K-1 Fiance(e) Visa Process & Procedureschange of address, really confused
Okay.
We have our NOA2 and petition is with the London Embassy. Now I, the US Citizen has moved. and I want to put my new address on all of his packet three stuff if i can, but i cant figure out where i need to change this address. he has to put the address in the US he'll be moving to. so obviously i should really change this so he can put it in Packet three.
i went on USCIS.gov and saw the AR-11 but that appears to be an address change for the alien not the petitioner. Any insight to this?? helpsmilie.gif
i can keep receiving mail at the old address also if its too much hassle.

i agree i think you should keep the job and even finish out the year in march. there's no reason why you cant and it will keep you busy and productive during the process. on the off chance you don't get approved then you will still have that work and money to show for all the time you've waited.

I'm 24 and my fiance is 23. Neither of us are concerned. You have to think about marriages in the US, I would say the majority of people getting married here are in their 20s. Most of my friends from highschool are married, have been married, or are engaged!

I would suggest NOT rushing your employer.. i work on the accounting side of a business and we have someone waiting for a visa trying to rush us on stuff all the time. but we have to send alllll of our financial stuff to a specialised accountant for taxes so we cant rush him and if we tried to he could mess something up for that person or the business.

don't freak out yet. RFEs can be sort of random depending on who's looking at your petition. There were things that I did differently in my petition that could have spawned an RFE from ####### employee. When i submitted my petition, i purposely did not go around on here reading posts on what you should and shouldn't do with the petition, as it was already out of my hands anyhow!

my birth certificate had a back. on the back it said something about if a copy of it was made that the certificate would read 'illegal copy" when it went through the copy machine. funny thing is, it never showed up on there. so i have a copy and it doesn't read that at all.
it made me laugh but i was worried they'd suspect that. i guess not!

What? that's almost laughable!!! i had to scan documents for signatures when i worked in mortgages, and every now and then it is hard to tell if something is printed but all you have to do is wave it back and forth in front of the lights to see that its in real ink... i think the entire 7 months i did this i only had one case that i wasn't entirely certain about...

Yes I should be fine. I will have a letter from my university saying I am coming back to graduate on December 18th and a return flight and bank accounts, and I am not even sure I will show up as a K1 filer this early on....a possible bonus of these backlogs, although I bet the one thing they do update is immigration records lol!

what I mean is that the B1/B2 visa I have is valid for up to 6 months at a time. When I go in, and tell them I intend to stay under 3 months they stamp it for only 3months, but it CAN be stamped for up to 6months, and was when I worked at the UN. However, as we are going through this process, I am worried that may be more problematic this time, and it might be best to stay for shorter time. I know there is no right/wrong answer just wanted thoughts!

Hi,

I would like some advice. I have read extensively, so understand that entry is subjective to POE officer at immigration and sometimes just a dash of luck!

However I am going to stay with my fiance in September, and have a B1/B2 visa. I am currently researching for my dissertation on HIV in the USA, and need to use libraries and UN resources over there ( my visa is from when I interned at the UN). I have not yet brought my ticket and am wondering what people's thoughts are on whether or not it will raise red flags if I intend to stay for 3.5 months (my visa allows it in theory), as we both want to come back to London for Christmas, where I Will stay until the embassy interview. I have ample reason to be there for my work, and am a student, and am intending to come home, but given that we are in the K1 process perhaps things might be different, and only shorter stays are allowed?

i apprecaite why you want to post. i guess there may be another american/mexican couple out there who had the same problem! personally if you have the cash i would go for it. if she has a valid tourist visa, a return ticket, and ties back home, i am sure they will let her in. why would you bother petitioning for the K1 and raising the red flags if you wanted to sneak her in?

I can't imagine it matters at all. They need to know the petitioner has a job or co-sponsor so they can support you when you move to the USA, but I don't think they care if you are employed. I think they only ask us for our employment history to check for large, suspicious gaps when we might have been getting up to no good! I would just quit, and enjoy your time in your home country with friends and family.

You can visit her no problem providing they normally let you in, and if she is from a country which operates the Visa Waiver programme, or could get a B1/B2 visa she has a good chance of getting in to the USA, despite the K1 application. I asked our lawyer about it, and he said he had never known anyone to be refused from my country,which is the UK, although you know how lawyers are with the truth whistling.gif It made me feel better about my coming visit though!

I just thought I would let people who are worried about getting in that I entered the US to stay with my boyfriend in NYC yesterday and it was all fine. I am from the UK, but was travelling on my B2 visa as I have research to do here (for more background you can see my other questions), and the officer at Newark was so friendly, in fact he also let me in back in April and July. He wanted to see my letter from university saying that I was enrolled, and writing a dissertation, but only after I volunteered it. He then asked to see my dissertation so far, also after I offered, but more out of interest I think,and said he wished he had time to read it and let me in!

He never mentioned the K1, although he asked what Sidiq does for a living, and it was really very easy, and now I am stamped in until March 6th 2008. So I know its only one story, but for all of you out there worrying, for me it was easy, and he did not seem to know or care that I have a K1 visa in process. We are together until we hear from the embassy, all fingers crossed, so I would say to all you wondering to try, especially from the UK, definitely give it a go!

I have heard that they dont like you to spend over 6 months of a calendar year there, but you are not near that, so I would go back as soon as you can, maybe early October so it is a fresh month. I have spent lots more than 6 months of the year in the US in the past, and am here now until March, but I have a B1/B2 visa for research work I do here.

For what its worth though, my lawyer told my boyfriend and I that he knew of no-one from the UK who had ever been denied entry on either the VWP or the B1/B2 visa whilst awaiting the K1. Plus you have a great reason for being here, with your fiancee being pregnant, because WHY you are here is always the first question they ask you.

If you have the money to not work for the next few months, and to risk it, I would come back, especially with your situation, I think you will get back in. I stressed about it loads, and honestly had no problems at all at Newark. And yes i know there is a chance it won't work, before anyone replies with that caveat, but I would advise you to try.

Just bring all your K1 info, any ties, and maybe a letter about her pregnancy from a doctor saying she needs your support. I think it would be a mean immigration guard who turns you back, and this is surely a risk/reward situation where its worth the risk!

Hi,

I am here now for 6 months on a B1/B2 visa and had been in the US for about two months this year before I arrived in September for 6 months. I had no problems, and my POE was Newark, which I always fly through as I have never had any problems there. Whilst I worked here at the UN in NYC it was renowned for being an easier POE and lots of my international friends from work entered through Newark for this reason, but it always depends.

You can read my other posts for details, as I don't want to bore people by repeating myself ;-). As for your situation, its really your judgement call, but I suppose being younger, with no ties, might cause problems, and like the lady said, you don't want them hassling you every time you enter hereafter, but if you have a spare £300 knock yourself out, you might get lucky!

Hi,

I think its relief, as the wait for your NOA2 especially right now, is the longest, most frustrating part of the process for most people, as it seems like your petition is in limbo at USCIS. The NOA2 also means its out of the hands of the USCIS, which can be a bit of a bureaucratic black hole, and is actually moving forward and is over the first hurdle.

Its still possible to get denied at the Embassy though for sure, as they are the people whom you must convince that your relationship is bona fide marriage material, the USCIS just need to know you met in the last two years.

I hope that helps, and good luck in your journey. I am filing through the UK too, and from what I have seen denials are rare, so lets keep our figners crossed for us & everybody on VJ!

We have been pretty lucky. We met when Sidiq worked in London in 2005, and then I moved to NYC to work at the UN around the same time he had to return to the US for work, so for the first year we were together in NY and London.

The second year I was a student again in London, and as Sidiq is an investment banker we got to see eachother every month as I had the time and flexibility and he had the money.

Now we are just waiting it out in NYC, as I am here on a research visa until March.

I really hope everyone gets to see their lovers as much as possible, and good luck finding ways around the various visiting issues!

Just to let you know. I have a B1/B2 visa in my UK passport, and visited my fiance recently. However they only stamped me in for 3 months. This has happened to me alot when I have gone to the US, as they ask how long you want to stay, and if its under three months, they logically stamp you in for only that amount of time. I have considered if I should ask for the 6 month stamp, when i return in September, as hoping to stay there for as long as possible then whilst we wait for approval (inshallah) , but i think it would appear too suspicious. but just to let you know, dont bank on the 6 month stamp, its optional for the POE officer!

Hi,

We also lived together before filing for K1, and are living together in NYC now whilst we wait for our NOA2, and I wondered the same thing about evidence, when day to day life does not necessitate lots of tangible communication like e-mail or letters.

I have just made sure we have photos of family events like Thanksgiving and Christmas, as this just shows how you are part of the fabric of someone's life. Apart from that we are going to have some e-mails, and also our tenancy agreement, and stamps to show when we went home to the UK together for christmas etc.

Anyway, good luck, and I am sure over the next two years you will gather more than enough evidence. People get through having only met a few times for a few weeks, and you have pre-empted the problem, so just make sure you send the odd e-mail, and take photos!

I feel for you in your situation, as our timeline is not far off yours, and I am the UK citizen. Right now I am about to go home after three months here in the USA with Sidiq, and I am really worried it will take months for this K1 to process, and I will not see him again for a long time.

Its a really hard call to make, but I have just tried to see this time in the UK as an opportunity to spend time with family and friends before I emigrate, and also to make some money, as the exchange rate is so good for the pound right now! So, if he decides not to risk it at POE try and think of it positively, and if you do best of luck!

Just hold tight, I know its horrible, as this visa process time frame is really " how long is a piece of string", but you are almost there, and January, February etc are always depressing months anyway!

Thanks for posting this, and I am happy she got through in the end.

Sidiq got stopped last time he came to visit me in the UK in July, and questioned for about two hours about his intentions here, his background, and why he was coming back when he had last visited three months before. They let him in, but like you, I was surprised by him being stopped, and its good to let other people know this can happen.

Thanks also for the advice to bring the NOA1 etc, as I am hoping if he gets stopped when we return for this Christmas that will appease the immigration officers, and I had forgotten to remind him!

I am relieved and surprised as I had mentally prepared myself for a 6 month wait just so I would not be disappointed every time I checked the website lol! We filed on July 27th so I think we are about on schedule, but maybe a bit before, so I hope everybody who is waiting gets a nice surprise in their inbox soon! kicking.gif

Just one question for anyone who knows about London. Do I need my police clearance when I return Packet 3 or at the interview? I am still in NYC with Sidiq and have not even applied for it yet. We are off home for Christmas in a week and will do so first thing, but worried I will need it to even set up the interview..I am hoping someone completes my day and tells me I do not need it until interview!
