K-1 Fiance(e) Visa Process & ProceduresGetting Ready for the Next Step

So we have sent off the packet, all seems to be going well, received NA01. I hate waiting until the last minute, so a few questions if you would be so kind as to help. What am I going to need for the Affidavit of Support? Here's why I ask...I worked in a hospital the last 4 years, March of this year I left to go on a Missionary Assignment with a friend.. that's how i found her...how we found each other..I didnt start back working until 2 weeks ago, Im an independent occupancy inspector, haven't even received my first paycheck yet... my prime question is...ii guess.. how do I prove to them I can support her?

You need to have filed out the form I-134 which is the Affidavit of support, have teh past 3 years tax transcript, which can be requested by many ways, see link: http://www.irs.gov/i...=110571,00.html

letter from you employer/ paystubs last 3 pay periods would work(feel free to get as many as you feel comfortable with)

if you need a co-sponsor he or she has to prove basically the same info I-134, proof of income n employment as listed above (this is needed when you didnt meet the poverty guidelines) see link : http://www.uscis.gov...form/i-864p.pdf

Good luck, and feel free to read previous threads! you've got nothing but time from here....

Hope you hear something in record time about your approval!

Hello all,

Does anyone know if NVC issue a case number once it receives an approved petition?

We were approved last week and are waiting for our case to be sent to the London Embassy, however before I can schedule my medical I need an LDN number. Does this get issued by NVC or the Embassy?

yes they do assign a case number upon receipt....ijust so happen to call them today to inquire about my mother's case that is completed and asked about my fiance's, i provided the receipt number and the confirmed that they got the case yesterday and I simply asked for the case number....

K-1 Fiance(e) Visa Process & ProceduresK-1 Step after NOA2
Heya,

just something to start yuh off . http://www.visajourn...ontent/examples and http://www.visajourn.../content/k1flow

after a few months, varies (3-8) you'll get ur noa2...normally wihtin 3-5 months

after you got ur noa2 which is ur approval your case is fwd'd to NVC for a few days then send to the consulate in Canada where they then send your fiance packe 3, they send back the documents required in that packet ( ds 156, ds 230 etc...) you should read the Canadian portal and the canadian embassy http://canada.usembassy.gov/

also the interview you still need to your initial packet to prove your relationship to the consulate in Canada along with affidavit of support and supporting docs....

Just some starters.... read along on the sight and you'll be just find!

Good luck

Ro - Thank you - I will go pay them a visit.

K-1 Fiance(e) Visa Process & ProceduresService Request and Catch-22

I called the USCIS on 12/8 (6 months after my NOA1 date) to file a Service Request.

Received my response on my Service Request today:

The response tells me nothing.

My next step was to ask my Congressman to get involved but the Congressman will not get involved except under the following circumstances:

Following those instructions, I went to Infopass to schedule an appointment but they only make appointments based on the following 4 reasons:

None of those reasons apply to me. I did file a Service Request and basically was told Zilch, however, since I did receive a reply I do not qualify to make an appointment via Infopass. So what is my next step beside just waiting? The local USCIS office is 20 minutes away so I plan on camping on their doorstep one day this week but not sure if that will

Any other thoughts on fighting through the Red Tape?

:wow: , we filed the same day

ummm about the congressional inquiry, i just went into my local office and signed an affidavit/permission form for the "community liaison" to be able to look into the case. She said that she had to do it exactly 1 month after the 5 month processing time and she did.....the next day I got an approval...Im not sure about how u went about doing that congressional inquiry but....how about you try again by just calling the office and find out their office hrs and go in there and do the same as i dod and give it another shot. some this has worked for, some it hasnt. I saw a case where someone got an approval the very evening that the inquiry was made from the congressional office

The community Liaison said as she was speaking to the lady from Vermont she pulled my file....

other to that....seems like waiting is it :/

GOOD LUCK!

K-1 Fiance(e) Visa Process & ProceduresAdvice/Options waiting on NOA2

We did it but got nothing. Congressman got the same answer from USCIS as everybody hears by the phone, and he couldn't help us at all, just told that if we will not hear answer from USCIS in 45 days (we already close to 6 months mark since filing!), we can try to contact him again. [Victor from Russia]

Awh ghee...Hang in there. but just to note to you all. Im not sure but the Friend of mines that I knew from college that was my community liaison at the congressman's office said she had to wait exactly 1 motnh after the 5 months mark...I had signed the form giving them permission as my timeline states then I called two days after and asked when she'd call...she said Thurs which was 1 month later. I didnt question it at the time but the Wednesday i called and asked why cant she do it now...and thts what she said. she has to wait exactly at 1 month *shugg shoulder* idk but ya....

Good luck to everyone.

Ro

i would wait until the holiday season is over, im sure they are all lazy and don't want to do anything right now hopefully something will come after the new years stay positive :)

K-1 Fiance(e) Visa Process & ProceduresAdvice/Options waiting on NOA2

The 5 months mark is a dead horse, they are not working under that guideline now, 16 June is the number handed out, everything you suggested, including the Congressman, will run into the 16 June "wall". The 5 month mark no longer applies to CSC at the moment.

none of that will work because CSC are working on june 16th petitions and not 5 month any more. a congressman will be told the exact same thing.

all the OP can do is call back every so often and as soon as they told that CSC is back on 5 months then they can put in a service request

Whoops, wasnt aware that CSC was not at normal processing time but :bonk: gracias....so OP, best you can do in my opinion to hang in there and check when they are back at the 5 months mark and try the congressional inquiry, Doesnt hurt to try hey..... thats just me. worked for me so I'm happy to encourage ya. I wouldnt do the "service request" I havent seen it to be rewarding much in reading prev post and it takes longer.

Ro

Thank you for all of the responses so far. I was afraid that was the case that waiting was my best option. But, it never hurts to ask :)

@Ro, thanks for the tips. I contacted my congressman's office today. Figured it doesn't hurt to get the ball rolling on that front to get them involved as soon as it is possible and/or feasible.

I understand there are people waiting longer than me. I am not asking for special treatment. But, I also think adding my voice to those that are waiting and not satisfied with the current system might help push it towards change at some point. The USCIS could make some changes that would make our life and their life easier. (yes, it would require money up front but would save them MORE in the long run and bring their processes into the 21st century ;) heh)

try sending CSC a nice christmas present :)

Not a bad idea....lol :)

K-1 Fiance(e) Visa Process & ProceduresAdvice/Options waiting on NOA2

Hello all,

I am hoping someone more knowledgeable than myself can give me some advice or options on how to proceed given the following situation.

My I-129F application hit the 5 month mark today since the NOA1. I called the USCIS nationwide line at 1-800-375-5283 and proceeded through the system until I reached a customer service representative.
She was pleasant with me and answered my questions to the best of her knowledge. She was starting the process to open a service request for me when she came back and told me the following:

CSC is backlogged and is only processing applications for June 16. So, she told me she can't open a service request given that information. I asked her if CSC is reporting that they are processing application from June 16, why are there applications submitted in late July (15th-22nd) that are being approved. She couldn't/wouldn't answer that question and offered to transfer me to secondary customer support.

I was transferred to Officer Lopez. She was also pleasant but unhelpful. She re-iterated the processing time of June 16th and that she couldn't open a service request because of that. When I asked her why applications from right around my NOA1 time are getting approved, she responded that some officers work faster than others and my application must be in a stack of someone who is behind/slow/something else. Since I don't know enough of the inner workings of the CSC, I have no way to refute this claim.

So, my hope is that someone on Visa Journey can give me some helpful advice or options. Or even just a sympathetic ear. I am really hoping there are some more options to pursue to get our application approved. Please help VJ'ers!

Thank you for taking the time to read! :) And MANY thanks for any advice or help! :)

Cliff notes:
CSC - I-129F - NOA1 on July 20th - 5 month mark today
USCIS customer service says CSC only at June 16th for processing so won't open a service request
VJ'ers reporting approvals from NOA1's around my application (July 18 to July 21)
secondary support says that our application is just unlucky and stuck on a slow officer's desk

Options? Advice? Is that really the way it works at the processing centers?

Do a service request (reason being after 5 months y calling the uscis) DIDNT WORK FOR ME, GOT THE SAME INFO I KNOW, "PENDING"

Do an infopass (dont kno how that works lol i didnt do that ) some ppl saw results

DO A CONGRESSMAN'S INQUIRY! Find your local congressman's office and call n visit to give them permission to inquire on your behalf; worked for many VJ'ers saw an approval same or next day. they person at my office said if i didnt hear back anything within 5 days. she'd call again but it wasnt needed (check out my timeline)

write them an email saying its over the 5 months mark, CSC.NCSCFollowup@uscis.dhs.gov. Be sure to provide all info, about ur case, i.e case receipt no. names DOBs etc (just got a reply today from a lady, "Linda" saying it was approved. emails them on Dec 7th and the inquiry with the congressman was made the 8th so her email was sooo late but at least we see they do check emails and get back to us)

Last option is to sit and wait my pet (but we aggressive ppl cant ever do that haha)

best of luck

K-1 Fiance(e) Visa Process & ProceduresMedical exam costs. :(

I don't think I'm being harsh. The costs only go up from the medical. Visa - $350, Plane ticket - $500+, Moving Expenses - $???, AOS - $1200, US health insurance($$$), not to mention unexpected costs. If neither of them have any income these costs will be impossible. I'm not about to tell someone it's going to be fine just because it's nice. She said they don't have the payment for the medical - he won't be able to get it done if that's the case.

My fiance and I both work, have a few thousand dollars saved up, and I'm still reconsidering moving there simply due to the high cost of living, immigration, and moving. I'm sorry it's not fun to hear, but it's also the truth (for one thing) and in your best interest to consider these things.

plz see my reply in its entirety ....I know how it is out there just as much as you do dukeandduchess, u're being real with the OP i stated that...thats great. But i just believe sometimes ITS NOT WHAT YOU SAY ITS HOW U SAY IT. I totally agree with you but could have said it in a better way....

OP, all the best with your employment and hope your fiance gets a job in record time....and yes plz sit and evaluate the pocket cost that you'll have to endure....

Be blessed,

K-1 Fiance(e) Visa Process & ProceduresMedical exam costs. :(

So my fiance is set to have his medical interview in the UK tomorrow. He'd read that it would cost 200 pounds. We were nervous enough about that, because neither of us are really financially independent right now. He's been on unemployment looking avidly for a temp job and I've just lost my job because the flower shop I work in is going out of business. Lovely global economy we're living in.

He's had shots and vaccinations from school, but apparently those don't count or something unless you got them done in a doctor's office? So he'll probably have to be vaccinated again.

So not only is the exam 210 pounds, but there are all these vaccinations (I'm not sure he has to get them all):

http://www.visamedic...fo/us-price.asp

We do not have the money from this. We don't have anyone right now that can [i]help[i] us with the money for this. His medical is tomorrow. He's just going to go and talk to them about it and see what happens.

Is this information accurate? How the hell is it so expensive? I'm really kicking myself over not finding out about this sooner, when I could have helped him with the money. This is the first time during this whole process where I've been so frustrated. :(
I'd just like some confirmation from someone who's had this done so I know I'm not having a panic attack over nothing.

He doesnt necessarily have to get all, i just completed my mother's visa and i had her go to a free clinic to get some of the vaccines. not that i cant afford it but who really in here doesnt like the word FREE!....she just had to pay for the doctor's service and Xray which wasnt alot :)

Im not sure how it works in London, but it was pretty clear cut to find a free clinic, and vaccines depends on the age for my country at least....if u can rescheduke ur medical i should do so i get a free clinic asap....my finace (in 20's)I know will need:

1. Mumps
2. Measles
3. Rubella
4. Diphtheria
5. Varicella

it will cut the cost for ya...all the best,

Ro

I don't want to make you any more distressed than you already are, but if you can't afford the medical/vaccinations you are going to have a hell of a time supporting him when he comes to the US. I doubt they will do the medical without payment.

They do look at your financial stuff at the interview. I hope you have a co-sponsor lined up. The job market is tough as hell, my fiance is trying to get a second job but there's something like 12% unemployment in California right now so I may not even move.

dukeandduchess, no need to be harsh with the OP.... OP even thou dukeandduchess is being is harsh i have to say that they are only being realistic here...hope u have everything else set as mentioned and are able to support ur fiance with basic necessities

best wishes,
Ro

K-1 Fiance(e) Visa Process & Proceduresnoa2 to nvc

The NOA2 date was on dec. 15th and I called the nvc customer hotline to check the status but still says that theres no record of it. According to the timeline, they are processing dec. 17th. its been like almost 2 weeks. has anyone waiting this long before?

Nvc is a long road to travel for some. I received noa2 on October 25, case reached nvc on Oct 31, and i am still waiting for case complete, almost 2 months later. I won't say be patient because I haaaaaaaaaated for someone to say it to me. I will say I waited almost 3 weeks just to even get any emails to pay fees or choice of agent. Calling them will only frustrate you more. Just expect that with the holidays, that they are moving a tad slower than normal processing times indicate.

My NOA-2 was dated Dec. 16. My husband, the petitioner called NVC and spoke to a rep and was advised to call after 2 weeks or wait for 15 days more for the case number. As of yet, they still haven't received our case nor they have assigned a NVC case number. They further told my husband to expect a little delay these days due to the holidays. But I still insist to my husband to call NVC every single day until such time that we receive our case number.

Hey all, I think we need to take into account that we are talking about 2 different petitions being filed...

The OP is doing a K1 visa which typically is transferred faster to the NVC and moves along to the consulate faster than it would with a I-130 petition

But OP, just be in contact with the USCIS and of course the NVC and check up with them as to if they've received ur case

bottom line is there is no "normal timing" fo any center to be thru with ur case....but u should always take it upon urself to check out if something seems abnormal to you

Best of luck

K-1 Fiance(e) Visa Process & ProceduresCost of this process

I'm trying to gather all the costs of this whole party...Am I missing something?

1. I-129f petitition, $340
2. Medical exam, not exactely sure, but have seen somebody write $600. (Anybody know the fee for the medical in Norway?)
3. Immunization, don't know
4. Interview/visa, how I read it I will have to pay about $400 dollars for the visa at the embassy.(Probably something for the child too..)
5. AOS for me, $1070
6. AOS for child, $635
7. Employment Authorization,$ 380
Total: 3425+immunization
And to add things up, the American Embassy in Oslo doesn't handle immigration visas anymore so we will have to travel to Stockholm, Sweden (transportation and hotel) for the interview....

So, I hope I'm not missing something:)I just don't want to be facing costs we didn't think about.

"Amount Month 1 *Dept. of Homeland Security, USCIS - Petition Filing Fee $340.00 Month 3-6 Dept. of State Visa Application Fee (paid abroad) $350.00 Month 6-12 Dept. of Homeland Security, USCIS - Adjust Status Fee $1,070.00 Month 27-32 Homeland Security, USCIS - Removal of Conditions Fee $590.00

K-1 Fiance(e) Visa Process & Proceduresunexpected change in child custody after K-1 Visa was approved - now what?
My fiancee was approved for his K-1 visa from the Vancouver consulate in Oct. He is planning on entering the US April 1, 2012 (expiration on visa is April 12). On the paperwork we filed for the visa we listed his 2 children. During the interview we were asked if the children would be following him and we told them that neither one would. The person who collected our paperwork had my fiancee quickly write something up saying that the children would not be following. We were approved and have been preparing for his move to the US. Just yesterday my fiance was surprised by his youngest childs (child is 8) mother stating that she could no longer handle the child was having personal issues and she was going to sign over full custody to my fiance. We were shocked but of course we will gladly raise the child. The problem is what do we do now? How do we get him a visa? We are not sure if the child would be coming in April or finishing the school year out and coming in July. Would it be better if my fiance enters the country first and then we pursue bringing the child over or is there something we can do to have him added on now? We would appreciate any advice/help anyone has, thanks!

K-1 Fiance(e) Visa Process & ProceduresFiring my attorney, where do I go from here?
Do you have a contract with your attorney? If so, are there terms and conditions for letting them go? Do you have to give them a certain amount of notice or are you still required to pay them? That's important information. I'm guessing that as lawyers, they have protected themselves, so you may have to finish what you started with them. You can however, do the Adjustment of Status portion on your own now though. And, if you can't fire them, then DEMAND better service! They should be having meetings and phone conversations with you. Email communication is not sufficient for explaining complicated processes like these if you arae paying them good money.

Second, yes you will be required to fill out the I-134 at your interview, and also show that you make 125% over the poverty level for your household (i know you have kids, so check what the required amount is for 5 people). You could still potentially need a sponsor, so ensure that you have someone lined up. You will need to show your tax returns (and any sponsors tax returns) and also pay stubs or proof of income. Also, for AOS, you will still need the I-864, so you're not home free with that form. Ensure that you will be able to fulfill the requirements of that form in the future when you get to that stage.

I agree with the poster who says you should file a claim with the bar association. I'd wait until after they're out of your life though.

Don't worry too much about being denied. Your fiance is from Canada, so not a high fraud country, and they know that Canadians are able to travel back and forth pretty easily, so your evidence is likely fine. I would ensure that your financial stuff is covered off on though, because that will cause a delay if you don't fulfill their requirements. His ability to work and his income unfortunately means nothing to them.

K-1 Fiance(e) Visa Process & Proceduresnon-legal religious wedding before K1 visa

Catholic priests cannot perform a non legal marriage ceremony. Code of canon law does not permit this.

Not true. We had a non-legal catholic wedding ceremony. It was however, AFTER our legal courthouse wedding. Our priest was understanding of our situation.

I agree with everyone else though, plan to have a religious ceremony AFTER you finish the K1 process. It's not worth the risk of them misinterpreting the wedding before getting your visa.

If you haven't started the process or if a wedding is going to be a big sticking point, then you should file for a CR1 or K3 after the wedding.

me and my fiancee had 2 broken hearts today , after all evidance we show them at the interview and the real relation we have and every thing the cousler said i approve you and wellcome to america you will get your visa in 2 weeks , so me and my fiancee get so happy ( it was since 1 mounth ) , even we call the embassy 4 times they say every thing is ok and its already approve and it will be with you soon , even since 5 days my fiancee call the embassy in cairo a lady answer her she say its already approved and she said she see the visa in my passport and it will be with me after 3 days , and it was right the dhl call me to go get my passport ,

and it was the shocked : we find the visa already stamp to the passport but over the visa a stamp said ( cancled without prejudice ) we feel like some body shot us really , even it had a letter said the embassy not beleave our case so it sent back to state ,

why they do this to us , and what the stamp for i know it mean cancled but what that stamp suppose to mean ??????
and why they send it back to state after the consler said we approved ?????
we here dont know what to do ????
some body help
and how much hope we had if they issue another visa in state after they send our file ???
did we need a lawyer ???
any body hear about it before ????
we are in a bad mode and need any help and pray for us please ,
any help will be appreciated

First I would call/email the Consulate and ask them what happened. If they don't give you any answers why then contact your local Congressman/Senator to make an inquiry. Did they put you in AP at all? Perhaps a name hit came up? Just a thought.

K-1 Fiance(e) Visa Process & Proceduresmy case sent back to usa

they send to me a letter said we dont belive your relation , and my passport have the visa in it and its had over it a stamp say cancled ????

i dont know why they do that , any way what the next step after it go back to state ????
what will happened and what the usa will do to it , is they can accept or what ?
if we need to marry each other how we can do that , and is there was a certain time after the i-129 refused by the embassy , or we can marry now

any help will be appreciated

It will go back to the USA. The service center can let it expire or send you a NOID where you can then write up a rebuttal. They can also send the case to the fraud unit. You might not want to marry so fast, you need to find out why they suddenly canceled your visa. Address all your red flags. According to your profile they made a home visit to your fiancee in the USA, that is not common. Usually it takes 1 to 3 months for a case to return.

K-1 Fiance(e) Visa Process & ProceduresIs this normal, or should I call?

When I look at my time line data information, listed below is what is written on my page. I clicked on the link they posted below and it does look as if I should have known something by now. According to the line chart, I should have been processed roughly 50+ days or so. Well, IDK I figured since I got my NOA1 on July 28th, I felt it's to soon to receive the NOA2. So should I call as they request below or just wait it out?

Based on timeline data, your I129f may be adjudicated between July 4, 2010 and July 7, 2010*.

If this date range has passed or your application is past due per
USCIS processing timesthen you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline.

Based on your timeline you received the NOA1 on 4/28, you should hear something soon. When I filed the k1 last year it took about 90 days to get NOA2. It will happen :)

K-1 Fiance(e) Visa Process & ProceduresK1 - SSN - AOS Timing

Hi All,

My wife entered the U.S. with K1 VISA on April 4, 2010. Her i-94 was stamped valid until July 4, 2010. We applied for her social security in her maiden name in the middle of April. We received the SS card in the mail, in her maiden name, near the end of April. We got married May 1, 2010. We received our marriage certificate from NY State on May 25, 2010. On May 28, 2010 I went back to the SS office with my wife to change her name to her married name.

A few days ago we receive a note from the SS office that they can NOT issue her an SS card in her married name because her i-94 is now expired. I guess it took them forever to process her name change application and now its too close to her i-94 expiration date to issue a new SS. I went down to the SS office with her today and they said I have to go to NY City - 20 Federal Plaza to get her VISA extended, then I can get her name updated. (The SS employee there also accused her of being illegal- great).

I have been following the K1 Process Flowchart on this site throughout my whole process. Everything has gone very smoothly. I was waiting for her SS number to be established in her married name prior to submitted our AOS application.

What should I do? Can I submit the AOS forms now and all this SS nonsense will be straightened out?

Thanks for any help.

You can submit the AOS forms, you will not have any problem. Just be sure to list her married name on the AOS. Once she gets her GC you can go to SS and have the name changed.

K-1 Fiance(e) Visa Process & ProceduresPlease reply me fast...
I had requested a FOIA and then after 10 months of waiting my Senators office told me it was holding up our case to be reviewed. I never got the FOIA and any review on my first k1. From what I heard it's very rare to find out the consular's notes(at least from Morocco).

You can refile another k1 but you need to know what they denied you for....

Possible red flags:

Age difference

Religion

You having any relatives in the USA

Financial status of the USC

Time having known each other

Filing after meeting only once

Prior marriages

Any attempted visa's prior to filing the k1

Put yourself in the Consular Officer's shoes and think what made you get denied

You have to address everything

I'm wondering if I need to sign/date this or does my fiance? Is it me filling this out with his information, therefore should be me signing it? Thanks!

That's one for each of you. You sign yours, he signs his.

K-1 Fiance(e) Visa Process & ProceduresFiace Refused For Reason of "Other"
Morocco has a high rate of fraud. They don't have to give you any reason for denial. Try to figure out your red flags. Do you have a large age gap, different religion... are you muslim?, different cultural backgrounds, how long have you known each other, filing after only meeting once, meeting online, meeting her family, her language communication with you...so many possibilities. You can re-file a k1 or get married but you must address the issues of the 1st case.

K-1 Fiance(e) Visa Process & ProceduresWhat does it mean
Get all your facts together. Letters from both families. Go over the questions asked at the interview. Any possible red flags? Age difference, cultural backgrounds, any divorces, amount of time you knew him before filing, how many times you visited him, how you met, if he has any relatives in the USA, has he applied for any other visa prior to knowing you.....

Ok... THank you :0) Insha'allah it will get approved

Be prepared for a rebuttal. Morocco is a considered a high risk consulate with lots of fraud. I hope they re-approve it!

K-1 Fiance(e) Visa Process & ProceduresWhat does it mean

We were never told why we were denied.... LOL in FACT we were never told we were denied.... LOL We were only told our application needed further review..... This whole process is NUTS!!!!!!

Apparently the CO did not like something. They don't have to give you a reason. It's not a denial right now. USCIS will make the next decision.

They will review the consular findings. They could send it back to Casa or revoke it.
