I think it depends on the adjudicator that is working on your petition or other similar factors, if there was something bad about your petition most probably that u had got an RFE already, when we sent the petition I was preparing myself for a loooong wait 5 - 7 months, but im so grateful we got approved after 93 days, just think we have to prepare ourselves for a long wait, so that when it comes faster its like GREAT!!! :) hope your petition gets approved soon though, I`m sure we will see u on the top of Igor List very soon :) :star:



Yea, I'm not blind to the fact that all cases are diff. But put some pep in your step Vermont! lol Awwh ghee thnks. i hope everyone gets their approval that are "long over due" too

My received date is May 12, 2011 and I am still waiting for NOA2. I called to put in a service request for VSC and the USCIS call center told me they are behind schedule, running at more like 7 months than 5. She pointed me to the USCIS website, which I now see has been changed over the past few days. Instead of now saying "5 months" it says they are processing applications from "March 15, 2011." So, I am losing hope on getting my NOA2 any time soon.

Surprisingly the USA doesnt seem to see fiancee and spousal applicants that way. If there were lots of fraud indicators how come denials for these visa types are rare and applicants are given chances to submit documents in order to meet the requirements.

I'm glad they dont! its horrid that real couples have to be punished at times because others take advantage of the system! I'm just injecting what I've been reading from VJers and what someone said to me after i was apparently "too" optimistic for them....

Got the interview on 10/31 with NOA1 dated back to June 17th. Smooth process for us. I'm flying to her on Friday so we can attend interview together.

Thats great, really shows that every case is indeed different! Again just to know that they are working on June Filers makes me feel better. From that all i can gather is that my case is diff and not that im forgotten :)

Great that you'd be able to go that interview. I wanted to do that but because it was going onto 2 years since i last say my baby I went home for 2 weeks and im afraid I'll leave him to be his radiant self and show that "person at the little window" that our relationship is nothing but real! I really hope I can get him for Christmas! keep your fingers crossed for me.

Hey, I definitely know how you feel. I'm a June filer at CSC and this last week I have been checking my status like crazy. All I want is for my fiancé to be here. :-( It is hard to be optimistic because the VJ stats for CSC show that only about 20% of the June filers have received NOA2s. Yours should be coming soon, it seems like VSC is moving faster than CSC, they show that over 50% of June filers have received NOA2s. The best of luck to you. :thumbs:

Thats pretty awesome! also your consulate is the Philippians (I've heard that they are pretty harsh on Filipinos! and that its one of the countries that have a high fraud rate)GOOD FOR YOU! Good news keeps me going!

I think you hit the nail on the head. I know it's difficult to wait and of course we all want to be with our loved ones, but realistically you're not even outside of normal processing times yet according to your timeline. Give it a couple of weeks and then call USCIS. Perhaps you'll receive your NOA-2 by then and then on to the next step.

Yea....i guess im a bit anxious...lol (lies) im a lot anxious but im gunna hang in there....its been 5 months now which usually was normal processing time. on the site it said they are at 5.6 months now for vermont....so i guess ill wait around 2 more weeks ....adn there goes christmas with my baby :( i was so prayful for christmas with him....next year i guess

Hey VJ Fam !! Hope everyone is Good and NoA2's are flowing in for you....unfortunately my case seems to be a "special" aka one that is taking a long time to get approved.....so much time has elapse from our NOA1...

BUT 5 months is enough :angry: ....even though Vermont is said to be behind in processing time...I'm currently looking into contacting my local congressman....but in some search in previous post on VJ I saw how some people are going about this in different ways....some are going thru the "Representatives" or senator / congressman/woman themselves.....which was from outcomes work best for you? and what was your method of communication....some are talking about filling out a forrm, writing letters.....or calling? I applied in May and recieved and RFE almost exactly 5 months to the day. I responded promptly to the RFE and it has now been 5 weeks since that happened. Everyone else that filed at that time have already recieved their NOA2s and are well on their way to interview and Visa in hand.

I contacted my Congressman which resulted in absolutely NO HELP whatsoever. I called USCIS today and because in their response to having recieved my RFE they state that it can take up to 60 days for them to process my case which will put me at over 7 months processing time.

Like everyone else here, I am hoping to hear something every day....but I have this sinking feeling that they will take the entire 60 days just because they bought themself some time.

I am very upset about this whole ordeal that sometimes I can't even breathe.

Yes my congressional office called yesterday also and was told the same thing, they are working on March filings, and K1 is not a priority in regards to all the types of forms they process. They said try back again in 60-90 days, which will put me at the 6-7 month mark from the time we received the NOA1. First this is the government your dealing with, that right there speaks of itself. Then they had the excuse of telling my congressional office the reason other applications filed after ours are processed is when the people at the service center finish other types of applications they are then put on the K1,s so they must just walk by a table and grab a few with no regard for dates, yes that's right they could not even offer a legitimate reason as to why they were not processing them in order of receipt.

so you know what, I am not wasting another thought on when we will receive our noa2, cause the answer is whenever they decide to process it, plain and simple.
I bought another plane ticket to the Philippines yesterday after hearing that ####### of a story and will spend Christmas with my sweetie. I would urge everyone to begin to contact their congressional office and demand some accountability from our government, I don't know about you guys but they were sure quick to cash my check, how many services do you pay for 4-6 months in advance??? Not to mention you are already paying towards this budget in your federal taxes, just sucks!!

sorry for my rant, just so discouraging.

I was a March filer - and I received my NOA2 at the end of July.

As somebody stated before, don't put much stock in the timelines. There are probably many different reasons for the delay, such as: vacation time, sick time, some background checks take longer than others, slow workers etc...I think waiting for the NOA2 was the hardest part of this process for me. And when I was processed - CSC was going MUCH faster than VSC - it was so frustrating to see that CSC was approving petitions in 2 months!! But, it happens.

If you have waited 5 months give USCIS a call. A friend did this and she was told to call back in 30 more days. She ended up asking her congresswoman to get involved, she did, and they heard something 3 weeks later.

Good luck - I feel your pain!



Yea, def the timelines are inaccurate because of inactive members etc, and the big fact that not everyone in the US that is applying for a K1 visa is on VJ! lol


um now at the 5 months mark and considering gettin the congressman involved but I think i;ll hold off just a bit more... a much as i want this to get going. the way things are going I'll get the wedding date i really wanted April 8th (I have a little thing for biblical numbers, n the 8th of April was the only weekend 8th date) *8 in the bible means a new beginning.

On another note, any june filers heard anything recently....! All the best this week. I kno the wait is horrific :blink:

Dont know if this will help much but i know of someone that did the K1 visa for her right now husband and she use to use the Benefit food card that is offered (think its some what equivalent to food stamps)and now that her husband had a good job i believe she said his tax returns was low because of it. the money she use to get yearly from the Benefit card was taken out of his salary or something to that effect.

So from that I'd say it pretty much affect you in some way.


This was a scenario i know of, anyone feel free to add... :whistle:

I'm just confused about the packet 3 and 4. Some other says you will receive the two packets or you will just receive packet 4. what documents should you send back to the embassy by mail? Is it true? I'm really confused about this.

Package 3 &4 varies a bit for various countries as far as I know....


the usually consist of the forms ds-2001 and ds-230 part 1 & 2 and the applicant info sheet....!! and this us sent back to the consulate as instructed in the beneficiary's country :)

Wasnt much help. I'm mad. simple..Pending? I know that, give me something more! grrrrrr Anyone has any idea if contacting the congressman/ representative would be any good on this? This case is well over normal processing time. My anxiety level is thru the roof and I had surgery earlier in the year and the two really arent good together. And now with this I've developed simular chest pains that led to me having surgery int he first place. I really cant handle this. Please help! :(

I've started a letter to the congressman. Will further look thru previous posts also for guidlines...

Boy I hear you loud and clear. We are now at 7 1/2 months. My fiance is going to the Hertford office on Tuesday for an infopass appointment. We got nowhere with the service request or congressional inquiry. In fact they told Glenn (USC / fiance) that with the service request they buy themselves 90 days to LOOK into the matter.
We even went over every piece of information we sent and there is NOTHING to give a delay (other than the RFE for a divorce certificate. The RFE was issued after 5 months of waiting.

I know patience.. well screw patience now, we want action.

Hey guys, how are ya!?

Hope everyone is fine....getting somewhere in the "long" process. NOA2's, interview approvals ....something!

Anywhooo I'm a really assertive person and its been 6 months since I filled and just couldn't sit around and wait "patiently" so recently I've just been accessing different medians of getting what we all wanter wanted at one point, a gosh darn NOA2!!

I had a service request done about 2 weeks back, that was no help. then wrote a letter to the online site to my local representative, no reply (at least not fast as I'd like, but i know that would be the fastest way so i went my little butt over to the local office to filled out authorization forms to have that office's liaison be able to access my case etc. (to my surprise it was an old college classmate that was the community liaison. YAY.) she said she'll contact place directly that would be able to help me on monday.....

has anyone every done this? has it helped your process?

Has anyone ever sent an email to vsc.ncscfollowup@dhs.gov or csc.ncscfollowup@dhs.gov and gotten their case actually expedited?????

Im all over the place just want to get every route going and working best for me not against me....the community liaison at the local congressional's office will be making an expedite request on thurs, but I look at every day as a lost that can be used towards getting something possibly done up another route....

Well as a few of you know our case seems to be stalled. You can see our timeline. This morning my fiance drove up to Hartford for a 7:30 appointment. What happened was:
Asked for appointment confirmation
Fiance explained the reason he was there
The customer representative said yes indeed ours was outside of processing time
They would be sending an email to the supervisor to check into our case and they would send us an email reply.
It is at the supervisors discretion as to when they approve/deny our case.
if we get the slow person, well we got unlucky. But that each adjudicator has a designated work load to get through in a certain amount of time.

So in summary..... no further ahead in information after the appointment than before.

Good luck to everyone and I think by the time we are approved there won't be any names I know on VJ...sigh..
had myself a little cry and then got on with my day. I broke out with shingles on the weekend, brought on by stress... WHO ME?????? STRESS......... nah how could that be?..

Oh man really now guys, get back to helping gout the OP. We've all read up on this process before and knew its not as easy as it seems (sign papers, bring fiance to US get married, have babies...oh how much I wish that it worked that way *hehe*) But the OP was simply not educated of the process, while being happily in love. Yes the OP should have done some reading on this subject matter but didnt, thats established now move along.

Thats weird, ask the reps on the phone if it can be faxed or emailed what ever is needed so that u can act quickly. ghee the uscis is a trip! arghh sorry. but just be in constant contact with them and you might just want to email the center yourself if it ever comes to it. vsc.ncscfollowup@dhs.gov or csc.ncscfollowup@dhs.gov to inquire....but since they did mention that you should receive it within 30 day you have to ride out that time :/ they wont act before that in most case.

Thank you very much. And, Yes, we provided the documents that show the last 3 years of the tax return of the co-sponsor.
I would do my best to know what I can do more to get my application again on the normal way. Thank you very much god bless you.



u did all the little things i mentioned? letters etc? everything? gheeseee thats the craziest thing. pls do cotnact the consulate by mail or phone something. callthe nvc and uscis get ur congressional office involved and email the center...

Today I went to the second interview,,,,,, a new CO wanted to restart from the biggining, and she grilled me by the questions... Finally she informed me that I am denied and gave me a paper that explains why :
Ineligible to receive a visa under the following section(s) :

- Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply in your case :
( Please note that your case is being forwarded to NVC for further processing. The petitioner will be contacted to complete the process.

-Section 212(a)(4) : which prohibits the issuance of a visa to anyone likely to become a public charge.

- Further consideration will be given to your visa application after you obtain and present the documents listed above and/or the following: *
( please note you are welcome to submit additional information for Consular Officer's review for reconsideration of 212(a)(4) above.

What does all that mean?
What should I do in this case ?
They denied it because my fiancee is not working and she has no income ,,, but why we asked to file an affidavit of support?
For what it is going to be used this affidavit ?
I am lost and frustrated and can not believe what happened.




Sorry if i missed this, but did you submit supporting documents, such as w2 forms for past 3 years for your co-sponsor, paystubs and/or letter of employment ?

did u also provide an AOS thou you are not working currently, i believe this is still needed. I'm really sorry about the agony that you're going thru with this process being that it has been so long already :/

this really has me personally scared, because ill be in the same boat...where im submitting my best friends information for AOS with an I-134...

my fiance is in algeria,if we do the fatha wedding witch is the religious wedding and is not the legal wedding,can we still apply for the k1 visa?



I know of sumone that couldnt bring their husband along to the US becus they had a fatha wedding....and since that was the case n that wedding ceremony isnt legal i would generally think that you can do a k1....maybe you can also call the uscis/nvc or ur consulate to inquiry whether they would frown upon the fatha wedding and you'd have to do a different visa process

So we have sent off the packet, all seems to be going well, received NA01. I hate waiting until the last minute, so a few questions if you would be so kind as to help. What am I going to need for the Affidavit of Support? Here's why I ask...I worked in a hospital the last 4 years, March of this year I left to go on a Missionary Assignment with a friend.. that's how i found her...how we found each other..I didnt start back working until 2 weeks ago, Im an independent occupancy inspector, haven't even received my first paycheck yet... my prime question is...ii guess.. how do I prove to them I can support her?




You need to have filed out the form I-134 which is the Affidavit of support, have teh past 3 years tax transcript, which can be requested by many ways, see link: http://www.irs.gov/i...=110571,00.html

letter from you employer/ paystubs last 3 pay periods would work(feel free to get as many as you feel comfortable with)

if you need a co-sponsor he or she has to prove basically the same info I-134, proof of income n employment as listed above (this is needed when you didnt meet the poverty guidelines) see link : http://www.uscis.gov...form/i-864p.pdf
