There are limits due to IMBRA on how often you can file a K-1. But I think you should be fine as your 2nd petition is more than 2 years after your first one. Unless you have filed more than 2 petitions; in which case you may have some issues.

You can try to call and see if you can get anything. Follow the prompts to respond to an RFE, and get to an operator. But they wont do much to expedite it until you passed 6 months of processing time.

Does anyone think I will have any delays from VCS on this I-129F this time if I had an approval 3 yrs ago and it did not work out and she went back to Ukraine?

Time line from USCIS?

Hi all
I am so happy I found this site it is great. I am a little confused on one issue I have.
I filed for an I-129F back in April ROA1 was 5-2-04 and approval was on 5-25-04 witch took 23 days. It did not work out with us and she went back.
I met someone and filed the I-129F for her and received ROA1 on 5-9-07 from VSC and was thinking it wouldn’t take long because of the first one I did. But when I learned how to read the USCIS updates it they saying Nov 13-06 and when I called them they said that was what they where working on now and nothing after that date? When I look at this and other websites of people that filed from 1-1-07 I see many approvals so what does this mean. Because they told me that my stuff wouldn’t even be worked on for 6 months?

Are they just saying this to cover if it takes that long and are people getting some fast approvals that applied in the last 3 months way before their nov13-06 date? My time line on this web site says I might get approval by July 22-07.

Any info will ease my mind and thank you.

K-1 Filing Requirement

Hi, my divorce will be finalized in a few months. Is it possible for me to file K-1 for my fiance before I have the official divorce paper?

My self and a friend in May of 04 both filed for I-129F papers and were approved in 30 days. My friend was also waiting on his divorce papers when he went to the Ukraine and met his girl. If you are getting a divorce the marriage should be over and you are free to see whom ever you want. I would just wait till you get the divorce papers ad than file. Having met her while getting a divorce should not be a problem but they will tell her you where married and getting a divorce in her interview, they did tell my friend’s girl this and she didn’t know. But she was approved and now they are happily married.

K-1 address change

Man I think I just made things take longer I hope not.
I have moved and I am 30 days and waiting on my NOA2 and just changed the address on line today. I would have got my mail due to mail forwarding to my new address anyway but I changed it on line today with VSC. Now I am wondering if I just added more time to my wait since I just did this before NOA2 approval. They said they will let notify me about address change in 45 days. Hell I was hoping to have my NOA2 before that. Any one have any experience on address changes before getting there NOA2?

RFE 60 days from mailroom to reviewer!?!?

Hum so let me see if got this right, we all sit around waiting, stressing and worrying about things like proving meeting in 2 yrs, criminal back grounds and tripling our fees when the government is trying to pass a visa bill for a new Z-something visa ( Z- I guess is to make us think its at the end of the rest of the visa’s lol) While this bill says all they have to do is have two friends they were already in the US illegally in January and they will wave all people that were engaged in criminal activity and I guess we all are paying this once again from tripling fees and taxes. Man I just don’t get it. Grrrrrrrrrrrrrrrrrrrrr.

I understand your question and the answer would hinge on whether she can obtain the needed police clearance from Canada. Please note that she'll need this regardless of whether she obtains the visa in Montreal or London because she has lived in Canada more than six months since age 16. This is a DO IT YOURSELF site. Can't figure out what part of any of my posts you're not understanding. Police clearance will be needed for Canada and England but those come months into the process. Check the link I gave you for how those are obtained and see if YOU see any problem.

sorry if it seems I am asking the same thing. my whole worry is that if she is not a legal resident in Canada anymore should I apply for her using her UK's address and she can go to the counsalte there to get her immigrant Visa. Offcourse its better if Its done in Canada but I don't wanna screw up my chances.

she spent most of her life in England and holds a British passport.so she will get a clearnace from England, but she currently lives in canada and even thoughs he is not a canadian resident but We will be using her address in canada for immigration purposes. would that be a problem?

Unemployment

With the economic downfall, I lost my job and haven't been able to find another job. My question is if you are unemployed, what can you do in terms of paperwork? I'm not sure but I heard something about co-sponsor and how much you have in the bank helps. One more question, if I started the paperwork already, hence sent in the I-130 form already, can I hold and submit the rest after I find employment or do i need to resubmit everything after employment. Yes, the general consensus is that there is not a big difference in processing times to consider filing for the k3 "advantageous"...In fact a great number of k3's are getting approved at the same time as their i-130 petitions for VJ'rs.

over all I was looking at spending at least $1500 dollars in our journey from beginning to end taking into account my traveling for my SO's visa interview

My sister put my package together, paper clipped documents and then stacked them in order and held everything together with a big binder clip. Received no RFE's and no touches for that matter, 3 months later got my NOA1

USPS is Stupid

Your husband cannot arrange for the redelivery ( I tried that once when this happened to me) it has to be the USCIS that arranges for it, and they will pick it up don't worry. They receive lots of packages in a big place like that they probably have their very own "mail room" employees in charge of things like that.

Processing Times?

Hey guys - firstly congrats to everyone who has made it out the other side of all this red tape!!!

Myself and my Fiancee are planning to Marry this summer and she has filed for a K1 for me in Newark - so it should go to Vermont based on what I have read. Our case is very straight forward and we have used a lot of the advice we found on this site -so we are hoping it will have no problems - but you never know!

So my question is what is the shortest realisitic time I can hope to be called for Interview to the US Embassy in London? Is it going to be more than 6 months based on people's experiences? Or should I start knitting now and expect to have done a few hundred miles of blanket before its done?

Any advice - news - comments would be appreciated.

NOA2 - How long after that?

Hey guys I can't believe it - we just got our NAO2 today by mail and email notification! We only filed like 3 weeks ago!

So what happens now - how long does it take from here on in (by other people's experience)??

I looked at the time lines and I am figuring on 3 months max - but we have learned in the past not to count our chickens!

so many different answers

Guys we are totally baffled - we have been asking advice but maybe in all the wrong places about what happens after I get my K1 Fiance Visa to enter the USA. So here are my questions - hopefully some of you can answer some of them:

Can I work as soon as I arrive in the USA and up until we get married?

Do I need to obtain a work permit?

If so, can this be done easily?

What is this sponsor document all about? I am worried because I don't know anything about it? If my fiancee does not have sufficient finances top support me - can her Father act as my sponsor for example?
