K so I think I have it covered pretty well, I have my passport which is stamped 4 times from August 2009 - November 2010 and I could only find 2 boarding passes and luggage receipts. I also have the text message records, some skype records, pictures of us on our various visits some in Canada, some in US, some of us alone, some with our children. I think that should definately establish we have met in person lol. OK should be mailing her off today!!

Thanks for the responses! This is difficult because even though we chat on webcam every single night I really don't have much proof. We used to use skype so I have some transcripts that I printed out (couldnt figure out how to print off of skype so I copied and pasted hope that's good)but the last one was really brief from December 2010 and before thatAugust 2010. Once skype started giving us a hard time we switched to MSN, but I can't seem to figure out how to get a history, I think I might of had that disabled. Other then that and the texts not sure how else to prove the ongoing relationship. I recently ordered my wedding gown do you think the receipt would be good proof? We also opened a joint checking account when he was here over New Years so we could prepare for the move and wedding, etc., would that be good? I have a card from his mom and sister congratulating us on our engagement umm...not sure what else we could use...

I'm about to send out my I-129F and I just had a last minute freakout and want to make sure of a couple of things before I seal her up, lol. My fiance is in Alberta, Canada so I guess we will be routed to the Vancouver consulate for interviewing (not sure if that info matters at this point).

Ok, 1st question - Should I send in a copy of my fiance's birth certificate or passport? It didn't mention it being required but then I read somewhere it could be helpful so now I'm confused.

My fiance made the initial trip when we first met back in 2009, but does not have the boarding passes (we didn't realize back then that we would be doing this!)I have at least one boarding pass from a trip and also have online itineraries from a couple trips plus my stamped passport, will that be enough to prove we met and have an ongoing relationship?

Can I just print some photos of us off the computer or do I have to get the photos developed?

Are copies of bills from my cell phone co. showing 2,000+ (no I'm not exaggerating lol)text messages good enough proof to show ongoing relationship?

I really would appreciate any help/tips anyone out there can give, thanks!!

I'm really confused and hoping someone can shed some light on this for me. I have alot of time before NOA2 but while we are waiting I'm trying to get my ducks in a row for the next chapter. I know that I am the main sponsor for my fiance and that past tax returns need to be sent in, here's the problem - I am unemployed and have been for some time. I was a stay at home mom and my ex- husband was the wage earner for 10 years. In 2008 we seperated, went through a long ugly divorce. Divorce was made final November 2010. I have received a small spousal support settlement and continue to receive child support. I am waiting to receive my portion of the marital assets (401K and IRA division) but of course there has been a delay and I don't even know yet the exact amount I will be receiving. So, I have no income therefor have not filed taxes. All previous tax years I was on my (ex)husbands return. My question is how do I fulfill the requirement to present returns when I haven't had any income to claim? Obviously since I'm not working and only get child support, we have another sponsor. My mom makes well over the 125%, has worked in the same company for over 20 years, and is going to sponsor my fiance and also provide us with a place to live until we get on our feet. I know we will need to present her returns and that is not a problem. So, my questions are:

1. How can I give them tax returns I don't have, can I just explain that I was not earning enough to file?

2. Does anyone think I will have a problem getting approved based on my employment status, or will my moms sponsorship be all we need?

I sincerely appreciate any advice/information anyone has, ty!

Hi Everyone, I see there are alot of questions posted by others on this topic but I'm still confused so hopefully someone can help me.

Here is some background so that you can understand my particular situation. I was previously married for 13 years, the divorce was settled in August 2010 and has been final since November 2010, in between was a long court battle. During the seperation/divorce period was when I met my fiance and we have known each other for close to 3 years and been in a relationship for 2 years now. I stopped working when I had my first child over 10 years ago, and have not worked since. My ex supported me during our marriage and we filed taxes jointly up until 2009. In 2010, I did not file taxes because I did not work and had no income other then child support which is not taxable income, I was claimed as a dependent on my mothers (whom I currently live with) return. I was unable to work until this time due to caring for my children that were having many personal/medical issues. I am still unemployed and plan to return to school this fall to get a certification in order to re-enter the job force since it has been so long since I have worked. My fiance has some offers of work as soon as he gets approval to begin working and I am expecting the settlement of 401k to be distributed to me from the divorce within the next few months, we will be fine just need a few months to get on our feet. I have never been a public charge. My mother has worked at her job for 25 years and makes well over the 125% poverty limit and is going to co-sponsor us, she is prepared to help us for as long as it takes.

My questions are:

1. Do you think the Vancouver consulate will accept my mother as co-sponsor?

2. Should I send tax transcripts from my ex-husbands and my 2008, 2009 taxes?

3. Should I write and notarize a statement as to why I haven't filed taxes in 2010?

4. Will 3 years tax transcripts and a few months pay stubs from my Mother (co-sponsor) be enough? Should she write a statement as well?

5. Do we need to order tax transcripts or tax account transcripts from the IRS?

I appreciate any info and advice anyone has to offer, thanks in advance!

Hi! My fiance lives in Alberta and has his interview scheduled in Vancouver. Vancouver only does interviews at 10am. We have my fiance's medical scheduled for the same day as the interview and that is being done at Woking at 6am. We scheduled it all for same day since that would be easiest for us being that we both have to fly into Vancouver and stay at a hotel. So, if you want to do both medical and interview in the same day, it's possible. This is how the scheduling will work for us:

Wednesday October 12, 2011

- 6 am Medical @ Woking

- 10am Interview @ Consulate

- 1:30 pm Pick up medical results at Woking

- After getting medical results, return to consulate to hand in results

Hmm, for my mom's, she does have a house and street number and they bring the mail to her, so I put her full address.

For the Street I put: House # & Street, Area/District (I didn't put May Pen P.O although I could have, she gets the mail from me whether I put it or not.)
For City I put: Clarendon
For Country I put: Jamaica
For Zip Code I put: W.I.


If he doesn't have a house number and street number I would write:

Street: Newell District, Watchwell P.O. or P.A
City: Saint Elizabeth
Country: Jamaica
Zip Code: W.I.

(W.I. stands for West Indies - everybody dealing with Immigration or related issues will know that so don't worry)

Maybe other people who have had a similar address layout as your fiance will respond.

Hi,

A friend of mine (22yo pre-med) asked me this question and I cannot find an answer anywhere:

He is engaged to a US citizen who is 17 years old (with her parents' consent).

Can she (the minor US citizen) petition a K-1 visa from him? If not, can they marry abroad (with her parents' consent)and can she then file an i-130 for him (remember she's is a minor under 18)

My initial response was that this is not possible, but I want to make sure. If anyone has a better answer or a similar experience, pls let us know.... tks.

Hi All,

Just wanted to let you all know that today my fiancé has called me and she was approved for visa finally. Interview went well and tomorrow she will go back to pick up her passport with VISA in it. Ohh yeah... :yes:
It was a long journey, no questions about that, but patience has paid off. I wish all members good luck in their journey.

I am sooooooo happy and glad that this is done. She will be here within a month and can't be more happy about it… OMG…. It's a great day for us today.

I have not really looked at next step moving forward once she arrives here, but as far as I know now we have to get married, apply for social security card and adjustment of status. Am I missing anything???

Can someone please be kind enough and to point me in a right direction of steps to take once she arrives here. Sorry I am beyond happy and I can barely type and at work ... :lol:

Wow, we are in the exact same situation! August filers(VSC), Waited till March just to get RFE, Responded back right away, Got RFE receipt from VSC on March 11, and now still waiting for VSC to do something.
Yeah, i was told by many people that after you send in the required documents for RFE that you should be approved in about 2 weeks. But yet again VSC disappoints! I think that is our first problem. Yeah, it does says that we should hear something within 60 days....Monday will be 30 days...I was planning on sending them an email to see if i can get any sort of response. Also have to see how all this Government shutdown goes.
I did see another fellow August filer approval on Igor's list a couple days ago. Just hope our approval comes quickly. Otherwise i will have to plan a trip just so that we stay in the "seeing in person within the last 2 years" requirement! Wasn't planning on another trip....but i also didn't think we would be waiting over 8 months just for an NOA2 for a K1 visa.

Now I see the sense in the ex[ression "misery loves company", LOL. we are feeling a bit miserable due to the wait but its kind of consoling to know that we have not been singled out. I did speak to a Tier 2 person and she told me that its too early to call blah blah blah. She was polite though and somewhat symphathetic. Yep, I am making that trip next month, an early honeymoon of sorts. Not to abuse the popular sayings, but when you are given lemons, make some lemonade, or something to that effect. if am reading this right am afraid your going to have to wait a little bit longer then 2 weeks for your NOA2

most people get they NOA2 (from the NOA1 date) average time of about 5-6 months (slightly longer then 90 days)


We received our NOA1 on August 27th. 2010. We are in our 8th month. It's beginning to feel like we are waiting for a baby as we approach the 9th month. The RFE was answered and USCIS received it on March 11th.

Hello everyone. We received an RFE, they needed my certified divorce decree. I answered and received an acknowledgement of receipt email from USCIS on March 11th. I understnad that their time frame allows for up to 60 days but most people get a NOA2 within two weeks. For us its been almost a month. Any one in our similar situation? BTW, we are Vermont filers. Congrats!! It goes to NVC...gets assigned a case number and then forwarded onto the embassy. They send it DHL to the embassy and may send it electronically also. You can call the NVC in a few days and see if they have it in the system...our was only there for a fews days. Good Luck!

They will ask you these questions for sure in the interview or as a minimum you have to be prepared to answer them. You need to have prove that she is not a widowed and that her son's father did not marry her. Get something certified from El Registro Civil before you go so you can show it was an honest mistake. They will go ahead with the application act calm and take as much documentation with you as you can do not take anything lightly. Here are the three things that can happen. 1 you get approved the visa, 2. your appliacation is put under review (this could take a couple of months) 3. You are denied and have to file again.

You will probably just get an RFE. If you listed your fiance as widowed you would have needed to include a death certificate and you did not. So you will have to explain that you were mistaken. That is all I can think of.

In the rush of sending all the required documentation for my I29F, I made a couple of errors i.e. selected widow for my fiancee (she's never married but her son's father died a few years ago), wrote her son's DOB wrong (just the year) and wrote his name the way she calls him (Andy instead of Andrew). Will these be red flags for the interview? Any one with similar experiences? I appreciate any input from the forum.

Dear VJ community, I'm happy to report that a process that started back in August of last year has finally yeilded a positive outcome. My soon to be wife was interviewed today and was a pproved for a visa. We are so happy and I am so thankful to VJ posters who always responded to my inquiries in a very precise manner. Thanks to all of you and I hope and advise to those who are beginning this process, to have patience and perseverance. Long distance relationships are a rocky road to travel but in the end its all good. BTW, her interview was in Guayaquil, Ecuador and despite the fact that I was not there, whe was approved. Absolutely,
ALL signatures need to be original. Best bet is to use BLUE ink so that USCIS does not mistakenly think documents signed with black ink are photocopies.

Certain documents that are included in the I-129F petition package can be copies (passport pages, birth certificate, etc), but signatures can not be duplicated for the I-129F, 325A, letter of intent or cover letter.

i'm baffled by the amount of time it's actually taking just to receive the interview date (Dominican Republic). After the consulate received my application, i called up the 1-800 number to find out the status, not only did they charged me $7 US dollars for this 3 minute call, but they are not able to narrow down or give you a ball park date as to around when you'll be receiving the interview date. My Fiancée has received absolutely NOTHING from the consulate (no forms, no package, or no letter informing they received the application).

is there a way to approximate the amount of days it'll take to receive the interview date?
Should i accompany my fiancee to the interview?

I mean this with the best intentions. Getting engaged/married/filing for a visa is expensive. Starting a life together costs money! Even if he was there with you already.

If you are not in a financial place in your life to visit (I'm guessing that would be around $2000-$3000) - How do you expect to pay all of the costs associated with such a huge life change? If you can't afford to visit, how will you afford to support him? If you parents are helping why don't they pay for a visit?

My bf and I have been dating for 4.5 years long distance. I haven't even filed for a K1 yet because I know that I want to be very comfortable financially so that when I get there we can buy a house, I can chill our until I'm authorized to work. We save save save and spend money to visit back and forth.

I know you want to be together, but I don't think its worth spending $400+ dollars to file a petition that will probably get denied.

Just go there, meet him, take some pictures, keep your boarding pass for verification.

OR

Get married in Pakistan and then file for a K3 visa instead. Then you are already married.

I believe that there are restrictions with the J1 visa, once it expires you cannot apply for another visa in the US for 2 years. I think there are waivers you can complete to get around it - but that seems too risky to me.

I would do and plan to do the K1 visa myself.

Can i get a TN Visa? I made the mistake of working for my father for 12 years at our family run restaurant, he had promised me a part of the business at some point. I did go to school here in alberta For the Professional Golf Management Program, but decided to get back into the restaurant business. Once i told him i was getting a divorce, he pulled it all off the table, and thus i quit my job. I am now working in the insurance business here in Canada. I am a certified licensed insuranc broker, but no insurance business in the USA will hire me until i get my permanent residence status in USA. My divorce will be finalized in may. Do people in the Food and Beverage Industry qualify for a TN Visa? I plan on marrying my new girl down in the states, can i apply for a K1 visa while on my TN visa? Any help would be appreciated.


No the TN Visa is only given to certain highly skilled workers (there is a list if you search) for example like Doctors, Nurses, etc. Retaurant Management or Insurance is not included I'm pretty sure.
