Simple question (I hope). I work for a large major company and make enough to be above the income guidelines for a K1 visa application for just a wife. This my deal, I can show pay stubs and get a letter of employment. But I do not have a bank account or real estate or anything else to list on the I-134. will this be a problem?

We have received the NOA2 and are now waiting to hear from the US Consulate in Paris after they receive our application file. 

 

I will be gathering all required police certificates for the interview, but i have one problem. I lived four years in Cambodia and i understand this means i need to provide a police certificate from Cambodia. But the problem is i left the country over a year ago, so it is very difficult for me to get said certificate - the certificate must be requested with the Cambodian ministry of the Interior and there doesn't seem to be any option for people no longer living in Cambodia. 

 

My question is this: Could it be problematic to go to the Consulate without a Cambodian police certificate and simply explain my situation (yes, i lived there four years but since i no longer live there, it was impossible for me to get the certificate)? Would it be possible or likely for the Consulate officials to be understanding or... is that a bad bet?

Well I don't know about the consulate in Paris, but in Vilnius when I got the packet 3 there were instructions in there saying that it is impossible to get the certificates from some countries and that a complete list of these countries can be found here http://travel.state....ocity_3272.html

Cambodia is not on the list of exceptions anymore, so you need to present a police certificate. But my problem is that i'm no longer in the country so it's very difficult for me to procure it.

we had a similar issue with my fiancé and we just wrote a letter explain we are unable to get a police certificate based on the fact that I do not live there no more and I quoted the paragraphs from the travel.state website.  My fiancé had her interview yesterday and was approved

This is most common with MENA Consulates. The best thing to do right now is contact your Congressman/Senators. Try contacting the Chief Consular at the Consulate. If they actually do send back the case to USCIS there are a few options...they could let it expire, they can review it and send you a NOID or actually deny the case(which they would need substantial evidence to deny). The CO was not convinced which is why he was refused a visa. You could go back to Egypt and marry there. What ever road you choose be ready to bombard them. If possible get affidavits from family/friends attesting to your relationship. Good luck.

we are in california service center.. does he need to come in the philippines for the interview? Im worried bout the expenses. We would rather save the money, then let him come over for the interview, but I am also worried if the consul will deny us of visa because we have not seen each other for 15 months now..



I just graduated college and was with my fiance 4 year this Nov. Prior to my last trip this Aug for 2 weeks I havent seen him since Jan 6th 2011 (thats the date i came back from my 2.5months stay in Guyana)

I'm sure you wont get an RFE....Just sit tight in there. I myself was trying to save in on the expenses but we missed each other a whole lot so I sucked up the expenses and went for the 2 weeks, thou that trip was not with the evidence that I've already submitted.


the various centers seems to be moving very unpredictable lately so.... be cool! stay encouraged and all will be fine!

How far in advance can I get my employment verification letter as well as letter from my Life insurance company? I am concerned that if I get these now that it will be too early.



I would get the employment letter after your fiance receives the Package 3....(just my opinion) Kinda depends on if you can easily get this from your supervisor.... you know how big or small your company is and would be able to judge. I believe that (3 recent )pay stubs also take the place of the letter but of course i always say get all you can and play it safe!


The life ins I'd say try getting that now, again my opinion becus that might be a bit more time to process....

The Ds230 forms, DS 156, DS 156K, DS 157, Application Info Sheet. make sure that you fiance(e) has a passport that is fairly new (It must be valid six months after entry into the US) He/she must obtain a police clearance (you can hold off on getting this, as it is only usually valid for 3 months prior to the interview) Not sure for Jamaica, but you need to get a new birth cert (for yourself and the beneficiary ) (2 years prior is but I'd get a newer one even if ...) Marriage cert from previous marriage, death cert, or divorce decree. Two Color photographs "visa size photos) (2? x 2? or 50mm square ) (beneficiary )

Evidence of financial support, that?s your Form I-134 (if you need a co-sponsor, you also need to fill out one of these forms ) And supporting docs, tax returns for 3 previous years or tax transcripts. Letter from employer stating the length of you working at the establishment and your income (under company letterhead)


Ammm also its good to give him/her a complete copy of the initial forms you submitted with the I-129F and evidence of ongoing relationship etc.

Funny thing is, I've never been all that nervous talking to border force! At least, not 'til they start getting really rude. The third time I went I think I even started off by joking about my previous experiences and I had all my information ready. The guy was just a jerk. My fiance has never had trouble getting into the US, but I guess he's a whole lot more suave and British-y. haha

And as for my job situation, that is basically the truth. I've been working as a temp employee but I'm about to be a full, on the books employee. :)

Welcome, if I helped in anyway I'm glad.... never hurts to try. They were helpful in my mom's case, sometimes i get a rude person but others, there are people that are human and helps out a great deal.

She has a link that explains exactly what London needs. It doesn't have to be a new certificate but it needs his parent's names on it.

The NVC won't be able to help much with a fiance visa except say what the new case number is and when they sent it to London. That's all that happens there because it's not an immigrant visa.



I know a lot of consulate requires new birth certificate....i was just speaking esp from the request made from mines....Very well, You'd know much more about this in regards to London :)

Ohh thank you so much! You've seriously lifted a huge weight off my shoulders with all that info. Also, I've found I probably included more than I need to in the package I'm sending my fiance, so that's good. Too much supporting evidence is much better than too little.

He sent for his police certificate about 4 weeks ago right before we received the NOA2, but he hasn't heard back yet. I'm not sure if that's normal or if he should call them, but he said he'd call tomorrow regardless.

As for the NOA2, I've got the original document safely here with me. :) I just included a copy of it in the I-134 package I'm sending off.

The only thing I'm still a little unsure of is the instruction from VJ's K1 Process flowchart to send all the original documents I'd sent copies of with my I-129F to my fiance to bring to his London interview. Does that mean I have to send my original birth certificate? Does London really care much about the original documents?




Just a quick note on the birth cert....You might want to check the requirement for London London Consulate Site....as I've seen on my consulate website that an ORIGINAL NEWLY ISSUED Birth Cert is necessary for both petitioner & Beneficiary, it gave a time frame from the last 2 years I believe.

And just because it can be a really frustrating process if the petitioner is in the US have them call the NVC perhaps they'll be able to help you out...(603) 334-0700 <---- this number was a savior to me when petitioning for my mother (who will be in here in 2 weeks =) )

What I don't understand is why there are so many people who are in the VSC queue that are June/July filers who are getting approved in 90-100 days. Yet VSC say they are doing March...How does that work?



THis is because the rep give the same info that is posted on the USCIS site....and that info about Mach filers was last updated as of Aug 31....

They are just repeating what they are suppose to per their position. I'm sure it's also frustrating for those phone operators to be greeted with frustrated applicants like us. Tier 2 officers can actually converse with you and dig a little deeper. Also, you will notice that on the USCIS website the filing dates are only accurate as of August 31st. So I wouldn't put too much stock in that. Your NOA 2 is coming soon. And you are a lot further along than when you started. Just a little while longer. You'll be a happy camper soon ;)



Def agree....hang in there everyonee......grrrr!! i know the frustration it bites..... as someone stated in a post from statistics from 2010 n 2011 June filers were approved within the 1 n 2 weeks of Nov....

Hi Ro Damon,


I would just send the copy of the i-129F if you want to send something with your brother and wait on sending the I-134F with the supporting documents. You have at least another 4-5 months before you receive the NOA2. You want the I-134F and supporting documents to have dates that are closer to the interview vs it being 5-6 months old. The I-134F is not needed until your fiance goes for the interview. I would send it closer to when he hears about the interview date or at the earliest when he receives package 3.

I will actually bring the paperwork and copies with me since I'm going to Guyana for the interview.

; one tip... don't send anything to your fiance YET.. I would suggest you send out the package right after receiving NOA2.

It will take an other 2/3 weeks before he receives packet 3, and then he has to send the required forms back to the US Consulate/Embassy (DS 156k, DS156 (2x), DS-230, only part 1 signed). Then an other 2/3 weeks for the packet 4 (interiew date) arrive and then you have to wait 4/6 weeks for the actual interview. (all in all, so much time to send in everything, trust me)

Don't fill in anything yet, as the date on the forms would be "old" after months...

The I-129f package you can send right after NOA2 + a new package with the requested forms (affidit of support) and new proof between the NOA1/NOA2 such as tickets, hotel receipts, pictures, phone/chat logs.

Send it all together, and it should arrive way before he actually receives his packet 4.

So here is where I wanted to send the docs i have now from the initial package i sent in. MY BROTHER IS GOING HOME and i wanted to get some of that stuff out. I wasnt trying to fill in any additional docs like the "DS 156k, DS156 (2x), DS-230, only part 1 signed" I just wanted to get the heavy stuff out like my packet 1 (initial packet)out to him.

But thanks for the help with the timeline on things also is the DS 156k necessary for every case?

HEY VJERS!!!


Just a quick question, is there any documents that I need to send my fiance in the foreign country? I know that I'll send him the enter duplicate of the first sent out package with evidence of our relationship etc....but are there anymore forms proceeding that I'll have to have notarized and send it to him for the interview or anything that needs to be notarized here in the US in general. Does he need to have passport pics of me?

I really just want to be on top of things before they ask for it, because mail from the US to Guyana might take a bit and my brother will be going to Guyana next Saturday so I really just want to send allllllll needed docs then... so please assist me if you can.

My fiance is a police in Guyana so wont need any probs getting a police clearance but when do we need that? Is that for his interview?

Here are the things ill be sending:

the entire i-129f package sent in initially (duplicate)
i-134 for me the petitioner (Is this the right AOS for me)
the i-134 affidavit of support of my friend( who will be the co-sponsor)


FYI I just say that the check was cashed yesterday :) Havent gotten my NOA1 hard copy yet....

We appeal and now our petition is approved. Thank god! It only took less then a month. We sent it on second week of October and got approved November 1. We sent the necssary documents and also stated we are going to have a baby. Thank god they approved what we sent with our appeal.

We sent our K1 on 6/8/11 and got NOA2 on September 30th (109 days) I thank God now that we got ours approved before VSC slowed down and is now processing at 7 months! That really sux! We are still waiting for NVC to process. It's been 19 days and the automated system keeps saying they don't have any record of our case. Grrrrrr. I finally decided to speak with someone @ NVC and she said it was received in their system 10/17 and "they don't hold onto them very long" and possibly by the end of this week we should get our case number. Fingers crossed -- as I plan on attending the interview with him and we're really hoping for a Christmastime homecoming with a tentative wedding date of 12/23/11!!

Best of luck to everyone on their continued journies! The wait is terrible!

A 'higher up' from uscis, on the phone about 2 weeks ago, said "4 months,... or less". to get NOA2.

I think.

She may have said '5 months or less'.




Arghh I hope so, anytime time now vermont!...pretty please! the rush and anxiety with me just comes becuz its so close to christmas :/

I think it depends on the adjudicator that is working on your petition or other similar factors, if there was something bad about your petition most probably that u had got an RFE already, when we sent the petition I was preparing myself for a loooong wait 5 - 7 months, but im so grateful we got approved after 93 days, just think we have to prepare ourselves for a long wait, so that when it comes faster its like GREAT!!! :) hope your petition gets approved soon though, I`m sure we will see u on the top of Igor List very soon :) :star:
