But a green card or the permission to stay and work legally in the USA is needed if i truly love her and provide her with financial support and everything so that she and my future child can enjoy a better life. My future wife is an US citizen by birth. I came here on tourist visa and expired. She wants to file for me two-three months after we get married but she doesn't want me to go back to my home country. She wants me to adjust my status living inside the US. I didn't come to the US with the intent of immigration and marriage. I have come to the US before on 2005 and stayed for 5 months but this time i am staying for more than 7 months, although i was supposed to leave in 6 months after the entry to the US. So far, i have calculated and figured out that i have overstaying for more than 45 days. The expiry date printed on the i-94 card was november 05, 2006.

It strongly states in Guides that if the couple are already married, and the spouse came to the US on tourist visa with the intent of immigration, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US. But it's just that I can't afford to go back because due to the lack of work permit i didn't look for work, although i work 6 days a week only to receive food and shelter from my employer. and since i haven't been receiving any money, i certainly can't afford to pay for the plane tickets, which would cost more or less than 2500 dollars in total. Also i fear that i will be denied reentry to the US because i have overstayed and two. in my country, even a legal marriage to a US citizen is considered fraud since so many people in my country would risk their lives to make it to the US by any means. hence i'm too afraid and she is too, which is why she wants me to get married to her in the US, then she will file for my EAD and i-130 and adjust status sitting in the US, not outside the US. is it possible at all?

I would not worry about a visitor's visa being denied since some countries do not allow visitor visas but other visas are approved without any problems. I know a male coming from Pakistan cannot get a visitors visa to the USA I personally would not worry about the B2 denial and wishing you good luck on the remainder of your journey.

i think from now on i ud just keep my retarded mouth shut and read what others are saying instead of describing my problems from fast to last asking for help. i bet that would help me solve whatever i'm going through. it doesn't feel good to be laughed at at all nowadays. i'm in lots of troubles and kinda frustrated when i see people drive cars in the streets and even though i can drive faster than any NYC cop, i can do squat to get me a driver's license. sometimes i feel that those who actually have got green cards through any means are god-gifted talented people and they are born magicians. how do you people do it? also so many people have won the diversity visa lottery but so many haven't. this whole issue has already made many illegal people commit suicide because there is just too much difference between the legals and illegals. for example studying should be encouraged and for example if i say i wanna study in college, compete with fellow students and get scholarship and stuff, the teachers should be happy. but if i say that to any teacher in any college in the US and express my willingness to study in his/her college, he/she gives me a form to fill out and in that form what i should write in the SSN field is something i'm asking god to tell me. i know some people before 9/11 came here and got taxi driver's license and making loads of money but after 9/11 noone can make fake documents anymore. things have gotten stricter. can anyone tell me wheather or not i should wait till the bush government gives me the amnesty? or should i go back to bangladesh and start to lose the willingness to live on that i earned in the US? this would be my very last post in this website and i thank you all for your assistance, encouragement and discouragement. but before i leave, i hope someone experienced would tell me wheather or not the government would give plain amnesty to us....please!!

hmm this is frustrating. i'm probably going to move to finland in a couple of weeks then. my brother married my finnish aunt and got papers over there, although in my last and only trip to finland he was able to do for me squat. let's leave US and try to find a girl in Finland, although i tried that previously but with no satisfactory result. how do you study in Finland if you are a tourist? last time i tried to do that but they directly asked me wheather or not i am married to a finnish citizen and have a passport with a finnish study or work visa

She was treated in the US before and they found out both of her kidneys were not functioning and she received treatment for free for she had no money but had to buy medicines for 40 dollars per prescription at Jacobi Medical Center, bronx, NYC

My Aunt in Finland is teaching her kids to speak in American English so that someday they could come to America and get admission into schools without confronting too much problems and language barricade.

And speaking of your 500 dollars...I believe (although i am not sure) that the money will be spent on conducting investigation on you, your wife, her records, employment, bills, tax etc etc and come on! the immigration people are human too and they need to get paid for what they do. I have been to 27 countries so far including USA and in each visa interview everyone starting from the cops standing guard at the gates to the interviewer were happy with me in every ways since I did pay my honest respect to their cause, which made their work easier.

Respect the country you want to live in, respect her citizens and respect her laws. How would you feel if you are not getting paid for what you are doing?

I have been through all kinds of hardship and struggle you can think of in your wildest dreams and even after all these, i am tough enough to afford to pay more than 250 dollars for JetBlue Airtickets to meet my gf in VT and buy her expensive gifts, laptop (recently she needs a dell XPS laptop which is worth more than 1999 dollars) and yeah for the love of a woman in this lonely life of mine I am going to buy her that (many of you might think oh okay she is gonna marry you and file for you and hence you are doing all these? cool! but She is not gonna marry me that's what she told me and may be after 4-5 years she will make such a decision) and still i would have never frowned if i was born in a first world country like you and had to pay 500 dollars for filing purposes.

I have been to more than 27 countries (and yeah most of them are first world countries) and many girls dated, slept, had sex and proposed me and i have done what a grown man always does but in none of them did i ever overstayed in a country for the love of a woman. no matter how strong your love for a girl is, when you overstay, you break the immigration laws, to begin with. And yes i am grown-up enough to pay for my wife/gf/love's plane fare also so that she can come visit me in my home country and stay there if needed. I don't have to overstay to be with her.

I have been living in the US for the past 6 months and i i have been able to afford a room (not shared), 20 inch monitor, dell's latest AMD dual core computer, a dell inspiron laptop, bed, new clothes, food, alcohol and everything i always dreamt of possessing by spending my own money instead of depending on others and i know of so many grown up persons who haven't been able to be living in so many first world countries what i am today. look at the homeless people in NYC's subways. And look at you too!

The universal fact that canada is a first world country aint no shocker to me and I am educated enough to not be shocked when i have to send more than 500 bucks to my home country for my mother's medical purposes and it might be a shocker to you if you can have a close look at the pages of my passport and find out tourist visas given to me by so many visa officers of so many first world countries starting from USA, UK, Japan, Finland, Italy, Germany Norway to Sweden. and If you have any doubt, i will mail those pages to you, just in case you don't wanna believe somebody you apparently are hating on so much. And in each of those countries i didn't have to live like a homeless and worry about 500 dollars. I was born in a third world country but yes i am not lazy and i believe if i had the permission to study in any first world countries, i could have done and earned way much more than any average white or black by-birth americans or canadians.

Let's say I was walking the street and a police officer pulls over and asks me for information or whatever in a routine check, when I show him that I only have a Canadian ID would I have to goto jail and then be deported after jail time for being illegal? Also, would the amount of time ive been here show up in their computers?


I used to give a f about cops long time ago but nowadays whenever i see them i feel tired and if they ask me for any ID i just tell them "my ID is in my home. let's go to my home with me and you will stand downstairs and i will go upstairs and bring the ID back to you" (i did this thrice so far LOL) and upon hearing this and having a close look at my face, they say alright. But i wanna ask you...why do you think the police officer will pull you over? do you drive a car illegally also? lol...well and if you dont, then are you implying that you are committing any crime now? Cause in NYC they will ask you for your ID only if you have gotten yourself into something that involves a crime

How in the name of God do you find a qualified lawyer in, for say, New York City, NY, where I live? How can i be sure that the lawyer in question has helped people like the canadian guy before and was successful? How do I entirely rely on him and stop worrying about this and that related to immigration? I am afraid of talking to lawyers. everytime i visit one, i just think he is lying and giving me false hope, no matter how hard he tries to convince me by saying that he has done it a lot of times and how many times he wants to show me proofs of his previous cases. May be i am suffering from extreme paranoia, but again i don't dare to even dream of completing the forms and doing all the work myself, although i will confidently claim that i do have what it takes to do the work of a lawyer in marriage-based immigration related cases. If the thingy isn't approved by the government, will i be able to sue the lawyer or ask him to take next necessary steps or appeal or tell him to give me back my money? i bet these questions have struck newbies like me a million times.

But one thing for sure. If you really can't find a qualified lawyer, then simply don't go ahead. Fake crooked lawyers without valid licenses and experience can entirely wipe out your future in the US. I don't have a rough and bitter experience yet since I have never tried to be an immigrant in the US, but i have seen my relatives who put their trust on unreliable people who falsely claimed they were lawyers and lost thousands and thousands of dollars in the process. One of the crook is in jail now

Social security welfare isn't going to cover the fees, she has to. And she also has to be above the 125% poverty line... not sure that is possible with what social security pays out.

Since you are here illegally, you do know that if you've overstayed your visa by a considerable time, you may be forced to return to your home country for 3 or 10 years?


Thanks. I haven't been overstaying for 180 days as of today. If she is unable to be above 125% poverty line, then I have relatives who can come forward and provide a co-sponsorship. If all my relatives turn their backs on me, I will go from door to door to find me a sponsor. I believe it's not gonna be a huge problem.

But I heard once somewhere that if the US citizen receives social security benefit/welfare then the government would consider it and may want to waive the fees. Forgive me if I'm wrong.

It's not a big deal. If she can't come up with the money, then I will most probably sell this dell desktop that I'm using at 12:41 AM in the morning to come up with the cash. But finding a co-sponsor is going to be tricky anyways.

I agree with other who have replied. You should have viited your fiance sooner. Going forward I would suggest you visit your fiance again (take lots of pictures keep all receipts and plane tickets) Refile your I129F.

Some people are saying I should refile, some are saying I don't have to refile, Some are saying that I should contact the embassy. I don't know who to listen to??? Everyone in here is talking different.


If you have not recently visited your fiance or you have no intention of visiting your fiance anytime soon in the future, your only hope is to try to appeal your case with the consulate. You have not cured the condition in which your original petition was allegedly denied upon and any refiled petition will be denied because nothing has changed. Does that make sense?


personally i would go crazy if i can't go visit my gf and just slam her down on the back and have <censored> after every two-three months. she lives in Vermont and i live in NYC and the plane fair is like 200 dollars up and down each time but anyways three years is a damn long time i mean damn no sex in three years what's wrong with you all? :lol:

I want to know if it is absolutely necessary to have a picture of the married couple (K-3) during the embassy interview or other evidence will suffice. I have bunch of other information (E-mails, greeting cards, money transfer receipts, letters through snail mail, phone records etc), but no pics. Will this be a problem.

Should I ask my boss for the letter stating my job title, start date, salary, and full-time status tomorrow, or is it too soon? (See timeline in my signature for where we are in the visa process.) My 3-month "probation period" with this job will end January 26th, I'm not sure if I'll get a raise then (hehe I hope so)... but I'll probably have my NOA2 by then anyway... so... I may as well get the letter now, I guess? Especially in case it takes them a week or two to actually print and sign it for me? Or would the date on it be too early?

Is there anything else the letter should say? Do I have to specify for it to be on company letterhead?

We sold the house last year and now the new people are ready for moving in. We are renting a house on a month to month basis but there is no telephone connection and so I will not be able to get on the internet as much as I normally do, so will not be able to keep a check on things in here.

I will be using a friends computer once a week or so, just so I can keep an eye on the list and to see when we get the case complete. I just hope it is not too long as just about everything we have is going into storage apart from a bed and 2 sofa's, our tv, which we are not taking to the states anyway and some of our clothes. It is not going to be much fun living like that but we have no option at the moment.

It was a risk we had to take, selling the house, with the market the way it has been in the UK for quite a while we could not risk not selling in time. Push comes to shove and Alan gets a denial, we will just have to buy a new house here ;) We are of course praying that that does not have to happen.

it has been and still is a stressful time for us and having to move into another house rather than be moving to the states is definitely not helping, but we will cope :thumbs: no option have we ;)

Anyway, just wanted to let you good people know why I would not be on here as much and to say that as soon as I find out we are case complete I will get back on here somehow and let you all know.

OMG I am so sorry that I can't talk with you nomore everyday.
Wonder how I can contact you if something should happen.
But I can tell that I did the same for 1 year ago and now only live in a 1 room apartment with a little kitchen. A shower cabin next to my bed and toilet at the outsite hall.
I don't have any furnitures only a little sofa, coffeetable, a double bed, my tv and my pc with internet connection.
Just to save up I did this.
There will be a while in US where I am not allow to work.
I am use to work everyday and still do. Don't like if I cant support with my part to start up a new life together with Mike.
