but making a blanket statement about stuff will get stolen is childish. i've sent numerious packages to my fiance via courier (Bombino express) and not even once it has been delivered late, misplaced, broken, nothing.

btw, bombino express is about the best courier to india (maybe they deliver to other places too?) - they charged me $15 for 2 LB package and it reached my fiance in about 3-4 days.

You must have a police certificate issued within 30 days of your interview to present to the embassy at the time of interview Confirm with the embassy as things do change but this is what I have ALWAYS seen. :yes: :yes:

For those of us who are doing CR-1 the process is slightly different as the PC is good to send to NVC for up to 6 months. However, we must also obtain ANOTHER PC at the time of interview, within 30 days of the interview. :D

OK so here is my deal.
we are engaged now and I want to file for K1 within the next few days, and we plan on getting married in June. I know she wont get her K1 visa by the time we get married looking at the processing time. so how does this work.. would i need to change the status once we get married? is it even worth filing K1 at the moment. becasue when i do get married in June do i have to start the process for a wife visa and the time starts all over again?

If you have started the K1 visa process yes she can come and visit from Canada as she can be on a VWP and can visit for up to 3 months. You cannot get married in Canada and apply for a K1 visa as told before. you would have to apply for a CR1 . You could have a party in Canada but no wedding and then when she comes to US then you have 90 days to marry.
She has to return to Canada till your K1/129f petition is approved. Then you will get notice and she will have an interview in Canada and receive visa to come to US. No she cant come to the us and marry you on visitor visa and then change her status. You need to do this the proper way and the legal way.

In most states it is possible to speed up a divorce. As an example - in NJ regular uncontested takes 4 month, I did mine in 23 days (Final divorce 23 days after filing date). Usually time consuming part is waiting for 30-35 days after service of papers, but you can sign Affidavit of Service with waiver (goes by different name in different states), notarize it, and ask your wife to submit this Affidavit together with Final Judgement of Divorce to court. Then you (or she) can ask Clerk of the Court to put it right on the calendar for nearest available date... Since it is uncontested - should be no problem. But then again - if you let me know which state are you in, then I can give you a better answer..

I knew about the arrival before 21st birthday but we had a problem with our petition and it was denied owing to lack of some information (no RFE). We wondered if they would still process our new petition prior to her birthday and issue a visa even though she will age out before she arrives. So are you saying she will not be able to enter the US on the K2 if she has turned 21. We thought there was a possibility of her being able to stay the 90 days but not adjust status.

I wish you best of luck on this journey. It also would not hurt to ask USCIS in writing to expedite this case. I know, I know... there going to be some people writing "USCIS will not expedite for this reason..." and such... :) But just write about your previous application denial, explain your situation, and mail it by express or similar mail. Write in bold letters "EXPEDITE REQUEST" on envelope. There is nothing to loose, except money for postage. If it doesn't get expedited - it will proceed with normal course, but at least you will know, that you tried.

If the petition for a K1/K2 goes to USCIS before the 21st birthday of the K2 (who is soon to age out), will USCIS approve the K2... assuming all documents are okay?

Will the Embassy issue the visa regardless of the birthdate?

I'm wondering if it is possible for the K2 to be approved under these circumstances and be allowed to enter the US for 90 days since by the date of travel she will have aged out and whether she would therefore be able to enter the US but not be able to adjust status and instead leave before the 90 days is up?

Hi. I'm in the same situation with K2. What I've learned so far - it will be very tough. She needs to enter USA before 21st birthday, her visa will expire on that day. Embassy will issue a visa up until 21st birthday. If date passes by, and she reaches age of 21 - visa will not be issued (and in my personal opinion, even tourist visa will be almost impossible to get, because of earlier application for K-2). There are only few avenues after that. One of them is for her mother to petition for her.
If, by chance, she enters USA on K-2, even on day of her 21st birthday, she CAN adjust. Don't listen to anyone here, telling you differently. Even if USCIS local office rejects adjustment, courts (and BIA) most of time overturn this decision, and let person to adjust.

Since my fiancee been at Germany for the last 5 months, is she required the police certificate from Germany? If so, I wonder how fast she can get the police certificate? Thanks and appreciate your help.

It doesn't take long, if person still in Germany. 3-5 days by mail, or within one day in person. If you need to apply apostille to it will take additional 2-3 days. My fiance lived in Germany for couple of years, but certificate was requested by mail from Ukraine. and alltogether it took 3 weeks (including transit time). Just make sure, if ordering it from outside of Germany, that all directions (including notarization of request) are followed. We want to fly up to Las Vegas to get married, will we be allowed to do such. I know the Visa terms are single entry so will I have a problem going to Las Vegas to marry and return to Atlanta?

And, BTW, your service center will be either California or Texas... to the best of my knowledge, Nebraska doesn't process I-129F. If you take a look at processing times at USCIS website, Nebraska Service Center shows last application processed was December 31, 2007. Anyway, you send it to Dallas Lockbox, and they will notify you with receipt number and Service Center.

While filling out the papers for the I-129F package i noticed on the example forms in the cover letter and a few other documents it tells me to put the address of my service center. i live in Utah and so i believe my service center is in Nebraska. Should i put the address to Nebraska service center on the papers that ask for that or the address to the lockbox in Texas where i believe i need to send the package. Also when i finish the package the instructions say to send the package to the Texas lockbox address is that where i send the package even if my service center is in Nebraska.

Cover letter is very optional thing... However, if you want to attach one - it doesn't make any difference on where it addressed to... You can put "USCIS Service Center" and leave rest of address blank..Or just put "..to whom it may concern..."...

"...Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete."

Now, my question is to the nature of this background check. I informed USCIS of my past run-ins with the law--i.e. that I have a couple of misdemeanor marijuana possession charges as well as a misdemeanor simple assault charge--each of which date back to 2005 and prior. I have long since served the required probationary sentences, and have been without even a traffic ticket in years. I sent the USCIS certified documents from all of my local authorities. I believe that I was very thorough in my presentation of the facts concerning my background.

So, does anyone know if this deal with my criminal background is the reason for the postponement? Or could the statement above from USCIS include more than just criminal background--i.e. maybe the background of my relationship with Julia, my work background?

Quite simply, I am confounded as to why this case is taking so long to be approved. I see others all over Visa Journey who've received their NOA2 within two or three months, and I am now 6 months removed from my NOA1, and not a peep. Well, that is until yesterday when I received word that an expedite is not possible. I suppose I can be grateful that I heard that much!

As to charges. You don't have to explain any charges against you (anyone can be charged with anything". CONVICTIONS is all that matters). An Expedite is the least of your worries at this point. You have multiple criminal charges and more than likely will be deemed inadmissable. Not sure if a waiver is even possible.

An individual may be found inadmissible if he or she has been convicted of or admits committing a violation of (or conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance. Any drug conviction or admission of the essential elements of a controlled substance offense will render an individual inadmissible.

What??? Since when US Citizen becomes "inadmissible"???

Or you can open separate bank account and send out debit card. For example, TD Bank uses market conversion for foreign funds and have daily limit on $756 for withdrawal. They charge $2 for non-TD ATM use, but as long as the other ATM doesn't charge fee, you end up paying only $2 for $754 withdrawal at good rate. Beats all money transfers and such.

Passport (photocopy every page) should be enough but I believe one of the forms will need the date of your naturalization. You can probably also order a copy from the office where you got it.

Unfortunately it is extremely lengthy process (6 month at best).

"In place of any of the above, you may give the USCIS a copy of valid, unexpired US passport issued with a validity period of at least five years. You must submit copies of all pages in the passport. "

So that you can do that.

No difference. If birth certificate lists fathers name - permission needed. Otherwise - not. They are looking for permission from father as long, as there is one listed.

Did you have to get a permission letter from the childs father allowing exit from Philippines? Was it required even if your anullment stated custody of child is with the mother? Thanks, Jim.

RAGS is a Ukrainian ministry that issues "certificates" based on court decrees which, in Ukraine, are not "official" until they are registered, same with marriages. It does NOT apply to foreign divorce certificates which should be a copy of the official registered document. In the US that is the court order that has been stamped as "filed".

The Ukrainain consulate in giving these instructions to largely Ukrainian applicants has used language that is applicable to 99% of their applicants. It does not apply to a per son a foreign divorce document, including you, the US citizen.

Any document not in English, Russian or Ukrainian needs to be submitted with an English translation

Good afternoon.
I was reading instructions for K visa applicants, from US Embassy in Ukraine website, but need to clarify one part.
It says " DIVORCE/DEATH CERTIFICATES: Divorce certificate as a proof of the termination of any previous marriage must also be submitted. If the spouse is deceased, a death certificate should be submitted. Divorce certificates must be obtained at the local registrar?s office (RAGS). Court decrees terminating marriage are not acceptable ." (I highlited that part)
It is hard to fully understand requirements for CERTIFICATE and non-acceptance of COURT DECREE.
Does it apply to divorces in Ukraine only?
My question is to anyone, who had divorce in the Germany - is there such thing as DIVORCE CERTIFICATE? My fiancee was divorced in Germany, and what she got was COURT DECREE with validating stamp (that divorce went into effect) and Apostille.
Obviously it was enough for USCIS to approve our petition, but is there any other papers, that are needed, to prove divorce?

You can either send certified copy or copy of certified copy. If you're in Massachusetts(looking at your local USCIS office), make sure you send them copy of absolute divorce nisi.

I am not quite there yet, we haven't even started our process, but I am a proud member of this site and often just read through things.
This summer is the first time I met my boyfriend, in April I booked a flight ticket and left my home at the end of June to finally meet him. I am still here while I am writing this and won't be leaving until September 22nd.

I had a bit of problems at the Homeland Security, because they were quite sure I was going to either stay here in the US or work here, but everything turned out well, they just told me I am not allowed to work here. So my problem is that they took away my flight ticket (I have an electronic flight ticket and got some copies of it, so this won't be a problem), my boarding pass! And this is what worries me. They took away my boarding pass and as I heard, boarding passes are a primary evidence of us meeting, which would be great to have, but they took it away from me at Homeland Security. Will a copy of flight ticket work instead of a boarding pass? I am of course planning on saving those I get on my way back home.

I am very scared we (in case we ever start this process) won't have enough primary evidence. First of all because we are both pretty young and cannot really afford going to hotels together and fly over the ocean to see each other very often.

I would be very grateful if anyone could write down a list of primary evidence, so I can start saving things. :)

Best thing is to just file I-129F while you're still in the US.Fill out part 12 of application. On part 18 I just wrote three sentences, and last one was .....she is in the USA at time of this form submission, leaving on MM/DD/YYYY... As to rest of stuff we submitted just couple of pictures, copy of her visas with entry stamps... You can do letter of intend and notarize it at same notary at same time on same page... But, anyway Part 12 of I-129F and copy of your visa page with entry stamp is most reliable proof (they can check your I-94 in one minute). Actually what you have already - is best evidence. Don't forget to sign G-325A, since you're already here :)

BTW, if you have passport, which is good for international travel, your name should be there already, spelled in latin letters. Use same way as in that passport.

You have to use latin alphabet for all forms. On form G-325A, on bottom, there is a box, where you will write your name in original language. And, yes, you'll have to use C ....

Good afternoon. Although this situation is mentioned in another recent thread, I want to start a new topic here, so maybe other members can see, and share their experience. My question is for VJ members, who signed up for case updates, and were approved already. Especially from VSC. Did you have a TOUCH on your case AFTER approval date? An if so - did it coincide in any way with NVC receipt of your case (like in couple of days, week, etc NVC received). If you never checked, please do so and let us know ;)
