. I hope and pray that does not happen. So I will stay calm until tomorrow morning. If that visa is in her passport, I'll then dance the jig.

 :D

Oh My God!!!! She arrived at 8 PM and was done by 10:30! The interviewer was very nice to her. There is so much to tell, but I am fried and want to sleep a deep and sound sleep. I will explain everything tomorrow. Now I go to bed.

Thank you VisaJourney! YOU ALL made this happen because without you we would not have been prepared! Without you my wife to be would be like all the girls she saw with blue slips today.

K-1 Fiance(e) Visa Process & Procedures129-F Questions

Whatever address you are using on the form to receiving documents from them, make sure it won't be changed within the next two years and it should be your US address.

Why two years??? Is this a rule? I'm just wondering because i have started the K-1 process for my fiance (filling out the I-129) but i certainly can't assume I'll be in the same apartment for the next two years....

K-1 Fiance(e) Visa Process & ProceduresI-129F - send evidence of ongoing relationship or not?

Good luck! And don't worry, since you're a vermont filer, your waiting game is going to be more like checkers than chess. More like tic-tac-toe than monopoly? Insert your short game v. long game analogy here.

Thanks!! Since you're going through the same embassy as me im excited to see how far off they set your interview date, for some kind of idea. looks like london gets a lot of requests

I am thinking about this stuff way too much but i'm just excited! I finally pushed through my 325A and almost done with the I-129F and all of it's 'attachments'.
I'm running into something funny though. some people on here mentioned that they sent proof of on-going relationship with the initial petition. Chat logs, emails, phone bills..
but the instructions for creating the package dont mention it, other than the cover letter.
did you all send such evidence along or wait to send it for the interview?
hoping to send in about two weeks when i get his part in the mail and all the stuff assembled.. yay!

K-1 Fiance(e) Visa Process & ProceduresNo Letter about transfer to Cali

Our papers were recieved in Nebraska on June 24 but I havent heard that they have been transfered to Cali. I am waiting for my NOA2. Shouldnt I have gotten a letter by now saying that they are moving them to Cali?

If you say you're waiting for your NOA2, did you get your NOA1 from Nebraska?

Yeah, you got your NOA1 from nebraska? I got mine from Cali, and we sent them about the same time to NSC. Weird.

However, they didn't notify me about the move, so perhaps they NOA1'd you and then sent it on, in a classic USCIS disorganized mess? That's my guess.

If you got your NOA1 from nebraska, are you watching your status online? That would have told you when they transfered it. Also, your IMBRA RFE would have went back to CSC if thats where your case is.

Maybe that will help a little.

wolf

With her timeline, she's not going to have an IMBRA RFE, I'm guessing. The online status did not inform me of the move, either.
Alex+RFemaleBrazil2006-08-16 12:15:00
K-1 Fiance(e) Visa Process & ProceduresChange of Address
All you do is call them when you've moved. Don't get confused and think you have to fill out a form. Your fiancee will have to do that if you ever move when she is in the US. But when the USC moves during the process, no.

Summary: Just call USCIS.

K-1 Fiance(e) Visa Process & ProceduresImmigration lawyer vs. Doing it yourself
I would venture to say that if you have no complications (prior overstays, the stuff Vartan listed, etc.), you do not need a lawyer if you use VJ.

Plus, I have seen so many people posting about how their lawyer screwed this or that up, or their lawyer doesn't know as much about the process as other VJers, etc.

How long before I receieve a number so i can track my progress online. I mailed the I-129F on Aug. 2, 2006. Thanks!

It will be on your NOA1.

Or, if you can see the back of your check when it's cashed (if your bank displays it online or something) I believe CSC stamps the back of the checks and prints the case number on there.

I got my NOA1 first though.

K-1 Fiance(e) Visa Process & Proceduresupdate of I-129F Form
If you filed the old form, you will get an RFE sooner or later. When did the form you sent in expire? June 30 or June 15? If you filed it after it expired (and I don't remember that date) then you might get your whole petition back for filing an expired form, I believe. Anyone can correct me if I'm wrong.

Good luck!
