Plus you would most likely have your AP within 3-6 months(give or take) of living there, so this is only really an issue for the first 3-6 months.

I understand that when someone very close to you passes away, your mind is not always working 100% but this is something that should be considered before you even apply for a visa in my opinion. There are a lot of "what ifs" and you need to be prepared for the worst when immigrating because the rules are the rules and there isn't any way around them so it's really important to protect yourself right from the start.

I'm pretty sure your AP is good for 1 year and by then you should receive your greencard, or they will extend the AP.

I believe if there is a death in the family - you can get your AP expedited. I could be wrong on that though.

There is a lot of really good information here that it makes it really unnecessary to use a lawyer, especially if you have a pretty straight forward case.

If you make a mistake or they require extra information they will send you an RFE and you won't have to start over, just possibly get delayed a month or so.

Yes you can definitely have visits while the visa is processing but like other have mentioned you need to show proof that he is going to back to Canada. So, a letter form his employer, a lease, other bills, and of course a return ticket. I've also read that it's good to carry all of the documents you have filed.

My bf and I intend to travel back and forth just as we normally do throughout the process.

Sorry you can't get married on a Cruise with a K1. When you go on a Cruise you leave the country and have to go through U.S. Customs on your way back in.

^^ Yeah its definitely good to have, but I wouldn't flaunt it out or anything. They usually just always ask me when I'm returning and I give then a firm answer and they are usually good with that. Sometimes they ask me to see the return ticket.

They also asked me who was moving where... but I just said we hadn't decided yet and he was okay with that answer. When I visit after we've filed, I will say myself and I've filed for a K1. Hopefully it won't be too much of a difference. You would even think that would be better since we're all doing it the right way and not just moving there "unintentionally".

We haven't filed for a K1 yet, but I just travelled back and forth twice in the past 2 months and didn't have a problem. I also live with my parents and don't have a lease. I do travel with a letter from my employer if I'm going for a week or longer. I also have a Dermatologist card with my next appointment written on it which I go to every month, which is actually kinda lame wouldn't use that unless they were being really harsh on me or something.

I think the return ticket and a letter from your employer will be just fine.

Toronto doesn't do K1 unfortunately, and neither does Ottawa. Only Montreal and Vancouver do them. If you live in Ontario, your interview will be in Montreal.

my bf and I were in a similar situation actually. We wanted to save money and even though we know we love eachother and want to be together, we wanted to make sure we weren't rushing anything and had a good savings for our future and were at a good place in our lives.

Luckily, I live in Toronto and him in NYC, so doing the long distance thing isn't so bad. What we decided to do was wait until we had a good chunk of money saved and where I'm at a point in my career that I will have the proper experience to get a good job there. I graduated grad school in '07 and have been working for 1 year now and I figure I'll leave my job in another 8 months or so.

So anyways, we've filed now but are not officially engaged. I'm guessing at some point we will get officially engaged before I move there. Then we'll just get married at the courthouse and have our wedding a year after that and consider ourselves "engaged".

If she can't extend her student visa, I like the idea of her going back to Taiwan and then filing for a K1 fiancee visa from there. That would take around 8-10 months. You could save money that way.

Well, he has a very important fact wrong... Canadians don't need to be in the VWP to travel to the US. So, that to me just points to stupidity. I have had a stamp stating B2 in my passport, but I don't get it everytime. I think they just stamp it when they feel like it.

Secondly, you can do what he is stating, BUT and this is a big BUT.... if your INTENT is to marry when you cross the border and you are caught in that lie, you are comitting immigration fraud. You must be able to prove that your intent was just to visit and that you meant to get back.

The sheer fact that you are considering filing for a K1, already kind of denotes that you have intent. But that's your risk to take....

I personally would rather stick out the K1 for the 8-9 months that it takes and just do it the right way. I'm waiting for an interview and the whole process has flown by.

We filed in June and got officially engaged in November...

Like the others have said, you just have to sign a letter stating you have intent to marry.

I thought it might ruin the surprise, but in the end I was totally surprised at how he actually proposed! He had to get creative because I knew it was coming!

I had a similar situation. I went away to University and kept my fixed permanent address at my parents house. I actually only used my parents address and didn't put any of my temp addresses there BUT I never received any bills there or registered for school there or anything. I don't think it would hurt you if you put them all down though.

For the other part about the 'present' line - I just left it blank on Adobe and then wrote in 'present' on all my forms and that was fine. Anything Adobe wouldn't let me type in, I just wrote on any of the forms.

I wouldnt' worry about it. I'm sure what you did send will work for them. If not, they'll send a request for more information.

And like others have mentioned, just bring them with you to the interview when it comes time. I sent in a bunch of photos and they gave them all back to me at my interview, so I think all of our other documentation must've sufficed.

I need a little bit of advice here.

I am a US citizen. My fiancee and I have been dating for about 1 (one) year. We are considering 2 options:
1)Fiancee visa
2)Spouse visa

We are somehow more inclined towards the fiancee visa just in case things get delayed. However we had planned already on getting married in southamerica, so the spouse visa is under consideration.
Now everywhere I read, it mentions a minimum of 2 years knowing each other for the fiancee visa. How can we deal with that and move forward with the fiancee visa since we only have dated for 1 year?

From the little i know, its actually that you physically had to see eachother within the last 2 yrs...not known eachother for 2 yrs..i am in the fiance visa process i know my fiance only 5 months...been to see her 4 times since we met

I printed my pictures, wrote the date on the back and included names of the people in the photo (and who they are...relation to...), as well as location (cities and places we visited).

This worked out perfectly fine at the interview. Be sure to include pics of you and your SO with family....as well as lovey dovey....and sensual pics innocent.gif

I agree to that :thumbs: I visited my fiance 2 times prior to filing the first K1 and Casa was not convinced of our relationship, it took another 3 years of visiting and was approved on the 2nd K1. Get to know each other better in person, meet his family and learn the culture then try applying again.

I have been checking my status online which is on USCIS website and it has been in a status of "Initial Review" for more than 3 months by now.

And wondering how I would know if the office has mailed us the NOA2 by checking the status.

That would be your K1 approval which can take 3 to 6 months from your service center. A lot of times cases are not updated in the system. You can make an inquiry after 120 days if you have not heard anything. After the K1 is approved it gets forwarded to the NVC and from there they forward it to the consulate.

My fiance was denied the 1st time as well. We refiled and sent in much more ongoing proof of relationship. I had friends,family, Congressman and Senators write for us. I wrote a letter to USCIS addressing our 1st interview and the possibilities why we were denied. At the 2nd interview the CO had a large file on us. My fiance was questioned for 30 minutes but he had a very positive attitude. He gave short and brief answers. There was nothing they could deny us for again. He got the visa and he is now here in the USA.

Thanks everyone i pretty much got all my paper wrk together all im waiting for is to fill out him mom bday info on his G-325 and wait for his passport pics to come in the mail,(i have a very neat and organized package just waiting to be shipped off) i have looked through all the introductions and forms to print, this website is truly a blessing for anyone going through this situation, i checked the guidelines for income and the proverty guideline for 1 person is 10,830 and i make 30,993.44 so im assuming im okay by the guidline even though between the trips back and forth and these fees im overwhelmed lol... lastly you dont need a certain amount of money in your bank account?

Hello VJ I’m a newbie that is filing for a K1 visa my Fiancé is in Jamaica, any who I just started the paperwork but i am confused on a couple of things and I wanted to know if you guys can help me?

1. With the g-325 form the area where you write how you and your fiancé met, do you have to write two different perceptions one for your g-325 and one for his or can you use the same one for both?

2. Is there a certain amount of money you have to make to be able to file for your fiancé? And is there a certain amount of money you have to have in your 401k or bank accounts?

3. I’m confused on my service center and the place you sent the I-129 is this the same place I looked up my service center and mines stated Jacob Javits Federal Building 26 Federal Plaza, 3rd Floor, Room 3-310 New York, NY 10278. But I often read something about a Nebraska office on this site?

4. Is color pics really important? (i have alot of pics and this seems kind of costly)

5. in my I-129 question 18 letter I wrote on Valentines Day we mutually agreed that we did not want to be separated anymore and wanted to get married and live the rest of our life’s together no matter what sacrifices we had to make, I did not say he got one knee and proposed to me, should I change my original statement to reflect this I ask because we do not have a ring yet and honestly that’s not how it happened but it is a FIANCE visa?

6. On the g-325 his work history is self employment he has a farm, he designs t shirts and do music locally is this okay?

7. the FEES omg i was looking and a guideline from 2006 and I’m thinking the fees are still the same so I’m still trying to get over the $170.00 to $455.00 jump just to file the I-129 so my question is where can I find the fees for him I know there’s a fee for the police report from Kingston, to set up a interview and such I’m guessing if the fees changed for the I129 it probably changed for the other documents

Call up your congressman, tell them the story and they might help. Not always but I have heard cases especially in New Delhi where the congressman have gotten involved and then the case is approved.

My fiance is waiting for her packet 3 before the interview. Seems New Delhi is taking a long time sending it out, but I was told she can submit the forms at the window at the embassy anyday. Form 156K and the Applicant Statement.

I looked around and all the 156K forms are all outdated. Say expired 7/2007.

Does anyone have a link for the new forms...
