The CR-1 takes longer to receive, but the AOS is complete and she has a passport stamp allowing her to work immediately (as sson as she gets an SSN) The K-1 is processed faster but is only "half done" when she arrives. You have to get married and file AOS. She cannot work until she has an EAD or Green Card. You must get marreid and then file and then wait 2-6 months for the green card. EADs are usually issued in 90 days or less. So her "time to working" is probably the same. If your fiancee being able to work is a major consideration, then the CR-1 is the best route for you. Another item of "delay" is that you can file for a K-1 today. Doing a CR-1 will require you to travel back and marry her first. Thanks for all the info! I recently graduated, so I don't have any listed income for the 2009 fiscal year. I currently am making about $2400/month (after taxes), and have the pay stubs for it. I will find out if I will be employed full time at the end of March, and hopefully will receive the NOA2 by then. Are the pay stubs alone enough for the I-134, or what other evidence do I need? On a side note, if that isn't enough for the I-134, I can have my mom be a co-sponsor. Her income is roughly $60k/year. My first step was to call the consulate number listed on the website, where I got the email address that applied to me. I immediately sent them a message, explaining what had happened, and they replied first thing Monday morning. I then told my fiance what she needs to do, which was: Good morning, The applicant must send us the package as well as the passport with the visa and an attached letter explaining in which situation the envelope was opened or damaged. After sending the mentioned items to our office, you will have to contact TNT to pay for the return of the passport and the envelope. As soon as we receive them, all documents will be reviewed. When we receive the TNT payment notification from them, we will send back the envelope and the passport to the address you informed TNT. She sent the package today with her explanation. I found it strange that there was no mention regarding the fee. I decided not to ask, since it wasn't mentioned. I was not able to find any posts in the forum that indicated whether or not someone had to actually pay that fee. I am curious if they will contact us regarding that. I sent the information to my fiance regarding the closest TNT office, and she will go there tomorrow to pay for the return. Honestly, some of the posts here were more frightening than the email reply from the consulate. I wish people here were a bit more supportive rather than threatening.
