Does she have any proof of payment for the airplane tickets? Also copies of the stamps in her passport.

I am Moroccan and I have an interview for a fiance visa the 13/october/2010 at the U.S. Embassy in Casablanca, at 08:00 am, I wanted to know if there s someone who has already spend maintenance in the embassy at Casablanca for a fiance visa how it goes? and what kind of issue as proof I should take with me, I would say that my fiancee did come to meet me three times in Morocco but we have just the last plane ticket that she bought (that is normal to lose the first proof of purchase plane tickets cuz we did never think that we will apply for a fiance visa one day to save them she bought those tickets to come to see me not to make a proof)

You should be well prepared. You will need to know everything about your fiancee, EVERYTHING! Bring emails, chats, phone call logs, letters from family, any receipts from her 3 trips, photo's .....you don't want to overdue it but enough to show you both have met and communicate often. Also you will need copies of her last years income tax and possibly 2008 and 2007. If she does not make enough income then you will need to show proof of having a joint sponsor. It's a tough consulate but just answer the questions short and sweet. Show confidence. K1 was denied in Casablanca Morocco today. I have been to Morocco 2 times in the last 6 months. My fiance brought all the necessary evidence but was still denied. We are thinking he was denied today because he applied for a visitor visa about 2 years ago and was denied. PLEASE PLEASE PLEASE if anyone can guide us on what to do now......we feel helpless and don't know where to start!!!!

Your case will remain at Casa for at least a month(they always say they sent it back sooner). Try contacting the Consul General by phone, fax them letters from friends and family, contact your Senators/Congressman to stop this case from being returned.

The total comes to $1,010 ($930 plus a biometrics fee of $80)and should be filed before the 90 days expire.

That's the fee before November 23rd. The AOS has no time frame to be filed however it's recommended to file ASAP. The marriage must take place within the 90 days of entry.

I believe as of November 23rd the new fee for the fiance visa goes down to $340 however the AOS fee goes up to $1090( I think). You will also have to add in expenses for travel to the US and if you will need any vaccinations in the US for the AOS. The marriage fees, cost of living.... You can't work until after you get married and file for AOS and receive a EAD/GC allowing you to work. You're looking at a few grand. :yes:

Can someone please explain how there was no one to sign for my package? I sent it to USCIS P.O box 660151 Dallas TX.
When I tracked it this morning it said (We attempted to deliver your item at 9:26 am on November 03, 2010 in DALLAS, TX 75222 and a notice was left)
How Could there be no one there to sign?????

Your package is addressed to a PO BOX. A USCIS employee will pick it up soon.

I never got a NOID or notice of expiration. I did refile a k1 3 years later but that was because my husband (fiance then) went back to school. We thought we would have heard back from USCIS during that time but NOTHING. When we refiled the 1st petition was addressed with what knowledge we had from the 1st interview. They had no grounds for denial the 2nd time around and he is now with me in the USA :)

Your lawyer should have addressed the possible issues of the 1st case. Even though the case was closed they still have the notes from the 1st case. As suggested, you should write a rebuttal letter.

My FIANCÉ HAD HIS INTERVIEW ON 10/26/2010 AND WAS DENIED THE VISA. ACCORDING TO THE LETTER THAT THEY GAVE HIM HE WAS DENIED UNDER SECTION 221g. FROM WHAT MY FIANCÉ SAID HE BELIEVED THAT WE WERE DENIED BECAUSE THE OFFICER DIDN'T BELIEVE WE HAVE A BONA FIDE RELATIONSHIP. HE HAD ALL THE REQUIRED DOCUMENTS AND EVIDENCE SUCH AS EMAILS, CALL LOGS, MSN, CHAT AND PHOTOS. TODAY I EMAILED THE EMBASSY REQUESTING THAT THAT THE CHIEF IMMIGRATION OFFICER REVIEW THE APPLICATION. THIS IS VERY FRUSTRATING ..... IF ANYONE HAS ANY ADVICE ID APPRECIATE IT.

You do not have to wait until you return to file the petition. Sponsorship issues are dealt with after the petition is approved months from now. Yes, permanent residents can act as joint sponsors but I would avoid using the foreigner's family members if possible. Using those family members in the USA to sponsor adds to the suspicion of a fraudulent relationship and you're already dealing with one of the more difficult Consulates. A job of your own, or using your own family as sponsors if needed would be a better choice.



As pushbrk mentioned the above +1. The CO could see this as a red flag.

Since your k1 is closed now(which is actually better since you got married) you can now file the CR1. You will have to load your new petition with more evidence of your relationship. If you know the possible reasons why they canceled your visa then you need to address that with the new petition as well. There is something that did not convince the officer of your relationship.

You have to wait until it returns to USCIS. They will possible review it and request more evidence from you and if they approve they will send it back to the consulate. They can close it which then you can immediately refile. They can let it expire.

Usually NOA1 comes within 30 days of them receiving your package. This will have your receipt number. If your fiancee signed up for email/text alerts then they will send her a alert .Good luck on the wait for NOA2, 6 months is the average now :whistle:

Just noticed you mentioned "wife" in your other post and "fiancee" here----you should not mention "wife" at your interview!

We never knew the "actual reasons" but we had "red flags" that most likely made the CO return our case. We addressed the possible issues with the 2nd petition. With the 2nd time around the CO could not deny us on the same issues as the 1st petition. Our "red flags" were most likely our age difference and religion.

HELP!

I just received a notice from the USCIS today that my 129F case was sent back to them from the State Department, and they were asked to review it. Does anyone have any clue what this might mean? My fiance went through the Consulate interview in Mumbai back in December 2009 and was issued a 221(g). They told my fiance we were trying to be fraudlent in trying for a visa for him, when we weren't. I wrote a few letters, involved two Congressmen's offices, and no luck. I had pretty much given up on it. Then....this.

Is there still hope?


That's normal procedure when a 221g is given. USCIS could review it and request more evidence from you, re-approve it or deny it, close it or just let it expire. It happened to us the first time around and USCIS never reviewed it, we ended up filing a 2nd k1 and getting approved. You can refile a k1, get married and file a cr1 or just wait it out and see if they review your first case.

Thank you for all the advice I got on my previous posts regarding the "abnormal" RFE we recieved on our case. I have obtained all of the information they requested and am also resubmitting much of what I previously sent. The one thing I am still unclear of is this. I know "normally" they do not ask for all of this information, but, that hasn't answered my question of do I send the information from my most recent trip in February, which was approximately 2 months after I had filed the intial application? I want to know if I should gather my airline receipts, credit card statement, bank statements etc. and attach these along with everything else even though the trip was taken after the initial filing. Please advise, thank you!

Not being negative but here's my 2 cents....get to know your SO really good before even applying. I see that you're meeting in India but is it possible to meet in his home country and meet family? Perhaps make a 2nd trip before even filing? Can you marry rather then file for a fiance visa? If you do file after the 1st trip that could raise a red flag. Also is there a large age gap between you and him? I've been down this road myself.

i have emailed my senator twice with no response. not going to get help from them until i get home and can call them. i have always heard that if you are denied for a k1 visa there is no point in getting married and filing for marriage visa as getting married proves nothing.


FALSE Many cases have been approved 2nd time around(either k1 or CR1)

First your case was not "denied". The consulate sends it back to USCIS for recommendation, USCIS makes the decision. Should USCIS close your case you will have the opportunity to refile.

Sorry that this happened to you. No lawyer can help you at this point, they can only take your money. Once your case returns to USCIS they will review it. It's possible they could send you a NOID or close it and you could refile a k1 or marry and file a cr1 or re-approve it and send it back to Algeria. If you could contact your Senator/Congressman right now perhaps they could get it turned around. Do you have any letters from family and friends acknowledging your relationship? They are definitely not convinced right now.

I've got bank statements showing the purchase of my tickets for the past 2 years traveling ....I have the itineraries, photos, webcam print screens, facebook print screens, conversation histories sprint screens showing the amount of conversation history i have witth him compared to anyone else, I've got google voice call print screens,and regular conversation print screens.

The above items proof really nothing. You need passport stamps, boarding passes and pictures of you together. If you have bank statements proving transactions at the place you visited together, better. The rest proves the opposite: that you have been in opposite places and you;ve established communication. That is only to be used for the interview at the embassy. It doesn't hurt to send it, but is NOT proof you've personally met within the last 2 years. Remember, travel itineraries do not prove you got on an airplane. Purchase of tickets do not even prove the tickets were for you. I have purchased tickets for my parents, for example. Luggage tags, boarding passes, passport stamps and bank statements proving ATM transactions at the city and country are the BEST proof you can send.

I'm not sure you do have enough evidence of meeting.

These items: "webcam print screens, facebook print screens, conversation histories sprint screens" are evidence of an ongoing relationship, not of meeting. These items: "bank statements, itineraries, photos" are all secondary evidence of your meetings, but you have no primary evidence.

Primary evidence of meeting would be: passport stamps, actual boarding passes of the flights, hotel receipts, etc. The flight itineraries and bank statements only prove you bought the ticket, not that you got on the plane. That's why they like to see boarding passes, they are only issued after you check in. With photos, its hard to prove when they were taken, so they don't generally take these as primary evidence of meeting, they like to see more concrete evidence.

Why don't you have passport stamps?

not harsh at all, my passport has stamps of all trips there :) i thnk thats the concrete evidence that will drive the secondary evidence to get an approved ! :) thankss I sent it out yesterday i was so nervous all of yesterday. and even got a headache....this is a big step!!!!!!!!!!
