I can understand that hope.

I was very patient with USCIS and accepted the 3 month wait just for them to open the darn envelope. I accepted the wait for the NOA1. I accepted the wait for online status.

But now I'm getting irritated. People who have filed recently are getting approved and there are September and October filers, myself included, still waiting w/o so much as a touch. diablo.gif

By default, purple means you've accessed the page and blue means the link has not yet been followed. But since you're accessing a web page that does a query to a database, it has no knowledge of the underlying data. Meaning, there is zero connection. (And when I say "by default" I mean if your system is using the default Windows settings.) The color has everything to do with Windows and browser cache and nothing to do with the actual status of your application.

This is a function of your browser, not of USCIS. There is a color for links you haven't access and links you have and the color is based on your windows settings.

Having a lawyer would do nothing to improve processing times. (And half of the visa lawyers don't seem to really know their job as far as I can tell, anyway.)

On the 22nd it will be 6 months for me, too. But we are fortunate in that we get to see one another frequently. I feel for those who are apart for the majority of this process.

So that's the key -- send in two forms and the first one, feeling the pressure will get itself noticed! jest.gif

If there's one thing we've all probably noticed it is that the date you sent something and the date they actually do something with the forms are not necessarily going to line up. So being patient makes the most sense.

The question is, if someone who filed in October did not receive a NOA by the end of January, what do they do? They don't have any real tracking information other than (hopefully) a report from the postal service stating when USCIS received their package. Refiling does make sense. At least that gets you in the queue again.

I think it was just a reminder that the officer at customs has the authority to prevent entry -- but not a warning that there IS a problem with your situation. Because yes, they can, but no they don't without cause. And they'll have no cause with you.

I can't believe anyone could be upset about your good fortune. And hey, it wasn't really good fortune was it. You used the system the way it is intended to be used. My husband is safe and prosperous where he is and I'm grateful that is the case. Given my choice between putting him in danger and being able to expedite and having him wait in comfort I'll take the wait. His entire family is safe. Too many of our loved ones and their loved ones are not. You did a good thing by getting her out sooner.

As we've discussed and you documented to us, Brazil has a lot of hazards too so don't be shy about how you got your approval. I saw that you were approved yesterday and even searched through some posts to see if you burried the info somewhere but I couldn't find anything. I'm really, really glad for you both and hope that the rest of the process moves along faster than the Vermont. (How can it not??)

So I guess that means that we haven't seen a CR1/IR1 approval for a while now out of Vermont apart from expedites. Sigh...

Mountain, I read what you wrote and the implication is clear. That it wasn't stated outright does not erase the motivation behind the posts. Using language that skirts what you are clearing implying does not change the implication. It is clear to most 16 year old girls and probably quite a few 13 year olds as well. I don't know what to say about cases that should be slam dunks but are delayed for seemingly no reason. There is simply no good reason for it. It sucks but that's the way it is.

It is prejudice and nothing more to suggest that all Iraqis are terrorists, and that's exactly what some people are stating in this thread.

And yes, Iraq was dangerous before. That doesn't get us out of responsibility for how dangerous it has become now. I'm not anti-war. But I recognize our responsibility in Iraq.

Anyway, I agree that it is the process that's screwed up.

And, anyone who can prove that their spouse is in danger can apply for an expedite. The process allows for it.

Of course it is possible. As someone stated recently, (000) just being associated with an American puts an Iraqi in danger. Being married to one puts them in even greater danger.

I don't think you really need a lawyer to do this. Look at the guides and read about the K-3 or the CR1 and decide which is best for you. I don't really think that adjusting status is an option for you since you know what you know.

The paperwork isn't difficult. It is the waiting that is hard.

That said, we're lucky because Canada and the US have a good relationship and we can come and go in each other's countries w/o a lot of hassle. And I'll tell ya, we have the miles on our vehicles to prove it!

I really don't think you answered the question, pushbrk. You said a lot of words but you didn't indicate how the K-1 is as difficult or more difficult than a K-3 or CR1.

Further, the expense of a K-1 over a K-3 or CR1 only adds to the argument that this is about fees as much as it is about anything else. But the expense up front is low enough and considering that most people would pay a hell of a lot more to have their spouse with them sooner, that the K-1 may be more expensive than the K-3 (because not everyone has 2 years of marriage under their belts before a visa is granted) is a longer-term concern and not an immediate concern. The immediate concern is getting a spouse on US soil.

Actually, the ombudsman has documented that the easier an application is to process, the faster USCIS will work on them, often leaving more difficutl cases of the same period to lay untouched for weeks, months or even years.

And, by the same token, since USCIS is funded by throughput rather than making deadlines, processing easier cases gets them a healthier budget than does dealing with more difficult cases.

If the rules were the rules were the rules, your logic would apply. The problem arises because there are differing interests that are competing for limited resources. Therefore, rules get bent to support the system that created the problem in the first place. Fair is not fair in immigration, unfortunately. Fair is whatever USCIS claims it to be.

I'm not sure I understand the desire to meet a "Western" spouse. Are these people more attracted to Westerners? And if so, there are a lot of countries that are considered the west so why the US? And wouldn't you consider that someone who has the desire to meet a potential spouse of a certain whatever, be it income or homeland, is certainly a greater risk because they have an ulterior motive? It is one thing when someone meets someone else by chance and they strike up a conversation and then begin dating and things flow naturally. But the idea of going somewhere to meet someone from a particular country with the idea of marriage at the forefront seems to put the cart well before the horse and begs one to question their motives.

I guess the right question to ask is, if one of these folks were denied a visa to come to the US, would they gladly go back home (or stay home) and have their US spouse join them in their country?

There are two parts to the scrutiny -- one is the person who meets the foreigner -- they should date long enough to be able to suss out motives and two, is USCIS. While anyone else can wonder about motives, those are the two entities with a great deal of interest in the truth. And for the former, I hope they do their homework and find a wonderful life-time mate. Well, actually, the foreigner too. If you think about it, they may be taking a lot of risk, too if they hook up with (and that's not in today's terms) the wrong person. If your desire is to be in the US, I should imagine that makes you vulnerable especialyl if you aren't aware of your rights.
