IR-1 / CR-1 Spouse Visa Process & ProceduresEthnic/Religious Fears...
Visit the ME/NA forum (in Regional Forums) where many people have experience with these issues.

Wow, I don't know how people like you (whose husbands have tourist visas) find the strength to file for fiance visas and not commit visa fraud by marrying on the tourist visa, knowing that it can sometimes be difficult to get visas in a timely fashion from the MENA area. Congrats on being a better person than I probably would be in your situation...

Also goes to show that something must be don with the way their system is run....Its a bunch of BS.....They dont even inform us as to where we stand , where they stand...all we get is the same " you are withing the 6 month timeframe".....the website is update by a computer monthly and thats about it....maybe if they kept us better informed, the process would be a little bit easier to handle!!!!!!!!

IR-1 / CR-1 Spouse Visa Process & Proceduresinterview

My finance had interview January 28th and was denied
The CO would not look at any of his information.
She asked him "DOES YOU FAMILY APPROVE?"
He smiled and said yes.
She said 'YOU SMILE AT ME. YOU LIE. I WILL NOT GIVE YOU VISA."
SO I called attorney here and he advised me to go to Morocco and marry.
I have done that and sent in new CR-1 application. But I hear nothing. I wrote to my US Senator and was assigned someone to look into this bu tI hear nothing.
Is there anything I should be doing. I received my receipt July 7, 2009 and it is almost a year now.
Please any help you can give us is appreciated
We married March 15th, 2010
but we could not open joint account in Morooco. They would not let us
I had to return home to take care of my property and he does not have visa for here so we only could live together 2 months so far

Did your lawyer withdraw the first petition? That could be holding up your 2nd petition. Have your local Congressman/Senator do an inquiry on your new case.

Evidence of a Bonifide Marriage
The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. What evidance do we need ? She lives in morocco. I live in the state Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresGreen Card lost in Mail.

Today we received letter from usics that our Green Card might have been lost and we will have to fill up form I-90.

I am heartbroken. Not sure what happen. I called post office they said they don't have any mail on hold. it might be either missed delivered or send back.

Not sure what should i do now. I am spouse of USA citizen and came to usa 2months back on IR-1. I-90 form has fees of around $290. :S

Try contacting your Senator/Congressman to help you.

IR-1 / CR-1 Spouse Visa Process & Procedureslawyer or no lawyer

Which is faster filing the papers yourself or using a lawyers office.

Using a lawyer will not speed up the process. If you check the "guides" here you can do this on your own and save those dollars for use down the road. Good luck.

IR-1 / CR-1 Spouse Visa Process & Procedureswhich kind of visa i need
Before getting married and having your fiancee spend all that money again....try figuring out why your K1 got denied. It seems that you were approved first and then they did a 360 on you and canceled it. The Consulate must have something on record and no matter what visa you apply for they will continue to deny you UNLESS you have a strong come back.

IR-1 / CR-1 Spouse Visa Process & Procedurespdf half filled out by hand, half by computer?

Yikes hi everyone, finally I'm ready to send off my I-130 petition for my wife. I just received in the mail her signed form G325a form but for some reason about half of the fields printed with nothing in them but the other half of them are filed out,(I filled them all out on the pdf before emailing it to her) she printed it out there, then signed it and sent it back to me here in the USA.

Is it okay to go back and fill out those boxes now? I'm worried that USCIS might raise an eyebrow when looking at the form half filled out by computor and half by ball point pen. thoughts on this?? anyone sent in forms half and half like this?

Thanks!

It should not be a problem.

IR-1 / CR-1 Spouse Visa Process & ProceduresFilling out I-130 for CR-1
Hello,

HOpefully someone can help me with my situation! My spouse is currently in the US for work on a B1 visa. He is traveling back the end of this month(his B1 is valied for 6 more months, but his work wants him back). We decided to go the safe route - and we'll apply for the CR-1. However, I want to start the process of filing now - send the i-130. On this form, it asks whether my relative is currently in the US and for his i-94 record. Any advice on how to fill this out? He's leaving in a few weeks - so I don't know whether to say he's here and give the information or not! I don't want them to think he's staying in the US during this process - and I dont want to say he's in the UK before he goes back. However, I know the faster I fill out this form, the quicker the process gets started. Any advice!? thanks!!

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting England
Thank you so much to everyone!!! I already have a ticket into Heathrow - IMO the most painful airport in the world...!! so I will bring our NOA and a letter from my employer and hopefully be ok.

I think you're right about being honest. If they look through my passport they will see visits to the UK and I don't think I could get away with English countryside... :innocent: :innocent:

Thanks again. :) I'll let you guys know how it goes! Fingers crossed.

PS _ I do have paranoia! Would hate to get there, get denied, and have the pain of not seeing him PLUS the bad stamp on my passport during a visa process!!!

I got grilled quite a bit - but luckily always got through. The interview questions definitely have me nervous as I have a visit planned for next weekend. Since we are married now - and he has a CR-1 visa in process - do you think that I will get into UK ok?? ANything I should take or tell them to make it a smooth customs chat!!!? Any advice would help!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about filing I 130 from the outside the USA
Hi.
My sister got married outside the US and she doesn't plan on coming back until her husband is approved for a visa. Here are the questions she is concerned about.
1. Can she file I 130 while living abroad?
2. If yes, which address should she write as her permenant address, the local US embassy told her she should write the US add, since she is on a visit visa to that country.
3. Can someone else mail the petition for her in the US while she is abroad?

As I mentioned,my hubby has interview in August and we had to send everything to NVC and NVC sent everything to embasy so on the check list,it seems that my hubby don't have to bring anything,besides 2 more pics,passport and medical exam papers...so they have all the other civil documents already there...Anyway-he will bring photos and copies of my plane/bus tickets when i was visiting...NOW-HERE GOES MY QUESTION: They are mentioning phone bills,letters etc...BUT WE DON'T HAVE ANY OF THESE BECAUSE ;
1.WEW DON'T TALK ON THE PHONE(that would be outrageous,it so pricey...INSTEAD WE TALK ON SKYPE AND AIM...BUT WE DON'T WRITE,WE TALK ON THE MIC AND CAMERA,HAHAHAHA so how can I prove that???We are on the messenger all day... Also,we have sms-s every day at least one or two ever since we got merried and apart...We both have myspace and are sending to each other comments but how much I'd need ink to print all that out :)))) ????
So WHAT DO WE DO??? IS HE NOT GOING TO GET VISA IF WE DON'T HAVE SUCH STUFF??? EXCEPT THOSE FEW I MENTIONED...PICS,TICKETS AND MAYBE SMS...OR SHOULD I PRINT OUT SKYPE LOG IN,BECAUSE THERE'S NOTHING ELSE,SINCE WE ARE USING MICROFONE AND CAM???? THX
AND YES,WE ARE NOT LIVING TOGETHER BECAUSE WE ARE ON TWO DIFFERENT CONTINENTS...SO NO COMMON BILLS OR SIMILAR...IT'SO DAMN STRESSFULL.:)

i was wondering, with the documents that go with the Ds-230,like the birth cerfiticate & marriage certificate, they need originals?...aren't they like the USCIS and could lose the things we send,so we shouldn't send originals?so why originals?and if we're suppsoed to give them the original marriage papers, what are we supposed to take to the interview with us?...

Thank you all:)

IR-1 / CR-1 Spouse Visa Process & ProceduresAugust Interview

I know NVC told me that they schedule interviews on the second week of each month for the that month and the next month.
So kucenemacene, yours is scheduled in July so August is the next month.

NVC also told me that they schedule the interviews AFTER they talk to the embassy to see how busy the embassy are for that month and the next month.

Tex, are you going over to Vietnam for the interview? If so, you will see us there at 8 am in the morning.
Tickets are around $2000 right now.

what do you mean mine is schedulled for july???I received schedule letter in june(june 26th) for august...and it should be for july 26th...

IR-1 / CR-1 Spouse Visa Process & ProceduresAugust Interview

Hi all,

Our case was closed on June 4th. I called NVC one time after the second week of June and NVC told me they have not scheduled my wife interview date.
They said the Embassy was backed up and that we didn't make the June or July interview dates. They told me may be we will make the August interview dates.
However, I believe NVC is just covering themselves with that statement. I have recieved the email today saying my wife will be interviewed on August 6!
So, for all of you who is waiting, NVC works pass the second week of each month setting up interview dates.

The last thing I would mention is not to bog them down with calls...it will only delay the process.
Call once or twice because as you probably know, it takes several tries to get through.

Amazingly the visa process as been pretty speedient for me...just make sure you read the instructions and submit the require documents.

I sent my ds230 and civil docs on june 6th and two days ago received letter with schedulled interview for august 26th....I always thought interview is about 1 month ahead but ours is 2 months..so we were wondering why...so you think is because of NVC or embassy is busy????

Anyone here has suffered a long waiting for the processing of Packet-IV. I sent my DS-230 on 3rd june still then no updates yet I got time RFE for DS-230 on 11th June. After getting that RFE my husband called NVC they told us "your packet might be in our mailroom just ignore AVR updates it will change once your packet of information will be processed". After a week we got an email from NVC stating that your i-864 has been received by the NVC and we are still waiting for your DS-230 form along with all the supporting documents..lol.we called agin and then finally last week on june 18th they told us they received our documents.I am just wondering its been 22 days since we sent our documents how long it will take to complete my case?Generally it takes about 10 working days to response to the checklist then why it is taking so long?

IT TAKES FORM 2-4 WEEKS,I SENT MINE ON 16TH OF JUNE AND GOT BACK INTERVIEW DATE YESTERDAY...

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion for couples...

Me and my husband got married on March 27th, 2010 and last saw each other on April 10th. It's been almost 3 months and I am all ready dying inside without him. I don't know the next time I will be able to go to Serbia because it might be better for me to stay here and work till he gets his visa (which we are starting in August :0). We will see what happens, who knows maybe i decide to buy a ticket and just stay over there from october till whenever he gets the visa for here. This is such an emotional process and I haven't even started it.

honey,we are one yr married and only 4.5 months of that actually together in person...no birthdays,no new year,no xmass,no anniversary-very first one, instead on that day our will be nervewrecking because that's when they decided to give us interview...I certainly don't know why do they do this to people..it's ok 3 or 4 mos but a yr....c'mon. :(

Mi case being as K3 and USCIS pass to CR1/IR1 and we work as NVC sent us process.
If it is you case same and is close June 30, then you hope 15 or 20 days up and NVC must work together with US embassy of your Country calendar or fix date interview and near July 15 to 20 NVC will send a email with packet to you and your petitioner with all instrution and date interview.

I would suggest not creating a problem that doesn't exist. Be sure to have all your documentation in order, think positive thoughts only and instead of focusing on what can go wrong, focus on what will go right. Don't drive yourself crazy.

Remember the glass is half full AND half empty, both are right, it just depends on your perspective. It's ok to be nervous but understand that nervousness and worry change nothing, and promote very little meaningful thought processes. Freak if you need to when you need to; until think pleasant thoughts and smile. :innocent:

YOU ARE TOTALLY RIGHT!!! THIS IS WHAT MY HUSBAND TELLS ME EVERY TIME I STARTS WITH-WHAT IF....He doesn't even let me talk to him about interview any more...But I admitt-I am bad when it comes to things like that..Just my caracther I guess. :)
Lovebirds2009Female02010-07-12 19:59:00
IR-1 / CR-1 Spouse Visa Process & Proceduresvisa denial

Definitely not true. Check out some of the things that have happened in Ecuador...people have been denied just because the petitioner has not shown up to the interview. Well, I suppose you may be right in so far as you won't be denied without some type of evidence of fraud, but I do not think that the petitioner not showing up would constitute a reasonable amount of fraud to the average person. Now, most embassies do not unofficially require the petitioners presence, which makes it so important that the OP actually say where he/she is from and/or look at the reviews of the particular country.

well,in our embassy I CANNOT EVEN GO INSIDE WITH MY HUSBAND ON THE DAY OF INTERVIEW... and i am a petitioner! Just him!!! They also stated to send only his civil documents, nothing of me...Unless they want something on the day of interview..I asked them just recently and that is what they said. I would want to be with him inside at least but,in this embassy only applicant goes...petitioneer stays outside smoking,hahahaha...waiting and nail biting :))) Visa is given second day and sometimes same day in the afternoon...I guess each embassy has it's own protocol...

IR-1 / CR-1 Spouse Visa Process & Proceduresvisa denial

please understand, that just because it was 'accepted' at NVC, it doesn't mean the Consular Officer at the Immigration Unit inside of the US Embassy/Consulate will NOT find problems with it, ah ? Also, don't forget that an approved petition means the foreign spouse is ALLOWED to apply for a visa. Never means 'all is well' - IMO - 'all is well' on interview day - when the ConOff says 'yer approved - Welcome to USA'

Many times, I-864 is some issue, things strange on the DS-230 - NVC ONLY CHECKS for completeness and 'dollar amount' - and that's it. A ConOff knows how to sniff out problems - and the casefile always in hand prior to interview day - time is made for 'eyeball review', as well - so if any perceived ISSUES with the 'totality of the casefile' - notes are made in the casefile, prior to interview day.

The Interviewing Officer sees those notes, as well, and 'makes the interview' go a certain way, based on the notes.

Also - is different 'approach' as well, based on which US Embassy/Consulate it is.

Although your question is 'general' in nature, the answer is 'specific' in scope - it depends on where the interview is, as well.

my husband doesn't need to bring anything with him to embassy because everything is there
Many people have the 'bonafide relationship evidence', up-to-date file, on interview day. Please review the I-130 instructions, review the 6 types of evidence, review your Consular Reviews - then LET US KNOW if you feel you should prep a package for your foreign spouse, for this 'bonafide relationship evidence' - or not ?

WHAT POSSIBLY COULD BE A REASON IN ONE MONTH FOR NOW THAT HE IS DENIED FOR VISA??
difficult to say, EXACTLY, as only YOU know the contents of the casefile.

Well, besides pics, phone calls.plane tickets and similar,we don't have any bonafida because we don't live on same continent..no common bills, adresses, whatever else...Reviews in his embassy are pretty ok,7-10 minutes questioning time,in fact i know at least three persons who came within 6 mos to their spuses from the same city as he is from in last yr...If you know something else about Macedonian embassy, let me know.I sent mail to ask them exactly what else to bring, they said, they'll see at the time of interview...Check list has everything checked as received.. As i said,I know that he'll bring photos and messenger records,my plane tickets, proof of my stay for few months each time etc but there's nothing else really as we never lived together...But we are hoping we will soon :)
There;s nothing really I could find on that particular embassy on here..or their site...so hopefully it'll work out fine.
