I'm assuming ur on ur way to meet ur fiancee...from ur end u need to do the I 134 with the supporting documents if u have time before u leave. That way u can take it with u rather than mailing it later. It's not really needed until the interview, but I don't know how Thailand is in giving interview dates. VSC is usually quick about forwarding applications to nvc which is also relatively quick.
Otherwise, there is not much else to do as the petitioner. No need to have the noa2 or nvc letter scanned. Just don't lose the noa2 as u'llneed it later for AOS. Have a good trip!

U can still use ur Dad as a cosponsor as long as he meets the above poverty level criteria and apply 4 the k1. There are ppl who are in b/w jobs or in debt who used cosponsors. From my understanding, in instances where petitioner is on govt welfare they can be denied even if they use cosponsor. Good luck.

For many people, applying for k1 is pretty straightforward and visa journey spells it out for you. I hired an immigration attorney prior to finding out about vj. In retrospect I wouldn't have hired him for the k1 mainly cuz we really didn't need him. HE wasn't bad but still I felt at times that he wasn't that experienced and if it weren't for vj..who knows!

I was wondering if anybody knew whether you are able to apply for EAD at the same time as applying for the K1 visa?
My plan is to apply for the K1 and have the EAD so I can start working as soon as i arrive in america on the K1.

As far as I know you can work only for the 90 days that your K-1 Visa is good for and after the 90 days you have to stop work until you get your New EAD approved when you file your AOS. The AOS, EAD and AP are all in one filing now and will be affective July 30th 2007

Just was looking for some options and I know Ill get some here. :help: I just found out from my SO today that I put the wrong Date of birth of her 15 yr old son. I Put 1972 instead of 1992 which will make him 35 and not 15. :crying: This isn’t so bad except it makes him 1 yr older than his mother. :wacko: There are no supporting documents that are required for a child on the I-129F so i am not sure how this will affect the process. They will need this information for her son at their interview I know. Wonder if they will let that go till then or what maybe a RFE saying why is there a 35 yr old in the child column? Oh well what’s done is done. I have her sending me a copy of his birth cert and translation doc’s now just in case we get a RFE. I just hope that is not way its taking so long now. :(

It means that the approval expires after four months. But the CO can extend it if it takes more than 4 months to be interviewed. This can be done automatically, but I think some VJers had to call the embassy and made sure that they extend it. I would call if I were you, just to be in the safe side.

I am not sure what you mean the dates say 05/07/2007 to 09/07/2007 May 7 is the date they cashed my check and started working on my K-1 Notice date is 9/17/2007 witch is 10 days after? I have made the interview at embassy already and it was made on 09/09/2007 and interview will be on 10/23/2007. Are you saying I have to call them about this NOA2 and its dates? This doest make sense to me, I thought you only need the NOA2 for your change of status after you get married witch would be way after these dates shown on NOA2.

I have a question that was brought up recently due to my pending divorce (it should be final this month). My divorce has been in the works since February. Since then I've met someone else that I will need a K-1 visa for. I was told that if it shows that I met this person before my divorce was final that it will either raise red flags for a K-1 application or cause the application to be denied. My question is after we have approval for K-1 and my fiancee comes over here, is there a minimum amount of time she must spend in US after our marriage in order to be able to go the next step (AOS I believe?). I plan to get travel authorization for her and we plan to spend some time in her country, both for a wedding for her family there and because I like her country very much...we may end up if possible staying there 6 months or more out of each year if we are allowed by UCIS. Would doing so while out of K-1 status but not yet at AOS status jeopardize her AOS later on?

Hi zgt3344, thanks for explaining the positives and negatives of the H1b - I think I will go with the K1 as she wants us to have a wedding in her hometown as well too and I don't want to deny her that nor the ability to travel back and forth to UA either as it would be pointless for my business venture if she could not accompany me and be my translator...I guess I'll just have to marry her and hire her afterwards smile.gif.

I am probably going to file a K-1 Visa for my fiancee but I have another possibility, and I don't see any forums here that would address my question. My fiancee is from Ukraine and I am planning on having some business interests there. I have my own consulting company (IT - computers). I see a possibility that I could hire my fiancee and sponsor her with an H1B visa - I would probably use her in the capacity as a translator/interpreter for the people I have to deal with in Ukraine. Is this a feasible route to take? Are there any forums for this?

I'm trying to figure out the K-1 timelines. I'm looking first at the graph for VSC for NOA2 approval which is 120 days. Going to the processing times page I see the overall average right now is 194 days, but if I add up all the individual steps it is way over this, example for VSC, Step 1 is 10 days, step 2 is 120 days, step 3 is 28 days, step 4 is 9 days, step 5 is 6 days, and step 6 is 69 days...10 + 120 + 28 + 9 + 6 + 69 = 242 days, which is way over the last graph where the overall is 194 days currently...what am I missing here?

Your fiancee filing for a B2 will not raise a red flag on your K1 case but the K1 case itself is probably a big enough red flag to get the B2 denied based on obvious immigrant intent. It might work in some countries but not likely from Russia.


Not sure I understand why the B2 would be denied (actually from talking to a number of people, it seems more and more young women from Russia are being granted B2's...I personally know a very attractive 28 yo Moscow girl who was in NY recently for a wedding and she got a B2 visa no problem at all - she's a doctor so it's not as if she makes a lot of money.

In my case she has no motive to try to change the B2 to an immigrant status as she will already have a K1 in the pipeline - this is merely to visit and return back to her home country. Why would someone risk jeopardizing their status - for her to try to marry on the B2 would immediately raise suspucion of visa fraud since there is a K1 already filed - thus even less motoviation to try to immigrate on the B2. Perhaps reality might be different but I'm looking to see if anyone else has done this - from what I'm hearing B2's do seem to get issued to those who are waiting for the K1's to be approved.

Have a couple of questions about filing for K1...it's been a while (I'd filed a K1 6 years ago, got married, then divorced amicably after 4-1/2 years). In assembling the packet, when I did it years ago I used Acco fastener to put together the entire package. I've seen a couple of posts, from 2006, that indicate not to, but at this link:

So what is the current consensus about this?

Also, in preparing documentation for visits to my fiancee', I have seen her 3 times in the last 4 months...all the trips involved multiple leg flights. Should I make copies of *all* the flight legs or only the final leg to the destination? I'm guessing all, but it is a alot of boarding passes, tickets, and receipts. I'm afraid it might be too much but then again you could say it doesn't hurt right? When I previously filed a k1 I'd only had a single visit and so it was a lot less flight documentation to copy but this time it's a more (not including a vacation I took with my fiancee during one of my visits, which I also made copies of).

I have a question and I know it's been answered in a somewhat similar format but not quite the same. I was planning to send in the K-1 application for my fiancee and I tomorrow but something came up to change the situation slightly. I am facing the opportunity to be in her home country for an extended period of stay - 6 months or more if I so desire. But it's not 100% yet and I won't know for 4-6 weeks more. My dilemna is that I don't want to delay starting the K-1 proceedings if this opportunity falls through. So my question is that if I file for a K-1, I've heard it can be cancelled. Should this opportunity come through and I decide to go to Ukraine for 6-9 months, I then would have the option of marrying my fiancee after 6 months of living in country and do a DCF. I would not be trying to bring her in as married under the K-1 - and this is what most of the time I've seen questions on. Rather, I would be changing (probably cancelling in this case) the K-1 and instead going for aDCF with an I130 in country. As far as I can tell this is not illegal nor is it visa fraud, can anyone tell me if they know otherwise?

Okay I have a question. I am submitting a copy of my passport as proof of citizenship. The K-1 instructions state that it must be a copy of all pages of a "valid, unexpired U.S. passport issued with a validity period of at least 5 years." My passport is good from May 24, 2001 through May 23, 2011. Do they mean that the passport must expire at least 5 years from now (i.e., Feb. 2013) or do they mean the total span of validity? Basically I'm asking if this is going to cause issues or not?

As part of the K1 guidelines it is recommended to submit "Declaration of how you met in person in the last two years. This should be a single typed page attachment regarding question 18 of the I-129F. Make sure to sign and date it."

Now I met my fiancee while I was separated from my ex-wife for a year and 6 months into a divorce. Should I mention this? If I don't mention it in the declaration letter will it raise flags as to why I was meeting someone when I was still married? I have 2 versions of a declaration letter, one with mention of the divorce, and one without. Basically I explain the divorce that we were separated due to job requirements and she filed for divorce 6 months into our separation, and 6 months after her filing for divorce I met my fiancee. I go on to explain my meetings with my fiancee and the date of my divorce. Do you think it is necessary to explain this or is the divorce decree enough in itself? Or will it raise red flags or an RFE if I don't explain?

I got my NOA1 approval on October 22 and received a RFE notice e mail on Feb 5. It took another four days to receive the hard copy in the mail (Feb 9). I had 60 days to respond. If you send in your K1 this week you most likely have a NOA1 before you leave.

I would make sure to sign up for automatic e mail notification from The Department of Home Land Security once I get my NOA1 approval. If you are having someone getting your mail while you are away you can tell them to be looking for it. I have e-fax. If you have such a service they could then fax you the notice and you could get it via an e-mail attachement.

Things must be moving much faster now...I sent in my K1 application, they received it Feb. 19, and I got my NOA1 3 days later and it was dated for the same day they received the application, Feb. 19. Wow...I hope the rest of the process shows a similar decrease in processing times.

Hmm posted this yesterday and it disappeared...so here goes again.

When do people seem to get their RFE's (if at all)? Is it usually very soon after the NOA1 (indicating that someone actually went through the file after picking it up and putting it on their desk) or was it a while after the NOA1 (indicating that the file gets picked up and then put on their desk, to be reviewed as they get to it)? The reason I ask is they received my K1 package this week and I have a chance in 21 days or so to visit my fiancee for 4-5 weeks and I'd hate to be over there if I were to get an RFE here.

I have a question now that I am seeing VSC NOA2's coming back so fast...originally I was concerned about RFE's but now it seems I need to be concerned about NOA2 as well...I plan to travel to Ukraine middle of March to see my fiancee. I plan to be there for 4 to 5 weeks, but I'm concerned that the NOA2 may happen during that timeframe. I read in the K1 guide to send a copy of the original application to my fiancee - that's no problem, I will be bringing it with me to give to her. I will also get my I-134 done before I go see her as well...but what about a copy of the NOA2? How important is it that she has that right away? I don't want to delay the process because I don't have a copy of the NOA2 (which I won't if it happens while I am in UA). According to the K1 flowchart it looks like I have around 3-4 weeks after NOA2 before it leaves NVC and gets to Kiev...so me being in UA from mid March to Mid April probably won't impact things right?

I know the I134 is required for a K visa. I am an IT (computer) contractor so I have contracts that run anywhere from 3 to 6 months in duration, then I look for another contract. I get paid well enough that just working a couple of months this year I easily exceed the minimum requirements for income. Usually I take some downtime between contracts for both training and vacation, and having just finished a contract I planned to spend a month with my fiancee. As such I don't show income currently but I have bank statements showing deposits from my last contracting job that show my income has already gone well over the minimum required income, and as well I have assets that far exceed the minimum required. And of course I have tax transcripts etc that show my income over the last 3 years esaily exceeds the minimum required as well. Will this be sufficient or do you think I have to find another contract before my fiancee has her interview?

Hi AnneLisa+Mark, I did not get any touches at all on our packet. I was waiting and checking every day to see if it got touched and Monday morning I check my email and there is one from USCIS telling me we were approved, went online and it says we were approved March 08. My impression is that VSC seems to be going so fast now you may not even see a touch, you just get approved if all is in order.

Storyangel, I agree just looking nice won't get you approved if you don't meet the requirements and I agree if you are well organized I think it can only help - a person who used to work for the USCIS made some helpful posts and in one of them he said some adjudicators will dig around for the information if it is not readily apparent in the application information and others will simply fire off an RFE...so I have to believe that by making things easy for the adjudicator to find the information in the packet the less likely an RFE will be. I did not want our adjudicator to say, "hmm where is the return boarding pass for this trip? Okay, RFE time." Rather I wanted him to look at my packet and say, "hmmm no return boarding pass but it says right here they were lost on the trip...ok no sense in sending an RFE for something that they lost." That actually was one of the pages of my boarding pass since I cannot find the return boarding passes for one of my visits.

Hi everyone, someone pm'd me off list and raised a question I thought about and perhaps telling others what I did may help a bit with avoiding RFE's. Mind you, I am not professing to be an expert or even knowledgeable, I'm simply ####### retentive when it comes to these things and perhaps that helped. So I think what I did may have helped:

I had intended the file right after my divorce decree but instead I took my time, redid things multiple times to make sure it was perfect (you don't know how many G325-A's I threw out cause I did not like the way one thing looked or another, or realized another spot where I could put "None" instead of leaving it blank). I ended up taking 1-1/2 weeks to do it the way I was satisfied with it, every time I thought it was right I'd look it over the night before mailing it and find another flaw. In the end I ended up making sure there were no blanks or unanswered questions.

One thing I think that helped was the primary evidence of our meeting that I included. I scanned (not copied) my airplane tickets but I did not print out the scans right away. Before printing them out I used photoshop to put text in there in bold print (18 point Arial font) on the bottom of each page to explain each page of tickets/boarding passes. Such as "Tickets for trip to Ukraine from 9-4-08 to 9-17-08, including boarding passes" or "Tickets to Ukraine from 11-5-08 to 11-15-08, return passes not included because they were lost." I made sure that I made things very easy for the adjudicator to understand and where necessary explained why I had tickets/boarding passes going into Ukraine but not coming out, or vice versa or any other missing information. So each page would have a set of boarding passes then neat typing on the bottom explaining them.

Other than that my application was probably pretty standard fare. Hope this helps some of you...smile.gif

We got our NOA1 in the mail 4 days after they received it at VSC...the official date was the same day they received it (Feb. 19). We got it Feb. 23. So officially the NOA1 in our case was given in 0 days.

Wow, mine was the one sent to Kiev on March 12!!! That's 11 days less than the average right now. At this rate, if all else is just in line with the average, then my girl should be here in the US by the first week of May!

I have my hardcopy NOA2 in hand. On it, they state that "The above petition has been approved, and forwarded to the listed consulate."

This can't mean it's gone through NVC already, can it?

And it says the "listed consulate." I don't see the consulate listed on the NOA2...so I can only assume they've sent it to the consulate in Kiev (in my case), right?

I know, my list of stupid questions seems endless...

That's the DS156 form, that is filled out when you have NOA2 approval and is sent to your fiancee in her country. The photo gets attached at the embassy by their folks when you bring in the information (at least that's how they do it in Kyiv). The photo is simply stapled into the appropriate place.
