If you read the ombudsman's report you'll see that USCIS responds in a way that is deliberately evasive. There's something very rotten in that organization. They behave like guilty parties, obfuscating truth. Double-talk, lies, nonsense.

I hope you realize that a petition is not going to do much. The problem with most of these issues is that by the time anyone pays attention, the signers are already though the system and are not interested in fighting old battles.

Past that, as we've seen, our country doesn't have the stomach for immigration reform, let alone for refining internal governmental processes.

For whatever lame reason, K1s get the quickest turnaround. It makes no sense in terms of social engineering. Existing families are kept apart but people who aren't yet married can start a new life together sooner but can't work or leave the country for a while. (We'll keep you dependent on your USC spouse and keep you hostage!)

In any case, my entire point was to state that on the IR/CR board, we are often mixing apples and oranges (K3s and IR1/CR1s) when they're not the same, they only share one piece of paper.

Once the 129F is received, it would make no sense to me to work on each application independently -- IOW, if you grab the 130 you should also grab the 129F and complete them concurrently. That way you are not moving applications through the queue but you are moving APPLICANTS through. The number of pieces of paper and the number of times you touch each piece of paper only indicates inefficiency in the process.

Delicia suggested and I agree that they are not going by NOA1 dates. They are taking a random approach. WIWO is their motto -- "whenever in, whenever out".

That a CR1 gets done here and there doesn't mean that K3s aren't getting priority.

If I had to do it all again, I would have gone K-3 and said that he doesn't need to work for 3 months or whatever.

I think mixing the K-3 130 touches/approvals with the IR/CR1s doesn't give us a true picture. It appears that K3 130s are approved before IR/CRs. So I have a hard time getting giddy because another K-3 applicant gets some attention regardless of when they filed. I suspect they have different queues for people who have both a 129F and a 130 than for those w/just a 130.

September, October and November 2007 seem to be hit and miss with Vermont. Writing letters will unlikely produce any forward movement. You need an extenuating circumstance or they'll just blow you off. And since they claim to be working on July 2007 at this time, they'll tell you that you are within the normal timeline and you'll just have to wait.

It really depends on the officer. But unless she mentions being married to a USC it is unlikely they're going to care. She'll go and they'll ask why she's going and she'll say school and they may or may not want to see a visa.

Even real marriages can lose patience with wanting to actually begin LIFE together.

Look at our case :

We're in our 40s. We each have 2 children. We each have houses and stuff and jobs. When he moves here his job will transfer him to the US so he's ready to work. BUT. He can't do that now and so we both spend our pay on two places to live, and all of the things that go with it -- utilities, food, insurance, etc. etc. etc. We spend a ton of $$ polluting the environment so we can see one another. I've got over 60K miles on a 2006 vehicle to prove it. He's got a truck which is even more expensive to run. So naturally we're thinking about buying another car for him -- just so he can save some $$ on the drive but a car that we'd otherwise not want or need.

Instead of selling both houses and buying something for all of us, we're wasting time and money waiting. Instead of paying taxes to the good ole US of A, he's paying Canada. (You'd think the US would like his money, ya know?) Instead of saving more toward our childrens' educations and retirement we're spending money living separately and visiting one another. Instead of doing all of the things that we are very capable of doing right NOW if only they'd let us, we waste time and resources while Vermont twists American values and priorities into something horribly unrecognizable.

Oh, we're a bonifide marriage all right. But we're also sad that this process is causing two otherwise intelligent people to act like idiots in the name of love. Because nobody in their right minds would elect a marriage under these conditions. So if we were to split up Vermont could conclude that we weren't a real marriage from the start. But they'd be wrong. Love is a lot but it isn't everything. We have other responsibilities, too, namely to the children we have.

Of course, we're not giving up on one another. But if we did I'd tell Vermont to shove it where the sun didn't shine if they were to conclude that the end result determined the content or quality of our relationship.

I'm wondering what people's Plan B is and what their timeline is for going to plan B. While my eldest would have gone to Canada w/o protest earlier in the year, she's now certain she doesn't want to leave her school system and she begins HS in September.

Delicia sat in Canadian immigration hell so even Plan B doesn't look so hot for us.

If we pool all of our money, how about we buy an island somewhere for those caught in immigration hell. We can have an awesome tourism industry that everyone who is anyone will want to visit... only we do background checks and if you work for one of the service centers, you are banned for 10 years from reapplying to visit. We won't tell them that though. We'll do RFEs and "touches" on their applications or we'll lose their stuff for 3 months in limbo and then give them nonsense answers when they call our 900#. (800#? Hell no!)

OK. So maybe I'm not handling this visa thing well...

I sure do hope that there will be a LEAP in the October (and before) filer approvals out of Vermont. But I'm through holding my breath.

It *is* discouraging seeing others who have filed well after being approved. And I'm sorry I read the Ombudsman's report because that confirms everything we have seen and provides no comfort that things will improve. When USCIS gets called on a practice that sucks, they implement another one that sucks just as bad and call it an improvement.

One more week and I'm sending in a 129F.

It really does make me question the intelligence of getting married. Go K-1, accept a single person working for a while, pay the extra bucks and be together. Apply for advance parole if you want to leave the US. Just do the extra paperwork and pay the extra money and avoid trying to be responsible and intelligent. Apparently the US government doesn't value either of those things.

What do you mean? It says they process by receipt date clearly on their page. That it also says it could take as many as 10 months to process is possibly true but irrelevant. Only *if* the previous apps have RFEs does going to someone receipted afterward make ANY sense at all.

Even if they were to honor the actual NOA1 date, we're still screwed because my NOA date is January but people who were received after that have gotten approved.

Bottom line : FIFO is FIFO. Receipt date is receipt date. The date of the NOA is not the receipt date -- the receipt date is clearly stated on the NOA1.

How much clearer can they be that this is supposed to be FIFO?

They need to answer about the drunken sailor route they are taking through the applications.
