Dear....... Thank you for your service to this nation and its citizens. Your work has not gone unnoticed and for your concerns I am thankful or something nice here...haha. As one of such said citizens, I have a serious concern.
My name is __________. I filed a I-130 petition with the Vermont Service Center on __________.
That was 205 days ago.Today, May 21, the USCIS processing times were updated (with a May 15 date) and the I-130 petition for spouse, child under 21, and parent remains unchanged with a date of July 30, 2007.
This is the third month the Vermont Service Center states they are processing I-130s filed on or before July 30, 2007. The month before that they were in August and then on ________ does anyone have this date? the processing time for this petition went backwards.
Can NOTHING be done??
I miss my husband. Families are being ignored. I wake up everyday hoping that it will be my turn. I serve my community. I love my country, yet there seems to be no tangeable hope for me to be with my husband. I am not even asking for special treatment. I just do not understand why there is NO accountability in this department. Where are the checks and balances? Where is the accountability that this SERVICE center has to the U.S. Citizens? How is it that a Service Center can do no progressive work on a particular petition for months and noone speaks on our (the citizens and permenant residents) behalf?
Fiancee Visas (K-1 and K-2 Visas filed by the I-129F petitions) are into a November processing date at Vermont.Special work Visa's are being processed almost immediately after petition. Those of us separated from our husbands, wives, parents, and children..we are the ones getting
lost in the shuffle.Why the discrimination? I feel that you, as our liason between this service, you may have some answers.
We teach our kids that we have a government for the people by the people and all I can think is that when I call my the appropriate people to as for help that I am seen as a nuisance, or in some cases, not even intelligent.
I have heard numerous times about the backlog and the amount of unexpected petitions received before the fee hike that took place in July 2007. Why is this still an acceptable answer? As long as the Vermont Service Center leaves their processing date at a standstill we are told nothing can be done because we are "within processing times." Is this the representation of our government and it's services that you want your citizens to see and be treated with?

I think most people arent really concerned about increased fees, but alot are concerned not knowning anything about their case once its in hands of service centers. I work with goverment as well, I work in Medicare program, but I've never encountered problems like I have with immigration system. Lets take I-130 for a example a wife visa, why is excisting family member treated like a 2nd rate citizen? Why do fiance visa get accepted 8 months faster? Or how come People filing at same time are never approved in similar timeline. I've seen I-130 filers get aproved withing 15 days without expedite, and filers waiting for 2 years just to have I-130 approved. Too add on top of that if you cant see your loved one while I-130 is being aproved you cant bring her here on visitors visa because it automatically gets rejected. It makes very clear that American "VALUES" are not the same in immigration. "FAMILY" does not come first. Ever since the start of my case everything has been a horrible experience. USCIS customer care is absolutely useless, the time frame is unjustified and with system that only frustrates everyone. Out of millions of filers, only handful are happy. USCIS forces people to use illeagal ways to bring their family over, because of how broken the system is. It punishes law abiding citizens and lets others get away with breaking the law. It has been a disgrace going through immigration, I hope you understand that this is in need of fixing, families shouldnt suffer like this. Something has to be DONE!

As i said USCIS has different intrepretations about the rules & procedures how to process K3 visas. Technically we also didnt know what happened to our K3 visa since our I-130 approved and I-129F was no longer valid. Inorder to clarify issues re. K3, we called and spoke to the TWO (2) USCIS Officers named: Miranda & Aimee, whatever information they told us that was the origin of our post! THE USCIS Officers same words!!! Being the K3 petitioner/beneficiary, whatever information we may get from these people matters to us. Now, if u want to dig up more details you can call USCIS and share your own experiences and sentiments and u let us know here in VJ'es too, because as far as our concerned we only hopes to get assistance from the so-called expert-USCIS if they are whole bunch of liars there, that i dont really know. Thank you.

Just got notice about 1.5 hours ago.

The process of adjudicating my case was started this morning about 10am Vermont time ... the date was changed on the USCIS website and my Senator's office has been updating us by email via Vermont today.

This was an expedite under the criteria of National Interest backed up with Financial Hardship, Humanitarian, a US Army Commander and a kick ####### Senator.

I'm a bit happy at the moment, so I will post the details of the expedite later in a hope that it will help others too.

Right now I just want to hug the Colonel and especially the Senator .... the man whose team made this happen!

Expedites are not impossible

.... I also want to thank a certain person on this website who truly pi**ed me off last week as without her I wouldn't have had the fire up my ####### to pull the paperwork together so quickly ... and involve every Tom, ####### and his dog in my case to get it approved.

If we're prioritizing things in order of importance, I think providing things that you'd expect them to have by virtue of their job first would make a lot more sense than other things.

Does there have to be a choice? Well, yes. Every change requires time and effort (resources) to put into place. With limited resources, you have to decide what to do first. Medical care is far more important than immigration.

BTW, country of origin has to matter if people are going for a CR1 because a visa may be dependent on their being a visa number available to the beneficiary's country. I'm very fuzzy on this area so if anyone can elaborate, I'd appreciate it.

The ombudsman states that his investigations prove that easy cases are given attention and more difficult ones are left to fester.

If I were to give people advice on how to file their case in the future I'd say to give the absolute bare minimum in terms of documentation, etc. so that the package is small and appears easy to adjudicate. We know if they want more evidence they'll ask.

We also know that throughput determines funding so that makes it even less important to the service centers to handle difficult cases. If they can do 3 or 4 or 10 cases instead of a single difficult case, they have a better budget.

Are you saying that spouses of soldiers should get special treatment? I'm failing to grasp the nature of the gripe.

All I know is this : My husband is at work now and after work he'll return to his very comfortable home and have a full meal and nobody will shoot near him or in any way threaten the lives of his family. I very much want him to be with me but I'm not going to begrudge someone who is getting out of a hellish situation that perhaps, just perhaps, the US government feels somewhat responsible for creating.

Also consider that many have the option of leaving the US to be with our spouses if this process does not meet with our satisfaction. (I don't right now because of a blemish in my background, but in time I will.)

I hate this process. I hate what Vermont is up to. But on this issue, I give them a pass.
