Been away for a couple of weeks cause I've been so busy getting the house ready for Valya's arrival in the US.

I just want to make sure I know what's going to happen at the POE. I went through this about 6 years ago with my ex-wife from Moscow, but as she only had basic English skills at the time she could not tell me exactly what happened.

My fiancee will be arriving at JFK airport. She has the sealed packet (the one they tell you *not* to open) that they mailed to her from the US Embassy, the Visa in her International Passport, and her chest Xray (I'm pretty sure they don't need it at POE but I didn't want to take the chance...). Now I know you have to fill out a Customs declaration form and an I-94 form which they hand out to you on the airplane typically. Now what happens with USCIS? Does she give them the sealed packet (and I assume she does not get it back right?)? At Passport control they will look at her Visa, probably ask her what she is doing in the country (marry me of course). I just want to make sure I know what's going to happen so I can make sure things go smoothly for her (i.e., let her know so that she doesn't miss something).

I also think you guys will be fine good.gif he got a J1 visa approved for the second time and there were no problems obtaining that one. To my knowledge Camp J1 Visas are not usually subject to the 2 year residency requirement. This will be indicated on your DS2109 Form - good to have a copy of that at interview for proof I reckon. I know for a fact that the expedite request, once accepted generally gets a yes or no decision in 5 working days. At the end of that you get an answer on wether the petition is approved or not. So never mind their 30 days. I think they just tell you that so you won't call every 5 minutes. wink.gif

My expedite took over 3 weeks to get a response.
My senator said, that Vermont Service Center replied to their "URGENT" letter in 2 weeks. Where do you think we stand?

The office also advised that in order for any petition to be expedited the beneficiary must have a severe medical condition that has to be treated in the U.S. The illness of the beneficiary must be documented with certified letters from doctors and hospitals. Than upon review by the USCIS, a determination would be made.



If you do not hear any response as to the status of your wife’s current petition within 90 business days contact our office.

HAHA not 3 months, 3 months worth of business days, what a ###### spit in the face.


It is totally crazy! All we want is some really good information about our cases and not the run around!


Is there a law stating I can request some kind of details about my case legally that they have to reply to me?

Some people get notification emails when there is a status change, you dont get emails for touches, at least not from I heard. Some people dont even get emails even though they are signed up for them, they just get approvals and their online status wasn't changed.

I visited Congressman Saxons office today and talked to their immigration department. They told me they just had a USCIS meeting few weeks ago, and questions popped up why I-130's werent being processed. USCIS told them that they are only processing "SELECT" I-130's for the time being until they clear I-400 backlog which they said was their #1 priority.

BTW this is directed at VERMONT SERVICE CENTER only,

I believe the "select I-130's" are the easiest ones they can find, all of our DEC/NOV/JAN get ready for long wait. good.gif mad.gif blink.gif

I think person who looks at the expedite has alot to do with the outcome. Some people are more humane than others. Sometimes a case thats not really worthy gets approved, and sometimes cases that NEED to get approved get ignored. Its luck of the draw.
