When you get a chance update your timeline it helps others with similar cases.

You have two issues, they are related but not the same.

First, your wife's taxes. On the surface it seems it's not a problem, she filed for naturalization and her personal income tax issue did not come up during the process.
She probably didn't have taxable income, from w2's (issued by an employber) or 1099's (issued by a vendor when you are self-employed), interest income, pension or retirement, etc. So I don't believe that's an issue.

Second, you need verified income that proves that you and your dependents, if any, will not become a public burden. If your wife doesn't have sufficient income, that's where the sponsor becomes important. If she's currently working and earning above the poverty level guidelines maybe someone else in this forum can provide information on how important the previous 3 years of earnings history is.

As far as your relationship and how much you know and love each other, it's relevant to establish that you have a real relationship, it's irrelevant in establishing that you and your wife can put food on top of the table and stay off the welfare roles.

It is strongly recommended that you supply 3 years of tax returns, a current employment letter and recent pay stubs.
In my tax practice I recommend to clients with immigration interviews to also bring (in addition to the tax return copies) the last 3 years of tax return TRANSCRIPTS.

Regardless of the minimum requested documentation and requirements, providing sufficient proof of income and income stability is good idea.

I'm confused, I'm not familiar with the I-130, as I'm in the middle of a K-1, not there yet.
Isn't the I-130 filed out and signed by? The petitioner? Aren't you the beneficiary?
Your children would only be listed if and only if they had been petitioned for, you where not going to bring them and therefore your wife didn't petition for them. Am I wrong on this? So if this is so, how could you have lied? You didn't sign the petition your wife did?

Correct me on this, what am I missing?

Yes, that's how I got mine before my NOA1 arrived, back of my canceled check.
And my number was my case number, didn't have to add anything.

On the back of the canceled check you will find your case number which will let you track your case online.
It will be in your NOA1 document which arrives days later.
But sit back and wait, it will be months before it's "touched" again.
You will either get a NOA2 or a RFE at some point.

Ok, I can tell you this. You will have MUCH better chance of going to the university and pleading your case. The USCIS won't care. The university might. I would make an appointment with the enrollment office or financial office and tell them the situation. It is far more likely they will credit you the money paid for the next semester. They will likely not refund the money, but give you future credit. Really, your chances are 10,000% better of that happening

When you mean electronic check, you mean an ACH payment, wire transfer, etc.?

I believe that your payment must PHYSICALLY be attached to your application.
I don't believe that there is a way that USCIS can match an electronic payment to a pending application for a I-129F
your case number is not assigned until your application is received along with your payment, get it, catch 22.

If this is the case, and if I'm not wrong, either find a US bank that can provide a paper payment to send with your application or send the package to a friend or relative in the US who can then attach a payment to your application.

Reading between the lines, I get the impression that she needs the job she has. That she has a unique skill available for her Japanese employer, that if she can’t travel and work in the US she might loose her job. It would have been an ideal situation for both of you if things would have turned out differently. But these are not the facts at present.

You have a tough long road ahead of you. Don’t make any more mistakes, have faith, be diligent and persistent and in the end you’ll find what you are looking for. Along the way you’ll find a lot of good people in this forum to guide you.

I’ve read your other posts. I feel bad for you and your girlfriend / fiancée and the circumstance that you face. From everything that I have seen, read and heard you can’t have multiple visas at once, even without a ban. You can’t have a work visa and then simultaneously apply for a K-1 and get married here in the US while she is overseas. There is no such thing as a come in to work and then get married visa.

Your only options are to petition a K-1 a fiancée visa or go to Japan, get married and petition her as a spouse. At the appropriate point thereafter you will need to apply for a waiver.

Look at it this way, she came into the United States, overstayed her visa, left, then intended to return on a work visa stating she was going to get married. She implied she was going to do visa fraud. She was detained, jailed, banned and deported. Now you want her to get a waiver, return to the US on a work visa, then go ahead and get married intentionally on a work visa. Apply for AOS in the US and expect immigration not to accuse her of visa fraud, not have her deported and banned for 10 years to life from the US. Careful you are not charged and added as an accessory to visa fraud.

I hope you get the point.

Officially there is nothing you can do to expedite the process.

Unofficially there is only one possibility, again a possibility.

Gather one of your exact duplicates of all your docs from your application, pictures and all, including your NOA1.
Get copies of your sonogram with your baby pictures as soon as they are available.
Walk in cold to your local congressman's/congresswoman's office, well dressed business light formal attire with all the above.
The best time to do a cold walk in is between 9:15am to 11:00am.
Ask for help, the receptionist may take you to directly to the representative's immigration assistant or schedule you an appointment, plead your case without being obnoxious or repetitive, make sure your sonogram pics are on top of your docs as you speak.

Things that might be helpful; you have a voting record, your representative's view and opinion on immigration is positive, etc.
In other words that congressional office wants to and feels like helping.

Your receipt number is on the back of the check, mine was in the endorsement area, I had the check image online before the NOA1 letter. I went to the USCIS web site and found my NOA1 date, the NOA1 letter arrived a week later.
You may want to verify your address, you should have received it by now. Another member may be able to help on how to do that.

I used blue ink on a NON felt pen, a roller ball point pen, I didn't want an RFE because they thought I sent in signed copies.

You're approved, start celebrating. I might be approved but can't be sure yet!

A strange week at VSC. They seem to be processing a lot of petitions before the fiscal year ending 9/30/2009.
I've seen petitions as far up as the first week of June being approved.

On September 10th they sent me an email: We mailed you an amended notice.
I call USCIS and they tell me the same, except they add it was form I797

I posted about this yesterday. Search under "amended notice".

I have a hunch on all of this.
I think in the rush to get cases out, some cases have not been issued a NOA2 yet they have been approved.
There is another member here with an IDENTICAL time line as mine, VSC processing who has an identical situation as me.
I've searched the internet for hours, very rare scenario. The only time an I797 with amended notice has been issued is when it's a duplicate NOA2, hence my suspicion that I might be approved.

Anyone have any thoughts?

Let me jump in here and ask this question. K-1 and then eventually the AOS application, is the the PETITIONER'S (not the beneficiary) birth certificate required anywhere in the AOS process? The petitioner has a valid passport and certificate of naturalization but no birth certificate and chances of getting it are slim.

Hey how are you? Nothing yet, I checked the mailbox again today.
I have searched everywhere on the internet. The only time I see an I-797 amended notice is for a reprint of an original approval form I-797.
So I think we are both approved, but we can't party yet. Anyway that's my hunch.
