What do you mean? It says they process by receipt date clearly on their page. That it also says it could take as many as 10 months to process is possibly true but irrelevant. Only *if* the previous apps have RFEs does going to someone receipted afterward make ANY sense at all.

Even if they were to honor the actual NOA1 date, we're still screwed because my NOA date is January but people who were received after that have gotten approved.

Bottom line : FIFO is FIFO. Receipt date is receipt date. The date of the NOA is not the receipt date -- the receipt date is clearly stated on the NOA1.

"USCIS processes applications in the order they are received by application type"

How much clearer can they be that this is supposed to be FIFO?

They need to answer about the drunken sailor route they are taking through the applications.

USCIS doesn't say "FIFO" but FIFO is the equivalent of processing by receipt date which indeed is stated by USCIS.

In that respect, they both agree. FIFO tends to be used in computer circles and not in regular life. So that it doesn't show up on the USCIS site should not be of concern at all. It is geek speak.

The ombudsman's transcript is interesting. It says the date is for receipting, not processing. But USCIS clearly states that these are the dates they are just comleting, not processing. (Per http://www.uscis.gov...0000ecd190aRCRD )

So I don't find the ombudsman's report to be credible. Further, he's a watchdog, not USCIS. What he says is not in fact, fact.

I don't think quoting him gets us anywhere.

"May take" -- but since they are clearly processing I-130s filed recently they might want to explain to anyone with an October receipt date (or earlier) why this is the case. They should NOT be working on a case filed after if they are allegedly doing them in order. Unless a case is expedited, it shouldn't be processed except for when all previous cases have been dealt with in some manner -- processed and moved on or an RFE is put into place and the case waits for the petitioner to act.

They are clearly not using the receipt date. At best, they're using the NOA date. And even then, it isn't right!!

The way it works is that you call the 1-800 customer service number at USCIS, while in the automated phone selections you want to press the number that says " if you are calling about a notice that you recieved from USCIS requesting that you submit more evidence...." well something like that, once you do that you will enter in your NOA1 # and it will say you need to submit the evidence that was requested , then you can select to speak with someone regarding your RFE. These USCIS agents are really good with coming up with excuses on the fly. And to add insult to injury they also give you these "ballpark" answers. "Yeah Next Month It should be quicker, or we were backloged" (arent they always)

Yeah thanks USCIS but I've heard this before. Why did I ever decide to do everything by the book is beyond me. One of those things In LIfe I regret doing is sending the application to Chicago Lockbox!

So I call it today tell her all my info. I ask if there is any new info about my case, I ask about if they need my RFE. I ask when my case will be looked at. This are the answers I get back :
"I am sorry sir, It only shows you exactly the same thing as it shows you"
"I am sorry sir, you will be approved in 135 days or then you'll be outside the waiting time and can contact us again"(I've already waited 150 days)
"I am sorry sir, I can not tell you if your case has been looked at since we've received it."
"I am sorry sir, you'll have to make an infopass apointment with your local office and ask the officer"

NOA1 is "Notice of Action" number one. The action you're being notified of is their "receipt" of you petition. Any counting of days would begin there, IMO.

180 days is not necessarily how long it takes to adjudicate a petition. It is the number of days in a standard they use. They just won't do any official inquiry on your case until 30 days after the 180 days.

Petition adjudication takes as long as it takes, whether 30 days or 300 days.


Pushbrk sometimes you sound like you work for USCIS. If that is the case, maybe you could let the guys on the USCIS helplines know this information as I, like a lot of people have been told by USCIS that the 180 days starts from when they receive the petition, not from the NOA1 date.

This sounds a little mad to start it from the NOA1 date as most of the latter third of 2007 filers didn't receive their NOA1's till late2007/early 2008. Therefore it would follow on that there would be a clump of approvals (and not much before) when the NOA1 date becomes current .... in about 6 months. This does not seem logical in the slightest.

Why should we suffer for their innability to keep organized provide service that is advertised, and be reliable. If all of my paperwork is in order sent in November, proved by my USPS receipt, what else is there? Why should I be counted when they entered my claim in the system(measily 2 months later) ? I am sorry I dont have 60 days to just throw away, im gonna claw for every hour.
