K-1 Fiance(e) Visa Process & ProceduresMeeting within 2years?

The requirement is meet in person in the last 2 years. If you have done this, then you are ok. You can prove that with plane tickets, passport stamps, hotel reciepts, credit card bills in each others home town etc. Evidence of a relationship isn't needed until the consulate stage, and most of us mainly have phone records, letters, e-mails etc.

Evidence of meeting is needed to be included with the K-1 visa application to USCIS ,(the I-129F), additional evidence of continuing relationship may be requested at the consulate for the visa interview.
From I-129F instructions:

7. What Documents Do You Need to Prove That You Can Legally Marry?
Provide copies of evidence that you and your fiancé(e) have personally met within the last two years; or if you have never met within the last two years,provide a detailed explanation and evidence of the extreme hardship or customary, cultural or social practices that have prohibited your meeting;

One question...when you say two years, does it mean you have to know the person for 2 yrs...i only my fiance for about 5 months..

K-1 Fiance(e) Visa Process & ProceduresK1 petition - current processing time is simply unjustifiable

They will just lump it into the big immigration revamp that the politicians want to do and knowing how politicians work this should take a good 50 years or so.

I agree that they will do that if only 1 or 2 people speak, but if enough do, then maybe the story might be different

K-1 Fiance(e) Visa Process & ProceduresK1 petition - current processing time is simply unjustifiable

K1 petition - current processing time is unjustifiably long!

pl call and write to the congressmen and senators on this delay. this has a direct impact on the marriage and life of the citizens of this country.
our USCIS should give priority to this visa processing over some types of visas such as H-1 and all.
only if many of act together we can expect some change. as citizens of this country we deserve this and we should demand it.

here is the link that you can use to contact your senator,
http://www.senate.go...enators_cfm.cfm

u can google search "congressman state_name" (for eg: congressman nebraska") to find out the list of the congressmen from your state.
pl. call them and e-mail them. let us do this together. then we will see some change. otherwise, we all will suffer though the slow K1 processing.

thanks,

I agree!!!!!!!!!! look and i have a thread on here where im saying the sae time...if we stand up maybe just maybe somethimg might be done,,but if nobody does then nothing will happen

I dont know why but i have a feeling that my " great " lawyer didnt file a good enough package that im going to be requested to provide more evidence. All she gave was all of my fiance's information, all my information and a lette saying how we met , how we wantto be together and not much more...No pictures, nothing!! I really hope im wrong...i met her in feb. and have been back to Colombia 3 times since..Do i have something to worry about??

Keep copies of phone bills, chats, emails. Keep the boarding passes flight info you received from the Airlines too.
you should be ok...

Good luck !!

as far as the boarding passes, i dont have them but my passport has been stamped every time i went...i have all the calling cards i have bought to speak to her ( about 150 of them ) and i have kept every email from her and to her....about 300 emails..

K-1 Fiance(e) Visa Process & ProceduresPROBLEM!!!!!!!

Oh i agree with you completely!! At first i panicked, but now i think that if im just honest and list it on the petition then it will be alright...im leaning on the fact that it was her mom who applied for hefr and that it was 2 yrs ago...We didnt even know eachother existed!!

OK here is my problem...i filed a I129f petition on May 24th...I got my NOA1 and am waiting for my NOA2..Now here is my problem, my fiance's mother is in Canada seeking political assylum...She filed papers 2 years ago tryin g to bring her husband and daughters along with her...My fiance is one of those daughters...Will this affect decisions on my case?????? From what i have read as long as we are honest about it and put it in a letter we should be ok...And further more, the forms were filed 2 yrs ago, my fiance and i met 5 months ago...And her mom filed for her, she didnt do the filing herself....If anyone has any comments or advice , please help me out here!!!!!! :crying:

Not really sure how that might be a problem. Your applying for her to immigrate to the US and not Canada.

Just the point that her name is involved in another process at the same time, and Canada and the US share information if im not mistaken

They don't necessarily share all information. US immigration may not even know about it or care if they do. I think you might be asking for more trouble by volunteering the information, but instead if they do know about it, and they ask questions about it, be honest. There is nothing I know of requiring you to disclose pending visas with other countries.

I have read a TON of forums when it comes to the I129f in Colombia...and one of the things that i have seen the most being said is to be honest and not to withhold information...as a matter fact, on the actual visa application form for her , there is a part that asks wether anyone has ever filed a petition for her or uf she ever applied for a visa herself

Don't withhold information that is required. But you don't need to volunteer information thats not required. There is no where on the I-129F or G-325A that asks about visa applications to other countries.

Your right that it isnt on any form, but there is one part that asks if anyone has filed on her behalf.

The only question sorta related to what your talking about pertains to you, and whether or not you have filed for a fiancee or spouse visa before. Question number 11 on the 1-129F. The question is asked due to limitations imposed by IMBRA.

On form DS 156 which i believe is part of packet 3,question number 36 asks, has anyone ever filed an immigrant petition on your behalf...form DS 156 is the non immigrant visa application which my fiance has to fill out.

Thanks so much Byron, I'm a May filer waiting on CSC. Haven't received any touches since 5-30-07. I called USCIS service center a week ago and was given the same old line,, "still within the normal processing times" Got to love the Government when they can approve a green card to a immigrant worker in as little as a month and we are sitting here on our thumbs patiently waiting to get our loves ones here. Just doesn't make any sense. Well, thanks again for the numbers. Here's wishing you a speedy NOA2 soon. Best wishes to you and yours. good.gif kicking.gif

QUOTE (YuAndDan @ Oct 2 2007, 04:32 PM) <{POST_SNAPBACK}>
The I-134 form's directions are old and have not been updated to match the evidence requirements of the I-864.

USCIS does not use the I-134 for anything and only provides it for Department of State to use for NON-Immigrant visas like the K-Visas.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864. This is why many of the consulates and embassies specify IRS returns or Transcripts, employer letter, pay-stubs in their instruction packet letter.

EXAMPLE Manila:
QUOTE
k. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. Submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you.
http://manila.usemba...ov/wwwfivk1.pdf

In our case this what the I-134 included.
  • I-134 signed and notarized.
  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html
  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
Bank info and asset data is not required as long as income exceeds %125 povertyline counting self and fiancee, and any dependents, you should be fine.

I did not provide any asset data, my income was sufficient, keep this as simple as possible.

I think this case is different...he works off the books and has no tax returns.

Part one.....you can submit banking info and alsoany properties or assets...in other words any sort of income..
Part two......you are allowed to have a co-sponser...

Tax transcripts are the best thing to have, 3 years worth....the letter from your employer should list, job title, salary, and status..full time or part time. good.gif
