Good afternoon. Although this situation is mentioned in another recent thread, I want to start a new topic here, so maybe other members can see, and share their experience. My question is for VJ members, who signed up for case updates, and were approved already. Especially from VSC. Did you have a TOUCH on your case AFTER approval date? An if so - did it coincide in any way with NVC receipt of your case (like in couple of days, week, etc NVC received). If you never checked, please do so and let us know ;)

Said was recived on Sep 9, 2011 and Left Sep 12, 2011.

Oh thank god. We seem to be in the same boat. Hopefully we get the same treatment as those who claim their petition was entered into the system in a few days. Let's hope NVC is fast.
Hopefully you're pretty diligent with updating your timeline, since I will be following it just for my own sanity... :) Ofcourse, if mine gets entered, first thing thats happening is my fiancee will find out and then VJ (through timeline).



This makes me feel pretty good now. I will keep trying, mostly at the end of the day, since their customer care is almost close to being 24 hours.




Still nothing. Case not at NVC, yet... I wouldn't worry much about it, but my fiancee and I are very short on time. Literally, everyday counts. In the beginning of process I had post about K-2 aging-out. According to all replies there was not enough time for my fiancee's daughter to get everything done, including adjustment of status, before turning 21. As one member said - we needed series of small miracles to make it happen. So, we prepared her that she will stay behind. But then... first small miracle happen when USCIS approved our petition in a little over 3 month. In the meantime second small miracle happen. Recent BIA decision (which is binding to USCIS), on June 23, 2011 cleared a way to ANY K-2 to adjust as long as they enter country before 21st birthday. exact words from decision:"We conclude that to adjust status based on a K-2 visa, an alien derivative child must establish that he or she was under 21 years of age at the time of admission to the United States". Basically with about two month to spare our hopes have went up, that family might still be together, giving that Consulate is not that busy right now, and scheduling can be done pretty quick (no need to wait for packet 3, or to mail anything back and forth, in Ukraine). But now NVC.... saying there is no record, yet.... Killing that hope day by day...
Sorry, I just had to vent....

I'm in the same boat. Approved August 31, waiting on case number from NVC. But it is not entirely true about "lag". Looking at some timelines from VSC, you can see that for some people it takes 3-4 days, for others - longer. I've seen timeline saying that petitioner was approved on August 29, NVC received September 2. Is it correct entry, or nor - hard to tell (because same petitioner claims, that petition left NVC on same day). Just hope for the best, and keep calling.

we got approved and know I'm getting prepare for the packet 3.
I read that I need the police and birth certificate. I'm just wondering how many of the original should I request,because for later in the future when I need the AOS. Or is it enough one original and just take copies?

Consulate doesn't keep originals, all will be returned to you.So one original is enough.

K-1 Fiance(e) Visa Process & ProceduresNOA2 a success, now I need to know what to send her! Please help

I got the NOA2 and she is going to get her medical exam and she is preparing her vaccine documents. I know I need to fill out the affidavit of support form, but what else do I need to send her for the interview? (this is for K-1, she is in Ukraine)

Do I need to send:

original W-2s or just copies? How many years back?
Other financial forms? if so which ones?
Original birth and divorce certificates I know that at least.

What else am I missing???


Documents for support can be in any form. Right off Embassy website:"....It can be in any form so long as it contains enough detail and information for the consular officer to conclude that the beneficiary will not become a public charge, i.e. tax returns, bank statements, wage statements, etc. Petitioners may submit a notarized Affidavit of Support form I-134 if they wish.....". They can be copies, as well. If you decide to send I-134,in addition to any other documents, it has to be original and notarized. My fiancee had copy of employment letter and couple of bank statements showing direct deposits from company I work for. We didn't have notarized I-134 due to time constraint.

Basically, you need to complete everything, from petition to green card, before the end of October. It seems like it would be a minor miracle of this happened.

If she ages out then your wife will have to petition for her once she get's her green card.

Well, miracles do happen, when you trully wish for them. We didn't lose hope in this journey, and here it is.
First small miracle happened when VSC denied expedited, but processed our case in just 3 month.
In the meantime second small miracle happened, BIA ruled on 06/21/2011 in the binding decision, that K-2 CAN adjust as long, as they enter country before 21-st birthday. So, adjustment at anytime is not a problem anymore.
Third small miracle happened, after e-mail to Embassy. They actually agreed to expedite request and did interview on September, 30 (consular section is closed on that day, last Friday of the month.).
Today Olya got passports with visas, in her hand.
Just two weeks shy of my step-daugher's birthday.
What else could we wish for?

Hi everyone.
I would like to find out if anyone knows - what course of action (if any) can be taken in situation like my fiancée and I in right now.
I sent out I-129F about a month ago. Looking at "current" processing times it would be virtually impossible to bring my fiancée daughter here (she turns 21 at the end of October). However I don't want to give up or simply let it go as is. After receipt of NOA1, letter was sent to VSC, asking for expedited processing on this application. Most likely it is already in the shredder :)
(Sorry for sarcasm, but all I had is a bad experience with USCIS, took them 3 years to process my Green Card and 5+ years and lawsuit to get Citizenship, both slow-downs because of "lost paperwork" which was miraculously "found" once lawsuit was filed).
Anyway, I would like to find out if anyone had situation like this, and what to do? Does hiring attorney will help or nothing can be done?
Also - how long does it take for case status to show online? It is a month already, but...."Your case can not be found at this time in My Case Status...."

Hi everyone!! I need your help. My fiance had his interview today, but did not get his visa because they said he did not have enough evidence. I know my fiance before I came to the US 11 years ago. I went back in 2003 to see him and had picture we took in that year, however, we prove up for no apparent reason,long distance was a challenge. Recently we decided to get back together and take this relationship to another nothch. I visited him July of last year and he proposed to me. I went back to see him April of this year. Financially I'm good b/c I made 35k, plus I have don't have any children. I don't know what's their reason for saying he did not have enough evidence.

They told him they are sending the case back to the State, so for those that can help, what happen in a situation like this?

In my personal opinion and recent experience - longer you know the person, harder interview you get. Look at it different way. As you said - you know him for 11 years, in 2003 you met, broke up. Then 7 years later you meet again, and decided to get married. It is perfectly fine, but does he know major happenings in your life during this 11 years? Something that can be easily found through reports, court records, etc.? When people, who just met, dated for a while and decided to get married, but don't know some stuff from each other life - it is more or less normal, since they don't know each other for so long. Not in your case. They expect him to know you, to know what was in your life, at least, from 2003 till now. Whole interview my fiancee had (and we know each other since school) was about our life before I-129F, they were asking her questions about me, and were expecting correct answers. As I think, when you know each other for such long time, expect some grilling during an interview.

I'm getting ready to start the K-1 process. My fiancee had talked with somebody who just got their K-1. She said it took about 1 year and that they used an immigration attorney. I've noticed a lot of people on this site have had their visa from The Philippines after around 6 months.

Did most of you file for the visa or your own or did you hire an attorney? The girl suggested we use an attorney. Since I have obviously never gone through this before and I hear about problems a lot, I was starting to consider it. Now that I have found this website, I'm gaining some confidence for doing it myself. I can't see how much a local immigration attorney could do other than fill out the forms, and I'm a little skeptical of the websites out there that claim to work the entire visa process. It seems like an easy scam.

I guess I'm just looking for other's opinions or reassurance.

Permisos Para Menores
 
Para general conocimiento,  se hace saber que la Dirección General de Migración, amparada en las disposiciones establecidas en las Leyes No.285-04 y 136-03 (Ley General de Migración y Ley que crea el Código del Menor), instituye  los requisitos detallados más abajo, para que todo niño, niña o adolescente  pueda salir del país:
PARA MENORES DE NACIONALIDAD DOMINICANA:
1. Si el (la) menor viaja en compañía del padre y de la madre,  no se requerirá permiso de salida de la DGM.

2. Si el (la) menor viaja acompañado solamente de uno de sus ascendientes;  es decir, del padre o de la madre, deberá contar con la debida autorización del otro progenitor.

3.  Cuando exista algún conflicto entre el padre y la madre, el interesado deberá presentar una decisión judicial, emitida por una instancia  competente, que  autorice la salida del (de la) menor, debiendo  ser presentada ante la Dirección General de Migración.

4. En el  caso de que se trate de hijo (a) menor no reconocido por el padre, podrá salir del país, siempre que viaje en compañía de la madre, debiendo presentar original del acta  de nacimiento donde se compruebe la filiación.

5. En caso de que el (la) menor no reconocido por su padre, vaya  a salir  del país bajo la protección de otra persona o línea aérea,  se requerirá la debida autorización de la madre.

6. Cuando se trate de un (una) menor, que tanto el padre como la madre hayan fallecidos, la autorización de salida del país, deberá ser hecha por el tutor o tutora del mismo; y en su defecto, por un  Consejo de Familia.

7. Cuando se trate de un (una) menor, que el padre o la madre haya fallecido, no se requerirá permiso de la Dirección General de Migración, siempre que viaje en compañía del sobreviviente, debiendo presentar a las autoridades de migración un original del acta de defunción del finado o finada.  

8. Cuando se trate de un (una)  menor que el padre o la madre resida en el extranjero,  quien otorgue la autorización de salida, deberá hacerlo mediante  una declaración jurada  ante Notario Público  con dos testigos haciendo constar tal situación, debiendo presentarla primeramente a la Procuraduría General de la República y luego a  la Dirección General de Migración, para el permiso correspondiente.

En todos los casos,  la autorización requerida para la  salida de nuestro territorio de menores, deberá hacerse mediante acto bajo firma privada, debidamente legalizado por un Notario Público, visada por la Procuraduría General de la República, debiendo por último depositarse en la Dirección  General de Migración, donde se otorgará el permiso de salida, previo pago del  servicio prestado.


MENORES EXTRANJEROS:
Los menores extranjeros para salir del país, solo tendrán que realizar  el pago por concepto de estadía en nuestro territorio.

MENORES ADOPTADOS:
1. Para permitir la salida del país de un niño, niña y adolescente adoptado, bien sea por extranjeros o dominicanos, deberá presentarse  la sentencia que homologa la adopción, registrada y debidamente legalizada en la Procuraduría General de la República, en la Secretaría de Estado de Relaciones Exteriores y en el consulado del país de origen de los adoptantes. Las autoridades de Migración exigirán copia auténtica de  la sentencia de adopción con la constancia de su ejecutoriedad.

2. Si uno de los padres adoptantes ha fallecido, el superviviente deberá,  además de los requisitos indicados anteriormente, presentar a las autoridades de migración, un original  del acta de defunción.

3. En caso de que uno de los adoptantes haya fallecido, y el (la) menor adoptado (a) viaje con un tercero, deberá presentar la sentencia de homologación en la forma indicada en el literal a); así como también, la autorización notarial por parte del padre o la madre superviviente.

La Direccion General de Migracion les hace de publico conocimiento, que para los niños, niñas y adolescentes Menores de 18 años puedan salir del pais tendran que llenar los siguientes requisitos:
1. Si el menor viaja con uno de los padres, debera tener una autorizacion del otro, amparado en un acta notarial debidamente legalizada por la Procuraduria General de la Republica, documento que presentara a la Direccion General de Migracion para emitir el debido permiso, con los requisitos que se detallan mas adelante, (a,b,c,d,e,f).
2. En caso de que el menor viaje con una tercera persona, o linea aerea, ambos padres deberan autorizar a dicho menor, mediante un acta notarial legalizada por la Procuraduria General de la Republica, documento que presentara a la Direccion General de Migracion con los siguientes anexos;
a) Copia del pasaporte del menor y su acompañante.
b) Copia de Visa o Residencia del Menor y su Acompañante.
c) Original del Acta de Nacimiento Legalizada, si es Dominicano (Reciente) y copia.
d) 2 Fotografias 2x2 de Frente, solamente del menor.
e) Copia de las cedulas de los padres que autorizan.
f) El permiso tiene un costo de RD$1,000.00 de impuestos, por cada menor y se entrega en 48 horas. Si es VIP se paga RD$ 1,000.00 adicional.
 3. Si uno de los padres ha fallecido traer el acta de defuncion original y copia.
4. Aunque uno de los padres tenga la guarda o custodia del menor, deberan traer la autorizacion de viaje del otro padre o la autorizacion del tribunal de menores.
5. Si uno o ambos padres se encuentran en el exterior deben dirigirse al Consulado Dominicano mas proximo y solicitar un poder consular, autorizando la salida del menor con su acompañante.

I got the Hard copy yesterday and it was exactly what I thought. They wanted proof of citizenship and it specifically said My birth certificate with parents names' on it. I called USCIS and asked if I could use my passport since it is another proof of citizenship. They told me not to risk it and send my birth certificate. The problem is I only have the small style BC. So I called a VitalChek and ordered my birth certificate which should be here by wednesday. Its all worth it :) :)

Today at 9:30am I was working and unexpectedly noticed a text and email on my phone from USCIS informing me they sent an Request for evidence on May 11. I was thrilled to see that. I already knew I was going to get an RFE because I made the dumbest mistake and forgot to add my proof of citizenship....LOL...but I am very very HAPPY that they are looking at our case. It has been 4 months and 2 days since the NOA 1 so I'm hoping to hopefully get an approval around the end of this month. :dance:

You did the right thing...always give them exactly what they ask for...especially when they get very specific about what they want to see, as in this case.

It is good for you to be visiting her at the time, but you may not be allowed into the embassy/ interview area. Which US embassy will she be interviewing in?



True, the interview you may not be allowed. But you can enter the embassy and wait together.

Hello All,

This is my first time posting and I have many questions that need answers...

A lil about me: I been with my SO for the past 2 years but known each other for about 6 years. I am a US citizen (born and raised) but he isn't. We kept a long distance relationship for about a years until I decided to move to Santo Domingo to help my grandmother and worked out for both because he also is from the Dominican Republic.

We have been speaking about getting married and making a life here in the US but I am confused as to what I should do. I love him very much but I want to make the right choice. I am clueless as to this procedure and what are the steps that come after. How long would the process usually take? I need to get all the advice I can to better understand this whole USCIS procedure. What are the benefits for the Fiance or the Spousal visa?

We are not married yet but I am not sure if it's better for me to wait if approved to marry here in the US or I go to Santo Domingo to marry there and do the process when I reach the US... How much money is going to be spend? How long does the petitioner need to work before they try to bring someone to the US?

Hello Everyone,

I am new to this site and have a few concerns and questions regarding bringing my fiance to the US on the K1 Visa. I am so unfamiliar with this process, terms and conditions.

I met my SO back in 2006 but been in a relationship with him for a little over 2 years. When we started our relationship we were in a long distance relationship for over 6 months until I decided to move to our country Dominican Republic. We maintained our relationship until I return back to the states after 1 year and a half. I am a little confused as to which visa to apply to but I leaning more towards the K1.

Now I am back to the states and would like to bring him here but not sure under which visa, either the fiance or spouse one. We are not married yet but plan on it just not sure which method is the best one. If I was to apply for the K1 visa, how long will it take for him to be in the US, if approved? What are the requirement? I know we have to marry within 90 days from his entrance to the US.

*What if the petitioner doesn't work at the moment?
*How long does the petitioner have to be employed to be able to apply for the K1 visa?
*To file for the K1, what is required besides pictures?
*What are the interviews like?

Sorry for so many questions. I am soooo clueless with this process that I need all the help I can receive.

You can put your present address on the application now. You have every right to change your address at any time. USCIS gives you instructions how to change your address.




Thank you. But would it matter that I put one address on my application as to where I live then put a different one for where my partner plans to live? The reason is because I live at one destination but if and when he comes, we will not live where I live now.
