I don't think a lawyer is going to tell you anything that you haven't heard here. There is no loop hole.

My advice is to do what you can to change the wedding. Disappointing people is sad, but being denied entry to the US would be even sadder. Your livelihood and your relationship should be your #1 priority, not necessarily in that order.

My husband and I have been waiting 8 months for anything to happen with our CR1 application. We're living apart, traveling back and forth across the border. It is expensive to run two households. And married people should really live together. But we've both got our respective jobs, etc.

Your situation would be very difficult if you were denied entry into the US, which I could very well see occuring. The fight to get you back into the US would be extremely difficult and costly to your company. Plus, you'd be apart from your soon-to-be wife.

Disappoint the family. THey'll understand.

Take whatever you have that proves she's here on an IR1 and then print out whatever it is that you can find that documents what an IR1 means. I'm assuming you're not worried about getting back into the US again, but you are concerned with getting her into Canada?

If the prior, print out where it says that an IR1 is a multientry visa.

If the latter, it might be more difficult but most of the time I've found the border guys to be very reasonable.

well if u note I was mentioning July 30 2007 as the processing date not the date updated on top of the page.




Yes... but the only way that the July date could be correct would be if you ignored the dates at the top stating when the page had been updated. So if you knew about the update date you could not have even considered that the July date might be correct because you would have known that it was old information from an outdated page. And therefore, it was not at all clear that you understood this based on your statement.

The pastor that married us has ZERO knowledge of my relationship with my husband apart from the fact that he knows my children and my ex-husband. That does not make him a very compelling person to provide bonifides of the relationship. Anyone could show up to my wedding and that doesn't tell anyone about the relationship, either. All they know is they saw two people get married.

I can't even believe this thread. It is so far past ridiculous it isn't funny.

Think about the INTENTION of the request for bonifides. It is to prove that the two people are not entering into marriage solely for immigration purposes. This is about FAMILY-related visas therefore a true and honest MARITAL RELATIONSHIP is what they are interested in. That there was a marriage is proven by a license. But that license doesn't prove jack in regard to the intentions of the two people that got married. Sharing a life, money, plans, time, resources, children, hobbies, etc. says what kind of relationship the person has.

It ain't rocket science people.

We're also trying to decide between doing a K1 or a K3 but I'm finding it confusing.

Here's our situation :

Me - NY
Him - Ottawa

I'd be able to use Vermont which seems positive.

Also, looking at the processing time between K1 and K3, am I reading it right that there doesn't seem to be much difference at the moment going through Vermont?

He's got children who will (unfortunately) remain in Canada. Being able to go back "home" will be important.

Of course, we'd also like for him to be able to work as soon as possible.

If anyone could make any recommendations, I'd appreciate it.

Tha is not a problem. After you get married you go to the SS with marriage cert. and have it changed. Your passport doesn't need to be changed.

When I filed for Naturalization, the instructions said you could print in capital letters with black ink and that's exactly what I did and had no problems at all.

I suggest that you have the I-134 notarized once you are certain that the interview date is near. Meanwhile, start gathering the documents that may be needed for the interview. Also, try downloading the forms for the K interview: DS-156, DS-156K & DS-157 and have your draft copies ready. The more recent your documents are to the time of interview, the better.

This is what I did:

I favored IR over K3- main reason is my kids (I got three) automatically become US citizens once they enter US on an immigrant visa.

I filed I-130 for each of my family members, then upon receiving the NOA1, I filed for K3 too (just gambled with my $170) just as a back up (I have read scary posts of petitions getting lost, stalled, or in a standstill for no clear reason).

I pushed on with my I-130's. Timelines for I-130's at VSC & NVC were moving relatively fast late last year & I almost completely forgot all about my K3.

My I-130's became "case complete" at NVC mid January 2006. It's almost a month now, and no word if the petition has been sent to the embassy yet. Then I learned that it may take 2 months or more before I get to know. Lately, I have learned that I-130's for Philippines have to wait 6 months for the interview after the embassy receives the petition (this is unique to the Phils because of the huge volume). For my I-130's it is "too near yet too far."

I checked on my K3- and yes, they have a schedule for my beneficiary's interview- this March 2006! The kids are derivatives (K4).

I have decided to go for the K3/K4 route. I cant wait till the last quarter of 2006. I will make my choice on whether to dump my case completed I-130s and file for AOS (that cost a lot), or fly back to retrieve the I-130s when the interview date is set (that will cost more!) once we get past the K3, hopefully with no hitches.

It helps to file both petitions. And if you are without kids, it becomes a lot more simple.

Yes, you both do. Separate I-134's and supporting documents (tax returns, bank letter, etc.), if it is the I-134 that the embassy/consulate in the beneficiary's country requires (and not the I-864).
