My lawyer did such a horrible job. I was going thru the G325 form.. he put the wrong date of birth for my fiances parents.. they are from an area where they dont document the date of births.. but they know the month and year.. so my lawyer was supposed to put down 2/1952.. and 4/1950

but i checked and saw he put 2/2/1952
and 4/4/1950

so he just put the same date for the month as well as the date...

it was all approved and it is at the embassy now.. the DS230 was filled out.. by then they had the details and put the correct dob. 2/13/1952 and 4/15/1950

so now i am nervous again... her parents date of births are slightly off.. what do i do? is it an issue to be worriedabout.. do they double check between the DS230(submitted at the embassy) and G325 submitted to Vermont?

So my fiance and I are debating what language she should do the interview in? Clearly she knows her native language very well. She knows English, but it is broken English, her written English is decent.

She is practicing but we nboth think that interviewing in English might improve our chances... any opinions?

I would be careful. Although the COs are not all Indian. They do know the culture and it might raise some issues. They might think you got married.

If I were you I would escalate this to the congressmen. My congressman got involved about 6 months ago and they helped us. they sent a letter to the Consulate General and he replied back. The congressman actually knew us for years, so he wrote how he was very close to the family. I think you should call them and have them get involved. Or get married and refile for a K3.

I recommend not using a lawyer. I did and he didnt do anything but mistakes.. halfway thru I just stopped using him and did the rest(with help from VJ).

Most lawyers do not fill out the forms. so college kids who intern for them do it. This is just following instructions and filling out forms. If there was a serious issue or you need to go to court then I understand a need for a lawyer.. but trust me.. use VJ and it will go thru smoothly.

If the court has provided her with a judgement of sole custody - removing all legal rights of the ex. then this might be acceptable as well. I think that's what the Kiev site says... permission of the non emigrating parent or court order of sole custody.



there is a difference between sole custody and removing all legal rights of the ex. Very very rarely do courts remove legal rights of a parent. The child has a right to see both his parents. And both parents have rights to see their child.

I think the first thing you need to do is ask the childs parent if he would allow it. If not, then you go to court and see if they can force it.

I feel that you should get your refund. It may seem like a daunting task but VJ will help you the whole way. There are sample forms and if you dont know something just ask.

All the lawyers do is fill out forms, they still require you to gather all the data etc. The forms are actually not too hard. I had an attorney and he messed up so bad and he had a i dont care attitude, after the NOA2 came. I didnt even ask him to fill out the support docs or help me. It isnt worth it.

Hello!
Here is my knowledge/opinion on your questions:

1. You do NOT have to live with the sponsor. however.. this process is pretty financially burdensome. If you haven't worked at all or dont have an income source you have to find an alternative way to pay for processing fees, travel expense, moving expense.. plus there will be a period of time when your fiance wont be able to work legally so you will have to have the funds to support them or they will have to have enough money in the first place to support themselves.

2. There are no specific restrictions however it is harder for the fiance to come into the US to visit. Immigration sees that they have a fiance petition pending, and they may be skeptical about your fiance's intentions of entering the US. They may feel your fiance is coming to stay permanently ... and at their discretion may send them right back home. If they are coming to the US they should bring anything they can proving ties to their home and intention upon returning such as a letter from their employer stating that they are to come back to work after the trip or a lease to an apartment that they have signed. It is much better for you to go to the foreign country to visit. you will have little to no difficulty in doing so.

3. That's a tricky one. it depends on how quickly you file for Adjustment of Status and Advanced Parole, how quickly these are processed, and if they are approved.

4. That i don't know.

Form doesn't ask for permanent addresses, it asks for your addresses over the last 5 years. I had the student thing going on too, so I ended up attaching extra sheets. When the instructions are clear and simple, like they are here, follow them. If no qualifying language is used (like "permanent" or "residences for longer than x months"), then just give 'em what they want!

A few extra minutes making the addendum sheet will save you a lot of worry and potentially a lot of time later if your lack of a complete G-325A gets you an RFE.



You know how people keep saying not to let gaps of time in between jobs or residences? so when you were a student did you list the dorm address, then list home address for the summer, then new dorm address, then home address for the summer again, like keep relisting where you were back to live each summer?
i wouldnt say the instructions are clear, id say there are NO instructions. too much interpretation left open when i should just making this simple. I just want to do it right!! :)

Whoo, I had a number - had to add a separate sheet of paper.
I wrote down every single address and any part time job I had too.
See if you can dig them up - don't worry if there are a lot - that's normal for college students.


Yeah my first guess is just to list everything i possibly can even if the college addresses arent really permanent. i might call the school and see if they keep records of that stuff, because im not sure that i'd have mail from every dorm i lived in. i guess i could always list the hall name without the box number if i had to.

Hmmm.

So I'm having a couple of issues with the G-325A. Basically my fiance and i are both in our 20s, so we've moved around quite a bit and worked for many places in the last 5 years... so here is my question. I was in 3.5 years of college, so i have 4 different college addresses because of that. But the entire time my permanent address was with my parents at home. Do I have to dig up the college addresses?? I dont know if i even know what they are! If I put those I will have a total of 7 addresses for that form. Oh boy.

Next question is about jobs and it's very similar. If you worked with temp agencies that placed you around, did you list them? I have had about 4 permanent jobs in five years (mostly summer or part time during school and then fulltime ones after college) but i've been with about 3 different temp agencies as well!

Tracking down all these addresses is going to be super difficult.

Any advice?

Consider for a moment that we're a very, very diverse group of people here. Some people have lived together a long time and this visa is just a formality. Less fortunate of us have been able to visit and maintain a relationship long distance. Even less fortunate have met once but it is in the cards for marriage. None of us can know what will go down in that 90 days.
Now personally I'm certain that my relationship will become a marriage. I applied for the visa with the intention that this was my fiance and nothing is going to move that. but none of us know 100% for certain that nothing will happen in that time between arrival and marriage. none of us know that once married, everything will be happy and skippy and perfect or disasterous.
i think that there's some very small-mind thinking going on about one way being right or wrong. this conversation has become very 'black and white.'

Hi there,

I'm getting ready to mail in my I-129F packet, but I don't have a "passport-style" photo for my fiance''s G-325A. As he lives in Sicily, it would take a very long time for him to have it done there and then mailed to me. We're trying to submit ASAP (obviously), so I don't want to add any more time to the process (as we were originally mailing it in one year ago).

Would it be acceptable to crop down a regular photo that clearly shows his face? The only thing is that it's not a white background. I've read that the adjudicators aren't too picky about this, but I'd like to know if anyone has had experience with submitting photos without a white background and having no problems.

Thank you, everyone, for your advice. It's really helpful to see a range of opinions.

To answer someone's question, I don't have any loans/outstanding bills etc, to worry about, thank goodness, but I do have an apartment in NYC that I would have to sublet (which would be a pain, as being like most girls, I have nice things and wouldn't want them ruined!).

This just happened today, so I will need to do a lot of thinking. Thanks to previous job changes, with nice long breaks in between, I've actually "lived" there twice before (3-month periods), and I do know it's terrible to go back to being on my own. He's come here for similar chunks of time as well.

I think I'll give it a go here for about a month or so, and see if anything pops up on the job front. If things are still dismal (being a consultant, things are generally bad for us when the economy takes a nosedive, as we're not "essential"), I may seriously think about forwarding mail to my parents and then hightailing it there for the summer, at least. I could return in the fall (after 90 days) so as not to worry about getting a visa to stay in Italy longer AND if I can't find a subletter, i really wouldn't want to pay more than 3 months of wasted rent (although even paying one is unpleasant!).

Thanks again for all your input (I hadn't even known about DCF before!).

Hi there,

I submitted my I-129F in mid-February and we're still waiting for our NOA2. However, I lost my job today and given that I live in NYC where the cost of living is extremely high and my fiance lives in Sicily where the quality of life is perhaps, not as high, but the cost of living is low and he owns his home and his business, a thought crossed our mind today. Would it be possible to cancel/put our petition on hold?

There are three scenarios:

1) I could (temporarily) move to Sicily and we could at least be together while the economy picks up, I could then move back alone and we could resume our K1 process.

2) I could move there, we could get married and then I could move back alone and reapply (probably losing my application fee for the I-129F K1) to bring him back to the US as my spouse on a K3.

3) I could wait it out, try to find a job here, and let things run their natural course with him potentially entering the US on a K1 Visa in the fall when we could both be unemployed for a while.

Any thoughts? Has anyone been through this that could offer some guidance or advice?

The money would truly be a gift, it's going to be given to the USC anyways in order to pay for anything wedding related that the USC and her fiance wish to indulge in. (wedding reception, honeymoon, new car, house downpayment etc.) It would simply be given now rather than later at the time that the fiance is present in the U.S and the plans are moving forward.

Anyone see anything that would cause a problem with getting the sponsorship by the USC done this way ? Banks have to report anything more than 10k being moved between or into accounts, so if they( the government ) looked into it closely they'd see the money as being newly there and not from saved income.

The theoretical USC would like to keep the family happy smile.gif But will do whatever is more proper and viewed more kindly by the powers that be....


Assets used as qualifications are valued at 1/3 of income. If you are $2000 "short", you would need $6000 in bank deposits or assets to make this up.

That's the good news.

If you do this with a transfer of money, then get a bank LETTER which states current balance and annual deposits for the last 12 months. I would suggest NOT submtting bank statements as a large deposit just before the interview could be seen as fraud. Also, remember, you have to do this all over again with the AOS. So if the intent is to deposit your "gift" of wedding money and then spend it on the wedding, what will you use for the AOS?


Gary, question for you. I'm about to fill out my I-134. I lost my full-time job in April and now have a job that's contract (freelance) to potential full time. My employer wrote my letter stating that I started in May, get paid a day rate and have potential to be a full time hire. Now, if you multiply out the day rate fo the year it's way above the poverty level. BUT I'm worried that since it's temporary, without 100% sure of being full time in the future, it will be a problem. What do you think? Or, anyone else?

We have all the usual things prepared, but I am also taking along some letters from people I worked with at the UN in NYC, my professors, and our family and friends on notarized letters, just saying that we have been together, and they have been familiar with us as a couple for the last two and a half years; not sure how much they help but our lawyer suggested just to over-prepare. We are also getting these from people who work in a professional environment and can write their contact details etc on the letter, so the embassy knows they could call and verify.

Also lots of pictures of us at Thanksgiving and Christmas with his family here in the US, and photos with my family, all members from our baby nephew/nieces to our nanas. We will also take pictures of our trips abroad to Italy etc. Also travel documents, pictures of last summer when Sidiq and I and our little sisters went to Greece with my Dad's family, and just photos of random parties and days out from our time living together. I think these are good as they show us in different locations, with different people and at different times of the year, as 30 photos all from one trip do not really show continuity.

We have been living together here in NCY too so I am going to ask our landlady for a notarized copy of our lease with our names on, but I don't think that will help you as I am not sure you guys lived together yet.

Thats about all I can think of right now that may help. I think they prefer proof of tangibly being together to e-mail/chat etc as we all spend so much time online nowadays, but I am sure all of that does not hurt either!

I had no problem getting in, and it was great as we received the NOA2 on DEcember 10th and its now at the London embasso so it made it all so much easier to be together. Don't know if that helps, but just to let you know we did it and had no problems!

Just a quick question for English Muffin if you are still reading this thread!..On your timeline it shows about a month before you returning P3 and receiving P4, and then your interview date is about 4 days after you receive P4. Were you able to find out your actual date before this, or did they only give you 4 days notice?

You have to go with her to the interview. In DR if the petitioner doesn't go they will either deny the visa or if lucky, schedule an open appointment for a later date. The emabassy is weary of fake relationships for visa so they like the see both parties present so they can do a thorough interview if need be.

We already received our first Notice and are awaiting our second. whistling.gif I don't really have any questions, but I do like that I have a place where I can vent about "HOW FRIGGIN' MUCH I MISS HIM" crying.gif and how tired I am of everyone asking me if he is marrying me just for his papers. I find it insulting, frustrating and dissapointing that I almost have to declare and explain our love. I honestly find that at times I am not prepared for this line of questioning. It feels as though I have to have some sort of explanation in the wings, besides we love each other and want to marry. On the G-325A, where it says "Date, City and Country of Birth (If Known)" - if you don't know then put "unknown". Check all your personal documents first, like birth certificate, and make sure the city where he was born isn't listed on one of them. Where it says "City and Country of Residence", put "deceased".

Once you get to the states and get married you will file for the I-145 (AoS) and you can apply for the I-131 (Advanced Parol) and I-765 (Employment Authorization Document). You don't have to apply for the I-130 as thats the petition for a visa for someone who is married, and you will already be in the states on your K1 and can adjust from that.


That is what I thought too. He just read me the letter and it said:

"Once you are married, your US citizen spouse will need to file I 130 form and you must also file from I 485 AOS"

So, I'm not sure to follow the direction or go by the Visa Journey guideline.
