As far as I understand it is legal to marry anyone at anytime. But it is not legal to come on a tourist visa with the intentions of marrying a citizen. But if you really came here to visit and happen to meet someone and 14 month later get married I think that is completely legal.

Hi guys,

So I still haven't heard anything from the USCIS regarding my K1 fiancé visa.

My NOA1 was received August 9th, it is now January 3rd and I still haven't heard a word.

I hear I am able to contact after 5 months to check the processing of this application?

It was sent to the Texas Service Centre and forwarded to the California Service Centre after the NOA1

Please help... I'm going crazy!?!?!

I would give our congressman's offce a call when it gets to the normal processing time....after Jan 9th....my local congressman community liaison was able to call the vsc 1 month after the 5 months mark and the next day i got approved....call it coincidence but something worked. saw many others that got the same result as well as some that didnt get any response from this inquiry ..... it wont hurt to try!

CSC is not on the monthly schedule, last I heard they are stating they are working on June 16th. Just have to sit back and wait, calling your Congressman won't even help as they will be told the same thing. :crying:



I wouldnt go say that ALL congressman inquiries are the same.....contacting some local offices has resulted in some vjers getting an approval in less than 48 hrs....

Gotcha, im sorry. Ummm i feel like im reading what my fiance said to me...haha it may not be that they didnt get it yet just that they may not have recorded it.....my fiance mailed packed 3 on dec 29 and is mad that they havent "received" it yet....im going to email them tomorrow to see if they did....


other to that what i can say to u is just hang int here for a while...u kno that other countries (outside of the US) have some carrier issues and aside from that like i said they may have received it but not just recorded it ...it all depends on the load that they get everyday...patience. :bonk:


My advise is to just email and ask them if they have received it every 3 days or so...use your discretion [ u dont want them to get annoyed by u]

That's not necessary. For the petitioner to prove US citizenship, they can use their birth certificate (which is what the OP is providing, according to their list) or their passport pages. One or the other. Don't need both.




If the petitioner is not a US citizen from birth thats what shows citizenship. and the passport pages also shows that the petitioner has indeed traveled in the pass 2 years to visit the beneficiary. Serves 2 purposes if not one.

So I made a service request last Wednesday (5/23/12).
I called the NCSC number after not hearing anything from VSC
regarding my RFE (it has been a month at the time since they received my RFE).
I figure it wouldn't hurt to ask and expected an answer of "wait full 60 days then call".
The customer service rep was very nice and helpful and did a
service request for me since I been waiting for 6 months overall since USCIS received my I129F.
Also gave me a reference number and told me to call again if I don't hear anything for 15 days.
It has been 9 days so far and have not heard anything from VSC. I'm just bit worried
because I noticed others receiving service request response within a week.
Should I expect service request response by next week?

The process is taking it's toll on me and my fiancee...
It has become quite the emotional stress...

I have a question I have been like everyone here constantly checking the status between Visa Journey, Igors List/Berkley List and USCIS.

Our case still says Initial review on USCIS website all of the EAC###### after and before us have moved on, does this mean there could be something wrong with our case?

Every time I call USCIS no one gives me any information instead they respond as if I am asking them for their social security number and bank account numbers. (Never a pleasant call)

Any insight would be greatly appreciated.

That has yet to be decided. Ideally, the longer the better - It would be awesome if she could stay for at least a month. But I have the feeling that anything over 2 weeks might arouse suspicions.


The fact that she doesn't have a job will definitely work against her. When my fiancee came to visit this past April, the officer almost didn't let her through because she didn't have a job. Because she won't have a job, there is a chance that she might not be allowed to come in - it all depends on the officer. He let her through because our stories lined up and I was honest from the beginning. He asked me if I was travelling alone, and I said "No, I'm with my fiancee but because she's not a citizen, she's on the non-citizen line over there." Little did I know that because there were so many people on the non-U.S. citizen line, they sent the non-citizens to the citizen area to be checked after all the citizens were checked.

If you don't want to take the risk, you could possibly think about sending in your I-129F while your fiancee is in the States.

We filed the I-129F in December, my guy visited from England for 89 days under the visa waiver program with no problems from February until the beginning of May. He was up front about having a pending K1.

I made a post in the site discussion forum to have a thread pinned about visiting: http://www.visajourn...-you-can-visit/ but the mods seem to be ignoring it?


You were very fortunate. My fiancee was almost denied access, and she was only visiting for a month (we entered together on April 23, and she left by herself May 22).

I'm in a similar situation. My fiancee and I have just started the K1 process (sending out the I-129F petition packet next week), but we would still like to visit each other in the U.S. while our application is being processed.

The only thing is, like Randy & Kim, she doesn't have the usual proof of "Strong ties" to Japan, her native country. She's quitting her job this month to spend time with her family before moving to the U.S., and she lives with her parents, so she doesn't pay rent. Aside from the usual return ticket and utility / cell phone bills, is there anything else she could provide to show that she intends to return to Japan within the 90 days?



How long does she plan on visiting for?

We want to know if she can visit while I29F is being processed (not the K-1, we know she can visit while that part processes). So the petition part, which is the I29F, which we understand can take up to 4-5 months, can she visit while that is being processed, pending approval? To put it another way, can she visit between submitting the I-129F and receiving the NOA2.

Hey famousamos, by the looks of it, it seems as if you and your fiancee were able to get through without any problems. My fiancee and I just recently entered the States together while her i129f was in process, but she almost got sent back.

The same immigration officer ended up checking us out, which was definitely a surreal experience in and of itself (what are the chances). The reason why my fiancee was almost denied access to the States was because she resigned from her job a few weeks before traveling. The officer, rightly so, was suspicious that she was just going to enter and never leave again. We had a return ticket to show the officer that she was indeed going to come back, but that wasn't enough. What made him finally allow her to enter was that our stories matched up.

Probably doesn't help you now, but for anyone else who may be reading this, as long as you show that your fiance/fiancee is going to go back, there shouldn't be any major problems.

Yes you can, but be prepared to show that you have ties to the Netherlands and/or that you're going to go back. My fiancee almost got denied entry to the U.S. because she wasn't employed when she visited.

I was online when my fiance's ex girlfriend popped up and told me that uscis takes a long holiday break from October till after the new year around February. During this time, everything is sort of "frozen" and anything that has not been processed or approved before they go on break will just sit there till after the break. This was the first I had heard of this and I am really hoping she is wrong...



Don't listen to her. She's obviously trying to discourage you and get in between you guys. Unless she works for the USCIS or is a lawyer or has gone through the process herself, she has no credibility whatsoever.

Not sure what to do with the K1. I'm an American Citizen and have overstayed in Canada while living with my fiance (she's Canadian) for the past couple of years. We'd like to move legally to the US so we can get married and start a family.

I have a legal residence in the US where I file taxes (grandparents house) but it is a rural area so they do not get mail delivered and need to use a PO Box.

The plan would be to file the K1 from here in Canada, go through to process, and when/if approved move back to the states together with our belongings. (Stay with family a few weeks probably while looking for a place to live and work)

Questions -

1) Proof of meeting in the past 2 years. Obviously we have photos since we live together, I've also written plenty of checks to her to pay bills, plus I can include receipts of things I've bought here with my CC. What we don't have are passport stamps or recent travel documents. Heck when you cross on foot from the US/Canada they generally don't even stamp your passport anyways. What are our options here?

2) Mailing address. The plan now is to send all the documents to my sister to have her place them in the mail for us in the States. All the forms are asking for Residence which would be different than a mailing address. What do we do here?

3) Do I need to return to the States without her? This is really a last resort type of option for us, we desperately do NOT want to part for any long period. We've been together for over 3 years and are very much in love.

I didn't send any passport photos of pictures/copies of boarding passes. I only sent a copy of my birth certificate, 4 photos of me and her, 4 copies of cards I wrote her (I write her one every month), and a detailed explanation of how we met, and I didn't get an RFE. So from personal experience, just wanted to let you know for your first question that you don't absolutely need passport stamps. You just need to show that you met and your relationship is genuine.

Hi all. We have our NOA1 and now waiting for our NOA2, but were wondering what would happen if we were to have a ceremony in my fiancee's home country before getting officially married in the US. According to South Korean law, having just a ceremony is not recognized as an official marriage in South Korea, and therefore the US wouldn't recognize it as an official marriage either, right? We wouldn't be signing any papers or anything.

The NOA1 is when USCIS receives your petition and will work on your petition according to that date. The NOA2 is your notice of approval.

On your letter, where it says "Notice Type" on your letter, if it says "Approval Notice", then it is your NOA2. If it is indeed your NOA2, congratulations!
