Hi,

I am so happy I wanted to tell the only people in the World who i know will appreciate it that we were approved today, December 10th ! I am relieved and surprised as I had mentally prepared myself for a 6 month wait just so I would not be disappointed every time I checked the website lol! We filed on July 27th so I think we are about on schedule, but maybe a bit before, so I hope everybody who is waiting gets a nice surprise in their inbox soon! kicking.gif

Just one question for anyone who knows about London. Do I need my police clearance when I return Packet 3 or at the interview? I am still in NYC with Sidiq and have not even applied for it yet. We are off home for Christmas in a week and will do so first thing, but worried I will need it to even set up the interview..I am hoping someone completes my day and tells me I do not need it until interview!

Don't worry. We got our NOA2 today and we never once got touched.

All it said was "this petition was received on and began processing on 13th Aguust", or whatever they say, and we sent it in July. I was worried for the same reason, but sometimes I think no touches are a good thing as they just look at it and approve it..maybe lol!:wacko: ....just try and think of it in a good light!

We wrote "none" in the blank and to be extra safe attached a sheet saying he had no middle name. I think they're used to it, so whatever you do they'll figure it out.

We just didn't want his middle name being listed as "none" :)

No problem. Congrats on getting started and I hope your "journey" goes smoothly!

Also, if it wasn't clear: What happens is the NOA1 will have your case number on it. (One other way of finding the case number is that it is sometimes stamped on the back of your check which you can maybe see on your bank website, but that might only happen at the Calif. Service Center). Once you get your case number, go to the USCIS website and register for e-mail updates. That is where you will be able to see if they have updated anything on your case, sent you an RFE, and eventually, approved you. Cheers.

We didn't include mine with our package (and I have been stressing a bit about it!)... in fact I'm in the process of obtaining a passport (have long form birth certificate though!) .. I'm wondering if no RFE's because we are Canadian?

Just kidding. As far as we know, it's due to name hits in their system and verifying that the beneficiary is not someone else.

I sent in my birth certificate as indicated by the requirements and was never asked for my fiance's birth certificate.


Yes, of course I did. They sometimes send an RFE for the beneficiary's if, for example, they need to confirm his/her identity. That is what assumed happened in this case. They have their reasons, and it does not hurt to send it. The RFEs for this are increasing, and it's been suggested by some VJ veterans that people send in the beneficiary's BC with the I-129F.

The important thing to remember is that if you're going to send in your fiance's birth certificate, include a translation where necessary. Otherwise you will definitely receive an RFE.

We had this situation before. My congressman's immigration liason told us that my boyf wasn't eligible to apply for a K1 until his 2 years were up. Not to receive the visa. We ended up having him stay there and doing the K1 instead though, so I can't give you any conclusive answer.

Pretty sparse ev. Pictures, but photocopied onto a piece of paper with the dates and locations written in underneath. 2 of the ticket stubs that I could actually find, about 5 pages of e-mails that had discussed us getting together in specific places throughout the year, a receipt from the video store showing we had a joint account there.

Oh and a Skype log for good measure.

It really, if you consider it, didn't prove that we had met. But they took it.

Oh also some passport stamps. But not my whole passport because I didn't want them to take notice of my one-year overstay in Brazil. ;)

I think either way the idea that you took 6 mos off will be conveyed. I tend to think saying you were still technically employed by a Canadian employer the whole time might be a good idea, so as not to arouse suspicion that you were actually employed by Americans during your six months here.

Question 18 is a chance to tell them that your relationship is real. They will know that he is free to marry, and as far as I know, being a friar does not LEGALLY prohibit you from marrying--only in the church--and thank god for separation of church and state.

Don't worry about that.

The evidence is to prove you met in the last 2 years. You do not need to prove you met every time you say you did in Q18. Just in the last 2 years.

Well... hmm... since I didn't get any other comments earlier the letter's been printed, signed, and notarized... maybe I'll just save it in case we get a RFE? But then the hotel itineraries/reciepts are pointless because they don't have his name on them - does that mean I shouldn't send the itineraries/reciepts, either, then? Then all I'd be sending is his boarding passes, passport stamp, baggage stickers, and 2 photos - 1 taken in the JFK AirTrain, one taken in a local hotel. That just doesn't feel like enough. But you're right, France isn't a high fraud country, so...

I feel better having the letter from my parents that tie the both of us together and give some credibility to the hotel itineraries/reciepts... but I don't want to give them un-needed info that could take them longer to adjudicate and give them questions to ask that they wouldn't have asked otherwise.

Then if I don't send the letter or the hotel itineraries/reciepts I guess I just shorten my answer to Q18 to, "Yes, my fiance came to New York to visit my family and I from 12/18/2005 - 12/31/2005" and that's it?

I had just finally felt comfortable with this petition and now I'm all confused all over again. :(



I think you are fine. Send the letter, especially because it makes you feel better. The letter is straightforward, not lawyer-like, IMO. The point of the letter is to have your parents swear to USCIS that you're telling the truth in your petition, not for them to gush about how cute you guys are. Send all the info you were planning on sending. You're not overwhelming them, and there is no reason to shorten your stack of evidence just because less evidence *might* work. Do what will keep you from biting your nails nervously until NOA2 and send that package in!

I'll let you know if they make any comments at our interview in Rio. I doubt they will though. In Brazil the risk of fraud is probably mail order brides and much older men, honestly. I think being a girl would make it easier at the interview.

I'ts not like in the ME/NA where so many men scam older women into marrying them. I'm not saying that's the case on VJ, I'm just saying that relationships of older women and younger men in that region can send up a red flag. So in the ME/NA I'll bet fraud is less likely to be suspected of a male USC.

We were in the same situation (rejected J1, although his was work) and then filed for the K1.

So far so good, but he's not from a VWP-eligible country so I can't help you there.

I find the minimum age acceptable for a 50 year old man to be 18 years or whatever feels right to the two people as long as she is an adult and able to make her own decision.

I find the minimum age acceptable for ME to be with a 50 year old man to be about 45. Because I am not attracted to older men. But that's just me. Not everyone.
